AFFIDAVIT FILED UNDER SECTION 139 C.P.C.

I, Chittem Madhava Rao S/o Venkaiah, aged about 48 years, Hindu,
Health Supervisor, D.M.H.O, Office, Ongole, resident of Gaddalagunta Palem,
Ongole, Prakasam District, do hereby solemnly affirm and sincerely state as
follow:I am the deponent herein and sole petitioner in the main O.P. The O.P.
is filed for compensation for the injuries cased to me in a motor accident. Later
the same was decreed in my favour for a sum of Rs.70,000/- with interest and
costs on 12-01-2012. The 4th respondent deposited an amount of Rs.91,609/into the Court. I am entitled to the above said amount of Rs.91,609/- towards
compensation.
The Honble Court permitted me to withdraw 50% of
compensation together with accrued interest thereon and costs of Rs.47,290/- as
per decree direction, dt.12-01-2012 and I withdrew the same in I.A.330/12,
dt.13-06-2012 and the remaining balance amount of Rs.44,319/- was kept under
fixed deposit for 3 years. Later I filed a petition to send for the my entire
compensation amount with accrued interest thereon and the same was allowed
in I.A.No.150/15, dt.25-5-2015. The above said amount of Rs.58,016/- was
lying in C.C.D. I am entitled to withdraw the same and there is no stay or
appeal or attachments on the said amount. I, under take that if the Honble
Court directs me to re-deposit the amount, I will deposit the same. I am
herewith filing my Bank Pass-Book.
Hence I pray that this Honble Court may be pleased to issue a cheque for
Rs.58,016/- (Rupees Fifty eight thousand and sixteen Only) in favour of the
Branch Manager, Andhra Bank, Court Street Branch, Ongole, Prakasam
District, and he may be directed her to credit the same to the S.B.A/c
No.8910011020249 of the petitioner in the interests of justice.

over and explained in Telugu to the deponent and admitted him to be correct on
this the
day of July, 2015.
