CHAPTER V. Recall
Loss of confidence

The code requires the petition to be filed, not only by one person,
but atleast 25% of the total number of registered voters.

(a) Any elective local official may be the subject of a recall election
only once during his term of office for loss of confidence.
(b) No recall shall take place within one (1) year from the date of
the official's assumption to office or one (1) year immediately
preceding a regular local election.
Refers to the election where the office held by the local elective
official sought to be recalled will be contested and be filled by
the electorate.

Every local government unit shall design and implement its own
organizational structure and staffing pattern taking into consideration its
service requirements and financial capability, subject to the minimum
standards and guidelines prescribed by the Civil Service Commission.

All matters pertinent to human resources and development in local
government units shall be governed by the civil service law and such rules
and regulations and other issuances promulgated pursuant thereto, unless
otherwise specified in this Code.

Elective local officials shall be entitled to the same leave privileges as those
enjoyed by appointive local officials, including the cumulation and
commutation thereof.

In every local government unit, the local chief executive shall establish a
procedure to inquire into, act upon, resolve or settle complaints and
grievances presented by local government employees.

Any local official and any person dealing with him who violate
the prohibitions provided in this provision, shall be PUNISHED
WITH IMPRISONMENT FOR 6 MONTHS TO 6 YEARS, OR A

Validity of an Ordinance
(1) Must not contravene the Constitution or any Statutes
GR: Ordinances regulating matters on which is a general
law of a state must be in harmony with the state law, and in
conflict between an ordinance and statute, STATUTE
MUST PREVAIL.
(2) Must not be unfair or oppressive
(3) Must not be partial or discriminatory

IMPARTIAL and UNIFORM in its operation. Classification
must be germane to the purpose of the law.

The local referendum shall be held under the control and direction of the
COMELEC within sixty (60) days in case of provinces and cities, forty-five
(45) days in case of municipalities and thirty (30) days in case of
barangays.
The COMELEC shall certify and proclaim the results of the said
referendum.
