As a third world country Malaysia is the consumer of technology, we cannot run away
from the vast expanding of technology and its product especially when we lack of the man
power in some important area when others are already on the top of the game. Thus rather
than compete we make a specialist on the area to gain the knowledge of it, thus he price of
original copyrighted software, movie, music album and other intellectual properties are
reaching the sky. Because of the currency differences make it worst a game or movie
compact disc may cost us 100MYR to 400MYR each, with the current inflation rate the
middle class or low class citizen can barely survive which lead to the option of piracy which
are free aside from the internet bill. Other than money issues some of the intellectual
property are banned in some country that lead towards the other options such as illegal
downloading or maybe buy it outside from Malaysia which is not the main reason in
Malaysia.

Perbadanan Harta Intelek Malaysia (MyIPO) is one of the organisation that involve in
protecting Intellectual Property introduce a new initiatives on intellectual property which are
IP Valuation Model, Industrial Design Act (Amendment) Bill 2012 and the latest Industrial
Designs (Amendment) Regulations 2013 which acted on 1st of July this year.
Copyright protection lasts for 50 years after the authors death and extends to
computer software. The Copyright Act includes enforcement provisions allowing government
officials to enter and search premises suspected of infringement and to seize infringing
copies and reproduction equipment. The amendments to the Act passed by the Malaysian
Parliament in 2011 include new authority to combat camcording activities in cinemas.

Malaysia continues to face challenges in ensuring the effective protection of copyrighted

materials. Pirated optical discs remain widely available, although less conspicuously than in
the past. Unauthorized photocopying of textbooks remains a particular concern. On-line
piracy and illegal downloading of cinematographic and musical works has grown.
The Optical Disc Act of 2000 established a licensing and regulatory framework to control the
manufacture of optical discs and to fight piracy. Under the Act, manufacturers are required to
obtain licenses from the Ministry of International Trade and Industry and the Ministry of
Domestic Trade, Co-operatives, and Consumerism (MDTCC), to place source identification
(SID) codes on each disc, and to allow regular inspections of their operations.
MDTCC has taken steps to enhance Malaysias enforcement regime, including active
cooperation with rights holders on matters pertaining to IPR enforcement, on-going training
of prosecutors for specialized IPR courts, and the reestablishment of a Special Anti-Piracy
Taskforce. In recent years, the MDTCC has also instructed its enforcement division to begin
to take ex officio action, resulting in significant seizures of pirated products. Prosecution

The advantages of this topic mainly goes towards our government, if Intellectual
Property Protection is a huge success and widely recognize it will brings up our country
name as well as the economy. Since Intellectual Property covers a wide variety of fields,
investor will come start to take action since the securities are top notch. Thus our country will
gain the benefit of trust from another country, economic boost and job opportunity yet it will
be hard for the citizen at the early stages because of the cost. Aside from monetary problem,
the skill of cracking might be lost in our society. The knowledge that cause problem may cure
the problem, since they discover the loop hole from a huge company to share all over the
world. Thus if our government give us the benefit of the doubt for us citizen to learn the
knowledge maybe one day we can become the best in the field and help the company to
gain benefit such as development in our land which give us the opportunity to gain
management knowledge, business operation and many more. It is hard to avoid piracy since
its a man-made base on the intention of oneself, but one of the initiative have been taken by
our government such as announcing the amendment act which been monitored year by
year, blocking the P2P sharing website and the law suit by giving out ticket if a company use
a fake or cracked version of software.

To conclude this essay I would like to share my insight upon the topic, it is unethical
and against the law for an individual to use pirated software or illegal downloading it is
because of price issues if government can cut down some taxes on the related field I as a
fan of certain games, movies and art would love to give some support towards the
development of the producer by purchasing the original license. Aside from that, it is always
the best to expand the selection of product available in the market since the power to choose
give psychological impact towards the consumer.
