ENTREPRENEURS MEMORANDUM FOR SETTING UP MICRO,SMALL OR MEDIUM


ENTERPRISE
Memorandum is to be filed with the District Industries Centre, under whose jurisdiction the enterprise
is proposed to be located by a Micro,Small or Medium Enterprise,as the case may be, under subsection(1) of section 8 of the Micro,Small and Medium Enterprise Development (MSMED) Act 2006.There
is no need for processing the Memorandum. Existing units should fill up only part-II of the Memorandum.
In case of any change in the information,at any point of time, inform the details within three months to
district industries centre. Write/type in block (capital letters). Leave one blank box after each word. Fill
up whichever is applicable. All codes other than pin code shall be filled by the office. Form will be
machine numbered by the district industries centre.

The Kerala Industrial Single Window Clearance Board and Industrial


Township Area Development Act, 1999
Government of Kerala have enacted "The Kerala Industrial Single Window Clearance Board and Industrial
Township Area Development Act, 1999" to provide special provision for speedy issue of various licences, clearances, and certificates required for setting up of industrial undertakings in the State of Kerala and for the constitution of Industrial undertakings in the State of Kerala and for the constitution of Industrial Township Area Development Authorities and for matter connected therewith.

STATE BOARD
For the purpose of speedy issue of various licences, clearances, certificates required under various State enactments for setting up of industrial undertakings in the State, the Government, by notification, constituted Single
Window Clearances Board for the State.

POWERS AND FUNCTIONS


Every person intending to establish any industrial undertaking other than a small scale industrial undertaking in the
State, shall submit the application for clearances of licences or certificates required under various State enactments to the
Convener of the State Board in the prescribed form along with the required fee under the respective enactment. The State
Board shall after complying the procedure prescribed in this behalf and within forty-five days from the date of receipt of the
application take a decision as to recommend to the concerned authority for the issue of the licence or permission applied
for without any modification or with such modification as it thinks fit to make; or to refuse clearance if it is of the opinion that
the proposed construction, establishment or installation is objectionable.
The decision taken by the State Board shall be communicated to the applicant and the authority concerned by the
Convener of the State Board issuing of clearance, licences, certificates based on the recommendation. The authority
concerned shall, on receipt of the recommendation of the State Board, issue the clearances, licences or certificates applied
for in accordance with the recommendation of the State Board, within ten working days from the date of receipt of the
recommendations. If no clearance, licence or certificate, as the case may be issued within the said time limit the clearance,
licence or certificate, as the case may be recommended for by the State Board shall be deemed to have been issused after
the expiry of the said period of ten working days.
APPELLATE JURISDICTION OF THE GOVERNMENT
Any person aggrieved by the decision of the State Board, may appeal to the Government within thirty days from the
date of such decision by the State Board and the decision of the Government on such appeal shall be final
POWERS OF THE STATE BOARD TO REVOKE THE LICENCES(1) The State Board may suomotto at any time
examine the record of a District Board or an Industrial Area Board in respect of any proceedings under this Act and if the
State Board is satisfied that the clearance or certificate or licence under this Act has been obtained by misrepresentation
as to the essential facts, the State rnay, by order direct the authority concerned to revoke the licence or certificate or
clearance issued by them provided that the State Board shall not pass any order affecting any party unless such party has
had an opportunity of making a representation (2). If the State Board is satisfied either on a reference made to it in this
behalf or otherwise, that any person or authority to whom or to which the clearance or licence or certificate has been issued
under this Act failed to establish or to take effective steps to establish the industrial Undertaking in respect of which the
clearance or licence or certificate has been issued within the time specified therein or within such extended time as the
State Board may think fit to grant in any case, it may direct the authority concerned to revoke the licence or clearance or
certificate already granted (3) The provisions contained in the proviso to sub-section (1) shall apply in respect of any
proceedings under subsection (2) as they apply to a proceeding under sub-section (1)
DISTRICT BOARD
For the purpose of speedy issue of various licences, clearances or certificates required under the various State
enactments for setting up of small scale industrial undertakings having capital investment of more than two lakhs rupees in
each district of the State, the Government, by notification, constituted District Single Window Clearance Board for each
district in the State.
Members of the District Board
a. Collector of the District
b. General Manager, District Industries Centre of the District concerned
c. The President of the Grama Panchayat concerned or Chairperson of the Municipality concerned incases where
licence is required from the local bodies
d. The District Officer of the Kerala Pollution Control Board or any other officer of the Board nominated by the
Chairman, Kerala State Pollution Control Board.
e. The District Officer of the Electrical Inspectorate or any other officer nominated by the Chief Electrical Inspector.
f. The District Officer of the Town Planning Department or any other officer nominated by the Chief Town Planner.
g. District Medical Officer.
h: An officer of the Kerala State Electricity Board not below the rank of Executive Engineer nominated by the
Chairman, Kerala State Electricity Board.
i. District Fire Force Officer.
j. Divisional Forest Officer.
k. District Labour Officer.
I. Secretary, Urban Development Authority or Secretary District Panchayat.
m. Deputy Commissioner, Sales Tax and Agricultural Income Tax.
n. An Officer of the Kerala Water Authority not below the rank of Executive Engineer nominated by the Managing
Director, Kerala Water Authority.

Issuing of clearance, licences, certificates based on the recommendations


The authority concerned shall, on receipt of the recommendation of the District Board, issue the clearances,
licences or certificates applied for in accordance with the recommendations of the District Board, within ten working
days from the date of receipt of the recommendations. If no clearance, licence or certificate, as the case may be,
is issued within the said time limit the clearance, licence or certificate, as the case may be recommended for, by the
District Board shall be deemed to have been issued after the expiry of the said period of ten working days.

Units whose capital investment less than Rs. 2 lakhs


If the application for clearance, licence or certificate submitted before the Authority concerned for establishing
a Small Scale Industrial undertaking having capital investment less than rupees two lakhs is rejected or recommended with modification, the person aggrieved may file an appeal before the District Board against such order of
refusal or recommendation within thirty days from the date of receipt of order from the authority concerned in the
manner prescribed and such an appeal shall be disposed of within thirty days from the date of submission of the
appeal. A State Board would act as Appellate- Body over District Board.
APPELLATE BODY
Appellate jurisdiction of the State Board
1.
If the clearance or licence or certificate applied for before the District Board or Industrial Area Board has been
refused or recommended with modification, the aggrieved person may, within thirty days from the date of
receipt of such refusal or recommendation from the District Board or Industrial Area Board, file an appeal to
the State Board, against such order, in the manner prescribed.
2.
The State Board may, if it is considered necessary, call for additional details and on production of such details
and after giving an opportunity of being heard to the aggrieved person and the authority concerned, shall
dispose of such appeal within a period of thirty days from the date of filing the appeal. The decision of the
State Board on such appeal shall be final.
3.
The State Board may, with the previous approval of the Government, delegate to any Sub-Committee constituted by it, such of its powers and functions under this section subject to such restrictions and conditions if
any, as it may specify.
4.
The composition of the Sub-Committee shall be such as may be prescribed.
5.
Not withstanding anything contained in any law for the time being in force any licence, clearance or certificate
granted on the basis of a decision under the section by the State Board or a Sub-committee of the State
Board shall be deemed to be issued under the respective Statute.

Appellate jurisdiction of the Government: Any person aggrieved by the decision of the State Board other than
on matters decided by it on appeal under section II over the decision of the District Board or Industrial Area Board, as the
case may be, may appeal to the Government within thrity days from the date of such decision by the State board and the
decision of the Government on such appeal shall be final.

APPEALS
The Green Channel Clearance Committee (GCCC) of the district shall be the statutory Appellate Authority to review
the decisions taken by the Grama Panchayats and the decision of the GCCC shall be binding upon the Grama Panchayat.

(iii) Distance from structure 3 metres on all sides (from existing 7.5, 3, and 7.5 m)
Govt. also order that no permission is required for converting land from cultivation of food crops into areas for industrial use.
It is also ordered that the relaxation in Kerala Land Utilization Order will be applicable to factories as well as house plots.

ENTREPRENEUR SUPPORT SCHEME (ESS)


Definition and explanation
(i) Entrepreneur: A person who has filed Entrepreneur Memorandum as per MSMED Act 2006 and has taken effective steps to set
up an industrial unit. (effective steps means purchase of land, apply for bank loan, placing orders for purchase of machinery or
other demonstrable event in the life cycle of an industry)
(ii) Women enterprise: An enterprise in which at least 50% of the promoters are women.
(iii) Young entrepreneur: An entrepreneur between the age of 18 and 45. In case of more than one promoter, all the promoters shall
be between the age of 18 and 45. At the time of filing application for assistance under Entrepreneur Support Scheme, the
entrepreneur (s) should have attained 18 years of age as on the 1st April of the concerned financial year and should not have attained
46 years of age as on the 1st April of the concerned financial year.
(iv) Scheduled Caste and Scheduled Tribe entrepreneur: In case of more than one promoter, at least 50 % of the promoters shall
be SC/ST.
(v) Pucca building: Buildings used exclusively for industrial purpose; designed to be solid and permanent; built of substantial material
such as stone, brick, cement, concrete with RCC roof.
(vi)Semi pucca building: Buildings built without substantial material such as stone, brick, cement, concrete and without RCC roof.
In some such cases the building roof will be on four pillars without side walls.
(vii) Non-conventional energy: Non-conventional sources of energy comprise those energy sources that are natural, inexhaustible as
well as renewable viz. wind, tidal, solar, geo-thermal heat, biomass including farm and animal waste. (Hydro, coal, mineral oil,
natural gas etc are conventional energy sources).
(viii) New Technology: Technology developed and transferred by recognized institutions.
(ix) Recommending Authority: Kerala Financial Corporation in case of units financed by KFC and Kerala State Industrial Development
Corporation in case of units financed by KSIDC. In all other cases, the recommending authority shall be the respective General
Manager, District Industries Centres. The recommending authority shall accept applications, receive due application fees, process
the applications, place them before the sanctioning authority and disburse the assistance.
(x) Sanctioning authority: General Manager, District Industries Centres in case of assistance for Startup support. The District Level
Committees in case of Technology Support and the District/State Level Committees in case of Investment Support.
(xi) Bio degradable plastic: Plastics that will decompose in natural aerobic (composting) and anaerobic (landfill) environments.
(xii) Plastic waste recycling: Process of recovering scrap or waste plastic and reprocessing the material into useful products
sometimes completely different in form from their original state.
(xiii)Bio fertilisers: A substance which contains living microorganisms which, enrich soil fertility and fulfill plant nutrient requirements
by supplying the organic nutrients through microorganism and their by products.
Eligibility for applicants
1.All Micro, Small and Medium Enterprises engaged in manufacturing activities and set up in the State, which had filed Entrepreneurs
Memorandum Part I/II with the respective General Manager, District Industries Centre shall be eligible for this assistance.
Entitlement of a successful applicant
2. Entitlement in the scheme shall be limited to an amount of Rs. 30.00 (Thirty) lakhs per applicant unit to be availed only once. The
upper limit of Rs. 30.00 (Thirty) lakhs shall be enhanced by 5% per annum during the period of operation of the scheme to address
the escalation of costs. Subject to this maximum limit the assistance shall be limited to the fixed percentage of the composite
investment upon : (a) land, (b) land development costs, (c) building and improvement charges on existing building, (d) essential
office infrastructure, (e) fixed cost of plant and machinery, (f) electrification, (g) generators and associated equipment e.g. invertors
All testing and pollution control equipments shall also be eligible for computing the composite investment cost. Working capital and
recurring costs shall not be eligible.
3. Out of all eligible applicants, 30% of the earmarked assistance shall be reserved for micro enterprises. small and medium enterprises
shall be considered only in case of insufficiency of qualified applicants in the micro category, .
4. An assistance of 15% limited to Rs. 20.00 (Twenty) lakhs will be payable on the fixed capital investment of all micro, small and
medium enterprises set up in the State except those mentioned in paras 9 and 10.

5. All micro, small and medium enterprises established by entrepreneurs belonging to Women, Scheduled Castes and Scheduled
Tribes and Young entrepreneurs shall be eligible for an assistance of 20% of the fixed capital investment limited to Rs. 30.00
(Thirty) lakhs.
6. An additional assistance of 10% of the fixed capital investment subject to a ceiling of Rs. 10.00 (Ten) lakhs shall be eligible to the
priority industries such as:
a) Rubber based industries, b) Agro based and food processing industries, c) Readymade Garments, d) Industries manufacturing
equipments and machinery for Non-conventional energy generation, e) Bio Technology based industries, f) 100% Export Oriented
Units, g) Bio degradable plastic industries, h) Plastic waste recycling industries, i) Bio fertiliser industries
7. An additional assistance of 10% of the fixed capital investment subject to a ceiling of Rs. 10.00 (Ten) lakhs to all micro, small and
medium enterprises set up in the districts of Idukki, Wayanad, Kasaragode and Pathanamthitta.
8. An additional assistance of 10% of the fixed capital investment subject to a ceiling of Rs. 10.00 (Ten) lakhs to micro, small and
medium enterprises set up after acquiring new technology from approved research institutions, recognized as such by State or
Central Government.
9. Assistance to any unit which has already received any subsidy or grant earlier under other schemes, from other Government
Agencies, any State owned financial institution shall be limited to the balance remaining eligible assistance payable under the
Entrepreneur Support Scheme. For eg. any unit which has availed assistance from MPEDA, Spices Board, Rubber Board, local
bodies, etc. will be eligible for assistance limited to the balance remaining eligible assistance payable under the Entrepreneur
Support Scheme. However an industrial unit which availed Margin Money Loan from Industries Department is eligible for assistance
under Entrepreneur Support Scheme. In case the unit had availed start up support earlier, only the balance remaining eligible
assistance will be admitted to the unit.
10. The industries included in the Negative List and notified as such from time to time, Government controlled industries, public sector
undertakings, units started by Government controlled agencies, units financed by KVIC/KVIB etc. shall not be eligible for any
assistance under these rules.
Powers and Services offered by the sanctioning authority
11. District Level Committee:- Cases involving eligible fixed capital investment up to Rs. 200.00 (Two hundred) lakhs only will be
considered and sanctioned by District Level Committee.
12. State Level Committee:- Cases involving eligible fixed capital investment above Rs. 200.00 (Two hundred) lakhs only will be
considered and sanctioned by State Level Committee. In the case of State Level and District Level Committees the quorum of the
Committee shall be four.
13. It shall be the duty of the District Level Committee to notify schemes at the commencement of the financial year through press release/
advertisement and accept applications year round. The applications received in each calendar month directly in paper and electronically
will be processed electronically within the same quarter and placed before the District Level Committee to be convened every month.
14.The recommending authority shall provide facility to receive the application and application fee of Rs. 1,000.00 (One thousand) (Rs.
500/- for Sc/ST) per application either directly or electronically and issue receipt for the same. The Director of Industries & Commerce
shall be competent to enhance the fee from time to time not exceeding 10% at a time.
15. The recommending authority shall post the information regarding each individual applicant and inform the outcome of the application
directly or electronically at the end of the quarter. The decision of sanctioning authority shall be intimated to the party electronically
within 24 hours and disburse the eligible assistance via the bank account of the applicant unit within 48 hours of the sanctioning and
execution of the requisite agreement. In case the sanctioned amount is not disbursed within the stipulated time, then the recommending
authority shall obtain the approval of the next higher authority.
Obligations of the applicant entrepreneurs
16. The applicant shall provide all required details and declare such information as to be true.
17. The applicant shall pay the requisite application fee as stated in para 14.
18. The applicant shall provide clarifications or further details sought by the recommending/sanctioning authority.
19. The applicant shall allow inspection or verification of any details mentioned in the application including plant and machinery and all
other assets if so required by the recommending/sanctioning authority.
20. The applicant shall produce originals of any important documents if so required by the recommending/sanctioning authority for
verification.

21. The applicant shall execute requisite legal agreement online and if required on paper as and when the proposal is approved for
implementation and furnish the signed hard copy subsequently via post or otherwise.
22.The applicant shall utilise the amount received only in the manner agreed upon.
23. The applicant shall operate the unit as stipulated in the agreement in which the quantum of support received failing which the
assistance shall be resumed by restoring the provisions of Kerala Revenue Recovery Act.
24. The applicant unit after availing the assistance shall furnish copies of balance sheets, valid license from local body, electricity bills,
performance particulars in the prescribed proforma etc every year till the stipulated period before the 31st December of the next
financial year, as proof of their functioning to the notified authority.
Elements of Fixed Capital Investments
25. Land in the name of the unit, possessed and enjoyed by them evidenced by title deeds and considered essential to the running of
the unit by the recommending authority shall be admitted for assistance. Land in the name of the proprietor/partner or partners/
Director or Directors of the unit will also be considered for assistance as that of land in the name of unit, provided it is capitalised
in the books and accounts of the unit. The stipulation of capitalisation in the books and accounts can be relaxed in the case of
proprietorship units. The purchase costs (including stamp duty and registration charges) as per the deed or fair value of land
whichever is lower shall be taken as the value of land. In the case of land on lease for atleast 10 years the lease value of land limited
to 20% of the fair value of the land shall be admitted.
26. Land development costs such as filling charges and leveling charges shall be eligible for assistance upon certification by a Civil
Engineer not below the rank of an Assistant Executive Engineer of Government Department (Industries, PWD, LSGD, Irrigation,
etc) or a Chartered Engineer, Institution of Engineers India/Approved Valuer of Institution of Valuers, India. The investment in land
development admitted for assistance shall be limited to a maximum of 25% of the value of land admitted or valuation of the
Engineer, whichever is lower. Cases in which land is not admitted/eligible for assistance, Land Development Costs are not
admissible.
27. Building essentially required by the unit including improvements in the existing structure and situated in free hold land in the name
of the unit or in the name of the proprietor, Partner/Partners, Director/Directors of the unit, if it is capitalised in the Books and Accounts
of the unit or in land on registered hire purchase or on lease to the unit for at least ten years shall be eligible for assistance subject to
a cost ceiling per plinth area to be notified by the Director of Industries & Commerce from time to time. Building on land acquired on
lease, where the lease deed for land has been executed/registered after the date of commencement of commercial production can also
be considered for assistance, provided the period of lease of land in which the building under consideration is located is at least for
10 years. The plan, estimate and valuation shall be certified by a Civil Engineer not below the rank of an Assistant Executive
Engineer of Government Department (Industries, PWD, LSGD, Irrigation, etc) or a Chartered Engineer, Institution of Engineers India/
Approved Valuer of Institution of Valuers, India. Any civil structure not essentially related to production process shall not be eligible
for assistance. However, civil construction for pump house, generator room, canteen, toilets, compound walls etc. whichever is
necessary for production process, directly or indirectly, shall be eligible.
28. All brand new identifiable items of essential office equipments viz. Air conditioner, fax, telephone, over head projector, computers,
office furniture etc can be considered provided these costs are evidenced by invoices, proof of payments and a valuation certificate
of a Mechanical Engineer not below the rank of an Assistant Executive Engineer of Government Department (Industries, PWD,
LSGD, Irrigation, etc) or a Chartered Engineer, Institution of Engineers India/Approved Valuer of Institution of Valuers, India.
29. The investment in Land, Land Development Costs, Building and Essential Office Equipments shall be limited to 50%
of the total fixed capital investment.
30. All brand new identifiable items of plant and machinery including tools, jigs, moulds as well as material handling equipments shall be
eligible for assistance. Fabricated machinery shall be supported by a valuation certificate of a Mechanical Engineer not below the
rank of an Assistant Executive Engineer of Government Department (Industries, PWD, LSGD, Irrigation, etc) or a Chartered
Engineer, Institution of Engineers India/Approved Valuer of Institution of Valuers, India. Plant and machinery on hire purchase from
National Small Industries Corporation shall be eligible for assistance on the basis of original value. Generator sets, other energy
generating equipments shall also be considered as part of machinery for the purpose of computing the investment for assistance.
No commercial or private vehicles, second hand machinery, crates, pallets and consumables, stores and items not directly involved
in production process will be eligible for assistance.
31. All testing equipments will be eligible for assistance at the rates specified for each category as mentioned in paras 5 & 6 if supported
by a valuation certificate by a Mechanical Engineer not below the rank of an Assistant Executive Engineer of Government

Department (Industries, PWD, LSGD, Irrigation, etc) or a Chartered Engineer, Institution of Engineers India/Approved Valuer of
Institution of Valuers, India. Claim on this account can be considered independently without having to be a part of new, expansion,
diversification and modernisation project. In any case the total eligible assistance including the assistance for testing equipments
shall not exceed the maximum ceiling eligible specified for each category.
32. All pollution control devices supported by consent letter of Kerala State Pollution Control Board and valuation certificate by a
Mechanical Engineer not below the rank of an Assistant Executive Engineer of Government Department (Industries, PWD,
LSGD, Irrigation, etc) or a Chartered Engineer, Institution of Engineers India/Approved Valuer of Institution of Valuers, India shall
be eligible for assistance at the rates specified for each category as mentioned in paras 5 & 6. Claim on this account can be
considered independently without having to be a part of new, expansion, diversification and modernisation project. In any case the
total eligible assistance including the assistance for pollution control devices shall not exceed the maximum ceiling eligible
specified for each category.
33. Power connection costs to KSEB except security/caution deposit, transformer costs and costs of Industrial wiring including that
for Generator Set will be eligible for assistance. These costs should be evidenced by invoices, proof of payments, and where
industrial wiring costs and electrification exceeds Rs. 50,000.00 (Fifty thousand) by a certificate of valuation from an Electrical
Engineer not below the rank of an Assistant Executive Engineer, Electrical Inspectorate/Kerala State Electricity Board or
Chartered Engineer, Institution of Engineers India/Approved Valuer of Institution of Valuers, India. Power connection costs to
KSEB, paid in instalments shall be eligible in toto upon certification.
34. All investments on recycling of water, waste and rain harvesting if utilised for industrial purpose shall be admitted for assistance
if evidenced by invoices, proof of payment and a valuation certificate by a Civil or Mechanical Engineer not below the rank of an
Assistant Executive Engineer of Government Department (Industries, PWD, LSGD, Irrigation, etc) or a Chartered Engineer,
Institution of Engineers India/Approved Valuer of Institution of Valuers.
35. In case the total fixed capital investments claimed is less than Rs. 1.00 (One) lakhs, a valuation certificate from an Officer of
Industries Department not below the rank of an Industries Extension Officer is sufficient. Transportation and erection charges
shall not be taken for the purpose of computing assistance.
General provisions
36. Release of Assistance: The 1st stage is named Startup Support, 2nd stage the Investment Support and the 3rd stage, the
Technology Support. The Startup support is provided for enterprises prior to commencement of commercial production; Investment
Support after the commencement of commercial production and Technology Support after commencing production on acquiring
new technology.
37. All applications for assistance under Entrepreneur Support Scheme shall be submitted online by the applicant through the
designated website of Industries Department and produce the originals along with details of acknowledgement received at the time
of filing online, before the Recommending Authority.
38. The Officer while accepting the application form should examine whether all necessary details have been furnished. If any
information is found inadequate, the same should be intimated to the applicant unit both electronically and otherwise and grant 10
days time to rectify the defects.
39. A Committee shall be constituted in all offices of the Recommending Authorities who shall monitor all units which avail
assistances under this Scheme to verify whether they satisfy the provisions of this Manual. Any verification of the utilisation of
the assistance granted may preferably be made through the financial institution which financed the applicant unit. A unit which
avails assistance under this Scheme shall also be under the obligation to furnish copies of balance sheets, valid license from local
body, electricity bills, performance particulars in the prescribed proforma etc every year till the stipulated period before the 31st
December of the next financial year, as proof of their functioning.
40. Any dues on any account of the unit to Government/agency of Government shall be adjusted from the amount sanctioned as
eligible assistance to any unit before disbursement of the assistance. Government in the Industries Department will have powers
to relax this condition with the concurrence of Finance Department in exceptional cases for the reasons reported by the Director
of Industries & Commerce.
41. The disbursement of the sanctioned assistance to the unit shall be by electronic transfer to the bank account of the unit. The
Director of Industries and Commerce shall open an account in a nationalised/scheduled/private/any other bank into which the

funds earmarked for ESS for the financial year shall be parked. Each recommending authority shall open a similar bank account with
the prior approval of Director of Industries & Commerce. Based on the request of the recommending authority funds will be transferred
on a quarterly basis to the bank accounts of the recommending authority. The recommending authority shall disburse the assistance
to the entrepreneurs from their bank account to the bank account of the enterprise, based strictly on their seniority. Each recommending
authority shall furnish an Utilisation Certificate towards the fund received on a quarterly basis to the Director of Industries &
Commerce.
42. Startup Support: In case of all entrepreneurs who have been sanctioned Term Loan by any Financial Institution against a definite
Project Report recommended and forwarded by Industries Department and approved by the Financial Institution, for setting up an
industrial unit, the eligible assistance at the rates specified for each category as mentioned in paras 5 to 8 above shall be released to
the entrepreneur subject to the following conditions:(i) The assistance shall be limited to 50% of the eligible assistance under each category
(ii) The maximum startup support shall be limited to Rs. 3.00 (Three) lakhs.
43. An entrepreneur who intends to avail the startup support shall apply in duplicate before the General Manager, District Industries
Centre in the prescribed application form with the necessary documents and copy of the Project Report. The General Manager shall
thereafter within 15 working days prepare a Technical Feasibility Report of the Project and forward the same to the concerned financial
institution for sanction of eligible Term Loan. After sanctioning the Term Loan, the financial institution may furnish their recommendation
in the prescribed format along with attested copies of the Sanction Letter.
44. The General Manager, District Industries Centre shall have full powers for sanctioning startup support. Sanction of the startup support
shall be in the prescribed format. An agreement in the prescribed format shall be got executed on stamp paper worth Rs. 100/- by the
competent authority representing the unit before the payment effected in favour of the unit. All claims shall be disposed of within 15
days from the date of receipt of completed application failing which a penalty shall be paid to the applicant unit.
45. Startup support can be disbursed to the unit only through the financing institution concerned. The Bank/financing institution shall
disburse the amount to the unit on a pro-rata basis along with the disbursement of term loan. The financial institution shall adjust the
start up support against the Principal amount of the Term Loan only.
46. In case of any reduction and refixation of the loan/Fixed Capital Investment, proportionate reduction shall be made on the assistance
and balance unspent amount, if any, shall be returned to the General Manager, District Industries Centre forthwith by the bank/
financing institution. However, the unit shall be liable to pay the interest for the amount so returned by the financial institution till it
reaches the General Manager, District Industries Centre. In any case the Bank/financing institution shall complete disbursement of
the Term Loan and the startup support amount released to them by the General Manager, District Industries Centre within one year
from the date of its receipt.
47. Entrepreneurs who receive the startup support will be under obligation to commence commercial production of the unit within one year
from the date of receipt of startup support and remain continuously working for five years from the date of commencement of commercial
production. Any delay in commencing commercial production after the stipulated one year period, shall be intimated to the concerned
General Manager, District Industries Centre in writing by the unit within one month prior to the lapse of the stipulated one year period.
The maximum period of extension that can be allowed by the General Manager, District Industries Centre shall only be three months.
48. No collateral security or charge on assets of the unit during the pendency of loan by the unit to financial institutions or banks is required
for this assistance. But Government shall have a charge on the industrial assets of the unit, once the assistance is released. The
financing institution will advise the General Manager, DIC concerned in writing of their intention of releasing the charges created in their
favour in case of full repayment or of taking over the unit in case of default so as to ensure that the assets are not disposed off without
the knowledge of the Department if the action proposed is within the stipulated five year period.
49. Investment Support: All enterprises shall apply for investment support within one year of commencement of commercial production.
The District Level committee and State Level Committee shall however be competent to condone delays in individual cases on merits.
The District Level Committee may condone delays only up to a period of two years.
50. All applications shall be made to the respective recommending authority only after starting commercial production. All eligible investments
as on date of application for assistance can be admitted for investment support provided the same is envisaged in the original Detailed
Project Report irrespective of the date of commencement of commercial production.
51. Enterprises undertaking expansion, diversification and modernisation shall also be eligible for investment support at the revised rates
applicable to each sector. In the case of modernisation, the eligible fixed capital investment for support shall be fixed after deducting
the higher of written down value or sale value of the scrapped items. In computing the ceiling the investment support given to the unit,

the time it commenced production as a new unit and the course of its expansion etc. including under Central/State Investment
Subsidy Scheme shall be considered.
52. Expansion, diversification to be eligible for investment support should be different from routing replacement. Modernisation refers
to replacement of existing machinery with new machinery partially or fully with the same make or with different make. The
expansion, diversification and modernisation should have been carried out as per a definite project report, over a predefined period
of time. While expansion, diversification and modernization must result in at least 25% increase in plant and machinery in Gross
Block terms, expansion must also result in at least 25% increase in installed capacity.
53. Eligible investment support at the rates mentioned in paras 5 to 8 above, shall be sanctioned to the unit by the District/State Level
Committee after deducting the assistances if any, availed. However, the applicant unit shall be given an opportunity of being heard
under proper notice, before a decision is taken by the Committee. All claims shall be disposed of within three months from the date
of receipt of completed application failing which a penalty shall be paid to the applicant unit.
54. Investment support shall be disbursed through the financing institution which has financed the unit. If there are more than one such
financing institution the amount shall be credited to the term loan lending institution.
55. Industrial units which receive the investment support will be under obligation to remain working continuously for five years from
the date of commencement of commercial production. However, it is necessary that a unit shall be a working one as on date of
release of the assistance. Closed down units are not eligible for this assistance.
56. Technology Support:- All industrial units shall apply for Technology support within six months from the date of commencement
of commercial production after installing the new technology. The District Level committee shall however be competent to
condone delays in individual cases on merits. The technology support can be claimed by new units or existing units without being
a part of the diversification/expansion/modernization programme. The assistance shall be payable for acquiring new technology
at the rates mentioned in para 8 above.
57. The application for technology support shall be filed before the Recommending Authority along with copies of invoices of the
machinery acquired in this regard with proofs of payment from the research institutions owned or controlled by Government such
as CFTRI, CSIR, DFRL, DRDO, Rubber Board, CTCRI, ICAR, KVK etc. supported with proof towards the payment of
consultancy charges, valuation certificate of a Mechanical Engineer not below the rank of an Assistant Executive Engineer of
Government Department (Industries, PWD, LSGD, Irrigation, etc) or a Chartered Engineer, Institution of Engineers India/
Approved Valuer of Institution of Valuers, India and certificate from the research institutions that the technology is new.
Government Engineering Colleges approved by AICTE, institutions under the Council of Science &Technology, universities etc
which has Research & Development facilities and which develops technologies for industry shall also be considered as research
institutions for the purpose of the Technology Support.
58. Plant & Machinery for technology upgradation, improvement in packaging, energy conservation and consultancy/technology
transfer costs etc shall be considered for this assistance.
59. The Recommending Authority shall place the application before the District Level Committee for Entrepreneur Support Scheme as
mentioned in para 11, for sanctioning technology support. However, the applicant unit shall be given an opportunity of being heard
under proper intimation, before a decision is taken by the Committee. All claims shall be disposed of within one month from the date
of receipt of completed application failing which a penalty shall be paid to the applicant unit. Sanction of the technology support shall
be in the prescribed format. An agreement in the prescribed format shall be got executed on stamp paper worth Rs. 100/- by the
competent authority representing the unit before the payment is effected in favour of the unit.
60. Entrepreneurs who receive the technology support will be under obligation to remain continuously working for five years from the
date of commencement of commercial production after installing the new technology.
Appeals
61. The State Level Committee for Entrepreneur Support Scheme is competent to dispose the appeals, if any, received in the prescribed
format against the orders of the District/State Level Committee in case of Investment/Technology Support and even competent to
reconsider the decision of the State Level Committee. The State Level Committee is also competent to issue clarifications wherever
necessary in respect of Entrepreneur Support Scheme. In case of appeals against the orders of the General Manager, District
Industries Centres with regard to startup support the District Level Committee shall be competent to dispose the same.

62. The Appeals referred in para 61 above shall be filed within 90 days from the date of issue of orders of the General Manager, DIC/
District Level Committee/State Level Committee as the case may be and sent to the Member Secretary of the District/State
Level Committee concerned. No appeal after this period will be entertained. The Member Secretary shall place the case before
the Committee after getting the views of the recommending authority, if found necessary. The appeal shall be disposed of, as
far as possible, within three months from the date of receipt of appeal after giving the appellant an opportunity of being heard,
wherever necessary.
Expenses
63. An amount of 2% of the budget allocation under the scheme shall be earmarked and made available for disposal with the Director
of Industries & Commerce for allotting to the District/State Level Committees towards administrative expenses and advertisement
and publicity costs. The expenses can be met for the purpose of canvassing applicants, hiring of vehicles, associated telephone
charges, printing and publishing publicity materials, light refreshments for investor meets.
64. The fees being collected by the recommending authorities as application fees from the applicant unit may also be utilised for both
administrative expenses and advertisement costs. However recommending authority/ Committees shall furnish expenditure
particulars to the Director of Industries every quarter and also publish the same in the website.
Recoveries and Penalties
65. Any assistance viz. startup, investment or technology support to an industrial unit is liable to be refunded by the unit with interest
at the rate of 14% per annum from the date of receipt of the same, on issue of registered demand notice to the unit by the
Recommending/Sanctioning authority on grounds of obtaining assistance by misrepresentation, forgery or deception or not
found working continuously for five years from its commercial production or in case of units which availed startup support, if the
unit is not found to have commenced its commercial production within one year after receipt of assistance. All amounts due to
Government under this provision shall, in case of default, be recoverable as if they are arrears of land revenue under the
provisions of the Kerala Revenue Recovery Act, 1968 or in such other manner as Government may deem fit. Sufficient
opportunity to show cause in writing shall however be granted to the units before a demand is raised against it.
66. If an authorised officer of the Recommending/Sanctioning authority is found to have delayed processing of application or
disbursing of claim on approved cases deliberately, the Director of Industries & Commerce shall be competent to levy and
recover a fine of Rs. 500.00 (Five hundred) per day for each day of such delay determined subject to a maximum of Rs. 10,000.00
(Ten thousand) from the salary of the delinquent and award it as cost to the applicant unit. An opportunity of hearing shall be given
to the officer concerned before such damages are realised. This shall not count as disciplinary action under Kerala Civil Services
(Classification, Control & Appeal) Rules, 1960 etc.

TRAINING PROGRAMME
Training Programmes in the various aspects of management of industry (Entrepreneur Development Programme
- E.D.P.) as well as inplant training and job oriented training are arranged periodically by the Department. E.D.P.
Training is arranged in collaboration with other institutions like the Centre for Management Development, K.F.C.,
I.D.B.I. etc. Stationery and course materials are provided free of cost in the case of inplant training, E.D.P. as well as
Job-Oriented training. SC/ST candidates are paid stipend.

INCENTIVE FOR BAR-CODING


Financial assistance to Small Scale Industries for Registration for barcoding under Market Development Assistance
Schemes. (SSI-MDA) Letter No. (10 (6) 2000-EP&M dt. 16-02-2003 of DC (SSI)
All the categories of SSI units which have adopted Bar-Code on or after 1st January, 2003 are now eligible to get the
financial assistance of Rs. 15,000/- (75% of the registration fee of Rs. 20,000/- paid to EAN India). It is also further
clarified that those units which have adopted bar-code before 1--2003 will continued to be reimbursed the old
registration fee as was applicable to SSI/Tiny units earlier. For getting the incentive, the small enterprises should adopt
bar coding registration by registering with GSI-502-503

Margin Money Loan Scheme to Entrepreneurs in the Coir Sector


(G.O. MS. No. 76/2002/ID Industries (E) Department, Thiruvananthapuram, dated 25-07-2002).
With effect from 25-7-2002, The Director of Coir Development, Trivandrum is implementing a new scheme called

Margin Money Loan to entrepreneurs in the Coir Sector with the following objectives. The main objective of the scheme is
to attract the Private entrepreneurs to setup units for the manufacturing of value added Coir Products in the State. The
scheme is also envisaged to extend Margin Money assistance to the small scale entrepreneurs who are already running
coir products manufacturing unit for its expansion, diversification and modernisation. A registration fee of Rs. 500 is
prescribed. The promotor will have to take a minimum of 10% of the cost of the project and working capital loan. Margin
money loan shall not exceed 50% of the margin stipulated by the financing institution either for term loan or working capital
Loan. The maximum limit of margin money loan under term loan and working capital put together is Rs. 2.5 lakhs.

Seed capital loans to Entrepreneurs for setting up of New Handloom / Powerloom Unit
The entrepreneurs having technical qualification such as Diploma in Handloom Technology / Diploma in Textile Technology etc. will be given preference for assistance under this scheme. Entrepreneurs will be provided seed capital loan up to
Rs.2.5 lakhs subject to a maximum of 25% of the Project cost, which ever is less. The Promoter will have to take a minimum
of 10% of the Project cost and the remaining portion of the project cost may be raised as loan from financial institution. (GO.
MS No. 8/2003/ID dt. 8-1-03).

Margin Money Grant to Existing / Traditional Weavers for setting up New Powerloom Units
Weavers intending to set up new powerloom units with the financial assistance of NBCFDC NSFDC NMDFC through the
concerned channelising agency will be Provided margin money grant @ 25% of cost of new automatic / semi automatic
powerlooms and accessories, limited to maximum Rs. 50,000/- per loom. The weavers shall invest at least 5% of the cost
of the project as promoters contribution. The seed capital loan assistance will be provided @ 25% of the total working
capital requirements subject to a maximum of Rs. 2 lakhs.
LIMIT OF COLLATERAL FREE LOAN
The limit for collateral free loans to the MSE sector be increased from the present level of Rs. 5 lakh to Rs.10 lakh (Ref :
RBI/2009-10/449 RPCD.SME & NFS. BC.No. 79 /06.02.31/2009-10 dt. 06-05-2010 banks are mandated not to accept
collateral security in the case of loans upto Rs 10 lakh extended to units in the MSE sector.)

CREDIT GUARANTEE FUND TRUST FOR MICRO AND SMALL ENTERPRISES (CGTMSE)
Credit Guarantee
Any collateral / third party guarantee free credit facility (both fund as well as non fund based) extended by eligible
institutions, to new as well as existing Micro and Small Enterprise, including Service Enterprises, with a maximum credit cap
of Rs.100 lakh (Rupees Hundred lakh only) are eligible to be covered.
The guarantee cover available under the scheme is to the extent of 75% / 80% of the sanctioned amount of the credit facility,
with a maximum guarantee cap of Rs.62.50 lakh / Rs. 65 lakh. The extent of guarantee cover is 85% for micro enterprises
for credit up to Rs.5 lakh.
The extent of guarantee cover is 80%(i) Micro and Small Enterprises operated and/or owned by women; and (ii) all credits/
loans in the North East Region (NER). In case of default, Trust settles the claim up to 75% (or 80%) of the amount in default
of the credit facility extended by the lending institution.
The lender should cover the eligible credit facilities as soon as they are sanctioned. In any case, the lender should apply
for guarantee cover in respect of eligible credits sanctioned in one calendar quarter latest by end of subsequent calendar
quarter. Guarantee will commence from the date of payment of guarantee fee and shall run through the agreed tenure of the
term credit in case of term loans / composite loans and for a period of 5 years where working capital facilities alone are
extended to borrowers, or for such period as may be specified by the Guarantee Trust in this behalf.
Rehabilitation assistance
For the unit covered under CGTMSE and becoming sick due to factors beyond the control of management, assistance for
rehabilitation extended by the lender could also be covered under the scheme provided the overall assistance is within
the credit cap of Rs.100 lakh.

dream of setting up units of their own.
Yellow colour around flame indicates source of energy given by the Trust to the entrepreneurs for setting up units in the
MSE sector without having to worry about providing collateral security and / or third party guarantees.
The blue triangular shape resting on the word CGTMSE indicates the shed of an industrial unit and growth of MSEs in
upward direction.
Availability of bank credit without the hassles of collaterals/third party guarantees would be a major source of support to the
first generation entrepreneurs to realize their dream of setting up a unit of their own in the Small Scale sector. Keeping this
objective in view, Government of India, in the Ministry of SSI, launched Credit Guarantee Scheme so as to strengthen credit
delivery system. To operationalise the scheme, Credit Guarantee Fund Trust for Micro and Small Industries was set up by
GOI and SIDBI.
The lender should give importance to project viability and secure his loan purely on the primary security of the assests
financed. The other objective is that the lender availing guarantee facility should endeavour to give composite loans to the
borrowers so that both term loan and working capital facilities are obtained by the borrowers from a single agency. The
Guarantee scheme seeks to assure the lender that, in the event of an SSI unit, which availed collateral free credit facilities,
failing to discharge its liabilities to the lender, the Guarantee Trust would make good the loss incurred by the lender up to
80 per cent of the credit facility.
Guarantee fee
For credit facility upto Rs.5 lakh, an upfront Guarantee Fee (GF) of 1% of the amount sanctioned will have to be paid to the
Trust by the MLI. For amounts sanctioned beyond Rs.5 lakh and upto Rs.100 lakh, the GF is 1.5%, while for credit
facility upto Rs. 50 lakh for units in the North Eastern Region including Sikkim , the GF is 0.75% . The GF will have
to be paid within 30 days from the date of first disbursement of credit facility by the MLI to a borrower.
Annual service fee
Guarantee cover extended by CGTMSE in respect of any specific borrower shall be valid provided the MLI concerned pays
an Annual Service Fee (ASF) of 0.50% on the amount guaranteed for credit facilities upto Rs.5 lakh and 0.75% on the
amount guaranteed for credit facilities beyond Rs.5 lakh and upto Rs.100 lakh. Such ASF is to be paid by the MLI on or
before 31st May of that year. The Trust reserves the right to revise the guarantee fee / annual service fee from time to time.
Cost to the borrower
The Credit Guarantee Scheme leaves it to the discretion of the MLIs to decide about passing on the incidence of Guarantee
Fee and Annual Service Fee to the borrower or alternatively they may decide to bear it themselves.
Interest rate payable by borrower
The MLI shall follow the guidelines issued by RBI. However, interest rate shall not exceed 3 per cent over and above the
Prime Lending Rate of the MLI, excluding the annual service fee
C. Commencement of guarantee cover
The guarantee cover will commence from the date of payment of guarantee fee and shall run through the agreed
tenure of the term credit in respect of term credit/composite credit. Where working capital loan is extended to the
eligible borrower, the guarantee cover shall be for a period of 5 years or a block of 5 years, or for such period as
may be specified by the Trust in this behalf.
D. Eligible Institutions
The institutions which are eligible under the scheme, are scheduled commercial banks, including Public Sector
Banks, Private Sector Banks, Foreign Banks and selected Regional Rural Banks (which have been classified under
`Sustainable Viability' category by NABARD). National Small Industries Corporation Ltd. (NSIC), North Eastern
Development Finance Corporation Ltd. (NEDFC), and Small Industries Development Bank of India have also been
made eligible institutions. As on July 31, 2005 there were 50 Member Lending Institutions (MLIs) of the Trust,
comprising 27 Public Sector Banks, 10 Private Sector banks, 10 Regional Rural Banks and 3 other institutions viz.,
NSIC, NEDFC and SIDBI.

FOOD PROCESSING INDUSTRIES
Central scheme for technology upgradation / establishment / modernization of food processing industries

This Scheme will cover the following activities:


Setting up/expansion/modernisation of food processing industries covering all segments viz. fruits & vegetable, milk
products, meat, poultry, fishery, cereal, pulses, oil seeds and such other agri-horticultural sectors leading to value addition
and shelf life enhancement including food flavours and colours, oleoresins, spices, coconut, mushroom, hops etc. Objective

is to increase the level of processing, reduction of wastage, value addition, enhance the income of farmers as well as
increase exports, thereby resulting in overall economic development.
ELIGIBILITY & PATTERN OF ASSISTANCE:
All implementing agencies engaged in setting up/expansion/modernization of food processing industries covering all
segments would be eligible for financial assistance.
The assistance will be in the form of grant subject to 25% of the plant & machinery and technical civil works subject to a
maximum of Rs.50 lakhs in General Areas and 33.33% up to Rs.75 lakhs in Difficult Areas. Financial assistance to rice mills,
flour mills and pulse processing units will not be available with effect from 01.04.2002. Applications submitted to SNA(State
Nodal Agency) after commencement of commercial production will not be eligible for financial assistance. Financial
assistance for setting up/upgradation of projects relating to soft drinks/aerated water/mineral water including natural spring
water would not be available with effect from 06.2.2004. All pulse milling units would be eligible for assistance to the extent
of 50% of the cost of drier and dust control system up to Rs. 2.75 lakhs - Rs. 2.50 lakhs for drier and Rs. 0.25 lakhs for dust
control system.

General and Difficult Areas: The Scheme provides for different scale of assistance for project to be set up in
General and Difficult Areas of the country. It envisages enhanced rate of assistance for Difficult Areas ie., Jammu &
Kashmir, Himachal Pradesh, Utharanchal, Sikkim, North Eastern States, Andaman & Nicobar Islands, Lakshadweep,
Integrated Tribal Development Project (ITDP) areas.
Release of Assistance: Assistance in the form of grant would be released directly to the concerned implementing
agencies through the Bank or financial institutions wherever possible.
Recommendations: The proposals are required to be recommended by the concerned State Government or
Nodal Agency designated by them.

INCENTIVE FOR ISO 9000/ISO 14001 CERTIFICATION


The scheme provides incentive to small scale/ancillary undertakings which have acquired ISO 9000/ISO
14001 certifications, vide Administrative Order No. 41(8)/ISO/ Electx/2002 dated 28-10-2002 of the DC (SSI). The
salient features of the scheme are the following :i.
The scheme envisages reimbursement of charges of acquiring ISO-9000/ISO-14001 certifications to the
extent of 75% of the expenditure subject to a maximum of Rs. 75,000/- in each case. The Scheme is valid
upto 31 st March' 2007.
ii. The Permanent Registered Small Scale/ Ancillary/Tiny/Small Scale Service Business Enterprises (SSSBE)
units are eligible to avail the Incentive Scheme.
iii. The scheme is applicable to those SSI/AncillarylTiny/SSSBE units which have already acquired ISO-14001
certification.
iv. It is an all India Scheme administered by Development Commissioner (SSI), Ministry of SSI, Govt. of India. A
Screening Committee under the Chairmanship of AS&DC(SSI) has been set up to consider the applications
for approval of reimbursement.
v. The Scheme shall provide one time reimbursement only against a Permanent SSI registration Certificate.
The amount of incentive/subsidy/ grant already availed for acquiring ISO 9000 or ISO 14001 Certification
under any Central Govt. (including DCSSl Incentive Scheme)/State Govt./ Financial Institution shall be adjusted against the entitlement of reimbursement.
It means the total entitlement of reimbursement of acquiring one or more than one certifications shall be up to the
maximum limit of Rs. 75,000/- only. In case a unit has received reimbursement/subsidy/grant from Central Govt./
State Govt./Financial Institution against any one of the certifications for an amount less than maximum limit of Rs.
75,000/-the unit shall be eligible to receive the balance amount only.
vi. (a) Only one time reimbursement is allowed against a permanent SSI registration for acquiring ISO-9000/ISO-14001
certification; irrespective of the fact whether the concerned SSI has one or more than one Unit(s) within the same

premises/location or outside.
(b) In case an ISO-9000/ISO-14001 certificate is obtained jointly by SSI units (even having a separate Permanent
SSI registration certificates) under the corporate/group of Industries category, the total reimbursement shall be
limited to 75% of the total expenditure incurred by the concerned units or Rs.75000/- whichever is less; and each
SSI unit shall get the amount on prorata basis. Circular No.41(8)/ISO/2005 dated 23-11-2005 of the DC (SSI)
supersedes all the previous circulars issued in the matter of validity of Certification Bodies for ISO 9000 and EMS
Certification ISO 14001. In the case of applications for reimbursement received in the Office of the DC(SSI) on or
after 01-01-2006, reimbursement will be made against certificates obtained from Certification Bodies (CBs)
directly accredited by National Accreditation Board of Certification Bodies (NABCB) and bearing the logo of
NABCB only. Validity of a few of the Certifying Bodies specified in the list in the Circular dated 23-11-2005 ceased
for applications received in the office of the DC (SSI) after 31-12-2005.

GRANT FOR QUALITY CERTIFICATION / ACCREDITATION


The scheme, approved in G.O (Rt) No. 283/05/ID dated 26-3-2005, has the following salient features 1) Assistance by way of grant is extended to approved R&D Institutions for getting accreditation with International
Quality Testing Agencies. All R&D institutions duly approved by Govt. of Kerala and R&D institutions under SSl/
Large and Medium units and Cluster Consortia approved by the Industries Department will be eligible
2) Assistance by way of grant is extended to Industrial units for acquiring quality certification from approved
institutions/Research Labs. SSI, Large & Medium units and Cluster Consortia are eligible.
3) One time reimbursement of 50% of total expenditure incurred for getting accreditation with international quality testing agencies and for acquiring quality certification from approved institution/research labs,limited to a
maximum of Rs.2 lakhs, will be provided as grant. In the case of ISI the unit will be eligible for 50% grant for each
item of products subject to a maximum of Rs.2 lakhs per unit. An industrial unit that has already availed the
grant/incentive for the above purpose from GOI or else where, the remaining amount will be admissible under
the scheme subject to the ceiling of Rs.2 lakhs.
4) The following are the componets of expenditure eligible for reimbursement
(i) Payments made for acquiring quality certification such as cost of registration, cost of equipments for establishment of laboratories, application fees, marking fee, registration fees, entrance fees, membership fee
and allied expenses.
(ii) Payments made towards consulting, training, Calibration for acquiring quality certificates
(iii) Expenditure incurred for acquiring accreditation with international quality testing agencies.
(5) Applications in the prescribed format to be submitted to the GM, DIC in 3 months from the date of getting
quality certificate/accreditation. The Director of Industries & Commerce will be the sanctioning authority.
(6) The unit/R&D institution receiving grant will be under obligation to remain functioning for 3 years from the
date of receipt of quality certification/ accreditation.

Financial Assistance to Micro & Small Enterprises (MSEs) for use of Bar Code

1. OBJECTIVE : The basic objective of financial assistance is to enhance the marketing competitiveness ofMicro & Small
Enterprises (MSEs) by way of : (i) Providing 75% of one-time registration fee and annual recurring fee (for first three
years) paid by MSEs to GS1 India.(ii) Popularizing the adoption of bar codes on large scale amongst MSEs, and (iii)
Motivating and encouraging MSEs for use of bar codes through conducting seminars on Bar Code,
2. TARGET GROUP : Micro & Small Enterprises (MSEs) throughout the country.
3. ELIGIBILITY : Those MSEs who have Entrepreneurial Memorandum Part-II acknowledgement number from Directorate
of Industries/District Industries Centres and also have registration with GS1 India for use of Bar Codes are eligible for
75% reimbursement of one-time registration fee and annual recurring fee (for first three years) paid by them to GS1
India.
4. FINANCIAL ASSISTANCE : Under SSI-MDA scheme, the financial assistance is provided towards 75% reimbursement

of only one-time registration fee paid by MSEs w.e.f. 1st January, 2002. Considering the difficulty of MSEs to meet the
liability of the payment of annual recurring fee, 75% annual recurring fee (for first three years) is also reimbursed to MSEs
under NMCP scheme-Marketing Assistance/Support to MSMEs (Bar Code) w.e.f. 1st June, 2007. Fee structure for onetime registration/annual recurring to be paid by MSEs for using of Bar Codes are revised by GS1 India from time to time.
As and when, fee is revised by the GS1 India, the revised fee structure will be applicable. The revised fee structure is
available on the website: www.gs1india.org However, reimbursement will be restricted to 75% of the fee paid by MSEs.
Any other charges like service taxes, etc. are not reimbursable. Further, 75% reimbursement of one-time registration fee
paid by MSEs to GS1 India is provided to those MSEs who have got registration from GS1 India for use of Bar-Codes on
or after 1st January, 2002. In addition, 75% reimbursement of annual recurring fee paid by MSEs to GS1 India is provided
to only those MSEs who have paid above fee for the period from 1st June, 2007 and thereafter.
5. IMPLEMENTING AGENCIES : Office of the Development Commissioner (MSME) under Ministry of Micro, Small &

Medium Enterprises, Government of India was providing 75% reimbursement of (i) one-time registration fee, and (ii)
annual recurring fee (for first three years) to eligible Micro & Small Enterprises (MSEs) for use of Bar Code in order to
enhance their marketing competitiveness. With a view to ensure speedy and extensive implementation of the scheme,
the work related to reimbursement of one-time registration fee/annual recurring fee has been decentralized and transferred
to field offices i.e. Micro, Small & Medium Enterprises -Development Institutes (MSME-DIs) w.e.f. 1st June, 2009.
6. WHERE AND HOW TO APPLY : Eligible MSEs may apply to the Director, Micro, Small & Medium Enterprises-

Development Institute of their region in prescribed application form for claiming reimbursement on Bar Code. Application
forms along with formats for the supporting documents may be collected from Director, MSME-DI of their region and are
also available on this office Website : www.dcmsme.gov.in.

* To nurture the latent entrepreneurial talent.

Scope of the scheme


Any College or Higher Secondary School may set up an EDC with at least 25 interested students with a
teacher/faculty preferably from Commerce or Economics as Coordinator. In schools the members will be
preferably from Std. XI and XII.
The scheme will be implemented in selected Engineering colleges, Polytechnics, Arts and Science colleges
and Higher Secondary schools. Government aided and unaided institutions can set up EDCs. Institutions
will be selected in consultation with the Head of Department concerned. (Eg. Director of Technical
Education, Director of Higher Education etc.)
Students willing to join the EDC will be enrolled as members. A successful entrepreneur who is an Alumni
(old student) of the institution may be called for inaugurating such club by sharing his experiences. It may
help to create enthusiasm and encouragement to the present students. Similarly an old student from the institution
may be nominated as the Mentor (co-ordinator) of the club.
Functions of the club
Organise interactive sessions with successful entrepreneurs from outside as well as within
the State.
Organise workshops/debates.
Organise industrial visits to business enterprises within/outside State.
Interaction with promotional agencies.
Exposure to national and international events in various parts of the country related
to industrial developments.
Organize Entrepreneurship Clinics & Entrepreneur Awareness Programme.
To introduce talented youths to industrial research organizations.
To familiarize the youths to the latest developments through media.
Financial assistance
Rs.12,000 per annum will be given as grant to each club. A minimum of Rs.1200/- is to be contributed by the
institution. Additional assistance will be considered on merit.
Sanction of assistance
Any institution which forms the club and opens a Bank Account (joint account of Coordinator and the Head of the
Institution) may apply to the Executive Director, KIED for sanction of assistance under the scheme. The application
for assistance shall be accompanied by the list of members, Bio data of the coordinator, the details of the Bank
account and the proposed activities of the club during the year. 50% of the assistance sanctioned will be released
along with the sanction. On satisfactory utilization, balance will be released.

Consent from various departments is statutory before venturing into the project.The following licenses are compulsory irrespective
of the nature of the activity.

INQUIRY UNDER SEC. 65 RULE. 66 of KCS ACT 1969


Contest of Inquiry
a) Constitution of a Society
b) Working of a Society and
c) Financial Condition of a Society
Circumstances: The Registrar can order an Inquiry
a. On his own
b. On an application of a society in which the Society is affiliated
c. On an application by majority of Committee Members
d. On an application not less than 1/3 or the number required for the quorum of the General Body of the Society
Inquiry by whom: By the Registrar himself or by an officer authorised by him in writing.
Order should contain:
a. Name of the Society concerned
b. Name of the person authorized to conduct the Inquiry
c. Points on which Inquiry is to be carried out
d. Period in which Inquiry be completed
e. Meeting the cost of the Inquiry
f. Other matters related to the Inquiry
Issue of Order:
Order to be sent by Registered post with Acknowledgement Due to the President / Secretary with copy to the Apex Society
Powers of the Inquiry Officer:
a. Summon any person who he believe that who have the knowledge of the affairs of the Society
b. Instruct the President/Secretary of the Society to call for a General Body or call a General Body by himself. This
General Body need not have the quorum or the notice period.
Interim Report: If the Inquiry Officer feel that the Inquiry can not be completed within the stipulated time he can submit an
interim report and request the Registrar to extend the period for a reasonable time.
Inquiry Report: The Inquiry Report should be supported with documentary evidences and the details of the last Board of Directors
and also of the Secretary, and also about the cost of the Inquiry and how it should be divided among the parties.
CONDUCT OF ELECTION TO INDUSTRIAL CO-OPERATIVES (KCS Act Rule 35)
The committe in office shall take decision before 60 days before the expiry of its term to fix the date, time and place for the election.
Resolution to be sent to the Registrar within seven days
Registrar may appoint a Returning Officer
The committee in office should prepare alist of voters and supply to the Returning Officer as on 30 days prior to the date fixed for
election
The Returning officer shall publish the voters list at least 15 days( fifteen) days prior to the Election inviting objections to be filed
within 3 (three) days.
After considering objections the Returning Officershall publish the Final Voters list at least 10 days prior to the election
The Returning officer shall give intimation regarding the conduct of election to all members in the final voters list ( If the members
on the list exceeds1000 the notice shall be published in News paper)
Copy of final list shall be supplied to members on request on payment of fee fixed by the committee.
The Nomination form in the prescribed format should be supplied free of cost.
The scrutiny of nomination shall be done on the next day of the last day fixed for filing nomination.
Publish the list of valid candidates in alphabetic order.
Withdrawal of nomination upto 5 PM on the next day
Publish the final list of contesting candidates on the same day of withdrawal.
If the number of contesting candidates do not exceed the required number Returning Officershall declare them elected on the
date fixed for election.
If the number of contesting candidated exceed the required number,Returning Officer shall arrange the poll on the date and
time fixed for same.

PROCEDURE FOR LIQUIDATION OF A CO-OPERATIVE SOCIETY


1. Intimate the Office bearers of the society to hand over charges at specific hour and date by registered post with acknowledgement due. If they fail
to comply with, request necessary orders of the Magistrate within whose jurisdiction the society functions for securing the records and properties
of the society with prior permission of the Registrar under section 34 (1) of KCS Act.
2. The Liquidator shall take into custody of all the properties and records of the society and take steps to prevent loss or deterioration of the properties,
if no appeal is preferred under Sn.83 against the order of winding up. In such case the winding up order shall not operate until it is confirmed in
appeal, provided he shall have the authority to control the assets and authority to prevent loss or damage to such assets.
3. Publish notice u/s 69(2) of KCS Act requiring claims against the society.
4. Request the Audit department to complete the audit as on date of his taking charge.
5. Take action to realize amount due to the Society u/s. 69 of KCS Act.
6. Take steps to dispose of the assets of the Society
7. If the liquidator is satisfied that any debt due has become bad and is not recoverable, then move the Registrar to write off the same u/s. 62.
8. Issue demand notices to the debtors and give them an opportunity to be heard and issue awards u/s. 73(2)(h) and (j) and enforce the same u/s.76
of the Act.
9. Deposit all funds with the Liquidator in a financing bank as approved by the Registrar
10. Prepare a list of claims to be settled.
11. Earmark @20% of all the collection as liquidation cost and deposit in separate account.(15% as liquidation charges and 5% as
liquidation expenses)
12. Deposit an amount to cover the un-discharged liability for a period of 3 years.
13. Cash collected includes
a)
Withdrawals from bank.
b)
Deposits and withdrawals
c)
Cash balance taken charge by the liquidator
d)
Court costs realised
e)
Dividends received on shares invested
f)
Properties of the defaulters purchased by the Liquidator

14. Prepare the receipts and disbursements and get the accounts audited by the Registrar
15. Call for the final general body meeting of the society and present the audited accounts.
16. Submit report to the Registrar recommending winding up of the society u/s.74 of the Act.
The report should contain:
a) The number and date of appointment of the liquidator.
b) Statement of assets and liability as on date of taking charge of liquidator
c) Date of publication of claim notice
d) Receipts and Disbursements of liquidation work
e) State,ent of assets realized and liability discharged and assts written off and liabilityforfeited.
f) Recommendation for cancellation of registration.

(10) Taxi fare for Grade I Officials : - Grade I officials travelling to metropolitan cities and other larger cities are allowed
to hire taxies for the day as in the case of Government of India officials. They are entitled to taxi- fare at the rates fixed by
Government from time to time for journeys on tour from residence to airport/ railway station/ bus stand and back. The
existing status will continue.
(11) Auto rickshaw/Taxi fare for journeys on tour: - Actual fare at the rate fixed by Government from time to time for
