Settled is the rule that jurisdiction is conferred only by

statute can confer jurisdiction on courts and administrative agencies.

CRIMINAL PROCEDURE

In the absence of any clear showing that the trial court

overlooked or misconstrued cogent facts and circumstances which would alter a
conviction, it generally defers to the trial courts evaluation of the credibility of

A search warrant proceeding which is not a criminal action, much

less a civil action, but a special criminal process.
