TO ANSWER OR OTHERWISE RESPOND
TO PLAINTIFFS’ AMENDED COMPLAINT

Defendant, Yahoo!, Inc. (“Yahoo!”), files this unopposed motion to extend the

deadline to file its answer or otherwise respond to Plaintiff Fotomedia Technologies, Inc.’s

(“Plaintiff”) Complaint (“Complaint”), filed in this action on June 19, 2007. Per the Court’s

Order of July 19, 2007, Yahoo!’s answer or response to Plaintiff’s Complaint is currently due

August 24, 2007.

To enable Yahoo! to evaluate further the case and the parties’ respective positions

prior to answering or otherwise responding to the Complaint, Yahoo! has requested that Plaintiff

consent to extend by an additional fourteen days the deadline for Yahoo! to answer or otherwise

respond to the Complaint in accordance with Rule 12 of the Federal Rules of Civil Procedure.

Counsel for Plaintiff has agreed not to oppose Yahoo!’s requested extension. Subject to

approval by this Court, Plaintiff and Yahoo! have agreed to extend the deadline for Yahoo! to

answer or otherwise respond to the Complaint until September 7, 2007. Accordingly, Yahoo!

respectfully moves the Court to extend the deadline for Yahoo! to answer or otherwise respond
