GAY ADOPTION IN COLOMBIA

The last decade, Colombia has made slow progress on the rights of
homosexuals. LGBT rights has progressed since consensual gay activity
was decriminalized in 1980 becoming one of Latin America's most
advanced countries in regards with LGBT rights legislation. In 2011 the
Constitutional Court recognized homosexual couples as a Family and
since 2014 homosexuals ONLY can adopt the biological child of their
partner, however, it seems such a partial equality whe there is a legal
framework that supports homoparental adoption, thats the reason why
the Constitutional Court has given back to the equal adoption is for the
Congress to face an issue with divided opinions in the country
In
Colombia,
the
rights
of
lesbians,
gays,
bisexuals
andtransgeneristas are not only disrespected but also not guaranteed,
because in practice judicial and administrative authorities often prioritize
their biased conceptions when enforcing the law and/or ignore the
unique needs and rights of this population 1. The Constitutional Court in
Sentence C-029 de 2009 Sentence C-029 2009 granted civil, political,
social, economic, immigration and criminal rights to gay and lesbian
couples. Before this case, those rights had been reserved for nonmarried heterosexual couples. The Court stated that equal rights could
not allow qualifications or exceptions based on sexual orientation.
The child gets the opportunity to get the benefits from new parents both
in health and financial support. Since there are many children that are
off for adoption, gay parents are able to pour all their love for their child
through tangible and non-tangible things. Children get to grow in a home
that is filled with love and affection since the gay parents know how they
want their children to grow appreciating their life.
Adoptive parents are increasing and are able to lessen the children
staying in well-being communities. It is also considered as the best
alternative for the foster-care system that leaves child wanting to have
the same family or attention given by their foster parents while
temporarily staying with them.
The pros of gay parenting are not all about the benefits of the new
family unit but also in the society. Gay parents are able to help in
focusing on the welfare of children and give every child that they adopt
the opportunity in living in a loving family According to a report in
the Washington Post, "Bogota has a thriving gay neighbourhood, bars
whose patrons are openly gay and a centre that provides counselling
and legal advice to members of the gay community. Local politicians,
amongst them Mayor Luis Eduardo Garzn and prominent members of
Congress such as Senator Armando Benedetti, have supported the drive
to give more rights to gay couples.
