thereboot.Lotsofconsultationisneededinternallyandwith
stakeholdersinthefuture,hesaidtomaketheprogrammore
effective.
Thereare467daysleft(asofSeptember21)toputpracticesonthegroundtomeetthe
states2017cleanupmilestoneeliminating10millionpoundsofnitrogenand212million
poundsofsedimentfromgoingintoourriversandstreams.
Pennsylvaniaisevenfurtherbehindbecausewedidnotmeetthe2013pollution
reductionmilestones.
InJune2014,theU.S.EnvironmentalProtectionAgencyreportedPennsylvaniaexceeded
its2013ChesapeakeBaycleanupmilestoneforphosphorusby242,000pounds,butfellshortin
meetingthenitrogengoalby2millionpoundsandsedimentreductionmilestonebynearly116
millionpounds.

EPAfreetocomeupwithitsown
plan
onhowthestatecanmeetthem,andasRep.GarthEverett(RLycoming)saidduringDEPs
budgethearing,

Evenbyanyroughmeasure,Pennsylvaniawillneedtorampupitswatershedrestoration
programssignificantlytomeetitscommitments.

implementationfrom2009to2013,heresanestimateofhowmucheachofkeymeasureswould
havetoincreasetomeetthe2017milestonesdoneinAprilofthisyear:

DCNRexpectstorolloutthenewtoolsinNovemberwithtrainingsessionsscheduledin

Isympathizewiththehumanserviceagenciesatthecountylevelandthenonprofits,
saidWolf.Whatthey(Republicans)aredoingisaverycynical,hypocriticalattempttomake
peoplebelievethattheyareactuallytryingtomakehumanservicesagenciesliveseasier.
Theyrenot.Thisstopgapisnotthat.ThisstopgapisapokeintheeyeandIamtreatingitas
such,andIamgoingtovetoit.
Gov.Wolfalsofloatedtwonewproposalsonpensionreformandliquorprivatizationto
SenateandHouseRepublicansonWednesdaysayingtheywerehistoricproposals.
My(pension)planisabout80percent,Ithink,ofwhatthey(Republicans)hadinSenate
Bill1,saidWolf.Thisplan,unlikemyMarch3rdplan,hasa401kprovisioninit,ithasa
stackedhybrid.Thisplanisverydifferent.ThisisnotsomethingtheDemocratswoulddo
normally.Wediditbecauseweunderstandthatwehaveadividedgovernmentandingoodfaith
weputuponthetablerealpensionreform,weputonthetablerealchangesintheliquor
system.
(Onliquorreform)Iofferedacontractthatcouldbeforanyperiodfromtento25
years,saidWolf.Therewouldhavehappenedtobeprotectionsforworkers,protectionsfor
consumers,wewouldhaveprotectionforthecitizensofPennsylvaniasowearenotjustgiving
thisaway...andthatweareactuallygettingsomethinginreturn,andthatweareactuallygoingto
getserviceslikewineandbeerinthesupermarket.
WhatwastheRepublicanreactionsaidWolf?
Igotnothing.Igotnothingonseverancetax,nothing.Igotnothingoneducation,
nothing.Igotnothingonpropertytaxesrelief.Igotnothingonhowweareactuallygoingto

balancethisbudget,saidWolf.
Whatweneedisabudget,saidWolf.Weactuallyneedtohavethepensionandthe
liquor,andallthethingscombinedintoonepackageanditscalledabudget.

SenateRepublicanssaidtheyarenegotiatingingoodfaith,buttheyhavecoreprinciples
theyaredefending.Thevoteonthestopgapbudget,isavotetokeepstategovernmentopen,
saidSenateMajorityLeaderJakeCorman(RCentre),unlikeinCongresswheretheyaretalking
aboutshuttingdownthefederalgovernment.
"Iampleasedthattoday,wehaveadvancedlegislationtoprovideourschoolsandvital
serviceswithneededfunding,"saidSenatePresidentProTemporeJoeScarnati(RJefferson).
"ThisstopgapbudgetwouldprovidefinancialstabilityforourCommonwealthwhileafinal
budgetagreementcontinuestobenegotiated.AsmembersoftheGeneralAssembly,itisourjob
toensurethattaxpayers'moneyisnotbeingheldhostageduringthecurrentbudgetimpasse."
"TaxdollarscontinuetoflowtoHarrisburg.Themoneyisbeingcollectedfrompeople's
paychecksandthroughthestatesalestax.Votingtoprovidethisfundingistherightthingtodo,"
saidSenateMajorityLeaderJakeCorman(RCentre)."Frustrationwiththebudgetnegotiations
continuestomountbothinsideandoutsidetheCapitolbuilding.Understandablyso.Adopting
stopgapfundingisouronlyoptiontohelpfundourschoolsandhumanservicesorganizations,
whoarebeinghithardbythelossofstatefunds."
"WeareandwillcontinuetoworkwiththeGovernortocometoanagreementonafinal
appropriationsbill,buttheGovernor'scurrentapproachandthelevelsofspendingandtaxeshe
isrequestingdonotallowforthataccommodationatthistime,"SenateAppropriations
CommitteeMajorityChairPatBrowne(RLehigh)said."Inthemeantime,however,this
shorttermbudgetissomethingwecanandmustdotomeettheobligationswehavetoprovide
necessaryandcriticalfundingtoschooldistricts,nonprofitsandstateagencies,while
simultaneouslycontinuingthoseconversations."

SenateDemocratssaidRepublicansshouldbeatthenegotiatingtablenotthemicrophone
andstarttalkingaboutenactingarealbudget.
SenateDemocraticLeaderJayCosta(DAllegheny)said,TheSenateRepublican
stopgapbudgetplanisapoliticalploythatdragsdowneffortstoconstructalongterm,
comprehensivebudgetagreementthatincludesrealdollarsforeducation,humanservices,deficit
reductionandpropertytaxcuts.Stopgapbudgetsareonlyusedwhenyouarenotuptothetask
ofnegotiatingafullbudget.

bargainingsessionsthatwouldultimatelyresultinacomprehensivespendingplan.

PlanningGrant:
Grantsofapproximately$5,000willbeawardedtocreateacoldwater
conservationplanthatwillultimatelyconserveandprotectthecoldwaterstreamsof
Pennsylvania.
Thisgrantisto:GatherexistingdataaboutthecoldwaterecosystemIdentifypotential
impacts,threats,problemsandopportunitiestoourcoldwaterstreamsFormulateaplanofaction
forproposedconservationandprotectionstrategiesandBuildcommunityawarenessand
supportfortheconservationofourcoldwaterstreams.
ImplementationGrant:

FishCommissionReaches$2.5MSettlementOverDunkardCreekFishKill

TheFishandBoatCommissionMondayconfirmedthatithasreacheda$2.5millionsettlement
withMurrayEnergyforcivildamagesresultingfromadevastating2009pollutionincidentin
whichdischargesfromacoalmineenteredDunkardCreekinGreeneCountycontributingtoa
massivefishkillspanningnearly30milesofstreaminWestVirginiaandPennsylvania.
OhiobasedMurrayagreedtopaythesettlementinlieuofcivildamagesforthelost
aquaticlifeandlostfishingopportunitiesforPennsylvaniaanglersasaresultofthepollution
incident.
WerepleasedthatwevereachedasettlementandcanclosethischapteroftheDunkard
Creekcase,saidPFBCExecutiveDirectorJohnArway.Thankstotheeffortsofouroutside
counsel,SharonZ.Hall,EsquireofZimmerKunz,PLLC,andRobertP.Fitzsimmons,Esquireof
FitzsimmonsLawFirm,fourlongyearsoflitigationhavecometoanend.Butitwilltakemany
moreyearstorestorethecreektoitspriorcondition.Thedevastationwasastonishing.PFBC
biologistscollected40speciesoffishand14speciesofmusselsthatwerekilledbytheincident.
AmongthedeadmusselswasthePennsylvaniaendangeredsnuffboxmussel.
ThefundswillbeplacedinarestrictedrevenueaccountwithintheFishFundtobe
utilizedfortheprimarypurposeofdevelopingandimplementingprojectsthatbenefit
recreationalfishingandboatingandtheaquaticresourcesoftheDunkardCreekwatershed.
Oncerestorationiscomplete,theCommissionmayusetheremainingfundsfor

restorationprojectsinothersouthwesternPennsylvaniawatersheds.
InearlySeptember2009,atotalfishandmusselkilloccurredinthecreekafterhigh
concentrationsofchlorideandtotaldissolvedsolidsinthedischargefromConsolEnergy's
BlacksvilleNo.2mineinWestVirginiacreatedbrackishwaterconditionsfavorableforabloom
oftoxicgoldenalgae.
TheDunkardCreekmainstembeginsnearthetownofBrave,GreeneCounty,Pa.,and
meandersapproximately37milesbetweenPa.andW.Va.untilitsconfluencewiththe
MonongahelaRivernearDunkardTownship,GreeneCounty,Pa.
Atthetimeoftheincident,theminewasownedbyConsol,whichlatersolditand
severalotherminestoMurray.
InMarch2011,ConsolreachedsettlementswiththeU.S.DepartmentofJustice,theU.S.
EnvironmentalProtectionAgency,andtheWestVirginiaDepartmentofEnvironmental
Protection.
Thecompanyagreedtopaya$5.5millioncivilpenaltytosettlehundredsoffederal
CleanWaterActviolationsatsixofitsminesinWestVirginia,includingtheBlacksvilleNo.2
mine.ConsolalsoagreedtocompensateWestVirginiaforthenaturalresourceslostintheWest
VirginiaportionofDunkardCreekbypaying$500,000totheWestVirginiaDivisionofNatural
Resources.
ThePFBCwasnotincludedinthesettlementsandsubsequentlyfiledlawsuitsinWest
VirginiaonSeptember2,2011,andinPennsylvaniaonSeptember7,2011,seekingmonetary
reliefagainstConsolfordamagestothenaturalresourcesofPennsylvaniaandlostrecreational
opportunitiesforPennsylvaniaanglers.

HomeandpropertyownersnearReservoirCreekinNewportTownship,LuzerneCounty,will
benefitfromanewabandonedminereclamationproject,Sen.JohnYudichak(DLuzerne)
announcedMonday.
Sen.YudichaksaidtheDepartmentofEnvironmentalProtectionhasawardeda$988,000
contracttoBrdaricExcavatingInc.,Luzerne,fortheSt.VladimirVicinityabandonedmine
reclamationproject.
"ResidentsintheReservoirCreekareahavesuffereddamagedandlostpropertybecause
ofpastminingactivitiesthatreroutedthecreekclosertotheirhomesandbusinesses,"Sen.Sen.
Yudichaksaid."Thismuchneededproject,whencompletedwillalleviatelongstandingflooding
issuesforthepropertyowners."
BrdaricExcavatingwillmovetheSouthBranchofthecreekfromthenorthsideofWest
KirmarAvenuetothesouthside,whichisthecreek'soriginalbed.Thiswillalsolessenthe
possibilityofbridgedamageshouldtherebeaflood,anditwillhelptokeepWestKirmar
Avenueopenwhenheavyrainfalls.
"Approximately60,000yardsofmaterialwillbemoved,andmuchofthatwillbeusedto
recontourexistingminepitsthathavealsobeenasafetyissue,"said
EarthConservancy
CEO
MichaelDziak."I'msuretheresidentsnearthecreekwillbeextremelythankfulforthis

improvement."
"Theannouncementofthegrantforreclamationoflandinthetownshipisgreatnews,"
saidNewportTownshipManagerRichardZika."Thiswilleliminatethepossibilityofflooding
ofseveralhomesandbusinessesthathavebeenaffectedinthepastbythefloodingofthecreek."
Brdaric's$987,967.50contractisfundedbytheAbandonedMineReclamationTrust
Fund,whichissubsidizedbyfeespaidforeachtonofcoalthatismined.Theexcavation

completiondateisSeptember7,2016.

Thisraingardenisespeciallyimportantbecauseofthehighpercentageofimpervious
areaontheAirForcebase.Bestmanagementpractices,suchasthisraingarden,helpreduce
floodingandinfiltratestormwaterwhenthereislittlepermeableareatodoso.

TheOceanConservancysInternationalCoastalCleanupisheldfromSeptember1
throughOctober31andisthelargestvolunteereffortaimedatimprovingthehealthoftheocean,
bringingouthundredsofthousandsofvolunteersfromaroundtheworldtoremovemillionsof
poundsofplasticsanddebrisfrombeaches,lakesandwaterways.
Thiseventhasgrowntoincludeparticipationbyall50statesandU.S.territoriesand90
countrieswiththenumbergrowingeachyear.KeepPennsylvaniaBeautifulisproudto
coordinatethiseffortinPennsylvania.
Anycleanupsiteiseligiblesinceweallliveinawatershedandallwaterwaysflowinto
ourcoastalwaters.Glovesandbagsareavailableforregisteredeventswhilesupplieslast.

DavidJ.Gawronski,26,2341HillRoad,Sellersville,BucksCounty,ischargedwith
threecountsofunlawfulconductinconnectionwithallegedviolationsoftheSolidWaste
ManagementAct.
Gawronskiallegedlydumpedfive,fivegalloncontainersthatreportedlyheldpetroleum
contaminatedwaste.Thedumpingwasreportedintheareaof502EastCreameryRoad,
Perkasie,BucksCounty.Oneofthecontainerswasreportedtobedamagedandleaking.
Anoilstainedinvoicewasfoundtapedtooneofthecontainers,investigatorsallege.The
invoicewasallegedlyaddressedtoGawronskiAutomotive,LLC,Gawronskisbusiness.The
invoicehadaphonenumberwrittenontheback,whichinvestigatorssaidbelongedto
Gawronski.
GawronskiistentativelyscheduledtoappearOct.16forapreliminaryhearing.Thecase
willbeprosecutedbySeniorDeputyAttorneyGeneralBrianCoffeyoftheEnvironmental
CrimesUnit.
Apersonchargedwithacrimeispresumedinnocentuntilprovenguilty.

EPA:DunbarAsphaltToCleanUp29AcrePortionOfSharonSteelSuperfundSite

TheU.S.EnvironmentalProtectionAgencyMondayannouncedaproposedsettlementthe
governmenthasreachedwithDunbarAsphaltProducts,Inc.,tocleanupa29acreportionofthe
SharonSteelCorporationSuperfundSite
inHermitage,MercerCounty.
Thecleanupwillbetterprotectworkersfromexposuretocontaminantsonthesiteand
preventairbornereleasesofthecontaminants.
ThissettlementadvancesthecleanupworkatSharonSteel,allowsfortwolocal

businessestocontinueoperating,andprotectsworkershealthandthelocalcommunity,said
EPARegionalAdministratorShawnM.Garvin.Gettingthiscleanupworkunderwaybuildson
theprogressweresteadilymakingintheoverallcleanupandreuseofthisproperty.
Underthisproposedsettlement,Dunbarwillpaythecoststocoverexposedslagwith
asphaltorcleanfilltopreventreleasesofheavymetalsandpolyaromatichydrocarbons(PAHs),
andensurethereisnoexposedwaste.DunbarwillalsoreimburseEPAforfuturecostsrelatedto
thecleanupofthis29acreportionofthesite.
EPAestimatesthatitwouldhavecosttheagency$1.7milliontocleanupthisportionof
thesiteifasettlementhadnotbeenreachedwithDunbar.
DunbarandWilliamsBrothersTruckingCompanyareeachoperatingbusinessesatthe
site.EPAselectedaprocessthatallowsthebusinessestocontinueoperatingwhiletheprotective
remedyisbeinginstalled.
TheentireSharonSteelSitecoversabout325acresinMercerCounty.SharonSteel
Corp.usedthisareatodisposeofslagandotherwastegeneratedfromthecompanys
steelmakingoperationsatitsnearbyFarrellWorksplant.Theslagandotherwastes
contaminatedsoilandgroundwater.
In1998,EPAaddedthesitetheNationalPrioritiesListofsitesthathaveknown,orare
threatenedby,releasesofhazardoussubstances,pollutants,orcontaminants.
Theproposedsettlementissubjecttoa30daypubliccommentperiodwhichstarted
September11,2015,andrequirescourtapprovalbeforebecomingfinal.

laboratoryREIConsultants,Inc.$75,000forviolationsattheirBeaver,WV,lab.
REIConsultantswillalsoneedtofundathirdpartyassessortoreviewthelabsabilities
tomeetaccreditationstandardsaspartoftheconsentorderandagreementwithDEP.
Webelieve,withthisagreement,REICwillbecomealabthatconsistentlygenerates
validandaccuratedata,saidDr.MartinaMcGarvey,directoroftheDEPBureauof
Laboratories.
InMarch2015,DEPsLaboratoryAccreditationProgramconductedaregularly
scheduledonsiteassessmentofREICandfoundthatthelaboratorysmanagementwasnot
providingadequateoversightandtrainingofthelaboratorypersonnel.
Inaddition,therewerenumerousviolationsduringthedatareviewandonsite
assessmentofREIC.BasedupontheDEPsassessment,REICagreedtovoluntarilyrelinquish
certainaccreditationsandtheDEPthensuspendedotherareasofaccreditationforthefields
impactedbytheviolations.
PennsylvaniaDEPisREICsprimaryaccreditationauthority,butthelabdoesnot
performcompliancetestingforDEP.REICusesitsprimaryNationalEnvironmentalLaboratory
AccreditationProgramaccreditationfromDEPtoobtainsecondaryNELAPaccreditationfrom

Virginia.
REICisanenvironmentallaboratoryperformingprimarilycommercialenvironmental
andindustriallaboratoryservicestooutsidecustomersinmicrobiology,wetchemistry,trace
metals,andorganicsprimarilyinnonpotablewater,andSolid&ChemicalMaterials.
Inadditiontothe$75,000finethelabhasagreedtohireanindependentthirdparty
auditortoreviewthelabsoperationsabilitiestomeettheconditionsofitsaccreditation.Any
issuestheindependentauditorsreportuncoversmustbecorrectedwithin30days.

AvailableControlTechnologyandLowestAchievableEmissionRate,saidMikeBedrin,
DirectorofDEPsNortheastRegionalOfficeinWilkesBarre.Thisplantwillalsohave
emissionstesting,recordkeepingandcontinuousemissionmonitoringrequirementstoassistDEP
inmonitoringemissionsfromthefacilitytohelpensurecompliance.
MoxieFreedomsubmittedanairqualityplanapprovalapplicationtoDEPonOctober6,
2014.Thecompanyplanstoutilizeacombustiongasturbineandasteamturbinetoproduce
electricity.Eachcombinedturbineandaductburnerwillexclusivelyfirepipelinequalitynatural
gas.
Theburnerswillbeequippedwithselectivecatalyticreductiontominimizenitrogen
oxide(NOx)emissionsandoxidationcatalyststominimizecarbonmonoxideandvolatile
organiccompoundemissions.
Theprojectwillbecapableofproducing1050Megawatts(MW)ofelectricity,whichwill
thenbedistributedtothepowergridforuse.

civilpenaltyintheamountof$197,203.00fornumerousairqualityviolationsduringafouryear
period.
QuarterlyemissionsreportssubmittedtotheDepartmentbyKeystoneshowedthatthe
companyexceededpermittedemissionlimitsforcertainpollutantsandthatitfailedtosatisfy
dataavailabilityrequirementsfortheircontinuousemissionsmonitoringsystem(CEMs).
Inaddition,fromSeptember2013throughJune2014,Departmentinspectorsidentified
pressuredropviolationsrelatedtotheoperationofairpollutioncontrolequipmentatthefacility.
In2009,thecompanyreplacedtwoofitscementkilns,whicharelargeovenlikeunits
usedtoheatarawmixtureofmaterialstoproduceclinkerduringthecementmanufacturing
process.Theclinkeristhencooledinaclinkercooler.
Keystonestwokilnswerereplacedwithonelargerandmoreefficientkiln.Thecompany
alsoupgradedandreplacedotherpartsofitssystem,includingitsclinkercoolersandabaghouse
designedtocontrolemissionsfromitsoperations.
KeystonescementkilnisequippedwithaCEMtomonitoremissionsofsulfuroxides
(SOx),nitrogenoxides(NOx)andcarbonmonoxide(CO).Theclinkercoolerisequipped

withaCEMtomonitortheopacityoftheemissions.Opacityisawaytomeasureparticulate
fromtheclinkercooler.KeystonehaslimitsinitsairqualitypermitsforSOx,NOx,COand
opacity.
DatafromtheCEMsystemissubmittedtotheDepartmentonaquarterlybasisfor
reviewtodeterminewhetherthecompanyisoperatingincompliancewithapplicableemission
limits.
Theselfreportingofemissionsisanimportantpartofdemonstratingcompliancewith
permittedemissionslimits.TheDepartmenttakesemissionsmonitoringandtheproperoperation
ofcontrolequipmentveryseriously,saidMikeBedrin,DirectorofDEPsNortheastRegional
Office.Ouractionshereservetoreinforcehowimportantitisforcompaniestoaccuratelykeep

RecoveryCouncil(ERC),thenationaltradeassociationrepresentingcompaniesandlocal
governmentsengagedinthewastetoenergysector.
IappreciatetheopportunitytoprovideinputonPennsylvaniasprocessrelatedto
designingastateplanthatwillimplementtheCleanPowerPlan(CPP)undersection111(d)of
theCleanAirAct.
ERCurgestheCommonwealthtotakeadvantageoftheopportunitiesaffordedbythe
CPPtoutilizewastetoenergyasatooltoreducegreenhousegasesfromthepowersector.
Thereisatremendousopportunitytobenefitfromreducedgreenhousegasesmadepossibleby
Pennsylvaniaspastandfutureinvestmentinwastetoenergyfacilities.
Thereare84wastetoenergy(WTE)facilitiesintheUnitedStates,whichproduceclean,
renewableenergythroughthecombustionofmunicipalsolidwasteinspeciallydesignedpower
plantsequippedwiththemostmoderncontrolequipmenttominimizeemissions.
Americaswastetoenergyplantsprocessapproximatelythirtymilliontonsoftrashper
year,enablingthemtosendnearly15millionmegawatthoursofelectricitytothegrid,aswellas
exportsteamtolocalusers.Inaddition,wastetoenergyfacilitiesrecoverandrecyclemorethan

700,000tonsofmetalsperyear.
PennsylvaniaishometosixWTEfacilities,locatedinChester,Conshohocken,
Harrisburg,Lancaster,MorrisvilleandYork.Thesefacilitiesprocessmorethan8,700tonsof
trashperdayandhaveanelectricbaseloadcapacityof268megawatts.
In2012,theseWTEfacilities,producedroughlyonethirdofPennsylvaniasnonhydro
renewableelectricity,whilereducingtheemissionofmorethanthreemilliontonsofgreenhouse
gases.
TheCleanPowerPlanrecognizeswastetoenergyasaneligiblecompliancetoolthatcan
beincludedinstateplans.Pennsylvaniashouldincorporatewastetoenergyintoitsstateplan
forthefollowingreasons:
WTEreducesgreenhousesgases
WTEisbaseloadpower
WTEiscompatiblewithrecycling
WTEboostslocaljobsandeconomiesand
WTEisacostcompetitivesourceofrenewableenergyandGHGreduction.
WTEReducesGreenhouseGases
TheclimatebenefitsofWTEtechnologyarewelldocumented,bothinternationallyand
intheU.S.AccordingtoU.S.EPA,lifecycleemissionanalysisshowthatwastetoenergy
facilitiesactuallyreducetheamountofgreenhousegasesexpressedasCO2equivalents(GHGs
orCO2e)intheatmospherebyapproximately1tonforeverytonofmunicipalsolidwaste
(MSW)combusted.
Wastetoenergyachievesthereductionofgreenhousegasemissionthroughthree
separatemechanisms:1)bygeneratingelectricalpowerorsteam,wastetoenergyavoidscarbon
dioxide(CO2)emissionsfromfossilfuelbasedelectricalgeneration,2)thewastetoenergy
combustionprocesseffectivelyavoidsallpotentialmethaneemissionsfromlandfillsthereby
avoidinganypotentialreleaseofmethaneinthefutureand3)therecoveryofferrousand
nonferrousmetalsfromMSWbywastetoenergyismoreenergyefficientthanproductionfrom
rawmaterialstherebyavoidingCO2fromfossilfuelcombustion.
WhiletheCleanPowerPlanonlyrecognizesavoidedGHGsfromthepowersector,
PennsylvaniacanuseWTEinitsstateplantoleverageotherGHGreductions.
WTEisBaseloadPower
Itisimportanttoconsiderthatwastetoenergyplantssupplypower365daysayear,
24hoursadayandcanoperateundersevereconditions.Wastetoenergyfacilitiesaverage
greaterthan90percentavailabilityofinstalledcapacity.Thefacilitiesgenerallyoperateinor
nearanurbanarea,easingtransmissiontothecustomer.
Wastetoenergypowerissoldasbaseloadelectricitytoutilitiesthatcanrelyuponits
supplyofelectricity.Thereisaconstantneedfortrashdisposal,andanequallyconstant,steady,
andreliableenergygeneration.
WTEisCompatiblewithRecycling
Statisticscompiledfornearlytwodecadeshaveproventhatwastetoenergyand
recyclingarecompatible.Sinceresearchonthesubjectbeganin1992,communitiesthatrely
uponwastetoenergymaintain,onaverage,ahigherrecyclingratethanthenationalEPA
averageandverymuchinlinewiththerecyclingaveragesofthestatesinwhichtheyserve.
Inapaperentitled,ACompatibilityStudy:RecyclingandWastetoEnergyWorkin
Concert,2014Update,EileenBerenyiwithGovernmentalAdvisoryAssociate,Inc.researched

therecyclingcharacteristicssurrounding80wastetoenergyfacilitiesin21states.Recycling
datawasobtainedfrom700localgovernments,aswellasstatewidedatafromthe21states
coveredinthereport.
In2011,thereportshowsthatcommunitieswithwastetoenergyhaveanaverage
recyclingrateof35.4percent.ThenationalaverageforrecyclingasestimatedbyEPAis
estimatedat34.7percent,whileBioCycle/ColumbiaUniversityestimateittobe28.9percent.
RecyclingcompatibilityisborneoutbytherecyclingratesofEuropeancountriesasit
relatestotheirrelianceuponwastetoenergyorlandfilling.
Themostprogressivecountriesrecyclealot,recoverenergyasmuchaspossible,and
landfilllittle.Lessadvancedcountrieslandfillasmuchaspossible,whiledoinglittletono
recyclingorenergyrecovery.
WTEBoostsLocalJobsandEconomies
Inaddition,wastetoenergyhasaverypositiveeconomicimpactonthecommunitiesin
whichthesefacilitiesarelocated.InPennsylvaniaalone,thewastetoenergyindustrydirectly
employsapproximately400peoplewithsalaryandfringebenefitsinexcessof$33millionper
year.
Inadditiontodirectemployees,theWTEsectorcreatesanadditional751indirector
inducedjobs,whichpaysalaryandbenefitsofmorethan$38millionperyear.Thetotal
economicimpactofrevenuesforwastetoenergyinPennsylvaniais$586million,includingthe
$299millionproducedbythewastetoenergysectordirectly.Everydollarofrevenuegenerated
bythewastetoenergyindustryputsatotalof1.95dollarsintotheeconomythrough
intermediatepurchasesofgoodsandservicesandpaymentstoemployees.
WTEisaCostCompetitiveSourceofRenewableEnergyandGHGReduction
TheU.S.DepartmentofEnergysEnergyInformationAdministration(EIA)uses
LevelizedCostofEnergy(LCOE)tomeasurethecompetitivenessofaparticularenergy
resource.EIAdefinesLCOEas:
Levelizedcostisoftencitedasaconvenientsummarymeasureoftheoverall
competivenessofdifferentgeneratingtechnologies.Levelizedcostrepresentsthepresentvalue
ofthetotalcostofbuildingandoperatingageneratingplantoveranassumedfinanciallifeand
dutycycle,convertedtoequalannualpaymentsandexpressedintermsofrealdollarstoremove
theimpactofinflation.Levelizedcostreflectsovernightcapitalcost,fuelcost,fixedand
variableO&Mcost,financingcosts,andanassumedutilizationrateforeachplanttype.
TheaverageLCOEfromanewWTEfacilityisapproximately$85permegawatthour.
ThisplacesWTEhigherthancombinedcyclenaturalgascomparabletoonshorewind,hydro,
andgeothermalandlessthanoffshorewind,solar,biomass,coalwithcarboncaptureand
storage,andnuclear.
ThisiscomparabletootherrecentlypublishedvaluesforWTEslevelizedcost,including
thoseinarecentpeer-reviewedarticlebyDukeUniversityscientists($94/MWh)anda2014
reportcoauthoredbyBloombergandtheBusinessCouncilforSustainableEnergy($48-$130/
MWh)(
seefigureinthetestimony
).
Inaddition,WTEisalargesourceoflowcostGHGreductionsuponwhichstatescan
relytomeettheirobligationsundertheCleanPowerPlan.
WTEfacilitiescanachieveGHGreductionsof70milliontons(megatons)ofCO2
equivalentsperyear,withaGHGabatementcostofapproximately$9pertonCO2e(2005$),if
theU.S.movestoamoresustainablewastemanagementpracticesmodeledaftertheEuropean

Union.
Theabatementcostiscomparabletothatofonshorewind,andwellbelowthecostof
manyotherGHGabatementtechnologiesincludingsolarPV,biomassco-firing,andcoal
electricalgenerationwithcarboncapture&storageasreportedinthelatestMcKinseyGHG
abatementcostreportpreparedfortheUnitedStates.
IncorporatingWTEintheStatePlan
TheCPPclearlyidentifiesWTEasaneligiblecompliancetooltodisplaceelectric
generationfromfossilfuelfiredelectricgeneratingunits.SincetheCleanPowerPlanis
implementedbystates,itisimperativethatPennsylvaniaincludeWTEaspartofitsapproved
stateplantoensurethatthebenefitsofWTEcanberealizedinPennsylvania.
Thetypeofstateplanadoptedcanhaveasignificantimpactontheabilityofastateto
achieveitsspecificpolicyobjectives.
Forexample,inaratebasedstateplan,onlygenerationfrompost2012renewable
facilitiescanbeusedbyregulatedelectricgeneratingunitstoadjusttheiremissionrates.This
wouldmakeitimpossibleforexisting(pre2013)renewablefacilitiesfrommonetizingtheir
GHGreductionsundertheCPP.
Stateshavegreaterflexibilitytoprovidepolicysupporttoexistingandnewrenewables
(includingwastetoenergy)underamassbasedplanthroughanallocationofallowancesaswell
ascomplementarystatemeasures.
PennsylvaniascomplianceplanshouldsupporttheinvestmentinWTEmadebylocal
governmentsbyensuringthatthisreliablemunicipalwasteinfrastructureissupportedwith
tradablecomplianceinstruments(e.g.allowances).
Underamassbasedplan,statesshouldallocateallowancestoexistingwastetoenergy
facilitiesinrecognitionofhistoricandfutureGHGreductions.Thissupportwillprovide
financialstabilitytoGHGreducingWTEfacilities,whichoperateinincrediblydifficultmarkets
dominatedbycheapwholesaleelectricity,cheaplandfillingrates,andextremelyvolatile
commoditypricesforrecycledmetal.
Throughsupportforexisting,aswellasnew,WTEfacilities,Pennsylvaniacanensure
thattheinvestmentmadeinWTEcancontinuetoprovidelonglastingGHGreductions.
ItisimportanttorememberthatifaWTEfacilitycloses,anditswastesupplyisdiverted
tolandfills,GHGgasemissioninthestatewillincreaseimmediately.Thisriskcanbemitigated
bytreatingWTEappropriatelyinthestateplan.
Theresultwillhelpprotectlocalinvestment,keepdisposalcostslowforlocal
governments,supportlocaljobsandtheeconomy,andreduceGHGsfromfossilelectric
generatorsandlandfills.
Insummary,theEnergyRecoveryCouncilurgesPennsylvaniatodevelopastateplan
undertheCPPthatreinforcestheCommonwealthssolidwastehierarchyandsupportsthe
investmentthatlocalgovernmentshavemadeinwastetoenergy.
FailuretosupportthewastetoenergysectorintheCPPplanwillhavetheunfortunate
impactofincreasingthereleaseofgreenhousegases,reducingrenewablegeneration,and
increasingthedifficultyandcostofcomplyingwiththeCPP.Thankyou.

PeachBottomAtomicPowerStationinYorkCounty,andLimerickGeneratingStationin
MontgomeryCounty.
Wealsoownasignificantportfolioofwind,hydropower,solar,gas,andoilfired
generationhereintheCommonwealthandnationwide.
ExelonappreciatestheDepartmentseffortstoseekpublicinputconcerning
PennsylvaniasimplementationofEPAsCleanPowerPlan,andweofferthefollowing
comments:
TheImportanceofNuclearPowertoaLowerCarbonFleet
Nuclearpowerisanoftenoverlookedlynchpinofthetransitiontoalowercarbon
electricitygeneratingfleet.Environmentalistsandscientistsaroundtheworldhaveconcluded
thatthenecessaryemissionreductionscannotbeachievedwithoutthecontinuedoperationof
nuclearpower.
Pennsylvaniasfivenuclearpowerplantsgenerate34percentofPennsylvanias
electricity,and93percentofPennsylvaniaszerocarbonelectricity.Thatequatestonearly35
milliontonsofcarbonemissionsavoidedthroughthisreliablesourceofbaseloadgeneration.
UndertheCPP,PennsylvaniamustreduceCO2emissionsby10milliontonsfrom2012
levelsby2022andbynearly26milliontonsby2030,sothelossofanynuclearplantherewould
nearlydoublethecomplianceobligation.
NuclearPowerisExceptionallyReliable
AsPJMhasnoted,nuclearplantsprovideunrivaledperformanceduringallweather
conditions.
ExelonNuclears24unitsacrossfivestates,includingPennsylvania,achievedanaverage
capacityfactorof94.3percentin2014.Thatmeansthattheyareavailable94percentofthe
time.
Whilemanyplantsstruggletorunduringextremeheatorcold,whentheirpoweris
neededmost,ournuclearplantsarevirtuallyalwayson.Forexample,duringthepeakofthe
polarvortexinJanuary2014,thenuclearfleetrepresentedonlythreepercentoftheforced
outagesexperiencedacrossPJM.

Systemoperatorsneedreliable,baseloadunitstomaintainsystemreliability.Forthat
reason,PJMsCEOhasstatedthatitiscriticalthatthenuclearfleetinourregionremains
economicallyviable,andthatretirementofthenuclearfleetinPJMisunthinkable.
EconomicThreatstotheNuclearFleet
Despitetheirenvironmental,reliability,andeconomicvalue,anumberofexistingplants
faceprematureretirementlongbeforetheendoftheirdesignlife.Ownersofsixofthenations
104nuclearunitshaveretiredunitsorannouncedthattheywillsoonretireunits.
Otherowners,includingExelon,havestatedthattheywillcontinuetowatchmarket
developmentsandevaluateplanteconomicstoinformdecisionsaboutthefutureoperationsof
nuclearstations.
Thereareanumberoffactorscausingtheeconomicchallengesfacingmanynuclear
plants,butchiefamongthemistheabsenceofmarketmechanismstovaluethecarbonfree
natureofnuclearpowerortorequirecarbonemittinggenerationtointernalizethatsocialcost.
Wedonotexpectthefactorsdrivingtheseeconomicstochangeintheneartermabsent
EPAsrulemaking.ThiswashighlightedintherecentfailureofTMItoclearinPJMs2018/19
capacityauction.
TurningtoEPAsFinalRule
ImplementationoftheCleanPowerPlanimplicitlyreliesonthecontinuingoperationof
theexistingnuclearfleetinordertoachieveCO2reductionswhilemaintainingreliabilityand
affordability.
Thus,weencouragePADEPtoimplementamassbasedcomplianceprogramthat
includesnewandexistingfossilunitsinordertosendtheneededmarketsignalstopreserve
existingnuclearandotherzerocarbongenerationnowandoncecompliancebeginsin2022.
Massbasedcomplianceprogramsaresuperiorforanumberofreasons.
First,massbasedprogramsareprovenandwellunderstood.Forexample,thepower
sectorhasutilizedamassbasedprogramtocontrolacidrainpollutantssince1995.
Sincethen,manyotherenvironmentalprogramshaveutilizedsimilarmethodsto
costeffectivelycontrolpollutionincludingtheNOxBudgetProgram,CAIR,andCSAPR.
Massbasedprogramspromotereliabilitythroughtheireaseofuseandclearpricesignal
theynaturallyalignwiththeleastcostdispatchprincipleofelectricitymarkets,whileother
approachesmayrelyonartificialdecisionsthatcouldimpairreliability.
Asyouknow,the
RegionalGreenhouseGasInitiative
orRGGIhassucceededin
reducingemissionsinninenortheaststatesusingamassbasedprogramsince2009.
Second,massbasedcomplianceprogramswillachievethestatesmanyobjectivesand
obligationsundertheCleanPowerPlantheyachieveactual,easilyverifiedCO2reductions
theyminimizetotalcompliancecosts,includingratepayerimpactstheypreserveelectric
reliabilitytheyaretechnologyandfuelneutralandtheysimplifycomplianceandreduce
administrativeburdens.
Third,massbasedprogramsmaybesinglestateorallowtradingbetweenstates.States
donotneedformalagreementswithotherstatestoallowinterstatetradinginthefinalrule,EPA
hasremovedthisbarrier.
Thus,stateimplementationplanscanbeassimpleasrequiringthesubmittalofone
allowanceforeachtonofemissions,withnorequirementthattheallowancebeobtainedinstate.
Pennsylvaniawouldstillretaincontroloverallowanceallocationand/orauction.
Lastbutnotleast,massbasedprogramsminimizecoststotaxandratepayers.

Massbasedprogramsareanefficientwaytotranslateanenvironmentalgoal(e.g.,levelof
emissions,usuallyexpressedintons)intoapricesignaleasilyunderstoodbythemarket(e.g.,an
allowancepricethatiseasilyincorporatedintogeneratorsvariablecostsjustlikeanyothercost
ofoperation).
Asaresult,massbasedpricesignalsaresimpleandclear.Allowancesareauctionedor
soldinatransparentmarket,withasinglepointofcostpurchaseofallowance.Bycontrast,
ratebasedprogramsrequireamultitudeofoftenopaquecosts.
Inconclusion,ExelonstronglyencouragesPennsylvaniaDEPtorecognizetheimportant
environmental,reliability,andeconomicbenefitsofexistingnuclearplantsandthecarbonfree,
reliablegenerationtheyprovidetoPennsylvaniabusinessesandfamilies.Thebestwaytodo
thisistoimplementamassbasedcomplianceprogramforcompliancewiththeCleanPower
Plan.

ThePennsylvaniaweknowtodayisbeingfundamentallyalteredbythe
impactsofclimatechange,accordingtoscientistsandeconomistsfrom
PennsylvaniaStateUniversity.
Their
ClimateImpactsAssessmentUpdate
,preparedforthe
DepartmentofEnvironmentalProtectionatthedirectionoftheGeneral
Assembly,findsthatPennsylvaniahaswarmed1.8degreesinthepast
110years,andthewarmingwillincreaseatanacceleratedrate.
By2050,Pennsylvaniawillbe5.4degreeswarmerthanitwasin
theyear2000.By2050,Philadelphia'sclimatewillbesimilarto
currentdayRichmond,Va.PittsburghwillbesimilartocurrentdayWashington,D.C.,or
Baltimore.
Thisreportisprofoundlydisturbing.
Scienceisshowingusthatnotonlyarethechangesanddisruptionstoourstate'sclimate
significant,buttheyarealsooccurringalarminglyfast,inwaysthatwillaffectkeysectorsofthe
economy,ourhealth,andourqualityoflife.
Climatechangecouldworsenairqualityincreasingpollenandmoldconcentration,and
groundlevelozonecausinglongerallergyseasons,aggravatingasthma,andincreasing
mortalityamongatriskpopulations.
VectorbornediseaseslikeWestNilevirusandLymediseasecouldincreaseduetomore
favorableconditionsformosquitoesanddeerticks.
Somechangeswillbepositive.Longergrowingseasonsandmoretolerabletemperatures
forcropsnotcurrentlygrowninPennsylvaniaoffernewopportunitiesforfarmers.Butwarmer
temperatureswillbringmorefavorableconditionsforagriculturalpestslikeweedsandinsects.
Severestormsstrengthenedbywarmertemperaturescouldaffectreliableelectric
serviceandthreatenourcurrentelectricinfrastructure.

forestsandtheirecosystemsarealreadychanging,facingincreasedstress.
Thoseimpactswillhaveunquestionableeffectsonourwaterquality,onthewayweuse
andenjoyourforestsandparks,andonsignificantindustrieslikeourforestproductssectorand
ouroutdoorrecreationandtourismeconomies.

Afriendsgroupisagroupofmotivatedcitizensinthelocalcommunitythatunderstand

Thismeetingwillserveasanopportunitytoidentifypotentialprojectsandassessthe
interestinformingagroupatthispark.
Foundedin1903,CaledoniaStateParkinAdamsandFranklincountiesisthesecond
oldeststateparkintheCommonwealth.SeveralCivilianConservationCorpsstructuresstill
standandareinusetoday.Theparkispopularwithbirdwatchers,hikersalongtheAppalachian
Trail,andtroutfishermen.
CaledoniaStateParkwillbehostingtwomaineventsthisyear:theAnnualArts&Crafts

ofConservationandNaturalResourcesandthe
CommonwealthFinancingAuthority,NaturalLands
Trustpurchaseda100footswathofland,onepier
(Pier56),andtheassociatedwaterrightstotaling9.5acresfromK4Philadelphia,LLC,on
August26,2015.
ThislargewaterfrontsiteislocatedbehindtheSheetMetalWorkersLocal19
HeadquartersatColumbusBoulevardandWashingtonAvenue.Thesalefollowsthepurchaseof
fiveacresoflandand11acresofriparianlandsattheendofPier70Boulevardin2012by
NaturalLandsTrust.

ThesetwoparcelsserveasbookendsfortheproposedsouthernDelawareRiverTrail,a
permanent.7milemultiuse,recreationaltrailalongtheriver.
Theacquisitionofthismajorparcelofwaterfrontlandisaveryimportantstepinthe
developmentofahighquality,continuouswaterfronttrailthatwillrunfromPier70Boulevard
northtoWashingtonAvenuePier,saidTomCorcoran,presidentofDRWC.Wearevery
gratefultotheCommonwealthofPennsylvania,especiallytoDCNRandCFA,forsupporting
thisimportantelementoftheMasterPlanfortheCentralDelaware.Wearealsoverygratefulto
ourpartner,NaturalLandsTrust,fortheiruniqueexpertiseinacquiringprivatelandsforpublic

ThetrailwillalsoconnecttwoverydifferentnewparksdesignedandbuiltbyDRWC.
WashingtonAvenuePierisanecologicalparkopenedsummer2014atthelocationof
PhiladelphiasoldImmigrationStation.
ThesoontobeopenedPier68alsoacquiredwithassistancefromNaturalLandsTrust
