THE SCHOLA JURIS VESPERTINA PROPOSED CONSTITUTION

NAME

AND

ARTICLE 1
NATURE OF THE ORGANIZATION

Sec. 1. This Organization shall be called the Schola Juris Vespertina (SJV).
Sec. 2. The SJV is a non-partisan, non-political Organization composed of students of the
different evening sections of the University of the Philippines College of Law.

OBJECTIVES

OF THE ORGANIZATION

Sec. 1. The SJV aims to support its members in meeting the rigorous demands of law school
while facing the professional requirements in the workplace in the pursuit of being
exemplary evening law students of the UP College of Law.
Sec. 2. The SJV serves as a venue for building camaraderie and stronger ties among the five
evening sections in the College and the alumni.
Sec. 3. In the long term, the SJV aims to establish a cohesive network of lawyers and
professionals with expertise in various fields of endeavor, working together towards helping
improve our country.
ARTICLE 3
MEMBERSHIP
Sec. 1. Unlike traditional organizations, membership in the SJV is automatic to all evening
students. Unless required by a simple majority vote of the SJV Council of Representatives
(SJV Council), no formalities will be required to gain membership in the Organization.
Sec. 2. Dues. -- Members of the SJV shall pay a semestral fee and other dues as may be
prescribed by the SJV Council.
Sec. 3. Rights and Privileges. -- Each member of the SJV shall enjoy the following privileges:
a. To be fully informed of all the plans, concerns and activities of the SJV.
b. To be consulted regarding major policy decisions of the SJV.
c. To be appointed or elected as heads and members of Ad Hoc Committees to be formed
by the SJV Council.
Sec. 4. Duties and Responsibilities. -- Each member is expected to:
a. Uphold the provisions of this Constitution.
b. Actively promote the objectives of the SJV.
c. Respect and abide by the decisions, policies and guidelines of the SJV Council, Executive
Council and the general body.
d. Actively participate in the activities and projects of the SJV.
e. Pay semestral and other dues to be prescribed by the SJV Council.
f. Attend the general assembly.

ARTICLE 4
THE COUNCIL OF REPRESENTATIVES
Sec. 1. The SJV Council of Representatives (SJV Council) shall be the highest policy-making
body of the Organization. It is composed of ten (10) members from the five (5) evening
sections in the College.
Sec. 2. Composition. -- Each block shall be entitled to two (2) representatives in the SJV
Council. One of the representatives from the block will be the incumbent block president.
The blocks are entitled to choose their other representative in a manner they deem most fit.
Sec. 3. All policy and organizational decisions will have to be approved by at least a simple
majority of the SJV Council members. Major policy decisions will be made only after
consultations with the different blocks. Only members of the SJV Council are entitled to vote
on decisions to be made by the SJV to ensure proper representation from all the evening
blocks. But any member of the Organization may attend the SJV Council meetings and
exercise their right to be informed and heard. In case of a tie in voting, the vote of the
incumbent SJV President shall prevail.
Sec. 4. Quorum. -- A simple majority of the members of the SJV Council shall constitute a
quorum.
Sec. 5. To prevent partisanship, members of college-based organizations, fraternities and
sororities will be limited to a maximum of two (2) seats in the SJV Council. If there are more
than two (2) block presidents or representatives belonging to the same organization, they
will agree among themselves in determining who sits in the SJV Council.
Sec. 6. The SJV Council shall meet at least two times a semester in a time and place as they
may agree upon.
Sec. 7. Duties and Responsibilities of the members of the Council of Representatives. -- The
Block Presidents and Representatives shall be responsible for the following:
a. Reporting the decisions and issues discussed during the SJV Council meetings to their
respective blocks.
b. Consulting and securing the stand of their block regarding major policy decisions
affecting the Organization.
c. Reporting to the SJV Council and/or Executive Council issues and concerns affecting their
blocks.
d. Ensuring block participation in the activities and projects of the Organization.
e. Ensuring block attendance in the General Assembly.
f. Attending and participating in the meetings of the Council of Representatives.
In addition, the Block Presidents shall be responsible for the following:
a. Submitting to the Secretary a complete directory of their block not later than fifteen (15)
days after the start of every semester, reckoned from the day classes officially begin.
b. Collecting from their respective blocks yearly dues and fees prescribed by the Council of
Representatives and turning these over to the Treasurer.

ARTICLE 5
THE EXECUTIVE COUNCIL
Sec. 1. Officers. -- The officers of the SJV which form the Executive Council shall be the
President, the Secretary, and the Treasurer.
Sec. 2. The members of the SJV Council shall elect among themselves the officers of the SJV.
In case of a tie in the voting, the outgoing president, or if he is still in the council, the
president of the newly graduated evening class, shall cast the tie-breaking vote.
Sec. 3. Other positions and ad hoc committees may be created by the SJV Council but these
are co-terminous with the SJV Council that created them. Their duties and functions are to be
determined by the Executive Council. The persons occupying the ad hoc positions shall be
elected or appointed by the SJV Council from the general body.
Sec. 4. Duties and Functions. The Executive Council shall perform the following duties and
functions:
a. The President shall head and be the official spokesperson of the Organization.
a.1. He/She shall preside over all meetings of the Executive Council, Council of
Representatives and General Assembly.
a.2. He/She shall serve as the liaison and representative of the Organization to the
College, University and the general public.
a.3. He/She shall supervise the activities and projects of the Organization.
a.4. He/She shall ensure that the members of the Executive Council and the Council of
Representatives are performing their respective duties and functions.
a.5. He/She shall prepare a line-up of activities to be proposed to the SJV Council.
a.6. He/She shall approve the minutes, evaluation and calendar of accomplishments
submitted by the Secretary before presentation to the general assembly.
a.7. He/She shall approve the financial reports submitted by the Treasurer before
presentation to the general assembly.
a.8. He/She shall convene the next batch of Council of Representatives before the end of
the academic year in order to call for elections for the succeeding years next batch
of officers.
b. The Secretary shall be the record keeper documenting all meetings, projects and
activities of the Organization.
b.1. He/She shall regularly submit minutes and/or evaluation not later than ten (10) days
after the holding of the meeting, project or activity, as the case may be.
b.2. He/She shall submit a calendar of accomplishments after every semester.
b.3. He/She shall regularly maintain and update the bulletin board of the Organization.
b.4. He/She shall produce and update a general directory of members and alumni, the
data of which he/she shall collect from the different block presidents or
representatives, not later than fifteen (15) days after the start of every semester,
reckoned from the day classes officially begin.
b.5. He/She shall maintain the records of the organization, arranged in an orderly
fashion, and ensure that all such records be properly turned over to the next
Secretary or Executive Council of the Organization.
b.6. He/She shall represent the Organization in case the President is absent.

c. The Treasurer shall be the chief finance officer of the Organization.


c.1. He/She shall collect the semestral dues and other fees prescribed by the Council of
Representatives from the different Block Presidents.
c.2. He/She shall conceptualize and supervise fund-raising projects of the Organization,
subject to the approval of the Council of Representatives.
c.3. He/She shall prepare a financial report after every major activity of the Organization
not later than ten (10) days after the holding of such major activity.
c.4. He/She shall prepare a financial report at the end of every semester and ensure that
all financial reports be properly turned over to the next Treasurer or Executive Council
of the Organization.
c.5. He/She shall represent the Organization in case the President and the Secretary are
absent.
ARTICLE 6
AMENDMENTS
Sec. 1. Proposals to amend, alter or repeal this Constitution, supported by at least threefourths of the SJV Council in a meeting called for the purpose, will have to be ratified by a
simple majority of the five evening blocks for their effectivity.
Sec. 2. The SJV Constitution shall be reviewed every three (3) years by the SJV Council. No
amendments, alterations or repeal of this Constitution shall be made within two (2) years
upon ratification of the Constitution.
ARTICLE 7
ADOPTION
Sec. 1 The foregoing articles were adopted and ratified by the simple majority of the
members of the five (5) evening blocks on August 3, 2006 at the UP College of Law,
Diliman, Quezon City.
