SYNOPSIS
THE EMERGENCY IN 1975 THE DARKEST PERIOD OF INDIAN DEMOCRACY
History bares testimony to the fact that great nations face grave crises. In 1933, the
United States was struck by the great depression, which exposed the fallacies of the market
economy. A few years later the military might of Japan was crushed by the United States
during the Second World War. At the start of the last decade of the millennium, the fragilities
of Socialism were exposed and it led to the eventual demise of the Soviet Union.
Indias strength has always been its vibrant democracy. Ours is perhaps the only country
where people from contrastingly different castes, creed, religion and race live together in
peace and harmony. The other hallmarks of our country are a strong judicial system and a free
press. The imposition of the emergency in 1975 struck at the very core of these ideals, which
constitute our democracy. It was perhaps the darkest period in the history of independent
India.
OBJECTIVES/AIM OF THE STUDY
The researcher will be discussing the following cases which are related to emergency concern
matters.
1. State of Uttar Pradesh v. Raj narain [these case was basic thing for imposition on
emergency]
2. Jabalpur v.Shivakant Shukla and others [(AIR 1976 SC 1207)] etc.
SIGNIFICANT/BENEFIT OF THE STUDY
This study helps us to know about how it is reflected on Indian democracy. And why it is
called darkest period of Indian democracy. The imposition of national emergency between
June 1975 and March 1977 .It has undoubtedly become a pivotal focus for scholarship in
diverse disciplines such as political science, sociology and contemporary history
among others. For the purpose of legal studies, the existing discourse concentrates
on the much-discussed decisions in above cases as well as the arbitrary use of legislations

that included provisions for preventive detention and had been immunised against judicial
review.

SCOPE OF THE STUDY


The scope of the study limited to the only emergency period during 1975- 77.And also
limited to the political conditions, role of opposition, and reason behind emergeny. Doctrinal
based study.
RESEARCH METHODOLOGY
The process used to collect information and data for the purpose of making decisions. The
methodology may include publication research, articles and other research techniques.

RESEARCH QUESTIONS
1. What prompted Mrs. Gandhi to take such a drastic step? Could the emergency have been
avoided? What role did her son Sanjay and his cronies play during this crucial period? Were
there any personal motives? Why Indira impose emergency?
2. There is any possibility in happening of emergency in future?
3. There are different opinions regarding emergency in 1975.Why?
4. What are reasons for imposing censorship on media, press?
