ith a history of disagreements over


the years with the regulatory body of
the telecommunications sector, the
Liberia Telecommunications Authority
(LTA) Liberia giant GSM service provider, Lonestar
Communications Corporation has found itself in further
trouble with a huge ruling by the Tax Court against the
company.
At the moment, Lonestar Cell has a complaint against the
LTA protesting increment on the tariff for international
calls which has been proposed by the regulatory body
and while the Civil Law Court at the Temple of Justice
has summoned the LTA, another court has also ruled
against Lonestar Cell.
In a ruling in the case Lonestar Communication
Corporation vs BOTA for judicial review and Liberia
revenue Authority Vs Bota also for judicial review
growing out of the case Lonestar Communication
Corporation Vs Ministry of Finance/Liberia
Revenue Authority, an appeal against administrative
determination that found that the GSM company
should pay US$19,197,903.44 as tax obligation to the
government of Liberia.
The Ministry of Finance reported to the LCC that from a
forensic audit conducted it was discovered that the GSM
Company had tax obligation of US$ US$19,197,903.44
which led the Ministry to conclude that the company
had defrauded the government and it was therefore
demanding assessments of the company records.
LCC on the overhand denied any wrongdoing and
improper tax records and demanded opportunity to
review a d respond to the new information but refused
to grant the Ministry of Finance access to its records.

Court records indicate that the Ministry of Finance on


April 17, 2013 issued a letter to the LCC in which it stated
that based on new discoveries or unreported income,
indistinct expenses, and unclear interconnectivity
transactions, the Ministry was attaching copy of an
audit based on its recent re-assessment of the LCC
for the period of 2007-2011 resulting in a tax bill of
US$19,197,903.44, which amount should be paid within
30 days, after which time the MOF will be constrained
to implement enforcement actions in keeping with the
Tax Laws to ensure the recovery of this tax debt.
In the background of the case contained in the ruling
of His Honour Judge Mozart A. Chesson, Resident
Tax Court Judge, Montserrado County stated that the
LCC objected and resisted the claims by the Ministry
of Finance, requesting a conference with the relevant
MOF staff and ended by stating In the event that a
resolution cannot be reached, Lonestar Cell MTN shall
exercise its right of appeal in accordance with sections
59 and 60 of the Revenue Code Act 2000.
During the course of the trial, the court records
indicated that both parties presented their respective
contentions in which LCC contended that Ministry of
Finance made an allegation of fraud but did not present
evidence in support of such fraud during the hearings
before Bureau of Tax Appeals (BOTA).
The Ministry of Finance on the other hand contended
that although BOTA had compelled the MOF to
participate in a reconciliation exercise requested
by the LCC, the BOTA had permitted the LCC to
reject the results of that exercise when it proved
unpalatable to it and the MOF prayed the tax court to
enforce the results of that exercise, which the LCC had
requested, and in which it voluntarily participated, the

conclusion of which found the LCC owing the sum of


US$13,146,385.21.
In the ruling, the Judge indicated that the LCC knew or
should have known what the statute provides; it knew
or should have known that the BOTAs Rule 5 misapplied
that statutes provisions; it knew or should have known
that BOTAs internal Rules-up and all of this should
have prompted the LCC to immediately challenge that
provision in order to protects its interest, something it
indicated that LCC unaccountably failed to take such
steps.
Judge Chesson ruled The court finds itself with no
alternative but to hold that the Lonestar Communications
Corporation failed to file its appeal against the Ministry
of Finances determination within the statutory time,
before the determination had become final and no
longer subject to challenge. Accordingly, the appeal
filed by the Lonestar Communications Corporation
to the Board of Tax Appeals, brought up to this court
on petition for judicial review, must be denied with
prejudice, and the determination of the Ministry of
Finance that the corporation owed taxes in the amount
of US$19,197,903.44, having become final and not
subject to challenge before the taxpayers appeal had
been filed, must be sustained.
The legal counsel for LCC excepted to the ruling and
announced an appeal to the Supreme Court which was
granted by the Judge.
In with law, the Supreme Court is expected to hear
the appeal and render an opinion in this case either
confirming the ruling of the lower court judge or
mandating the court to further look into the case.

THE UNITED NATIONS Mission in Liberia, which has been


in the post war country for over a decade, is expected to
depart in 2016 i.e. if the United Nations Security Council
finally decide to end the operations of one of the largest
UN peace keeping missions ever.
ALREADY LIBERIA HAS been told that it will take charge
of its own security from UNMIL by June 2016 and the
country is preparing with a plan, dubbed the UNMIL
drawdown, finding out ways to fill the security gaps when
the UN mission is over.
WITH A LONG HISTORY of security agencies paying loyalty
to individuals instead of the state, coupled with abuse of
power by those in charge of security, many Liberians fear
that the UNMIL drawdown could threaten the peace of the
country.
TOP SECURITY OFFICIAls are all appointed by the
president. Rather than protecting the entire population,
these officials focus on protection of those at the helm
of power leaving the citizens at the peril of criminals,
resulting to what is commonly known in Liberia as no
Justice for the poor.
ADHERENCE TO THE rule of law is still a major problem in
the country as some individuals rely on their connections
and power to abuse the rights of ordinary Liberians and
these Liberians in most instances do not get redress.
ONE OF SUCH incidents of abuse of power and use of force
against innocent Liberians occurred on September 13
in the Barnesville Housing Estate, a suburb of Monrovia
where a top security personnel, Deputy Director for
Operation of the Executive Protection Service, Darlington
George is said to have severely beaten one Esther Glain
leaving bruises and spill of blood on the face of the female
victim.
ESTHER, EXPLAINED to FrontPageAfrica on Sunday that
while at the Barnersville Sports pitch, EPS Deputy Director
for Operation, George and his men terribly beat her for
arguing with him.
THE VICTIM SAID it all started while she and her friends
were having a good time watching a football match, an SUV
pulled up so close to them almost to the point of ramming
into them, prompting them to yell out of fear only to see
Deputy EPS boss walking over to call them prostitutes.
THE GROUP OF women were said to have reacted angrily
and, according to eyewitnesses, George grew furious and
struck Esther hard in the face, kicked her to the ground
and then ordered his men to join in. When he was beating
me, one of his men used a Malta bottle and smashed it on
my head and later stabbed me on the jaw, Esther narrated.
ESTHER SAID SHE was left unconscious while Darlington
and his men drove away. She later found herself in a local
clinic where she was treated.
THE SITUATION of Esther, who is currently feeling the
pain, is one of many taking place around the country
where security personnel use their power to abuse the
ordinary people and go free.
BESIDES PHYSICAL INJURIES caused Esther, the alleged
action of a member of the presidential elite security is
good reason for his dismissal by President Sirleaf.
THIS IS THE SECOND TIME THE President Sirleaf has
dismissed an official of government for physically
assaulting a peaceful citizen.

rapidly and several new outlets are taking
the stake to hit the pedestal, according to our
finding. Though we hope to see new ones
emerge between now and end of the year, below are
our ten most listened to radio stations in the country
presently:
#1. UNMIL RADIO 91.5- Run by the United Nations
Mission in Liberia, it is known to be the nations most
liberal outlet. She pushes total peace and reconciliatory
programs and is heard in the nook and corners of the
nation and neighboring countries. Her consistency
on the air 24/7 gives rural dwellers hope and a closer
feeling onto the capitol. A team of Liberias objective,
professional and investigative crew gives a great deal of
having hope in a nation coming out of decades of civil
conflict.
#2. ELBC 99.9- This is the government run platform
and, before the war, was the only political media outlet
operating in the country. It is strictly public relations
outfit for the government. State radio as it is called, is
gradually transforming into a total public broadcaster
where everyone can at least have a say. This outlet now
runs online and stretches to all counties in Liberia. The
failed hopes of the past are being restored.
#3. HOTT FM 107.9- Initially started as Liberias HIPCO
revolution promoting Liberian talents in the music
industry and running comedies during drive time. A
team of great producers is making the radio station
become a branded mouthpiece in a short while. Starting
off with a political show that took the nation by storm,
Hott FM is gradually becoming an unbeatable radio
station for innovative folks. They could do far better in
the not too distant future by their innovations.
#4. VOICE FM 102.7 The nations premier in leftist
styled radio talkshows, touching those issues that
several others will not venture into and sometimes
taking a side as a political commentator. Partnering
with other leftists, Voice FM gives Monrovia a totally one
route listening in the morning. Voice FM brings a great
deal of the nations renaissance and the democratic
tenets of 21st century governance which undoubtedly
keeps them on air.
#5. FABRIC RADIO 101.1- It all began on Fabric, many
people will say. Liberians woke up to the morning when
they could call on a radio station in their country and
their relatives in the US and other parts of the world
could hear them and feel elated. It is really fun listening
to Fabric, keeping diaspora Liberians up to date about
what their fellow compatriots feel on the ground. They
have won several awards from the Press Union of Liberia
and placed media outlets on a run to go online.
#6. Truth FM 96.1- Followed by listeners in Monrovia
and its environs, the outlet faced series of challenges
from fire gutting its premises to changing of its best

consistency. Accurate and balance news programs and
an outlet many initially believed was the brain child of

unacceptable the assault on a law enforcement officer,
particularly a female, by a member of her government.

President Hellen Johnson-Sirleaf. Rating downturns are


eminent but with a committed and robust team, things
can rise up for the better. Resource seems not a challenge
but essential tools, innovation and farsightedness can
lift the bar again. Its old fame keeps the outlet to be still
followed by many. They have what it takes to transcend
beyond current position.
#7. ELWA 94.5 FM- the station is Liberias premier
gospel radio that has been broadcasting to the nation
since 1954. Completely destroyed in 1990 during the
Liberian civil war, its FM and shortwave broadcasts
were relocated to the old ELWA Garage building, itself
thoroughly looted in 1996. Nevertheless, resumption
and expansion of FM, SW, and Liberian language
broadcasts were accomplished in the early 2000s. ELWA
has been a hope to many and its shortwave broadcast a
pride to a global audience long in advance.
#8. Radio Gbarnga 96.5- Distant it might be but the
platform of this outlet in central Liberia is high. More
importantly, Radio Gbarnga has churned out most
of the nations top media gurus today and is yet to go

GSM tycoons, 105.1 is expected to introduce more
political commentators on the airwaves in an effort to
drive the dream. Its audience comprises mainly of those
with a political taste of Ureys aspirations and they use
interactions to champion their utmost cause.
#10. Radio Gbezohn 106.3- Grand Bassa is quiet not
because of the just ended election that saw the sole
supporter of the Precious jewels educational sojourn
lose but due to the fact that Radio Gbezohn has been off
air for over a month. The station is faced with series of
challenges from continuous vandalism of its property to
the flogging of its employees by politicians. Struggling
to get back on its feet following the latest incident, it is
listened to in parts of Rivercess and Margibi counties
and its talkshow gives no different flavor than that of
Monrovia. Listening to Radio Gbezohn 88 miles from
the Capitol gives one a great deal of the true art of
professionalism.

SIRLEAF AT THE time declared that she hopes her action


will serve as a deterrent to others in government who
would want to use their positions to abuse and violate the
rights of others.
ASSISTANT MINISTER Krah at the time walked into the
offices of FrontPageAfrica where he declared that he did
not assault the police officer. Krah was never investigated
but summarily dismissed from his position.
SO TOO THE dismissal of George is laudable but based on
the gravity of the injuries sustained by Esther, the state
must draw charges against him for hurting a peaceful
citizen as his action is a crime against the state.

A PLEA FOR HEARING INTO MISMANAGEMENT AT NOCAL

The Editor,

iberians for a New Democratic Order, an organization of


Liberians dedicated to ensuring pluralistic democracy, good
governance and accountability in Liberia, is calling on the
National Legislature to, without delay commence hearings
into circumstances that led to the collapse of the National Oil Company
(NOCAL), to determine if any laws were violated and crimes were
committed.
The group wants the investigation to look into how oil contracts
were awarded and to whom, as well as how NOCALs resources were
handled.
The group, in a statement issued over the weekend, is also asking
the National Legislature to place a hold on plans by President Sirleaf
to reward executives at NOCAL who oversaw the collapse of the
company with hefty financial benefits.
The group is also calling on the legislature to block the approval for the
disbursement of funds by the finance ministry, either from recurrent
funds coming into NOCAL coffers or from government reserves
towards any NOCAL restructuring and benefits payment until those
NOCAL executives are excluded from any restructuring program.
The Legislature must also bloc the NOCAL executives from further
obligating the company through any loan programs.
A credible restructuring will require new, respectable individuals, not
the same ones who mismanaged the agency into failure, the group
noted in its statement. We are also calling on President Sirleaf to fire
all those executives at NOCAL and to appoint a new management team
that will oversee the restructuring of the agency, the group noted.
The group is also calling for the commissioning of an audit to determine
how NOCAL funds were handled and how oil block contracts were
awarded; noting that there is little doubt that mismanagement,
corruption, bribery and a kick-back scheme are at the heart of the
failure of NOCAL.
The awarding of contracts on the basis of bribery and kick-backs and
not on the viability and track record of the companies seeking the
contracts, as well as mismanagement by NOCAL executives led to nonperformance and the massive collapse of NOCAL, the group noted;
wondering further, why would an organization as small as NOCAL
whose major source of funding is sale of exploration fields, have nine
vice presidents, each being paid thousands of dollars per month? Why
would members of the Board of Directors be paid millions of dollars in
board fees and bonuses?
And did statutory members of the board, such as the ministers of
Finance and Economic Planning and the Minister of Justice, who are
already on government payroll, also receive huge board fees, the
groups statement noted.
Liberians for a New Democratic Order is also calling on Liberian civil
society organizations, interest groups and the student movement to
rise up and insist on accountability and justice, as they, their families
are children are the direct victims of these acts of criminality and
abuse.
Labor and trade unions have a responsibility to stand up on behalf
of the poor workers who are being victimized through lay-offs
for the actions of NOCAL executives and all other workers whose
livelihoods are being threatened; students and young people must
rise up because it is their future and the future of their children that
are being mortgaged by the rampant acts of corruption, theft and
mismanagement that have driven NOCAL into the ground and that
have been a common-place in the Ellen Johnson-Sirleaf administration
and that continue to undermine the countrys development; the public
needs to standup because they are the ones that are most affected
by the poverty and under-development that corruption imposes
on societies. The unemployed need to rise up because corruption
undermines a favorable business climate that is the engine of job
creation.
When a corrupt public official receives a bribe or kick-back to award
an inferior contract or when he or she steals from the public coffers,
he/she is essentially denying a student the opportunity for a better
school, a pregnant woman the chance for prenatal healthcare, or a
community the opportunity for a good road to bring their produce to
market or to reach a clinic or hospital. The recent Ebola epidemic was
a classic example of how it is the people who suffer when government
officials steal and mismanage national resources.
Accordingly we urge Liberias civil society organizations, groups and
movements, and the public, to take actions including letter writing
campaigns, visits to their members of legislature, demanding urgent
and immediate action on the NOCAL saga. These actions can also

include peaceful demonstrations, sit-ins, and other actions that


will force president Sirleaf and members of the Legislature to take
immediate action to address the NOCAL problem.
Our organization was founded against the backdrop of the pervasive
culture of crime, corruption and impunity that has taken hold in
Liberia. This culture has been largely responsible for our national
backwardness as well as the periods of violence and bloodshed to
which our nation has been subjected.
Ina scathing critique of President Sirleafs legacy on corruption and
accountability in Liberia, the group noted that the culture of corruption
and impunity has reached new heights under the leadership of President
Ellen Johnson-Sirleaf. President Sirleafs record on accountability is
at best dismal and this has been largely responsible for undermining
and delaying the recovery and development of the countrys broken
infrastructure. Since her ascendency to power, in 2005 and her reelection in 2011, President Sirleaf has consistently failed to prioritize
the fight against corruption and other forms of public crime and
malfeasance. In spite of her rhetoric describing corruption as public
enemy # one and as a vampire the Sirleaf administration has failed
to prosecute and to place any severe sanctions on individuals who
have been found by the various accountability and anti-corruption
agencies to have engaged in serious acts of corruption and other
serious economic crimes. Instead she has approached corruption
with empty rhetoric and lip-service, while doing everything to protect
her cronies from accountability and prosecution.
President Sirleafs legacy on war crimes and crimes against humanity,
corruption and other economic crimes has been to reward war
criminals and corrupt officials with powerful, lucrative positions in
government, rather than hold them accountable for their actions.
While the thousands of Liberian victims of war crimes and crimes
against humanity, and the international community was campaigning
for accountability and sanctions against perpetrators of the criminality
that characterized the Liberian civil war, President Sireaf chose the
path of appeasing war criminals by rewarding them with powerful and
lucrative positions in government where they can still lord over their
abuse. She refused to implement the recommendations of the Truth
and Reconciliation Commission calling for sanctions and reprimand
for the most serious crimes associated with the war.
Although the General Auditing Commission, the Liberia AntiCorruption Commission, and the Liberia Public Procurement
Corporation have variously indicted several government officials for
acts of corruption and massive theft and mismanagement of public
resources meant for addressing the dire needs facing the poor,
President Sirleaf has consistently failed to punish anyone for their
crimes, often defending them or simply giving them a slap on the wrist.
This latest decision by the President to terminate the employment
of hundreds of ordinary workers at the NOCAL while rewarding the
executives whose corrupt acts or mismanagement drove the agency
into the ground with huge retirement benefits and the opportunity
to keep their high paying jobs is just another act in her consistent
pattern of rewarding criminals and corrupt friends and cronies, while
neglecting the poor and powerless victims of crime, corruption and
mismanagement.
We call on all Liberians to reject this latest attempt by the President
to reward rather than punish corruption, and urge the public to
forcefully resist and demand accountability. NOCAL is a public entity,
a property of the Liberian people, funded by the peoples resources;
as such President Sirleaf and those who presided over its demise have
a responsibility to explain why and how the agency, which was so
a-washed in funds, has suddenly gone broke.
We praise Mr. Samuel K. Woods for his consistent fight on behalf of
downtrodden Liberians, his courage and bravery in fighting corruption
and crimes and commend his stance on the NOCAL, even as he is being
attacked and vilified by the President. We reject the unwarranted
attacks by the President and her surrogates on Mr. Woods as attempts
to intimidate and silence him but we take comfort in the fact that
Woods has never bowed to threats, attacks and intimidation, even
during the height of the civil war.
We urge you to contact your member of the National Legislature and
the Office of the President to demand hearings and other immediate
actions on the NOCAL issue. Contact information for members of

Judicial Circuit Court
has disbanded 12 of
the 15 empanelled
jurors
in
the
ongoing
trafficking case involving some
Liberian girls and a Lebanese
national in Bomi County.
The ruling of Judge William
Sandoe came after the
Prosecution requested the
court to investigate and
ascertain information revealed
by the defense in the trial.
It can be recalled the defense,
represented by Atty. Arthur
Johnson and Cllr. Cooper
Kruah, objected to the sight
of armed police officers in
the court on grounds that
the presence of the men was
intimidating their client and by
extension the trial.
According to the defense team
of the lone suspect, they have
received credible information
that the presence of the armed
men on the grounds of the
court is an intimidation tactic
deployed by the prosecution
to tilt the case in favour of the
state.
Defense
counsel
says
reliable sources have told us
that the Prosecution is bent
on
intimidating
lawyers,
defendant, court staff and
jurors, which is not healthy
for the trial. This case is not an
armed robbery case so there is
no need for the heavy presence
of security armed officers in
court, the defense said.

the submission made by the
defense is fabricated and the
timing intended to halt the
proceeding of the case.

search to complete the panel.
The 15 panel, as per the new
jury management, provides
that the panel is to have 9
persons but after a submission
by the Defense, an argument
was
held
between
the
parties and 15 persons were
empaneled.
But on Thursday, the judge
said 3 of the 15 should remain
and he ordered the sheriff
of the court to write the
commissioners to forward
those presentable to serve as
jurors.
The judge also ordered the
sheriff to keep the three in an
isolated area, wherein none of
the parties will have access to
them.
Meanwhile, the judge referred
the jury tempering complaint
as a hearsay and could not
be
substantiated
neither
witnesses could verify the
claims.
At the same time, the judges
decision revealed that the both
parties are afraid of jurors to
decide judgement in the trial.
It is not known when the court
will finally begin the case as
the court is gradually closing
its August term 2015.

been summoned by the
Sixth Judicial Circuit Civil
Law Court Montserrado
County
to
answer
questions on surcharge
recently announced on all
international calls by the
regulatory body.
The summons to the LTA
is as a result of complaint
filed before the court by
the National Association
of Telecom Consumers
(NATELCO).
NATELCO
is
an
organization
which

represents consumers of
telecommunications
in
Liberia.
Recently, a commissioner
of
the
Liberia
Te l e c o m m u n i c a t i o n s
Authority (LTA), justifying
the rationale behind the
recent order by the LTA said
Liberians do not often make
international calls, a claim
NATELCO disagrees with.
According to the LTA
Order, international calls
will incur a surcharge of
5 cents for every minute,
which means if one makes
an international call for 10
minutes, they will have to
pay 50 cents to the LTA for
the call, which is in addition
to the rate charged by
service providers.

The regulatory surcharge,


which is not considered a
tax, would be paid to the
LTA and used as additional
funding for the LTA's budget.
The Civil Law Court, in
its writ of summons,
instructed the LTA to enjoin
and restrain from the
enforcement of LTA order
(001-07-31-15)
which
imposes a surcharge on
all outbound international
calls.
The National Chairman of
NATELCO,
Barthalomew
Wilson,
at
a
news
conference recently said
it is unfair to the Liberian
people who are struggling
to meet up with the current
economy situation the
country is faced with.

What concerns us most


is the manner and form
in which this regulation
was issued and the overall
triggered
down
effect
it is sure to pose on the
over 2 million consumers,
majority of whom survive
on oversea support from
family
members
and
relatives especially during
difficult times like this, he
noted.
The LTA, known for its
exorbitant spending on
salaries, foreign travels,
expensive vehicles, and
high rent, would be directly
placing the burden for
their extravagant budget
on ordinary consumers,
something the local telecom
consumers group frowned

on and took the LTA to


court.
According to the writ of
summons, a copy which is
in the possession of this
paper, the Civil law Court
has commanded the LTA to
appear before the Civil law
Circuit, sixth judicial circuit,

in its September term at
10AM.
The
court
further
commanded the LTA to file
their formal appearance

Monroviaiberia National Police has arrested an employee of


Lonestar Cell MTN for allegedly embezzling more than
US$60,000 and over $400,000 LD from the company.
Mrs. Suzette A. Blake-Binda, Central Regional Sales
Supervisor, was picked up by police officers early Thursday
morning following several futile attempts to have her attend
a disciplinary hearing as required by the policy of the GSM
Company. She is currently being interrogated and is expected to
be charged at the Liberia National Police Headquarters.
In a press release, the authorities of Lonestar Cell MTN said they
strongly believe in the rule of law and therefore holds that the
arrest of Mrs. Binda is a way forward in ensuring that due process
is accorded in keeping with law.
It is our conviction that the arrest and subsequent prosecution
of Mrs. Suzettee A. Blake-Binda will also serve as deterrent for
employees who harbor similar intention, the release said
Prior to her arrest, Mrs. Binda worked in the Sales and
Distribution Department with the responsibility to supervise
sales and Distribution of the companys products in Montserrado
County. In the discharge of her duties, Mrs. Binda is alleged to
have marketed products inclusive of scratch cards and phones
and diverted proceeds to personal use.
At the same time, the Management of Lonestar Cell MTN is
warning that it will not countenance any form of financial
indiscipline from its employees. We expect all staff to practice
complete accountability as enshrined in our core values.

NOCAL REMAINS COMMITTED


TO REDUNDANCY PLAN

Monroviahe National Oil Company of Liberia recently proposed


a redundancy plan which was approved by President
Ellen Johnson and led to the setting up of an interim
management team to spearhead the process.
Since the president approved the plan not much has been heard
from NOCAL but in a statement issued Thursday, the Interim
Management Team of NOCAL has said it remains committed
to the fair and equitable treatment of all employees during the
implementation of the entitys Sustainable Action Plan (SAP)
which was recently approved by the entity Board of Directors and
endorsed by the President.
The SAP calls for a company-wide reduction in NOCALs workforce
by the end of September and the restructuring of the company.
Employees from all levels of the company will be affected by the
exercise.
The Interim management team stated that to ensure compliance
with all relevant provisions of the Labor Practices Law, it has
contacted and is working closely with the Ministry of Labour
(Ministry) representatives for advice and guidance.
According to the NOCAL Interim management team, the Ministry
has advised NOCAL to evoke Regulations No. 8 of the Labor
Practices law in proceeding with the Redundancy of employees.
The interim also disclosed that the NOCAL has also been informed
by the Ministry that it has met all the initial requirements for the
Redundancy.
The restructuring plan, as endorsed by the President of Liberia,
included the payment of severance to all affected NOCAL
employees. The Interim Management team is working diligently
with all relevant stakeholders to ensure the availability of funds
for the redundancy payments. NOCAL employees have also been
notified of the pending downsizing exercise and informed that all
separation payouts to employees will be computed according to
the Liberian Labor Law.
Meanwhile, NOCAL has disclosed that is also committed to the
continuation of support of all students that currently participate
in NOCALs domestic and international scholarship programs.
The entity said it has confirmed with the relevant institutions that
the corporation is responsible for the payment of tuition and fees
for NOCAL scholarship students.
NOCAL indicated that all its scholarship students have registered
or going through the registration process for the current semester.

In a related development,

According to him, floods are
a result of obstruction of any
form - narrow passage of
waterway during heavy down
pour or narrow and outlived
drainage, blocked drainage,
and increased retention time
for free flow of water, among

that of course some of the
resulting factors are the
contamination of drinking
water sources, due to the lack
of resilient planning to climate
change adaption.

into one - land use planning,


especially when this scale
of misery is experienced"

According to him, there is no
need to lay the blame entirely
on any segment of society.
He said the solution is
important - hard thinking and
proper action that may result

contamination of wells, the

practical to sink wells in flood
prone areas but with better
technology - casting in-situ or
casting well rings that prevent
infiltration of surface run-off at
estimated height above flood

Senate ratifies bill liberalizing LEC

the 2015 Electricity
bill
establishing
the National Commission on
Electricity. The passage of the
law is in fulfillment of President
Ellen Johnson Sirleafs request
to the legislature imploring the
body for a six week extension
for ordinary sessions.
In August, President Sirleaf
wrote
the
Legislature
requesting them to stay for
additional six weeks to pass
some bills and ratify some
agreements that are already in
process. The passage will also
give way for Liberia to receive
US$250M from the United
States government to boost the
power sector.
In July this year, President
Sirleaf
submitted
to
the
Legislature,
for
its
consideration, a bill entitled:
2015 Electricity law of Liberia.
The Plenary of the senate,
subsequently after the bill
was sent to the Legislature,

mandated its committees on


Lands, Mines, Energy, Natural
resources, Judiciary, Human
Rights, Claims and Petition to
conduct public hearing on the
then drafted legislation and
advised plenary for action.
The then act, according to
the
committee,
contains
essential ingredients on the
Liberalization of the Electricity
sector and is largely consistent
with
international
best
practices.
Among many things, the
senate joint committee in its
findings to plenary said the
main crux of the bill from the
President is to liberalize the
electricity sector as a means
of driving competition which
could improve access, improve
quality and lower costs.
The proposed act establishes
the legal and regulatory
framework for the generation,
transmission,
distribution
and retail sale of electricity
and for import and export.
This will create an enabling
environment for private sector

investment in the energy


sector of Liberia.
Contrary to a plea from Grand
Bassa

Karnga-Lawrence
that the
Regulatory Commission must
not be under the umbrella
of the Ministry of Lands,
Mines and Energy (Policy
Maker) at anytime, even for
a brief duration, the senate
agreed that the institutional
arrangements, eventually, will
consist of the Ministry of Lands,
Mines and Energy playing a
policy oversight role, while
an independent regulatory or
authority is established.
According to her, incubating
what should be an independent
agency under the wings of
the policymaker could affect
the future orientation of the
agency when it is removed
from the Ministry.
Senator Lawrence said: For
effective functionality, the
membership of the regulatory
board or commission must
be at least five members.
However, to contain cost, the

law could be passed such that


the commission begins with
three members and increased
to five members within a
specified number of years.
The senator further added
The commissioners need
to have staggered terms so
all
commissioners
terms
cannot expire at the same
time to ensure continuation
of institutional knowledge.
The law therefore must make
provision for staggered terms
of commissioners.

Corporation
(LEC) is a player in the game,
representing the Government
of Liberia and must not referee
the game or be the regulator of
the Sector.
Because electricity is the key
factor to a nation's growth
and development, and also
a factor for a weak private
sector in Liberia, we must
make decisions that will make
the process reliable to attract

investors as soon as possible


if we want to see growth in the
economy and a better living
condition for our people.
The
institutional
arrangements,
eventually,
will consist of the Ministry
of Lands, Mines and Energy
playing a policy oversight role,
an independent regulatory or
authority to be established
and the Liberia Electricity
corporation (LEC) serving as a
national grid company and the
transmission system operator.
The law contains provision for
electricity regulation such as
licensing and registration, selfsupply by large consumers,
Micro-utilities,
theft
of
electricity,
tariff
setting,
dispute resolution, power
purchase agreements and
international transactions.
The law will also ensure
the establishment of an
independent Liberia Electricity
Regulatory commission which
will consist of a chairperson
and two other members to be
appointed by the President
with the consent of the senate
but many believe involving
the government will make the
commission no different for
the LEC.
From effective date of the
proposed law, LEC will be
considered to be licensed
provisionally
to
engage
in the power generation
business, power generation
transmission, distribution and
sale of electricity.
Energy consumption in Liberia
is dominated by biomass with
a share of more than 80%
of the used primary energy
sources. Most important is
woody biomass being used for
domestic cooking and heating.
In 2004, it was estimated that
over 95% of the population
depends on firewood and
charcoal for cooking and
heating needs and palm oil
for lighting. The most recent
Census (2008 data, published
in 2009) shows that 70% of the
urban population use charcoal
for cooking and 5% of the rural

population; 91% of the rural


population use firewood for
cooking and 21% of the urban
population. In Monrovia, the
percentage of households
using charcoal is even higher,
85%.
Modern energy services based
on electricity and petroleum
products are predominantly
used for economic production
and transportation. In the
household sector, the use
of modern energy services
consists mainly of kerosene,
electricity,
and
liquefied
petroleum gas for lighting,
cooking, and entertainment.
These are used by higher
income households in urban
areas.
Historically electricity was
mainly provided in the capital
of Monrovia; around 35,000
customersalmost 13 percent
of
the
populationwere
served by 1989. Total installed
electricity capacity was 191
MW. The generation mix was
composed of hydropower from
the plant at Mt. Coffeewith
a supply capacity of 63 MW
during the wet season and 5
MW during the dry season
(six months)and 31 percent
HFO and 21 percent diesel. The
utility LEC also handled the
electricity supply of rural areas
outside Monrovia through 10
small isolated power systems
with a total installed capacity
of 13 MW.
According to the data of the
government, about 10% of
urban residents and less
than 2% of rural residents
have electricity access largely
from self-generation with
gasoline or diesel generators
using expensive imported
fuel. The access rate to public
electricity is roughly 1%. In
March 2012 LEC served about
5,600 connections in Monrovia
(around
2,500
residents
from an estimated number
of 210,000 households), In
August 2012 already 11,000
customers are served by LEC.

Agreement among other things,
called for the establishment of
the Truth and Reconciliation
Commission (TRC).
The
Commission
was
established in 2006 and
operated for 3 years. After
three years of public inquiry
into the root causes of the
civil war (with statements
from victims, witnesses and
alleged perpetrators), the TRC
released its final report to the
President and the National
Legislature in June 2009.
The recommendations of the
report were wide ranging;
amongst them, lustration,
prosecution,
reparations
and National Palava Hut as
a
traditional
mechanism
to facilitate truth telling,
atonement and psychosocial
recovery.

The
INCHR
was
then
established to help lead the
implementation of portions
of the TRC Recommendations,
one of which is the holding
of a national palaver hut
conference where Liberians
can openly and freely express
their grievances for redress or
common ground.
The
on-going
County
discussions form part of
preparations for the successful
holding of the palava hut
conference. Each forum brings
together key personalities
from various sectors of the
country, including, women,
elders, civil society and youth
groups to brainstorm on how
to proceed in preparing for the
palava hut event.
At the opening of the forum
held in In Tubmanburg Bomi
County, the Chair of the National
Commission
on
Human
Rights (INCHR) Justice Gladys
Johnson said it was important
for Liberians to hold dear the
TRC recommendations and try
to implement most of the good
ones for the country.

we have good and bad people
that survived the war. There
were people who killed and
tortured others for no reason
at all; they took other peoples
properties by force but they
are still part of us. People have
excuses for what they did and
if they are remorseful and
apologetic and the things they
did were not grievous; then we

ASSOCIATION CONDEMNS MILITARY
TAKE OVER IN BURKINAFASO

(WAJA)
has
described
as
shameful,
the

disruption of the freedom and happiness
of the people of Burkina Faso. The
Military seized power on Wednesday
after taking prisoner the President,
his Prime Minister and two cabinet
members.
This happened as over a hundred
journalists [including the WAJA
President], academics, human rights
defenders and other professionals
assembled in Ouagadougou this week
for the annual International Festival of
Freedom of Expression and Press, which
ended prematurely.
Participants from around the continent
and other parts of the world had been
discussing the contribution of the media
in the changing political atmosphere in
Africa when they were slapped with yet
another violent change.
Following a popular uprising that ousted
former president Blaise Compoare a
year ago, transitional authorities in the
country were preparing to administer
general elections on October 11, 2015,
which now unlikely.
A joint statement signed by the

Faso and other media groups in the
country indicates that journalists
and media outlets have already been
attacked and forced to shut down in the
aftermath of the coup.
WAJA joins its affiliate in denouncing the
coup and the attending violence against
the media and calls for the restoration
of civil order.
It appears that these people know the
importance of media thats why they
could run to the national broadcaster to
announce the coup, but at the same time
they launch an attack on other radio
stations and brutalized journalists. This
is simply unintelligent, WAJA President
Peter Quaqua lamented.
While calling for the release of the
Transitional President Michel Kafando
and others, WAJA also insists on
the immediate release of all foreign
journalists and other nationals being
held hostage in Burkina Faso on account
of closure of the borders including the
airport.
WAJA will hold the coup leader
personally responsible for any damages
caused any of its members in the wake
this disruption.

1. Background:
The USAID Liberia Administration and Systems Strengthening (LASS) project is a 30-month, technical assistance
program to improve performance through strengthening administrative ability in Liberias National Elections
Commission (NEC).
The main purpose of this program is to work with the NEC to develop key institutional systems, policies, and
procedures in areas such as human resources, budgeting and financial management, asset management, strategic
planning, and procurement.
2. Objective:
The M&E Advisor is a long term member of the LASS team who will be responsible for two main areas:
Design and manage M&E and Performance Management Plan (PMP) systems for the LASS project; and
Provide expert technical assistance to NEC in the development and implementation of their own
Performance Management systems for USAID-LASS targeted back office functions.
3. Specific Responsibilities:
Ensure that high-quality data is provided on a quarterly, annual or on as-needed basis for USAID reporting
as well as for project management.
Design and implement the projects PMP according to USAID standards, ensuring timely reporting of high
quality results data to LASS Senior Management and USAID.
Design, schedule and manage internal evaluations and special studies with the purpose of gauging project
results in key areas.
Train LASS staff on their roles and responsibilities within the M&E system.
With STTA, develop a database application for the tracking of performance monitoring data and the
production of reports.
Liaise with officials of USAID Liberia Monitoring and Evaluation Project (L-MEP) Project to ensure
compliance with USAID/Liberia M&E documentation and reporting requirements
The Advisor will report to the Deputy Program Manager and will serve as a key provider of technical assistance to
NEC in guiding the creation and implementation of quality Performance Management Systems (PMS). This will
include:
Identifying key performance indicators for project PMS based on LASS capacity assessments and
subsequent Performance Solutions Packages (PSP);
Providing technical assistance and coordinating M&E related training for NEC partners; and
Implementing targeted data collection exercises where required for generating key PMS data.
4. Level of Effort and Period of Performance:
The level of effort for this assignment is approximately 500 days. This assignment is expected to begin on or around
October 15th and last through September, 2017.
5. Location:
This assignment will be carried out primarily in Monrovia, Liberia.

6. Qualifications:
Successful candidates will meet the following qualifications:
At least a Masters degree, preferably in Statistics, Economics, International Development or related field,
preferably with a strong emphasis on quantitative and qualitative research.
At least 5-6 years of experience working with USAID M&E methodologies and frameworks (both
quantitative and qualitative); have experience providing training on the development and implementation
of M&E processes; possess the ability in facilitating collaborative M&E project design and communication
between multiple stakeholders; developing M&E databases; and report writing regarding the successful
definition, design, and delivery of M&E structures. Candidates with a Bachelors degree, 8 years of

Brendan Rodgers left six firstteam regulars at home for the

to endure a disjointed firsthalf showing before Lallana
illuminated the contest.
The England midfielder had
not featured for a month due to
a thigh injury but scored with
an excellent solo effort midway

Nimba United in the
first leg play-offs of
the Liberia Football
Association
(LFA)
first
division national league at the
Antoinette Tubman Stadium
(ATS) in Monrovia on Sunday.
The two legs, which have been
likened to the biblical contest
of David versus Goliath more
than 2,000 years ago, bring to
an end arguably the worlds
shortest and worst league with
intermittent breaks, change of
venues and rules.
Both teams topped their
six-team mini league after
10 games and their pairing
will renew memories of a
two-horse race during the
2010/2011 national league.

LISCR cruised in Group B with


relative ease with 25 points
but it was
United, who endured a nervebreaking encounter to beat
Barrack Young Controllers
(BYC) 1-0 at the ATS on
September 10 in Group A, to
secure their place for a oneway ticket to next seasons Caf
Champions League.

Korvah and team are 180
minutes away from their first
ever continental engagement
but he knows that LISCR, who
represented Liberia in the
2012 and 2013 Caf Champions
Leagues, will be a formidable
opposition.
LISCR is a very good team.
So we are going to strategize
for them. They top their group
with ease, I would say but in
football, anything is possible
and we will properly plan for
them, Korvah added.
LISCR
won
back-to-back
championships before BYC
ended their dominance and
their coach, Cooper Sannah,
is no stranger to Liberian
football.
Sannah, who took Manding
Jallah from third to first
division, also won the county
meet with Bong in 2009 as
technical director following
four semifinals as head coach.
He believes his opponents will
be difficult to beat over two
legs.

It is a tough and interesting


encounter,
taking
into
consideration the fact that
Nimba United topped all the
teams in their group. Secondly,
there are no small or big teams
these days in football. But we
want to assure our fans and
sympathizers that we will
emerge at the end of the day,
he declared.
Reports say LISCR President
Mustapha Raji, who is in
Kuala Lumpur, Malaysia to
renegotiate the deals of former
players, has two plans for the
team.
Fabulous bonuses have been
promised for the championship
matches but heads could roll if
United emerge victorious after
two legs but Sannah is all too
familiar with the managerial
shocks associated with sports.
Coaches are like social
workers, who will be hired
today and fired tomorrow. So
we are not worry about being
fire. We are doing everything
every day to be successful.
I am not worry about that but
I have the pressure on me to
win and we respect them [our
opponents]. We are not going
to give relevance to any of their
