provide for the establishment of a Siatc Board ol School


~duwtionto regulate, supervise and develop schoal education
in the State of NagaIand.
It is hereby enacted in the Twenty Fourth Year of the Republic
of India as follows :Short title, extent and commencement
1. (i) This Act may be called thc Nagaland Board of School
Education Act, 6973.
(ii) It cxtends to thc whole of Nagaland.
(iii) It shall come into force on such date as the Slalc
Government may, by notification in thc Official Gazettc,
to

appoint.

(iv) From the date on which this Act comes into Forcc Ihe
Board of Secondary Educalion, Assam, shall ccasc to
excrcise its jurisdiction over the educational Institutions
in the State of Nagaland.
Provided that the Board of Secondary Education, Assam, :hall
continue to bavc the same jurisdiction as now cxerciscd by 11 in
lbe State of Nagaland over thc High Schools till such time as thc
State Government by notificarion in the Official Gazclte, may
appoint.

2. In this Act, unless there is anything rcpugnanl

(b) "Chairman" means ihe Chairman of thc Board,

Nagaland and rnaintaincd or admitted to thc pridcges

"Education Dcpartrnmt" means the Dcpartmeot of
Education of tbc Government of Nagaland;
"Rind" means B e Nagaland Board of School Education
Fund constituted under this Act;
"High School" means a School or Dcp-artmcnt af a
SchooIgivinginstructionsinschool education andpreparing students for Matriculation or High Schoul Leaving
Certificate Examination;
"Managing Comrnittce" means a Managing Committee
of a School,
"notificalion means a notification of ~ h Board

prior ro recognition by Ihc Bnard by any University
estabished by law in India or by any Board recopised
by the State Government,
"Regulation" means a regulation made by the Board
under this Act,
"Rule, means a rule madc by the State Government
undcr [his Act,
"School cducation' means such education as is designed
to mect the needs of the stage immcdiatcly slarting from
the stage of Primaryeducation and precedes immediately
Lhe stage of Dcgree cducation including prc-University
controlled by any University establkhcd by law in lndia
or by a Board constituted by Government for this purpose
and it includes techr~icalcducotion and vocational instruction upto thc Dipoma Icvcl,
"Secretary' m a n s Scaetary of thc Board;

(p) "State Government' or Government means the Slate

to acquire and hold any property, to transfer any property
held by it to enter into any contract and to do all other
things necessary Tor thc purposes of carrying out its
duties and functions, and by the'said name sue or be
sued.
Constitution of the Board
4. (1) Thc Boardshah consist of the FolIowing mem hers nanlciy :
(a) Ex-oficio Mcmhers.
(i) The Director of Education, Nagaland-Chairman.
- (u) Tbc Director of Industries, Nagaland.
( i i ) The Director or Agriculture, Nagaland.
(iv) The Dircctor of Health Senices, Napland.
(v) The Inspector of Schools, Nagaland.
(kt] Members to be norninatcd by the Government,
(i) Five teachers of whom at lcast two are women and
at lcast one is a Primary School teacher and one is
a College tcacher.

(u) Two teachers from Proicssional and Vocational


Schools.
( c ) Co-optcd Members;
The Board shall have powers to co-opt not more than twr~members
from amongst the distinguished cducatinnists.

(2) The Secretary shall be appointed hy the <;r)vcrnmcnl


who shall also be a member of the Board.

Publication of the names of Members of the Board

The namcs of persons nominated or co-opted as members


of the Board, shall be published by notification by the Srate
Government.

Provided that the State Government, may by notification in the
OfficiaI Gazeltc extend thc term of the office of ail such members
by a period not exceeding one ycar.
(ii) Notwithstanding thc expiry of the term of tbrcc years
specified in clause (i) the tcrm of oif~ficeof the out going
members shall be deemed to extend to tbc date on .
which the names of the newly-nominated members are
published under sectiot 5.
Disqualification membership for

A person shall not bc eligibic for nomination or co-option

as a membcr of the Board or of the Commiltccs formcd


by it if he;
(a) has becn adjudged by a court of law to bc of
unsound mind;
(b) is

undiscbarged insolvent;
(c) has bcen convicted by a court of law for an offence
which is dtclared by the Statc Government to be
an offcnce, iovotving moral Lurpitude, as provided
in thc rules.

(2) If a nominated or co-opted membcr af the Board or of


any Committee rorrned by it becomes subjcct trr any of
the disqualification specified on sub-section (I), his
membership shall thereupon ceasc.
(3)

AU disputes relating to the elig;bility of any person for


nomination or co-option, shall be rcfcrrcd to the Statc
Govcrnment whose decisinn on such matter shall be
find.

Reaignatioa of members and casual vacant!


8. (1) A member of the Board, other than an ex-officio mzmbcr,
may resign his seat by giving notiw thercrll in writing
to the Chairman, and such, memhcr shall he dccmed
to have vacatcd his seat from the dale of acceptance oC
his resignation by the Chairman
(2) The State Government may, by notification remove any
nominated or a-optcd member, who rcrnains absent
from three mnsecutivc meetings of the Board without
the leave of rhc Board.

In the event of a casual vacancy occurring by resignation,


removal, death or disqualification of a member such
vacancy shall be filled by nominalinn or co- option, as
the case may be, in the manner providcd in Section 4.
(4) Any pcrsan norninatcd or co-nptcd to lilI a ~ ~ s u a l

(3)

Meetlngs of t h e Board
F. (1) Ordinary meetings :-The Board shaIl mcct nclt Icss

(2) Spccial mcetings :-The Chairman or the Secretary may,
at any lime and shall upon the requisition made by not
lms than one-third of the membcrs of the Board other
&an the ex-otTicio membcrs and on a date not rntlre
than twenty-one days of the receipt of such requisition,
call a special meeting of the Board.
(3) Twenty-one days notice shall be given for ordinary
meetings of the Board and ten days noticc Tor special
meetings.
Quorum Proceeding not invalidate by reason of v;tcancies
10. (1) The quorum for every meeting of thc 3tl;ird shall hc
five.
(2) Subject to tbc provisions mntaincd in sub-sectiun ( 1 )
no act or proceedings of thc Bo;~rd shi~llhe invalkl
mercly by reasan of the existcncc :c:f any vacancy among
the mcmbers of thc Board.

Omcers of the Board


11. (1) Thc fouowing shall be the officers of the Board.
(a) The Chairman and
(b) The ~ e c r e t a r ~ .
(2) The Board may appoint such othcr officers and employees
as it considers necessary for thc efficient discharge of
its functions under this Act, on such terms and csnditions
as may be determined by regulations.
Powers and duties of the Board
12. Subjecl toany general or special order n l h Statc Government

and control school education; and in particular the powers


and duties mentioned below :
(I) to prescribe courses of instruction for Primary, High
and Profcssiond or Vocational Schools;
(2) to conduct and supervise examinations based or such
course or to causc to copduct and supcmse such ex-

aminations;

(3)

to admit to its cxaminations, on conditions that may bc


prescribed by regulations, candidates; who have persucd
the prescribed courses of instruction and also to takc
such disciplinary action against wndidates as may be

prescribed by regulations;

(4) to dcmand and receive such fees as may ha prescribed


hy regulation;
(5) to publish Lhe resulrs or its examinations;
(6) to demand and rcccive such fecs as may be prescribed
by regulation;
(7) to publish the results of its examinations;
(8) to grant certificates to studcnts passing in examinations;
( 9 ) Lo institu~eand award scholarships, prizes;
(10) to prcpare, publish andsclcct text books, supplementary
hooks or to cause to prcpare publish and select such
books;
(12) to lay down conditions of recognitiou of High Schoob
and othcr schools preparing candidates for High SchooIs
courscs and other courscs prcscrihcd by thc ~ o a r d ;

(l2) to recognise High Schook, and profcssianal and Vocational Schools and to withdraw such recognition;
(13) to take such disciplinary action as it thinks fit against
institutions as prcsctibed by regulations;
(14) foadopl measures for srudy and examination oCprnblems
in the field of school education;
(15) to advise Government on physical, moral and social
welfare d students in recognised institutions, and to
prcsctibe conditions for thcir residence and discipline;
(16) to pracribc necessary qualificationsnfleachers in recognised schools;
(17) to prescribe caurscs a training in undergraduate
Teachcts Trainiog Institutions and to hold examinations
oa such courses and to award certificates;
(18) to recognise undcr-paduatc Tcacher'~Training Insti~utions and to withdraw recognitions;
(19) io organise seminars aod provide "in-service" Teacher's
Training wurses;
(20j to receive gr+ts lrom Government and donations from
private individuals or associations for spccific or general
purposes;
(21) to call for reporb from Lhc Director of Education on
the anditiods of rccognised institutionsor of institutions
applylog for recognition;
(22) to advise ~ o v c r m e n on
t re-organisation and developmen[. of school educations;
(23) to advise Government relating to any matlcr within the
provisioas of this Aci on which he Govcrment may
consult the Board;
(24) to appoint olficcrs and other employe~qof the Bawd,
and to prescribed by regulalinn, thc terms and conditions
of thcir service;
(25) to institute by regulations ior rhc hnefir d its officcrs
and other employees such pension, gratuity and providenl
fund as i t may deem fit in such manner and subject to
such cqnditions, as may br: prescribed by regulations;
(26) to delegate any ofitspowersto any Commi~leeconstitu~ed
under this Act;

(27) to administer the Nagaland Board of Schrlol Education


Fund;
(28) to receive, purchase and hold any propcrry, mov;thlc or
immovahlc, which may become vcstcd in il :~ndto Jisposc
of all or any of the properly, mclvabIc or irnrnovahle

13. Notwithstanding :anything contailled in this A c t ;(i) The Statc Government shall have ~ h eright to addrcss

the rcasons thereof, suspend the execution of any rcs~lution or order of thc Board and prohibit (he cioing of an

Government is of thc opinion that such rcsoIution, c~rdcr
or act is in cxccss of the pnwers, crlnkrred upon [he
Buar-J by or under this Acl.
(v)

The SLate Governmenf may, aficr conwltiltion will1 the

Custody and investment of the SchooI Educution Ronrd Fund


IS. A11 moncys at the credit of thc Fund shall bc kept in thc
Government Treasury or the Stalc Bank of India, as thc

Applications of the Funds


16. Subject to [IIC provision of this Acl, lhc Fund st~allhc

incidental to matters specified in this Act.
Audit of the Accounts of the Roard
17. The accoullts of the Board shall hc audilcd nnly by sucl~
agency as may be specified by thc SI~II: liovcrnmcnl and a
copy of the audited accounts shall hc suhmittcd hy thc Board
to the Statc Governmen! by such datc cach ycar as thc State
Government may speciFy.

Provided thal all regulations, altcra~inns,and rcvncation thcrenf

Board to furnish reports, returns, to the State Government
24. The Board shall furnish to the State Government such reports,
returns and Statements and such other information relating
to any matter under khc control of thr; Board as the StatcGovernment may require.
Power of State Government to reconslltute the Board
25.

If in the opinion of the State Government Lhe Board bas shown


its competence to perform or perssitcntly made dcfault in the
perforrnancc of the duties imposed or cxcccded or ahuscd the
powers confcrred upon it by or under this Act, the Srate liovernment shall forniulale in writing specific charges against the Board
in respect of those matters and shalI forward a copy of such

charges to thc Board with direction to submit any cr~mmcntsor


explanations in rcspcct thereof it1 the State (iovernment within
such period as may bc spccilied ill this behalf. Aher the consideration of the commcnts and explanations of the Hoard, thc
State Government may if it thinks fit, by notification supersede
the Board and thcrcdtcr rcconstiture thc Board in accordance
with the povision of scction 4 and in every such casc the statc
government shall, as soon as may bc, lily befnrc the S ~ a l tcgislaturc

Vesting of powers till the reconstitution of the Board
26. Until thc Board is reconstituted aftcr supcrscssion undcr
