RESPECTFULLY SHOWETH:
1.

That

the

petitioner

is

an

owner

and

landlord of the premises 1st floor of SCO No.


321, Sector 40-D, Chandigarh and has filed the
case

for

the

eviction

of

the

tenant

on

the

grounds of Subletting & for making additions &


allterations.
2.

That

the

Ld.

Trial

court

ordered

the

eviction vide order dated 08/05/2013.

3.

That

against

the

order

of

the

Ld.

Trial

Court, an Appeal has been filed before the Ld.


District Judge.
4.

That

during

the

course

of

hearing,

the

respondent undertook to vacate the premises on


or before 31.07.2015 and further undertook to
continue to pay rent every month by 7 th till the
period

of

possession.

He

also

promised

to

deposit all the arrears of rent. A copy of the


statement of the respondent dated 15.07.2014 is
annexed as Annexure-A for kind perusal.

That

on

the

statement/undertaking

basis
of

the

aforesaid

respondent,

the

matter had been disposed off by the Ld. District


Judge vide order dated 15.07.2014. A copy of the

constant

requests, the petitioner failed to adhere to the

by

him.

He

has

neither

vacated the premises on the date so promised nor

undertakings given in the Court. The respondent
has acted in gross violation of the undertakings
given in the Honble Court.

of contempt of court as defined under Sections10 and 12 of Contempt of Courts Act, 1971. The
