PETITION
COMES NOW the petitioner, through the undersigned
counsel, and unto this Honorable Court, most respectfully
asseverates:

1. That petitioner is of legal age, Filipino, single and

presently residing at Nabbotuan, Solana, Cagayan,
where she may be served with notices, orders and
other court processes;
2. That public respondent was impleaded being the
custodian of the record sought to be corrected with
office address located at the Municipal

Hall of

Solana, Cagayan, where summons, notices, orders

and other court processes may be served;

3. That petitioner is one of the children of spouses

PEDRO MADRID and CORNELIA GUNNACAO-MADRID;
4. That petitioner was born on March 11, 1983 at
Nabbotuan, Solana, Cagayan and her birth and other
personal circumstances was recorded at the Local
Civil Registry of Solana, Cagayan;
5. That however, there were apparent errors in the
birth records and in the Certificate of Live Birth of
the petitioner and they are as follow:
5.1. Her name was recorded as LEONARDO instead
of LEONORA;
5.2. Her middle name was
recorded as
GONNACAO instead of GUNNACAO;
5.3. Her mothers maiden
was recorded as
GONNACAO instead of GUNNACAO;
5.4. Her gender/sex was recorded as Male instead
of Female;
Machine copy of the Certificate of Live Birth is
hereto attached and marked as annex A and made
as integral part hereof;
6. That

in

the

indispensable

document

of

the

petitioner, she used her true and real name as

LEONORA, her middle name GUNNACAO and gender
as FEMALE. Machine copy of petitioners Original
Transcript

of

Records

and

diploma

are

hereto

attached and marked as annex B and C and made

as part hereof;

7. To further buttress this petition, petitioner undertook

a medical examination to determine her gender.
Machine copy of the Medical Certificate is hereto
attached and marked as annex D and made part
hereof;
8. That there is a need to rectify the errors appearing
in the Certificate of Live Birth of the petitioner in
order to straighten her records;
9. That the petitioner is willing and ready to conform
with the requirements of Rule 108 of the Revised
Rules of Court such as notice and publication and all
other requirements as the Honorable Court may
order.
WHEREFORE, premises considered, it is

respectfully

prayed that, after due notice and hearing, an order be issued

enjoining the Local Civil Registrar of Solana, Cagayan to
rectify or caused the rectification of the errors in petitioners
Certificate of Live Birth:
a. Petitioners first name from LEONARDO to
LEONORA;
b. Petitioners middle name from GONNACAO
GUNNACAO;
c.

Petitioners mother maiden

GONNACAO to GUNNACAO;

d. Petitioners gender/sex from male to female;
