14601.2.(a)Apersonshallnotdriveamotorvehicleatanytimewhenthatperson'sdrivingprivilegeissuspendedorrevokedforaconvictionofaviolationofSection
23152or23153ifthepersonsodrivinghasknowledgeofthesuspensionorrevocation.
(b)Exceptinfullcompliancewiththerestriction,apersonshallnotdriveamotorvehicleatanytimewhenthatperson'sdrivingprivilegeisrestrictedifthepersonso
drivinghasknowledgeoftherestriction.
(c)Knowledgeofthesuspensionorrevocationofthedrivingprivilegeshallbeconclusivelypresumedifmailednoticehasbeengivenbythedepartmenttotheperson
pursuanttoSection13106.Knowledgeoftherestrictionofthedrivingprivilegeshallbepresumedifnoticehasbeengivenbythecourttotheperson.Thepresumption
establishedbythissubdivisionisapresumptionaffectingtheburdenofproof.
(d)Apersonconvictedofaviolationofthisectionshallbepunishedasfollows:
(1)Uponafirstconviction,byimprisonmentinthecountyjailfornotlessthan10daysormorethansixmonthsandbyafineofnotlessthanthreehundreddollars
($300)ormorethanonethousanddollars($1,000),unlessthepersonhasbeendesignatedahabitualtrafficoffenderundersubdivision(b)ofSection23546,
subdivision(b)ofSection23550,orsubdivision(d)ofSection23550.5,inwhichcasetheperson,inaddition,shallbesentencedasprovidedinparagraph(3)of
subdivision(e)ofSection14601.3.
(2)IftheoffenseoccurredwithinfiveyearsofaprioroffensethatresultedinaconvictionofaviolationofthissectionorSection14601,14601.1,or14601.5,by
imprisonmentinthecountyjailfornotlessthan30daysormorethanoneyearandbyafineofnotlessthanfivehundreddollars($500)ormorethantwothousand
dollars($2,000),unlessthepersonhasbeendesignatedahabitualtrafficoffenderundersubdivision(b)ofSection23546,subdivision(b)ofSection23550,or
subdivision(d)ofSection23550.5,inwhichcasetheperson,inaddition,shallbesentencedasprovidedinparagraph(3)ofsubdivision(e)ofSection14601.3.
(e)Ifapersonisconvictedofafirstoffenseunderthissectionandisgrantedprobation,thecourtshallimposeasaconditionofprobationthatthepersonbeconfined
inthecountyjailforatleast10days.
(f)IftheoffenseoccurredwithinfiveyearsofaprioroffensethatresultedinaconvictionofaviolationofthissectionorSection14601,14601.1,or14601.5andis
grantedprobation,thecourtshallimposeasaconditionofprobationthatthepersonbeconfinedinthecountyjailforatleast30days.
(g)Ifapersonisconvictedofasecondorsubsequentoffensethatresultsinaconvictionofthissectionwithinsevenyears,butoverfiveyears,ofaprioroffensethat
resultedinaconvictionofaviolationofthissectionorSection14601,14601.1,or14601.5andisgrantedprobation,thecourtshallimposeasaconditionofprobation
thatthepersonbeconfinedinthecountyjailforatleast10days.
(h)PursuanttoSection23575,thecourtshallrequireapersonconvictedofaviolationofthissectiontoinstallacertifiedignitioninterlockdeviceonavehiclethe
personownsoroperates.Uponreceiptoftheabstractofaconvictionunderthissection,thedepartmentshallnotreinstatetheprivilegetooperateamotorvehicleuntil
thedepartmentreceivesproofofeitherthe"VerificationofInstallation"formasdescribedinparagraph(2)ofsubdivision()(h)ofSection13386ortheJudicialCouncil
FormI.D.100.
(i)Thissectiondoesnotprohibitapersonwhoisparticipatingin,orhascompleted,analcoholordrugrehabilitationprogramfromdrivingamotorvehiclethatis
ownedorutilizedbytheperson'semployer,duringthecourseofemploymentonprivatepropertythatisownedorutilizedbytheemployer,exceptanoffstreetparking
facilityasdefinedinsubdivision(c)ofSection12500.
(j)ThissectionalsoappliestotheoperationofanoffhighwaymotorvehicleonthoselandsthattheChappieZ'bergOffHighwayMotorVehicleLawof1971(Division
16.5(commencingwithSection38000))appliesastooffhighwaymotorvehicles,asdescribedinSection38001.
(k)IfSection23573isapplicable,thensubdivision(h)isnotapplicable.
