General Alberto Gonzales, the Federal Reserve Board, and the Federal Trade Commission, by

and through undersigned counsel, will cross-move before the Honorable Mary L. Cooper, United

States District Court, Clarkson S. Fisher Federal Building and U.S. Courthouse, 402 East State

Street, Trenton, New Jersey, for an Order dismissing this action for lack of jurisdiction and

failure to state a claim upon which relief may be granted pursuant to Rule 12(b) of the Federal

Rules of Civil Procedure.

Defendants rely on the attached memorandum of law in opposition to Plaintiff’s motion

for temporary restraining order and in support of their cross-motion to dismiss.
