l. The City shallcontinueto respectthe dedicated1.8acreproperty,as it has


done for over 60 years,and shall not make any attemptto removethe
Defendantfrom Fair Park;

2. The City shallnot interferewith the Museum'sdaily activitiesor any


fundraisingactivitiesin which the Museummay engagein, unlessthe health,
safetyor welfare of the public is threatened;

3. The City shall not adverselyaffectthe historicalstructuredepoton the


dedicatedpropertyeither by affirmative action or preventingthe Museum's
maintenanceand protectionof the historicalstructure,unlessthe health,safety
or welfare of the public is threatened;

4. The City shallnot adverselyaffectthe collectionof railroadequipmentand


exhibits,includingthe locomotivesand rolling stockon the dedicated
property,eitherby affirmative action or by preventingthe Museum's
maintenance and protectionof the Museumcollectionand dedicated:site;

5. The City shallnot interferewith the generalpublic's or Museumof American


Railroad'saccessto the Museumwithout a courtorder:

6. The City shallnot demanda certificateof occupancyduring the pendancyof


this TRO.

IT IS FURTHER ORDERED thata'l'emporaryInjunctionhearingfor this causeis set

for the8th dav of March. 2010at 2:30 p.m.

Plaintiff s bond in the amountof One ThousandDollars ($1,000.00),on a file with

the Court,shallsatisfyall bond requirements,
