B. NatureoftheTaxWeHave
1. EstateTax

Wewillalsotaxtheappreciationonthepropertyyougifted
previously.

extension(thisdoesnotextendthetimeforpayment).Therearesomethingsthat
letyouextendthepaymentsoveryearsanestatewithacloselyheldbusiness.

Youcanhavethisonedistributeincomeandprincipletothechild.
Thenyouwouldwanttogivethechildsomesortofinterestinthetrust
sothatitisincludedinhisestate(becauseyouknowitwontbetaxed
ataratehigherthanthehighest).
Thenonexempttrustisgoingtobedesignedtomaximize
distributionstononskips.
Whenyouhaveanonexempttrust,youhaveaspecialexclusion
tuitionandmedicalexpensesforskippersonswithoutbeing
subjecttoGST
Ifthedistributionwouldbeexemptifpaidbyanindividualby
payingitdirectlytotheinstitution
Nevercreateatrustthathasaninclusionratioofanythingbesides1or0.
Youarebetteroffhavingonethatistotallyexemptandanotherthatisnot

thenweadoptedaunifiedsystemforthepurposeofestateandgiftax

gifts.Thetaxpaidonthegiftswillbecreditedtotheamountyoupay,thisisjustused
tocalculatethetaxrate

2. 2033PropertyinWhichtheDecedentHadanInterest
Thevalueofthegrossestateshallincludethevalueofallpropertytotheextentofthe
interestthereinofthedecedentatthetimeofhisdeath.

estatetoprovethatitisnotabeneficialinterest.

Statelawcreateslegalinterestsandrights.Thefederalrevenueacts

notterminateduponthedeathofthedecedent.
Differentpartnershipagreementsmaydictatehowthepartnershipisto
devisethepartnershipinterestofadeceasedpartnertohisestate,butthis
maynotbedeterminativeofitsvalueiftheServicethinksthatitisbelow
themarketvalueofthepartnership.

curtesyorsimilarinterestinthedecedentsproperty.
B. 2035AdjustmentsforGiftsMadeWithinThreeYearsofDecedentsDeath
1. Introduction

a. TheCommissionerhadlittleluckunderthecontemplationofgifttaxso
Congressexpandedtheruletoanautomatic3yearinclusionruleforalltransfers
inyearsafter1976.
b. Resultifatransferwasmadethatwouldbesubjecttothegifttax,itpushes
incrementsoftheestateintohigherestatetaxbrackets,yieldingaresultmuchlike
anestatetaxonatleastthelifetimevalueofthegift,reducedbythecreditforthe
earliergifttaxpaid.
2. TheFirstProng
a. 2035(a)Inclusion
i
2035(a)(1)requirespropertytobepulledbackintothe
decedentsgrossestateif:
thereisatransferifaninterestinpropertyortherelinquishmentofa
powerwithrespecttopropertyinclusionAND
thetransferorrelinquishmentisonethatwasmadebythedecedentwithin
3yearsofdeathforlessthanadequateandfullconsiderationinmoneyor
moneysworth.
Thissectionisnotapplicabletoanytransfersmadeoutsideofthethree
yearsbeforedeath.
Thetransferdateisthedatewhenthegiftiscompletelooktolocal
lawtodetermine.

2035(a)(2)Thescopeofthissectionisnarrowedto
applyonlyifthedecedenttransfersaninterestorrelinquishesapowerover
either
aninsurancepolicythat,withoutthetransferorrelinquishment,would
havebeenincludedinthedecedentsgrossestateunder2042OR
Theentireamountoftheproceedsareincludedinthegrossestate
becausethatiswhatwouldhavebeenincludedunder2042
Ifyouownapolicyonyourownlife,giveitawaybeforeyouareclose
todeathgiveitawayearly.
Ifyouwanttopurchasemoreinsurance,thenyouwanttotakethe
moneythatyouwouldbuytheinsurancewithandputitinatrustand
