JOINT MOTION FOR ENLARGEMENT OF TIME FOR THE PARTIES TO FILE

THEIR JOINT STATUS REPORT AND DISCOVERY PLAN

On October 9, 2007, this Court issued an Order setting out deadlines by which the parties

must meet to confer on certain issues, including a discovery plan, and by which the parties must

submit a joint status report that includes the discovery plan. (Docket No. 48.) The parties

conferred on October 30, 2007. Accordingly, the joint status report is currently due on October

9, 2007. (See id.)

The parties believe that the hearing currently scheduled before this Court on November

19, 2007, will help resolve a number of issues on which the parties were unable to reach

agreement on for the joint discovery plan. Accordingly, the parties respectfully request that the

Court extend the deadline by which the joint status report must be filed, up to and including

November 29, 2007.
