Dear Men Mei Ng:
As the authorized claims administrator for the City of Oakland, we completed our investigation
of your claim alleging damages that occurred at the intersection of Fallon St. & 8th, Oakland.
Our investigation revealed that the City of Oakland has not received any reports of dangerous
conditions related to said location or area prior to your alleged incident.
Government Code (Section 835-835.4) represents the code related to dangerous conditions of
public property. It states that a public entity can only be liable for a dangerous condition if it has
prior notice of that condition. The public entity must know that a dangerous condition exists, as
it cannot be responsible for conditions that are not known. Further, once a dangerous condition
is made known to the public entity, the entity must have a reasonable opportunity of time to
resolve the problem.
Based upon our investigation and the above Notice and Opportunity code section, we are
formally rejecting your claim. I have enclosed the applicable statutory notice outlining your
options should you wish to pursue this matter further.

NOTICE IS HEREBY GIVEN that the claim you filed with the City of Oakland on 11/25/2013 has revealed
no indication of liability on the part of the City of Oakland. Accordingly, your claim is denied.

delivered or deposited in the mail to file a court action on this claim. See Government Code Section 945.6.
