Should the justice system consider the mental state of a pedophile

in rendering judgement?
In my own perspective, the Philippine justice system may consider the
psychological disorder pedophilia in rendering judgement, but not to totally
discharge the defendant for his violation of the law for his action cannot be
condoned because of his mental illness proven with no certainty that triggers
the abuse to the victim. In the Philippines, it is not tenable for the judiciary to
consider such factor, because one may easily distort the information to be
turned into facts because of the unsecured system of medical records. This
may be in connivance with people, particularly those with power and wealth
to escape the imprisonment or any charges that may sue upon the
pedophiles.
The fault still lies with the child molester as he is naturally obligated to
assure that he is free from any physical and mental illness. This disorder may
be prevented or treated should he attend to his medical needs. One may
consider this unconscionable or biased since the law only consider the
condition of the victim. What our law currently provides that they should be
penalized regardless of having pedophilia is only reasonable considering that
the effects is a lifetime misery because of the traumatic experience at
childhood quite early for an innocent mind to handle such depression. The
victims may have felt that they have been deprived of their happiness while
the pedophiles unconsciously felt the sexual pleasure from molesting minors.
Undeniably, the pedophiles have benefited along despite of the unconscious
mind.
Considering pedophilia as a ground to lower the charge imposed upon
is a means to escape knowing that if they will be held by mental institutions,
there is a high probability that one may easily abscond because of the poor
security if being compared to a jail. Children are the most vulnerable
members of the society. If the law consider to let the pedophiles be free in a
society, it is as if the government let the predator wander among the weak
ones who is unable to protect themselves even self-defense wont do
considering that the adults can resist attacks.
Absolutely, there is no crime that is vehemently heinous than the
sexual abuse of a child. These extremely dangerous people should be
accountable for their transgressions. They deserve punishment, but I cannot
deny the fact that they also need help. They still deserve the tiniest spare of
mercy a human can give to release the inner demons that consumed their
mind. Perhaps, I would suggest that pedophiles should be put into a
detention center with some medical assistance for their illness but still in
need of high security until they have been completely treated.
