summaryofthechanges
isalsoprovided.
ResponsibleenergydevelopmentinPennsylvaniaiskeytothecommonwealthsfuture,
saidDEPSecretaryJohnQuigley.Wearecommittedtoprotectingournaturalresources,and
theserulesstrengthensafeguardsforourwaterandenvironment.
Theserulesaretheculminationofoneofthelargestpublicparticipationeffortsthe
departmenthaseverseen,withnearly30,000commentsand12publichearingsduringtwo
publiccommentperiods,saidQuigley.
Theamendmentstotheoilandgasregulationsbeganin2011toaddresssurfaceactivities
atwellsites,andcenteronfivecoreareas.
Theamendments:ImproveprotectionofwaterresourcesAddpublicresources
considerationsProtectpublichealthandsafetyAddresslandownerconcernsandEnhance
transparencyandimprovedatamanagement
WeaskedthepeopleofPennsylvaniafortheirconcernsaboutdevelopingoilandgas
resourcesinthecommonwealth,andtheyanswered,saidQuigley.Theseamendmentsreflecta
balancebetweenmeetingtheneedsoftheindustryandtheneedsofpublichealthandthe
environmentallwhileenablingdrillingtoproceed.
Afterthelatestroundofpubliccomment,twosignificantchangesweremade.DEP
decidednottoincludetheprovisionsfornoisemitigationandcentralizedstoragetanksfor
wastewaterinthefinalregulations.
Becauseofthecomplexnatureofnoisemitigation,itwasdeterminedthataseparate
processismoreappropriatetoaddressthoseconcerns.Intermsofcentralizedstoragetanks,the
departmentdecidedtoremovethisprovisionbecausethesefacilitieswillcontinuetoberegulated
undertheresidualwasteregulations.

Inaddition,changesweremadeinthislatestdrafttoaddresscommentsreceivedandadd
clarity.

AtmeetingsthisweekbetweenGov.WolfandRepublicansLeaders,participantssaidtheyhada
goodconversationaboutpensionsandeducationfundingtothepointofsayingtheissues
wouldbeaddressedinthefinalbudgetagreement,accordingtoHouseMajorityLeaderDavid
Reed(RIndiana).
Ofcourse,youcouldhavesaidthesamethinginMarchwhentheGovernorpresentedhis
budget.And,nowordonwhopaidforthepizzaduringthebudgetmeetingsthisweek.
MeanwhileGov.Wolfandhissurrogatescontinuedtocrisscrossthestateurgingsupport
forthenaturalgasseverancetaxtoincreaseeducationfundingandtheGovernorsotherbudget
proposals.
Gov.WolfdidpresentwhathesaidwasanewpensionproposalFriday,butotherwisehe
hasnotsoftenedhistoneonebitthisweek.HecalledtheRepublicanpassedbudgetadisgrace
andashaminNorristownonTuesday.Sen.VincentHughes(DPhiladelphia),MinorityChair
oftheSenateAppropriationsCommittee,saidThursdaytherewouldbenobudgetdealwithouta
severancetaxtofundeducation.
Astheimpassedragson,collegestudentswaitingfor$420millioninstateaidwillhave
towaitalittlelonger,statevendorsstillarentgettingpaidandnonprofitorganizationsproviding
socialandotherservicesonbehalfofthestatehavetofindsomewaytomakeendsmeet.

Aftermorethantwoyearsandlitigationbeforetwoseparatecourts,theClearfieldCountySolid
WasteManagementPlanisofficiallyfinal.WasteManagementInc.droppeditspendingappeal
oftheDepartmentofEnvironmentalProtectionsapprovalofClearfieldCountysSolidWaste
ManagementPlan.
TheCountysinnovativeapproachtodraftingitsPlantosupportitsintegratedwaste
managementprogramdrewobjectionsfromWasteManagementInc.onmultiplegrounds,with
theunderlyingthemeoftheappealbeingthattheCountywasattemptingtoreimplement
administrativefeestosupportrecyclingprogramswhensuchfeeshadbeenfoundviolateAct
101inaseriesofCommonwealthCourtdecisionsin2005.
In2012,withitsSolidWasteManagementPlandueforrevisionunderPennsylvanias
MunicipalWastePlanning,RecyclingandWasteReductionAct(Act101),theCountyputouta
RequestforProposalseeking50percentcapacityforallofClearfieldCountyswasteforthe
next10years,aswellasaninnovativeapproachtosupportandhelpsustaintheCountysvarious
wasteprograms,includingnotonlyAct101recycling,butotherprogramssuchasitsillegal
dumpingenforcementprogram,tire,applianceandelectronicsrecyclingprograms,andusedoil
andantifreezerecyclinganddisposal.
Duringthereviewoftheeightproposalssubmitted,theCountyscoredandrankedthe
proposalsbasedonavarietyoffactors,suchastheabilitytoprovidemorethan50percent
disposalcapacity,compliancehistory,economicfactorssuchasanottoexceedtippingfee
chargedtolocalhaulers,andenvironmentalsoundness,whichwasscoredbaseduponfactors
includingsupportfortheintegratedwasteprograms.
Thereviewresultedintheapprovalofallcountywastebeingflowcontrolledtoeitherthe
GreentreeLandfillinElkCounty,ownedbyAdvancedWasteDisposal,ortothepubliclyowned
WayneTownshipLandfillinClintonCounty.
GreentreeLandfillproposedareducedfeechargedtotheCountytopickuprecyclablesat
theCountysdropofflocations,asavingsofapproximately$34,000totheCounty,andan
annualmonetarycontributionof$27,500tosupporttheCountysprograms.
TheWayneTownshiplandfillofferedtopaytheCounty$2.00foreverytonofClearfield
CountywastedisposedofatitsLandfill,foranannualsupportsumofapproximately$7,500.
ClearfieldCountysubmitteditsPlantotheDepartmentundertheseterms,andtheDepartment
approvedthePlan.
WasteManagementappealedtheDepartmentsapprovalofthePlantotheEnvironmental
HearingBoard,aquasijudicialadministrativehearingboardwhosesolefunctionistoreview
finalactionsoftheDepartment.
Afterextensivediscovery,coveringeverythingfromthemakeupoftheCountysSolid
WasteAdvisoryCommitteetothemeaningofthetermnottoexceed,WasteManagement
filedtwoseparateMotionsforSummaryJudgment.
TheyfirstallegedtheRFPconstitutedanillegalsolicitationoffees,andthesecond
concernedtheprocesstheCountyusedforscoringtheRFPresponsesandchoosingtheflow
controlfacilities.
BothmotionsessentiallyclaimedthattheCountywasinessencerequiringthatfeesbe
paidtotheCountytosupportitsrecyclingprogram,whichwouldbecontrarytothe2005
CommonwealthCourtdecisions.
TheCountyarguedthatthesupportbeingofferedwasvoluntaryinnature,inthatnoone

wasrequiredtoproposeandsupportwhatsoever.
TheEnvironmentalHearingBoarddeniedbothmotions,andthemattermovedto
CommonwealthCourtonthesolicitationissueasaninterlocutoryappealbypermission.The
matterwasarguedbeforetheCourtsittingenbanc,andinanopinionauthoredbyJudge
Simpson,theCourtaffirmedtheEHBsdecisionandremandedthematterbacktotheEHBfor
trial.
TheCourtsteeredthepartiesawayfromthevoluntaryversusinvoluntaryissue,and
directedthepartiestofocusmoreonthelanguageofAct101itselfandwhethertheCounty
appropriatelydescribedandestimatedtheavoidedcostsofwasteprocessinganddisposalinits
PlanusingtheproposalssubmittedbyGreentreeandWayneTownshiplandfills.
TheCourtcautionedthat,goingforward,theavoidedcostsapproachisclearerwith
respecttoprogrammaticsupportandinkindservicesasopposedtostraightfinancial
contributions.
Priortotrial,WasteManagementwithdrewitsappealoftheDepartmentsapprovalofthe
Countysplan,makingthatapprovaladministrativelyfinalandnolongersubjecttoanykindof
challengeinstatecourt.

threatenthehealthofresidentsintheDelawareRiverwatershedifdrillingwerepermittedthere.

TheDelawareRiverBasinsitsatopasliveroftheMarcellusShale,thesecondlargestgas
fieldintheworld.Atthesametime,itisavitalresourceformillionsofpeopleandwildlifein
fourstatesacrossthenortheast.
The330mile,protectedriveristhelargestundammedrivereastoftheMississippi,is
hometodiversewildlifeandprovidesdrinkingwaterforover17millionpeople.
Thewatersoftheriverbasinprovidetheregion$22billionineconomicbenefitsfrom
activitieslikehiking,hunting,fishing,boating,andfarmingandsupports600,000jobsinthe
coastal,farm,ecotourism,water,ports,andrecreationindustries.
AddsvanRossum:Clearly,protectingthehealthofourDelawareRiversystemisvital
toprotectingtheregionseconomy,jobs,andourqualityoflife.
TheDelawareRiverBasinCommission,whichcontrolstheregion,draftedregulations
thatwouldallownaturalgasdevelopmentin2011.Avoteontheregulationswaspostponed,but
couldberescheduledatanytime.

DespitethemajorthreatthatshalegasextractionposestotheDelawareRiver,awater
supplyforover17millionpeople,thereislittleactiveresearchhappeningtoinformsuchavote.
Bylookingatwhatwouldhappenif4,000wellswerefrackedinthewatershed,CNA
researchersprovideadetailedanalysisoftheimpactsonspecificenvironmentalareas.
ThestudyfindsthatopeninguptheDelawareRiverBasintofrackingwould:
Require18to26squaremilesofland,theequivalenttobuildingasmanyas840Walmart

Convertlandtourbanconditionswithalossofcoreforestanddegradationof
environmentallyimportantforestedlands
Removeupto70percentofwaterinsmallstreams,permanentlydepletingcrucialflowsand
increasingdamagingrunoff,turningsomeofthehighestqualitystreamsintoditches
Raiseinstreamconcentrationsofcontaminants,includingbariumandstrontium,upto500
percentabovethenormalrate,analarmingincreaseinpollutants.Certainbariumtypescancause
changestoheartrhythm,paralysisordeathandradioactivestrontiumcancausecancer.Children
maybemorevulnerabletotheseeffects
Contaminateriverheadwaters,increasingsedimentationanderosionratesupto150percent,
degradingwaterqualityandecosystemsthereanddownstream
ContributetomethaneemissionsfromtheMarcellusShale,adding1.4to5.8billioncubic
feetofmethaneeachyeartotheatmosphere.Methaneisapotentgreenhousegasthatis86times
morepotentthancarbondioxideasacauseofclimatechangeona20yeartimescaleand
Asmuchasdoublenitrogenoxideemissionswherefrackingwouldoccur,creatingdangerous
smoginthelongterminareaswithcurrentlyclean,highqualityair.
ThisstudydemonstratesthatfrackingintheDelawareRiverwatershedwouldhave
disastrouseffectsonlocalenvironments,saidDr.AnthonyIngraffea,professoremeritusofcivil
andenvironmentalengineeringatCornellUniversity.Unfortunately,withlaxenforcementand
gapingloopholesinexistingregulations,theimpactswouldlikelybeworse.Theresultwouldbe
afundamentaltransformationoftheregionfortheworst,withrepercussionsforour
communities,economy,andtheenvironment.

TheCNAanalysisprovidesascientificallyrigorousandreplicablequantificationofthe
landuseandwaterqualityimpactslikelytoresultfromallowingshalegasextractioninthe
InteriorMarcellusoftheDelawareRiverBasin,Adamssaid.Bycomprehensivelyexamining
theanticipatedimpactswhichhasnotbeendonebeforeCNAquantifiesthedeathbya
thousandcutseffectthatgasextractionactivitieswillhaveonthehealthofstreamsinthe
DelawareRiverBasin.Thefindingsaresoberingforariverthatistheprimarysourceofdrinking
waterformillionsofpeople,andaneconomicdriverforthetourismindustry.Regulatorsand

Gov.TomWolfproclaimedAugustAsianLonghornedBeetleAwarenessMonthin
recognitionofthedangerthebeetlesposeformultiplePennsylvaniahardwoodspecies.
TheU.S.DepartmentofAgricultureproclaimedAugustTreeCheckMonthaspartofa
nationalcampaignurgingpeopletotake10minutestochecktheirtreesforsignsoftheAsian
longhornedbeetle.Augustwaschosensinceadultbeetlesaremostactiveduringthesummerand
earlyfall.
TheadultAsianlonghornedbeetleisthreequarterstooneandaquarterincheslong,has
ajetblackglossybodywithwhitespotsoneachwing,andlong,blackandbluishwhite
antennae.

ResidentscanalsocollectasampleandshipittooneofPennsylvania's67countyPenn
StateExtensionoffices,tothePennsylvaniaDepartmentofAgricultureheadquartersin

Manyspeciesofwoodboringinsects,includingtheAsianlonghornedbeetleandemerald
ashborer,canbespreadthroughtransportofinfestedfirewoodandlogs,campersand
homeownersareencouragedtouseonlylocallyharvestedfirewood,burnallofitonsite,andnot
carryittonewlocations.
Beetlelarvaetunnelthroughtreestemscausinggirdlingthatcutsofftheflowof
nutrients,eventuallykillingthetreeandresultingincoarsesawdustatthebaseofinfestedparts
ofthetree.Adultbeetlesleaveroundexitholesinthetreeaftertheyemerge.Thereisnoknown
practicalcontrolforthiswoodboringpestotherthandestroyinginfestedtrees.
Thebeetlesattackandeventuallykillmanyspeciesoftrees,butprefermaplespecies.
Soft(redmaple)andhard(sugarmaple)treesmakeupmorethan25percentofPennsylvania's
hardwoodforests.Thebeetlealsoattacksspeciesofash,birch,buckeye,elm,horsechestnut,
poplarandwillowtrees.Asmuchas$10billioninlumberandpulpproductionand$3millionin
maplesyrupsalesareatrisk.
NativetoChina,MongoliaandKorea,thebeetlewasfirstdiscoveredinNorthAmerica
inNewYorkin1996andhassincebeenfoundinIllinois,Massachusetts,NewJersey,Ohioand

Ontario,mainlyinurbansettings.

PAFarmlandPreservationProgramProtects2,857MoreAcresOfFarmland

DuringtheAugustmeetingofthePAAgriculturalLandPreservationBoard,anadditional29
farmsin16countieswereaddedtothestatesnationleadingfarmlandpreservationprogram
totaling2,857acresofadditionalfarmland.
Sincetheprogrambeganin1988,federal,state,countyandlocalgovernmentshave
investednearly$1.3billiontopreserve511,221acreson4,830farmsin57countiesforfuture
agriculturalproduction.
Twentyninefarmfamilieshavetakentheimportantfirststepinpreservingtheirfarms
bysafeguardingtheirlandpermanently,saidAgricultureSecretaryRussellRedding.Ithank

rights,fromownersofqualityfarmland.
Gov.TomWolfsproposedbudgetforfiscalyear201516buildsonPennsylvanias

TherenamingwastimedtomarkPinchot's150thbirthdayTuesday.Aformaldedication
isplannedatalaterdatebyDCNR.
Initialpurchaseofthedistrict'sstateforestlandcamein1902when2,854acreswere
purchasedinLackawannaCounty.Some100yearslater,stateforestacreagehadincreasedto
almost11,000acres,andtwomajorstateforesttractshadbeencreatedinLackawannaand
Luzernecounties.Today,thosetractstotal47,543acres.
"Mygrandfatherwasafounderofthepoliticalmovementtocreatepublicforeststhatare
managedtoprovidemultiplebenefitstopresentandfuturegenerations,"saidPeterPinchot,a
foresterandGiffordPinchot'sgrandson."Hebelievedthiswasanessentialfoundationfora
viabledemocracy.ItiswonderfulthattheLackawannaStateForestDistrict,soclosetohis
home,isbeingrenamedinhishonor."

,whoservedtwotermsasPennsylvaniasgovernorand
ledtheU.S.ForestServiceasitsfirstchief,andwhose150thbirthday
wecelebrateTuesday,hadafacecontemporariesloved.Mostofall,
theyadoredhismoustache.
CartoonistsexaggerateditsshapeandsizeduringMr.Pinchots
controversialtenureattheForestService.Itcaughtthefancyof
Pennsylvanianewspaperswhileheoccupiedthegovernorsmansionin
the1920sand1930s.
Helovedbeingthecenterofattentionandknewfullwell,right
uptohisdeathin1946,thathismoustachehelpedkeephiminthe

spotlight.
DespiteMr.Pinchotswidelyrecognizablefaceandpoliticalinfluencehisisno
longerahouseholdname.TotheextentthatPennsylvaniansrememberMr.Pinchot,manylikely
cursehim.Astaunchteetotaler,in1933hesignedthelegislationcreatingthestatesLiquor
ControlBoard.
Andyet,onthesesquicentennialofMr.Pinchotsbirth,itisworthlookingpasthis
lamentablelackofappreciationforfinewhiskey.IntheProgressiveEra,Mr.Pinchot,alongwith
closefriendTheodoreRoosevelt,arguedthatthefederalgovernmentwasessentialtothe
efficientandeffectivemanagementofsocietysaffairs.
Likehispresidentialpal,healsobelieveddeeplythatonlythenationstatecould
guaranteeamorejustandequitablesociety.
GiffordPinchotputhisvisionintoactionin1905inthenationalforests,assertingthat
theymustbemanagedforthegreatestgood,forthegreatestnumber,inthelongrun.
Sustainablemanagementofwhatisnowa193millionacresystemwasessential,he
believed,sothateachsucceedinggenerationwouldreceiveanundiminishedeconomicandsocial
valuefromthesevitalpubliclands.
Onlythefederalgovernmentcouldbalancethecrossgenerationalclaimsonthe
AlleghenyNationalForest
anditsmanypeersnationwide.
Seekingthegreatestgoodwasnocureall,however.Infact,whatconstitutesthe
greatestgoodhasbeendebatedeversince.ThatprospectactuallycheeredMr.Pinchot,forit
meantdemocracywasalive.Butitwouldflourishonlysolongasthesedisagreementsoccurred
inanopen,publicarenaandwerenotmanipulated(orignored)bycorporateinterests.
Therightsofpeopletogovernthemselves,Mr.Pinchotwroteinhisbook,
TheFight
forConservation
(1910),shouldnotbeinfringedonbygreatmonopoliesthroughtheirpower
overnaturalresources.
Mr.Pinchothappilyfoughtagainstentrenchedmonopolieswhileservingas
Pennsylvaniasgovernor(19231927and19311935).Thatswhythestatespowerelite
RepublicansandDemocratsdespisedhim.
Tosecureoffice,hehadtosubverttheprevailingpartysystembybuildingasuccessful
coalitionofthedismissed,thedisaffectedandthemarginalized.Hisferventsupportersincluded
women,miners,farmersand(yes)prohibitionists.
Withtheirbacking,hechallengedtheswellingcloutoftheutilityindustry,battledagainst
BigCoalandBigIron,anddispatchedthestatepolicetoprotectstrikingworkersfrom
companyfinancedgoonsquads.Forgoodmeasurehiswife,CorneliaBrycePinchot,stoodon
picketlines.
Puttingtheunemployedtoworkconstructing20,000milesofPinchotRoadsthat
pulledfarmersoutofthemud,theenergeticchiefexecutivesentotherstoregenerateclearcut
forestsacrossthestate.Ahealthylandscapeandasalubriousbodypoliticwerethecornerstones
ofwhatMr.Pinchotcalledhumanconservation.
HisprincipledapproachislittleevidentintodaysdebatesinPennsylvaniaoverfracking.
Givenhislifelongdistrustofnaturalresourcecompanies,withtheirimpactontheenvironment
andpoliticalmachinationsinWashington,D.C.,andHarrisburg,heprobablywouldhave
prohibitedfrackingintheKeystoneState,muchasNewYorkStatehasdone.
Inhisfirstgubernatorialterm,andmanydecadesbeforefederalcleanwaterlegislation,
Mr.Pinchotadvocatedforandsignedlegislationtostopindustryfromdumpingpollutantsin

Pennsylvaniarivers.
Hecouldnothavemissedtheparallelstofrackingwastewaterinfiltratingstreamsand
groundwaterandwouldnothavebeensilentabouttheseriousthreatthiseffluentposedtopublic
andenvironmentalhealththatis,tothegreatestgood.
EvenifMr.Pinchotdecidedthatfrackinglikeloggingandminingbackinhisday
wasessentialtothestateseconomyanditscitizenseconomicwellbeing,hewouldhaveput
strictlimitsonitsoperations.
Protectingthepeople,thecommunitiestheyinhabitedandthewaterresourcestheyand
futuregenerationsrelyonwouldhavebeenhisfirstorderofbusiness.
Andhewouldhavefoughthardforhisconvictions.Mr.Pinchotlovedthe
thrustandparryofPennsylvaniapolitics.Herelishedmixingitupwithopponents,knowingthis
wastheonlywaytochangethestatespoliticalcultureandexpandtheopportunitiesavailableto
itsleastpowerfulcitizens.
This,then,isamanwellworthcelebratingalongwithhissignaturemoustache.

syrups,jellies,leekdipsandothersmallbatchproductsthatreflectourruraltraditions,said
TatabolineEnos,ExecutiveDirectorofthePAWildsCenterforEntrepreneurship,theregional
nonprofitthatoperatestheArtisanTrailprogram.
Wevetriedtokeeptheprogramveryaffordable,from$25ayearforoursmallest
artisanproducersto$150forourlargerones.Wedothisbecauseweareworkingtobuildour
regionalbrandandweknownoonecaninfluenceitthewayourartisansandcreative
entrepreneurscan.TheArtisanTrailisworkingtogrowthiscottageindustry.Wehavesomuch
talentinthisregion,itisincredible.
Todate,morethan150artisansandretailersacrosstheregionparticipateinthePAWilds

ActionPlanistoconservePennsylvaniasnative
wildlife,maintainviablehabitat,andprotectand
enhanceSpeciesofGreatestConservationNeed.
Firstdevelopedin2005,theplanhasbeentheCommonwealthsblueprintformanaging
andprotectingimperiledspecies.AsrequiredbyCongress,StateWildlifeActionPlansmustbe
revisednolessthanevery10years.
Forthepast10yearsthePennsylvaniaWildlifeActionPlanandassociatedfundingfrom
StateandTribalWildlifeGrantshavebeencrucialforprotectingandrecoveringimperiled
speciesandtheirhabitats.
StateWildlifeActionPlansaredesignedtohelpkeepourcommonnativespeciesfrom
becomingmorerare,saidPFBCExecutiveDirectorJohnArway.Forrarespeciesalready
listedasthreatenedorendangered,theplanisaframeworktoassistwiththeirrecovery.The
SWAPisauniqueopportunitytoplanhowwecanworktogethertoprotect,conserveand
enhancenotonlyourdiversefishandwildliferesourcesbutalsothehabitatsthatallowthemto
continuetoliveandsurviveonourCommonwealthslandsandinourwaters.
PennsylvaniasWildlifeActionPlanisacommitmenttomaintainingthe
Commonwealthsvastdiversityofnativewildlife,somethingweareboundtopreservein
accordancewithourstateconstitution,addedGameCommissionExecutiveDirectorR.
MatthewHough.Itisntenoughtosaywewill.Weareboundbyourconstitutionalpromiseto
generationsyettocomeandourconservationethictomanageallofthestatesnaturalresources
wisely.Thisplanhelpsusdothat,anditensuresoureffortswillbeinstepwiththefederal
governmentandotherstates.

Bringingtogetherconservationagenciesandorganizationsfromacrossthe
Commonwealth,fornearlythreeyearstheGameCommission,FishandBoatCommission,and
theirpartnershavecompiledandanalyzedinformationrelatedtospecies,habitats,threats,
conservationactionstoaddressthethreats,andmonitoringofthesespeciesandhabitats.
Thereviseddraftplanhasidentified664speciesincluding90birds,19mammals,18
amphibians,22reptiles,65fishesand450invertebratesthatrequireattention.
AStateWildlifeActionPlanapprovedbytheU.S.FishandWildlifeServiceisrequired
