AFFIDAVIT FOR WARRANT OF ARREST AND DETENTION

The undersigned Affiant, who after being duly sworn by me, on oath, makes the following statement:

On or about the 9 day of October, 2015, in the incorporated limits of the City of Austin,

County of Travis, Texas, did then and there commit the offense of:

Public Intoxication - Class C Misdemeanor

OnOctober 9,2015 at approximately 19:31:07 hours Sergeant Jelesijevic 3462 advised me, Officer Muchnikoff7299, that he was on
his regular assigned patrol in the Downtown Austin area wearing the uniform of his profession to include shoulder patches and a
badge. Sgt. J elesijevic was driving a dearly marked Austin Police Department patrol unit equipped with emergency lights and the
word "Police" on the vehicle. Sgt. Jelesijevic was driving West bound on E 6th St. after dark and was stopped in the middle of three
lanes at the red light at the intersection ofE 6th St and San Jacinto Blvd, a public place. The E 6th St West bound light turned green at
19:3 1:07 hours and at 19 :31 :12 hours a group of one male and two females began crossing the intersection from the South West comer
to the North West comer against the clearly lit crossing signal. The subjects entry into the roadway obstructed the flow of traffic,
including Sgt.Jelesijevic, and was acknowledged by the subjects when the male subject lifted his hand in the internationally
recognized sign for stop when directing traffic as they crossed. Sgt. Jelesijevic conducted a probable cause subject stop on the three
crossing against signal by activating his emergency lights and repositioning his vehicle to be pointed directly at them. Sgt. Jelesijevic

After Sgt. Jelesijevic activated his overhead lights LaBeouf visually acknowledged him, looking straight at him, and raised his hands
waist high while taking six backward steps followed by three more while turning away from Sgt. Jelesijevic as he exited his patrol
vehicle and ordered LaBeouf to stop. LaBeouf returned next to Stanga and Alayna and a strong odor of an alcoholic beverage was
immediately apparent to Sgt. Jelesijevic as emanating from LaBeouf. Sgt. Jelesijevic stated that LaBeouPs speech was slurred and
thick tongued and his eyes were glassy and dilated.
While speaking with Sgt. Jelesijevic, LaBeouf stated that if stopped by Los Angeles Police Department he typically walks away
because Police had killed a friend of his and he became increasingly confrontational, aggravated, profane, and verbally aggressive
with Sgt. Jelesijevic throughout the stop, calling him a "silly man" three times. While interacting with Sgt. Jelesijevic, an unidentified
third party began filming the encounter which is common on E 6th St. LaBeoufreacted very hostile to this stranger bypuffmg his chest
and walking in an aggressive and threatening manner at the male, prompting Sgt.iJelesijevic to intervene and stop LaBeouffrom
potentially assaUlting the stranger. LaBeouf then continued his verbal tirade towards Sgt. J elesijevic and began to bow up or puff his
chest, a sign of prepatory resistance, out at Sgt. Jelesijevic, within two feet of Sgt. Jelesijevic's face and staring intently at him. During
this time LaBeoufbegan stating he was a member of the National Guard and that Sgt. Jelesijevic needed to "do whatever the fuck you
gotta do!"
Sgt. Jelesijevic stated he determined that LaBeoufwas a danger to himself and others due to his complete disregard for vehicular
traffic who had the right of way when he walked into oncoming traffic. LaBeoufthen acknowledged he was walking into traffic when
he attempted to unlawfully direct traffic at night in his highly intoxicated state. By stopping the oncoming traffic LaBeouf
acknowledged through his hand signal that vehicles had the right of way and he did not. LaBeouP s complete disregarded that traffic
might have to suddenly stop causing a potential collision to avoid hitting him, or worse a vehicle may have struck his party
highlighting his reckless and dangerous behavior. LaBeouPs escalating aggressive behavior towards by standers and Sgt. Jelesijevic
further demonstrated LaBeouPs poor decision making and that he was a danger to others. Sgt. Jelesijevic determined that LaBeouf
