NOTICE OF PUBLIC HEARING
ON PROPOSED PROJECT AND
THE ISSUANCE OF PRIVATE
ACTIVITY BONDS
Notice is hereby given that the City
Council of the City of Zumbrota, Minnesota (the City) will meet on Thursday,
October 1, 2015, at 6:00 p.m., or as
soon thereafter as reasonably possible
in the City Hall, 175 West Avenue,
Zumbrota, Minnesota, for the purpose
of conducting a public hearing to take
comments on giving host approval to
the issuance by the City of Chisholm,
Minnesota, and the City of Morris, Minnesota (together, the Municipalities),
of revenue obligations, in one or more
series, under Minnesota Statutes, Sections 469.152 through 469.165 (the
Act), in order to refinance, on a taxexempt basis, the cost incurred by the
Borrower referred to below with respect
to the following (the Project): (i) acquire and renovate the 102-bed skilled
nursing facility known as Chisholm Health
Center, located at 315 NE 6th Street,
Chisholm, MN including but not limited
to HVAC improvements, new windows
and resident room renovations; (ii) acquire and renovate the 134-bed skilled
nursing facility known as Viewcrest Health
Center, located at 3111 Church Place,
Duluth, MN including but not limited to
HVAC improvements, new windows and
resident room renovations; and (iii) demolition of an obsolete building and construction of a two-story, approximately
32,605 square foot, 17-bed skilled nursing
facility known as Zumbrota Health Services located at 433 Mill Street, Zumbrota,
MN and related improvements.
The Project is owned and operated by
St. Francis Health Services of Morris,
Inc. or one of its affiliates, Chisholm
Health Center, Viewcrest Health Center
or Zumbrota Health Services, which are
all Minnesota nonprofit corporations and
organizations described in Section
501(c)(3) of the Internal Revenue Code
of 1986, as amended (the Borrower).
The refinancing of the Project in the
maximum amount of $10,000,000 will
include financing a portion of the costs
associated with the refinancing. The
obligations and interest thereon shall
not be payable from nor charged against
any funds of the Municipalities other
than revenue pledged for the payment
thereof, nor shall the Municipalities be
subject to any liability thereon. No holders of the obligations shall ever have the
right to compel any exercise of the taxing power of the Municipalities to pay
the obligations or the interest thereon,
nor to enforce payment against any property of the Municipalities. Such obligations shall not constitute a charge, lien
or encumbrance, legal or equitable, upon
any property of the Municipalities, nor
shall the same constitute a debt of the
Municipalities within the meaning of any
constitutional or statutory limitations.
All persons interested may appear
and be heard at the time and place set
forth above or may submit written comments to the Administrator in advance
of the hearing.

UTILITY TASK VEHICLES AND
MINI-TRUCKS IN THE
CITY OF ZUMBROTA.
The Council of the City of Zumbrota
does ordain that Chapter 71 of the
Zumbrota City Code is hereby amended
to repeal existing Sections 71.40 through
71.45 and replacing said Sections with
the following:
SPECIAL VEHICLES: MOTORIZED GOLF
CARTS, ALL-TERRAIN VEHICLES, UTILITY TASK VEHICLES AND MINI-TRUCKS.
71.40 DEFINITIONS.
For the purpose of this ordinance,
the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ALL-TERRAIN VEHICLE. As defined in
Minn. Stat. 84.92, subd. 8, means a
motorized vehicle with: (1) not less than
three, but not more than six low pressure or non-pneumatic tires; (2) a total
dry weight of 2,000 pounds or less; and
(3) a total width from outside of tire rim
to outside of tire rim that is 65 inches or
less. All-terrain vehicle includes a class
1 all-terrain vehicle and class 2 all-terrain vehicle. All-terrain vehicle does not
include a golf cart, mini-truck, dune buggy,
