17.7.1

Power Plant Units fCCGT Power Blocks)

Preliminary Acceptance of each Power Piant Unit (CCGT Power Block

Preliminary Acceptance) shall be achieved when:

Technical Completion for the Power Plant Unit (CCGT

Power Block) has been achieved in accordance with
Paragraph 17.3.1 of this Schedule "A", and

17.7.1.2

The Reliability Run has been successfully completed,

and

17.7.1.3

The performance test has been conducted, and

17.7.1.4

All utilities and support systems are fully operational,

and

17.7.1.5

All warranties are in place pursuant to the terms of the

CONTRACT, and

17.7.1.6

The Test Record

COMPANY, and

17.7.1.7

The COMPANY has received from CONTRACTOR a list of

manufacturers
of
equipment
and
equipment
components supplied and installed under the
CONTRACT, and

17.7.1.8

In the case of CCGT Power Block No. 05, COMPANY has

received the complete Parts Data Package as described
in Paragraph 6.3 of this Schedule "A", and

17.7.1.9

In the case of CCGT Power Block No. 01, the COMPANY

personnel have completed training on operation and
maintenance .of the CCGT Power Plant as described In
the Scope of Work and Technical Specifications, PTS
No.
07EG908,
and
subsequent
addendum

clarifications.

Preliminary Acceptance of each Common Plant System/Facility

(Common Plant System/Facility Technical Completion) shall be
achieved when:

Paragraph 17.3.2 of this Schedule "A", and

The performance test has been conducted, and

CONTRACT, and

Preliminary Acceptance Dates

The dates on which ali of the conditions in Paragraphs 17.7.1,

17.7.2 and 17.7.3 of this Schedule "A" have been fulfilied shali be
deemed as "Preliminary Acceptance Date", even if the Preliminary
Acceptance Certificate is issued at a later date. Within two (2)
weeks after the Preliminary Acceptance Date, COMPANY shali issue
the Preliminary Acceptance Certificate to CONTRACTOR. However,
Preliminary Acceptance Certificate can be issued with minor punch
list items which do not hinder safe and reliable operation of the
PROJECT as determined by the COMPANY, SUbject to the same
conditions described in sub-paragraphs 17.4.9.1 thru 17.4.9.3.
17.8

Final Acceptance of the PROJECT PORTIONS and the WORK

17.8.1

Final Acceptance of the Power Plant Units (CCGT Power

Blocks)

Final Acceptance of each Power Plant Unit (CCGT Power Block Final
Acceptance) shali be achieved when:
17.8.1.1

Technical Completion for the Power Plant Unit (CCGT

Power Biock) has been achieved, and

17.8.1.2

Preliminary Acceptance for the Power Plant Unit (CCGT

Power Block) has been achieved, and the CONTRACTOR
has completed all the punch list items, and

17.8.1.3

The Performance Testing is complete, and subject to

Schedule "C" of this CONTRACT, liqUidated damages as
may be applicable have been imposed, and

Technical Completion for the Non-Power Plant Facility

has been achieved, and

17.8.3.2

Preliminary Acceptance for the Non-Power Plant Facility

has been achieved, and the CONTRACTOR has
completed all the punch list items, and

17.8.3.3

All defects found during the warranty period have been

repaired, replaced or as otherwise have been taken
care of to the satisfaction of COMPANY, and

17.8.3.4

All final "as-built" drawings and the Operation and

Maintenance Manuals for the Non-Power Plant Facility
have been received by COMPANY.

Final Acceptance of the WORK

Final Acceptance of the WORK (Final Acceptance Date) shall be

achieved when:

17.9

17.8.4.1

Final Acceptance for all Power Plant Units (CCGT Power

Blocks), Common Plant Systems and Facilities, and
Non-Power Plant Facilities have been achieved.

17.8.4.2

CONTRACTOR has fully demobilized from the WORK

SITE, and

17.8.4.3

The Final Receipt and Release Agreement (form #

15076) has been signed by CONTRACTOR and
COMPANY in accordance with Schedule "C".

Adjustment to Final Acceptance Dates

The Final Acceptance Dates and Critical Milestone Dates shall only be
adjusted when so stipulated in an AMENDMENT or in a CHANGE ORDER.
17.10 Readiness for Commercial Operation of Power Plant Unit (CCGT
Power Block)

17.10.1 "Readiness for Commercial Operation of a Power Plant Unit (CCGT

Power Block)" shall mean that the Power Plant Unit (CCGT Power
Block) is ready for Commercial Use after the following conditions
are fulfilled except the Performance Test:
17.10.1.1

All reqUired tests and commissioning for Commercial

Operation have been achieved in its specified schedule
as per detailed Milestones, and Technical Completion
Certificate has been issued.

17.10.1.2

Completion of 100% Load Rejection Test successfully.

17.10.1.3

The Power Plant Unit (CCGT Power Block) has been

operated for fourteen (14) consecutive calendar days
(Reliability Run) continuously stable operation on Baseload.!'

"Readiness for Commercial Operation Date" is the date when all of

the three conditions described in sub-paragraphs 17.10.1.1 thru
17.10.1.3 above are achieved and shall be the date when last of the
three activities is completed.
17.10.2 Notwithstanding Paragraph 22 (liqUidated Damages for Delay of
PROJECT) of this Schedule "A", COMPANY will not impose liqUidated
damages for delay against CONTRACTOR for failure to complete the
Power Plant Unit (CCGT Power Block) if the conditions set forth in
Paragraph 17.10.1 above were fulfilled by CONTRACTOR by the
Preliminary Acceptance Date specified in Attachment 11 of Schedule
"B" or as adjusted in accordance with Paragraph 17.9 of this
Schedule "A".
17.10.3 The warranty period shall commence from the "Readiness for
Commercial Operation Date" of the Power Plant Unit.
