STlPULATION REGARDING SEPTEMBER 5, 2008 HEARING

It is hereby stipulated and agreed by and between the United States and the Montgomery

Parties (Dennis M)ntgomery and The Montgomery Family Trust), through their respective

counsel, as follow;:

J. On Sep:ember 5, 2008, this court conducted an evidentiary hearing concerning matters

17

raised by Montgomery Parties related to the seizure, management, and return of property by the

18

FBI. See Minutes of Proceedings (#135). The hearing was conducted simultaneously in this

19

proceeding (3:06-.,v-0263) and in the related "civil proceeding" (3:06-cv-056).

2. The principal parties to the related "civil proceeding" have reached a settlement of
various claims in that proceeding and have lodged their proposed stipulation and dismlssal.
3. Montgomery Parties agree that they, individually and collectively, do not and will not

23

institute any court proceeding to challenge the adequacy or completeness of the FBI return of

24

seized property to Mr. Montgomery on March 29 and April 6, 2007, as ordered by this court.
