FEDERALHIGHWAYSACT

AnActtovestthepowersofmanagement,directionandcontrolofFederalhighwaysthroughoutNigeriainthe
MinisterofWorksandHousing,inrespectofplanning(includingresearchanddesigningofFederalhighways),
theconstructionandmaintenance,thesupervisionofusersofsuchhighwaysandtheregulationoftraffic
thereon.

1.

Ministertocontrol,etc.,FederalHighways

(1)SubjecttotheprovisionsofthisAct,allFederalhighwaysshallonthecommencementofthisAct,beunderthe
management,directionandcontroloftheMinisterchargedwithresponsibilityforroads(inthisActreferredtoas
"theMinister").
(2)TheMinistershallhaveresponsibility

(a)

fortheplanning(includingresearchanddesigning)ofFederalhighways;

(b)

fortheirconstructionandmaintenance;

(c)

forthesupervisionofusersthereof;and

(d)

fortheregulationoftrafficthereon.

(3)TheFederalgovernmentmay,subjecttotheprovisionsofthisAct,delegatetothegovernmentofaStatein
respectoftrafficonFederalhighwaysalloranyofthepowersinsubsection(5)ofthissectionasmaybeexpedient
inthecircumstances;andsuchpowersmayfurtherbedelegatedbythegovernmentofaStatetoanylocal
governmentwithinthatState.
(4)Whereanypowerisdelegatedpursuanttosubsection(3)ofthissection,itshallbeadditionaltoandnotin
derogationofanyotherpowerofthepoliceinrespectofroadtraffic,andthepowermayaccordinglybesub
delegatedtoandbeexercisedbyanypoliceofficer.
(5)Thepowersreferredtoinsubsection(3)ofthissection,are
(a)restrictionontypeorclassofvehicleandvehicleinspection;
(b)roaddiversionorclosurewherenecessaryasatemporarymeasure;
(c)prohibitionofparkingorwaitingasthecasemaybeonFederalhighwaysoronspecificparkingorwaiting
placesandonspacereasonablyrequiredforvehiclesapproachingorleavingpremisesonorimmediatelyadjoining
aFederalhighway;
(d)prohibitionoferectionofhoardingsandotherformsofadvertisingwithinadistanceofthreehundredfeet
fromthemiddlelineofanyroadformationinthevicinityofaFederalhighwayorwithinthedistanceaforesaid
fromthemiddlelineoftheFederalhighway;
(e)generallyensuringtheuninterruptedflowofvehicularandpedestriantraffic.(6)Penaltiesprescribedforthe
infringementofanyregulationsmadebytheMinisterunderthepowerconferredbythisActshall,applyandhave
effectinrespectofpowersdelegatedunderandforthepurposesofthissection,tothelikeextentasifthe
regulationshadbeenmadecontemporaneouslywiththeoperationofanysuchdelegationasaforesaidunderthis
sectionandhadsoprovided.
2.Powertoerecttollgates,etc.
(1)TheMinistershallhavepowertoerect,equipandmaintaintollgatesonanyFederalhighwayasandwhen
required,withtheapprovalofthePresident.
(2)Withoutprejudicetothegeneralityofsubsection(1)ofthissection,theMinistermayprescribesuchfees,dues
orchargesthatmaybepayableatanytollgateerected,equippedormaintainedpursuanttosubsection(1)ofthis
section.
(3)IntheexerciseofthepowersconferredupontheMinisterbysubsection(2)ofthissection,theMinistermay
classifythecategoriesofvehiclesplyingorpassingthroughanytollgatecoveredbytheprovisionsofthisActand
theamountpayablebysuchcategoryofvehicles.
(4)TheMinistermayauthoriseinwritinganyofficer,agentorpersontoexerciseanyofthepowersconferred
uponhimbysubsections(1),(2)and(3)ofthissection.
(5)TheMinistermaymakesuchorderwhichmaybepublishedintheFederalGazetteorissuesuchnoticeashe
maydeemnecessaryinrespectoffees,duesandchargespayableunderthisAct.
(6)ForthepurposesofthisAct"vehicle"includesmotorcycle.

(7)Anypersonwhowilfully
(a)preventsorobstructsanyauthorisedofficer,agentorpersonintheperformanceofhisfunctionunderthisAct;
or
(b)failstopaytoanyofficer,agentorpersonempoweredtocollectanyfees,duesorchargespayableunderthis
Act;or
(c)withholdsanyfees,duesorchargespaidunderthisAct;or
(d)doesanyotherfraudulentactorthingrelatingtotheissueofreceiptsorcollectionoffees,duesorcharges
underthisAct,
shallbeguiltyofanoffenceandliableonconvictiontoafinenotexceedingN10,000ortoimprisonmentforaterm
notexceedingfiveyearsortobothsuchfineandimprisonment.
(8)Anypersonwhocommitsanyoffencepunishableundersubsection(7)ofthissectionshallbetriedatthe
FederalHighCourt.
(9)Whereunderthissectionanypowerisdelegatedandinrelationtheretoanactoromissionisanoffenceunder
thisActandalsoanoffenceunderanyroadtrafficenactmentinforceinaState,theprovisionsofthisActasto
offencesshallprevailsohoweverthatwherebeforethecomingintoforceofthisActproceedingscommencedin
respectofanactoromissionwhichisanoffenceunderaroadtrafficenactmentinaStateandthepenalty
prescribeddiffersfromanyprescribedforthelikeoffencehereunder,anyprosecutionmay,ifthecasehasnot
beendisposedofonthecommencementofthisAct,becontinuedasifthisActhadnotbeenmade.
3.

PowertoacquirelandforFederalhighway

(1)TheFederalGovernmentmayinconsultationwiththegovernmentoftheStateconcerned,fromtimetotimein
suchmannerasitmayprescribe,acquirelandforthepurposesofthisActandwhensoacquiredsuchlandshallbe
deemedtobeaFederalhighwaywithinthemeaningofthisAct;andsuchlandmaybedisposedofinaccordance
withthelawoftheareaconcerned;inthissubsection,thereferencetolandincludesreferencetoaroad,other
thanaFederalhighway,formedonland.
(2)ExceptinrespectofroadswhicharedeemedtobeFederalhighways,compensationshallbepaidpursuantto
theLandUseAct,forlandacquiredundersubsection(1)ofthissectionafterthecommencementofthisAct.

(3)WherelandatthecommencementofthisActoratanytimethereafterispartofaFederalhighway,the
ownershipshallincludenotonlythesurfacebutalsothesubsoiltoanindeterminabledepth;anduseradverseto
thatasaFederalhighwayshalloperateinfavouroflevelcrossingsconstructedbytheNigerianRailway
Corporationandthenonlywhereatrainorengineisapproachingandwithinhalfamileofalevelcrossing.
(4)Itisdeclaredfortheavoidanceofdoubtthatintheapplicationofthissection,anacquisitionoflandforthe
purposesofthisActshallbeforapublicpurposeoftheFederationwithinthemeaningoftheLandUseAct.
(5)TheacquisitionoflandforthepurposesofthisActincludestherighttoobtaincontroloverthelandandtouse
thelandfortheerectionofbuildingsandforthesupervisionoftheuserbythepublic.

4.

Drainageandotherworks

(1)TheMinistermayintheperformanceofhisdutiesunderthisActmakeandthereaftermaintaininrespectof
anyFederalhighway,convenientdeckinganddrainageworkforthepurposeofmakinggoodanyinterruptions
causedtotheuseofthelandsofadjoiningownersoroccupiersthroughwhichsuchFederalhighwaypassesoris
made,orofdivertingstormorotherwaterfromaFederalhighway.
(2)Foralloranyofthepurposesinsubsection(1)ofthissection,theMinistermayenteruponlandadjoiningthe
Federalhighwaysubjecttothegivingofreasonablenoticetoownersoroccupiersanddoingaslittledamageas
possiblethroughsuchentryorexitafterentry;andinthecoursethereoftheMinistermayblockup,divertoralter
thelevelorcourseofwaterflowingindefinedchannels,naturalorartificial,orotherwisecontainedbyanymeans.
(3)NothinginthissectionshallrequiretheMinistertoprovideconvenientdeckingordrainagework
(a)

wheretheownersoroccupiershavefailedtomakerepresentationsduringthetimethatthe
sectionoftheFederalhighwayaffected,adjoiningorpassingthroughtheirlandwasincourseof
construction;or

(b)

whereownersor,asthecasemaybe,occupiersoftheadjoininglandhaveagreedtoreceiveand
havebeenpaidcompensation;or

(c)

wheredeckinganddrainageworkprovidedbytheMinisteristhereafterdivertedoraltered
otherwisethanbytheMinister.

(4)Intheexerciseofhispowerunderthissection,theMinistermayrequireanypersonhavingapparentcontrol
overthelocationofanypipe,electricwireorposttoalterthelevelorpositionthereofasthecasemayrequire
afterreasonablenoticeoftherequirementhasbeendulygiven;andtheMinistershallinthecourseofroadworks
generallycauseaslittleinconvenienceaspossibletopersonsaffected.
(5)ThefailuretocomplywiththerequirementoftheMinisterdirectedorgiventoanypersonunderthissection
shallbeanoffencepunishableonconvictionbyafineofnotlessthanN100ormorethanN200orby
imprisonmentforatermofthreemonths,orbybothsuchfineandimprisonment.
(6)Inthissection,"convenient"inrelationtodeckinganddrainageworks,meansofuseorbenefittoroadusersor
asthecasemaybeadjoiningownersoroccupiers.
Offences
5.Causingdeathbyrecklessordangerousdriving
AnypersonwhocausesthedeathofanotherpersonbythedrivingofamotorvehicleonaFederalhighway
recklessly,orataspeedorinamannerwhichisdangeroustothepublic,havingregardtoallthecircumstancesof
thecase,includingthenature,conditionanduseoftheFederalhighway,andtheamountoftrafficwhichis
actuallyatthetime,orwhichmightreasonablybeexpectedtobe,ontheFederalhighway,shallbeguiltyofan
offenceandliableonconvictiontoimprisonmentforatermofsevenyears.
6.

Reckless,etc.,drivingonFederalhighway

(1)AnypersonwhodrivesamotorvehicleonaFederalhighwayrecklesslyornegligently,orataspeedorina
mannerwhichisdangeroustothepublic,havingregardtoallthecircumstancesofthecaseincludingthestate,

condition,anduseofthathighway,andtotheamountoftrafficwhichatthetimeisormightreasonablybe
expectedtobeonthathighwayshallbeguiltyofanoffenceandliableonconvictiontoafineoffourhundrednaira
ortoimprisonmentfortwoyearsortobothsuchfineandimprisonment.
(2)Ifuponthetrialofapersonforanoffenceundersection4ofthisAct,thecourtisnotsatisfiedthattheperson's
drivingwasthecauseofthedeathbutissatisfiedthatheisguiltyofdrivingasmentionedinsubsection(1)ofthis
section,thecourtmayconvictthatpersonofanoffenceunderthissection.
7.

Carelessandinconsideratedriving

(1)AnypersonwhodrivesamotorvehicleonaFederalhighwaywithoutduecareandattention,orwithout
reasonableconsiderationforotherpersonsusingtheFederalhighwayshallbeguiltyofanoffenceandbeliableon
convictiontoafineofonehundrednairaorinthecaseofasecondsubsequentconviction,toafineoftwo
hundrednairaortoimprisonmentforsixmonthsortobothsuchfineandimprisonment.
(2)Whereapersonischargedwithanoffenceundersection6ofthisActandthecourtisoftheopinionthatthe
offenceisnotproved,thenatanytimeduringthehearingorimmediatelythereafterthecourtmay,without
prejudicetoanyotherpowerexercisablebythecourt,directorallowachargeforanoffenceunderthissectionto
bepreferredforthwithagainstthatpersonandmaythereuponproceedwiththatcharge,sohoweverthatthe
personchargedorhiscounselshallbeinformedofthenewchargeandbegivenanopportunity,whetherbywayof
crossexamininganywitnesswhoseevidencehasalreadybeengivenagainsthimorotherwise,ofansweringthe
newcharge,andthecourtshallifitconsidersthatheisprejudicedinhisdefencebyreasonofthenewcharge
beingsopreferred,adjournthehearing.
8.

Drivingunderinfluenceofdrink:powertodisqualifyfromdrivingincertaincases

(1)Anypersonwhowhendrivingorattemptingtodrive,orwheninchargeofamotorvehicleonaFederal
highwayisundertheinfluenceofdrinkordrugstosuchanextentastobeincapableofhavingpropercontrolof
suchvehicle,shallbeguiltyofanoffenceandliableonconvictiontoafineoffourhundrednairaorto
imprisonmentfortwoyears,ortobothsuchfineandimprisonment.
(2)Ifapersonisconvictedunderthissectionorundersection4,5or6ofthisActheshall,unlessthecourtforany
specialreasonotherwiseorders,bedisqualifiedforaperiodoftwelvemonthsorifthecourtthinksfit,forany
greaterperiod(fromthedateoftheconviction)fromholdingorobtainingadrivinglicence.
9.Powerofarrestincertaincases
ApoliceofficermayarrestwithoutwarrantthedriverofamotorvehicleonaFederalhighwaywhowithinhisview
commitsanoffenceundersection5,6,7or8ofthisAct,unlessthedrivereitherproduceshislicencetodriveor
producesotherevidenceofhisidentityacceptabletothepoliceofficer.
10.Driversofmotorvehiclestohavedrivinglicences
(1)ApersonshallnotdriveonaFederalhighwayamotorvehicleofanyclassordescriptionunless,heistheholder
ofavalidlicenceauthorisinghimtodriveamotorvehicleofthatclassordescription.
(2)ApersonshallnotemployanotherpersontodriveonaFederalhighwayamotorvehicleofanyclassor
descriptionunless,thepersonemployedistheholderofavalidlicenceauthorisingthepersonemployedtodrivea
motorvehicleofthatclassordescription.

(3)Apersonwhoactsincontraventionofsubsection(1)or(2)ofthissectionshallbeguiltyofanoffenceandliable
onconvictiontoafineofonehundrednairaorinthecaseofasecondorsubsequentoffencetoafineoftwo
hundrednairaortoimprisonmentforsixmonthsortobothsuchfineandimprisonment.
11.Offencesrelatingtolicencesandidentificationmarks
(1)AnypersonwhoforpurposesincidentaltouseronaFederalhighway(andwhetherornotsoused)

(a)
forges,orfraudulentlydefaces,alters,addstoormultilates,anydrivingorvehicle
licenceoridentificationmark;

(b)
exhibitsorusesanydrivingorvehiclelicence,oridentificationmarkwhichhasbeen
forgedordefaced;

(c)
lendsorallowstobeusedbyanyotherpersonanysuchlicenceasaforesaidor
identificationmarkpertainingtoanothervehicle;or

(d)

usesadrivinglicencebelongingtoanotherpersonorexhibitsorusesonavehicleanylicence
uponwhichfiguresorparticularshavebecomeillegible,orexhibitsorusesonavehicleany
colourableimitationofalicencetowhichheisnotentitled,

shallbeguiltyofanoffence.
(2)AnypersonwhodrivesonaFederalhighwayamotorvehiclerequiredtobearaprescribedidentificationmark
withoutthatidentificationmarkorwithafalseidentificationmarkshallbeguiltyofanoffence.
(3)Inthissectiontheburdenofproofofanyabsenceofintenttocommitanoffenceshalllieupontheperson
chargedtherewith.
12.Drivingwithoutauthorityofownerofmotorvehicle
AnypersonwhoonaFederalhighwaydrivesamotorvehicleonanyoccasionwithouttheauthorityexpressor
impliedoftheownershall,beguiltyofanoffenceandliableonconvictiontoafineofN100ortoimprisonmentfor
sixmonths,ortobothsuchfineandimprisonment.
13.Failuretoreportaccidents
(1)WhereanaccidentoccursonaFederalhighwaybyreasonoftheuseofamotorvehicleortrailerandinjuryis
causedtoanyperson,property,orlivestockinthechargeofanyperson,thedriverofthemotorvehicleshall

immediatelystopthevehicle;
whenrequestedsotodofurnishhisnameandaddress,thenameandaddressoftheownerof
thevehicle,theidentificationmarkofthevehicle,andotherparticularsrelatingtheretotoany
persontowhomortotheownerorpersoninchargeofthepropertyorofthelivestocktowhich,
theinjuryorotherdamagehasbeencaused,ortoanypoliceofficer;
ifthepersoninjuredsorequests,(andincasethatpersonisunconsciousortheinjurycausedto
thatpersonappearstoendangerlife)doallthingsreasonablypracticabletoattendtotheinjured
personsoastoprocureforhimmedicalattentionand,wherenecessary,hisremoval toa

hospital,andthedriveraforesaidshallreporttheaccidentasearlyaspossibletothenearest
policestation;and
(d)

whereacaseisnotwithinparagraph(c)ofthissubsection,reporttheaccidentassoonas
possible(notlaterinanyeventthan24hoursfromthetimewhentheaccidentoccurred)tothe
nearestpolicestation.

(2)Anypersonwhofailstocomplywithanyoftherequirementsofsubsection(1)ofthissectionshallbeguiltyof
anoffenceunderthisAct.
14.Failuretosupply,etc.,informationlawfullydemanded
(1)AnypersonsuspectedofhavingcommittedanoffenceunderthisAct,andwhorefuseswithoutlawfulexcuseto
giveapoliceofficerhisnameandaddressorsuchotherinformationthatmayreasonablybedemandedofhimby
thepoliceofficer,orwhogivesafalsenameoraddressorfalseinformation,shallbeguiltyofanoffence.
(2)TheownerandanyotherpersonincontrolorapparentcontrolofavehicleorofanyanimalsonaFederal
highwayshallonlawfuldemandbyapoliceofficer,givetothatofficerinformationwhichtheownerorother
personaforesaidmayhaveconcerninganyoffenceinvolvingtheuseofthevehicleorthedrivingofanimalsonthe
Federalhighwayatthetimeoftheoffence,andthefailuretocomplywithanysuchlawfuldemandshallitselfbe
anoffenceunderthisAct.
15.Overloadingordrivingavehicleinanunsafecondition
WhereonaFederalhighwayanoffencerelatingtotheoverloadingofacommercialvehicleorofdrivinga
commercialvehicleinanunsafeconditionorataspeedexceedingthatprescribedbylawiscommitted,the
personsliabletoconvictioninrespectoftheoffenceshallbe

(a)

thedriver;

(b)

theownerifnotalsothedriver;and

(c)

abaileeifnotalsothedriver,

sohoweverthatproceedingsagainstanypersonasownerorbaileeunderparagraph(b)or(c)ofthissectionshall
notbeinstitutedwithouttheapprovaloftheAttorneyGeneraloftheFederation,anditshallbeagooddefenceto
aprosecutioniftheownerorbaileeasaforesaid,provestothesatisfactionofthecourtthatnoactoromissionon
hispartwasconducivetothecommissionoftheoffence.
16.Useofmotorvehicleforpurposesotherthanlicensed
Anypersonwhousesamotorvehicleforapurposeotherthanthatforwhichitislicensedshallbeguiltyofan
offence;andsaveinthecaseofdrivingwithoutalicence(inrespectofwhichadifferentpenaltymaybeimposed)
nothinginthisActshallaffectordiminishtheliabilityofthedriveror,asthecasemaybe,theownerorbaileeof
thevehicleorasadriverunderanyotherenactmentorruleoflaw.
17.Offencesinrespectofwhichpenaltiesarenotelsewhereprescribed
WhereinrespectofanoffenceunderthisActnopenaltyisprescribed,thecourtconvictingmayinthecaseofa
firstoffence,imposeapenaltybywayoffineoftwohundrednairaorofimprisonmentforatermoftwelve

monthsorboth,andinrespectofasecondoranysubsequentoffence(whetherofthesamekindornot)the
penaltyshallbeimprisonmentforatermofeighteenmonthswithouttheoptionofafineunlessthecourt
otherwiseconsidersthatafinewillbeappropriateinthecircumstances.
18.Powerofpoliceofficertoretaindrivinglicence,etc.
(1)NotwithstandinganyotherprovisionofthisAct,ifapoliceofficerisoftheopiniononreasonablegroundsthat
theremaybedifficultyineffectingserviceofasummons,hemaydemandandretainthedrivinglicenceofany
personwhocommitsorissuspectedbyhimofhavingcommittedanoffenceunderthisAct.
(2)Whereadrivinglicenceisretained,whetherornotpursuanttothissection,thepoliceofficerretainingthe
licenceshallgiveawrittenreceiptforitandinformthepersonsurrenderingthelicenceofthenameofthepolice
stationatwhichitmaybereclaimed.
(3)IfasummonsinrespectofanoffenceunderthisActisservedonthepersonwhosedrivinglicenceisretained
bythepoliceorthatpersonappearspersonallyatthenominatedpolicestationnotlaterthanthreedaysafter
retentionofthedrivinglicence,hemayhaveitreturnedtohimupongivingtothepoliceareceipttherefore,duly
signedanddatedbyhim.
19.Powertonominatedriverofvehicleinpublicservice,etc.
Notwithstandingtheprovisionsofanyotherenactmentorruleoflaw,whereinrespectofvehiclesusedinthe
publicservicesofthefederationorofaStateanoffenceunderthisActiscommittedonaFederalhighway,the
MinistryorotherdepartmentofStateinwhoseservice(Federalorotherwise)thevehicleisused,maynominate
anofficialasthepersonresponsiblefortheoffence,andthatpersonshallbedeemedtobethepersonactually
liablethereforunlessthecourthearingthechargeissatisfiedthatthedriverofthevehiclewasinfacttheperson
guiltyoftheoffence.
20.Recoveryofexpensesincurredconsequentupondamagetofederalhighways
(1)WhereanystructuraldamagetoanypartofaFederalhighway,ortotheinformationofortoanydeckingor
drainageworkaspartofaFederalhighway,hasbeencausedbyanypersonwhetherornotthatpersonhasbeen
chargedwithanoffencecausingsuchdamageorwithanyotheroffenceunderthisAct(orunderanyother
enactmentorlaw),theMinistershallrecoverthecostofmakinggoodsuchdamagefromthepersoncausingor
responsibleforthedamage,theownerordriverofthemotorvehicleorthingthatcausedsuchdamage,orallof
them,jointlyor,inthecaseofanexemptvehicle,fromanyofthepersonsaforesaid.
(2)Wheredamageiscausedasaforesaid,theDirectororanypersonactingunderhisauthorityshall,withthe
assistanceofapoliceofficerseizethemotorvehicleorthinginvolvedinthedamage,orcauseittobeseized,and
removesametoanypremisesunderthecontroloftheFederalGovernmentorthegovernmentofaState,andmay
forsuchpurposeusesuchforceasmaybereasonablynecessaryfortheseizureorremoval,orforgainingaccessto
itoranypartthereofinordertofacilitateitsseizureorremoval.
(3)ThecostofmakinggoodthedamageshallbeassessedandcertifiedinwritingbytheDirector,whoshall
immediatelythereafterservethecertificateofsuchassessmentonthepersontowhomsubsection(1)ofthis
sectionrelates;andthecertificateshallcontainademandnoticeforthepaymentofthecost(asthuscertified)
intotheConsolidatedRevenueFundoftheFederation.

(4)ThecertificateoftheDirectorshallbeconclusiveevidenceofthecostofmakinggoodthedamage,andthe
amountasthuscertifiedshallbeadebtduetotheFederalGovernmentandshall,subjecttotheprovisionsofthis
sectionberecoverableassuch.
(5)Anyvehicleorthingseizedpursuanttosubsection(2)ofthissection,shallbedetainedinthesaidpremisesuntil
theamountofthecostofmakinggoodthedamageascertifiedundersubsection(3)ofthissection,hasbeenpaid
inthemannerspecifiedinthesaidsubsection(3)oruntildisposalthereofinpursuanceofsubsection(6)ofthis
section.
(6)TheMinistermaybyregulationsprovideforthemaintenanceofplacestowhichsuchvehicleorthingmaybe
removedandsuchsuitablefacilitiesasmaybenecessaryforitssafecustody,andmayalsobyregulations,
prescribetheprocedureforreclaimingitandforitsdisposalbysaleorotherwise:
Providedthatwhereasaleismadepursuanttothissubsectionand

(a)
thesumrealisedexceedsthesumstatedinthecertificate,theexcesssumshallbe
refundedtotheownerofthevehicleorthing;

(b)
thesumstatedonthecertificateexceedsthesumrealised,theoutstandingsumshallbe
recoverablefromthepersonresponsibleforthedamage,

andwhereasaleissomade,theMinisteroranypersonactingonhisbehalfshallensurethatthebestprice
availableisobtainedforthevehicleorthing,asthecasemaybe.
(7)Theforegoingprovisionsofthissectionareinadditiontoandnotinderogationofanypenaltyforoffencesthat
maybeimposedontheconvictionofanypersonforanyoffenceunderthisActorunderanyotherenactmentor
law,andtheprovisionsofthisActshallapply

(a)

(b)
notwithstandingthatanycivilactionorsuithasbeencommencedorinstitutedoris
contemplatedbyoragainstanyperson;and
(c)

wheremorethanonemotorvehicleorthingisinvolvedinthedamagesocaused;

whetherornotthepersononwhomthecertificateofassessmentofdamageisservedin
accordancewithsubsection(3)ofthissectionisthepersonchargedwithcausingthedamageor
provedtohavecausedthedamageortohavebeenguiltyofanyoffenceunderthisActorunder
anyotherenactmentorlaw:

Providedthatwherenegligenceleadingtothedamageisattributablewhollyorsubstantiallytoaperson,that
personshallbeproceededagainsttotheexclusionofotherpersonscontributingtothedamage.
(8)Theforegoingprovisionsofthissectionarewithoutprejudicetotherightofanypersonclaimingtobeinnocent
ofthedamagetorecoverfromanyotherpersonthroughthedueprocessofthelaw,theamountwhichhehad
paidpursuanttotheforegoingprovisionsofthissection.
(9)Inthissection

anyStatedirectorofpublicworks(howeverdesignated)towhomthepowersoftheDirectorof

neededforthepurposesofaFederalhighway,theMinistermayinwritingauthoriseanypersontoenteruponany
landinthelocalityforthepurposeofsurveyingandtakingnecessarylevels,andforthatpurposethepersonso

oneithersideofsuchmiddleline.
(3)NothinginthissectionshallauthorisetheMinisteroranypersonauthorisedbyhimtoenterintoanybuilding

(1)IftreesarestandinginapositionlikelyintheopinionoftheMinistertoobstructtrafficintheeventoffallingon
aFederalhighwayorlikelytoobstructtheviewoftrafficusingtheFederalhighway,anypersondulyauthorisedin
writinginthatbehalfbytheMinistermayenteronadjoininglandtoanynecessaryextentinordertofellor
otherwiseremoveorlogthetreesascircumstancesmayrequire,
(2)Ifthepowerconferredbysubsection(1)ofthissectionisexercisedinrespectofatreeonlandotherthana
Federalhighway,compensationshallbepayabletotheowneronlywheretheFederalhighwaywasinusebefore
thetreebecameapotentialsourceofobstruction,andthetreehadatthetimeofitsfellingamarketablevalue;in
defaultofagreementunderthissubsectiontheamountshallbefixedbyacompetentpersonappointedforthis
purposebytheMinister.
(3)Anawardofcompensationfixedbyagreementundersubsection(2)ofthissection,shallbefinal,andacourt
shallonlyentertainasuittorecovercompensationforanytreesfelledorotherwisedealtwithunderthissection
wheretheamountisfixedindefaultofagreement.
23.Powertoenteradjacentland
TheMinisteroranypersonauthorisedbyhiminwritingmayincaseofanysliporotheraccidenthappeningor
beingapprehendedinanycutting,embarkmentorotherworkundertheMinister'scontrol,enteruponanyland
adjoiningaFederalhighwayanddoallworknecessarytorepairdamagetherebyoccasionedandforthepurpose
ofpreventionorcontrolofslipslikelytooccurfromadjoininglandontoaFederalhighway.
24.Powertoacquirelandunderspecialenactments
WherelandisacquiredforthepurposesofthisActpursuanttosection2ofthissection

undertheLandUseAct;

(b)

ifthelandiscustomarylandwithinthemeaningoftheLandUseActandarequisitioninrespect
ofsuchlanddeclaresittoberequiredbytheFederalGovernmentforthepublicpurposesofthe
Federation,

Presidentmay,byorderpublishedintheFederalGazette,declareanyroadinNigeria(notbeingaFederaltrunk
road)tobeaFederalhighway,andmaybythesameoranyotherorderandwiththelikeapproval,cancel,amend

orvaryanynoticerelatingtoFederalhighwaystowhich,onitscommencement,thisActapplies,orthereaftermay
apply.
26.ApplicationofMotorVehicles(ThirdPartyInsurance)Acttoroadusersgenerally
(1)TheoperationoftheMotorVehicles(ThirdPartyInsurance)Acthereafterinthissectionreferredtoas"the
Act"isherebyextendedandthatActshallapplythroughouttheFederation,notwithstandingtheprovisionofany
enactment(includingtheActaforesaid)oranyStateLaworruleoflawtothecontrary;andtherequirementsof
theActastoinsuranceagainstthirdpartyrisksassetoutthereinandtheissueandproductionofcertificatesof
insuranceinrespectthereofshallcontinuetohaveeffectinallStatesoftheFederation,andinparticularthe
provisionsoftheActshall,inrelationtoanyFederalhighwaywithinthemeaningofthisActhaveeffectas
modifiedbythisAct,andshallstandamendedtoanyextentnecessary.

(1)TheMinistermaybyregulationsmakeprovisionsgenerallyfortheregulationoftheuseofFederalhighways
andforthemanagement,directionandcontrolofFederalhighwaysandwithoutprejudicetothegeneralityofthe
foregoingprovisionsmaymakesuchregulationsasappeartohimtobenecessary

withrespectto
(i)

and

thespeedatwhichmotorvehiclesofanyclassordescriptionthereofmaybedriven
eithergenerallyonanyspecifiedFederalhighwayorwithinanydefinedareaorplace;

(ii)

prescribingoffeesandothermattersrelativethereto;

classordescriptionorbyanypartorpartsofsuchavehicle ortrailerincontactwiththeroad,
andtheconditionsunderwhichtheweights
mayberequiredtobetested;

theparticularstobemarkedonmotorvehiclesandtrailers;

thetowingofordrawingofvehiclesbymotorvehicles;

(vii)

thenumberandnatureofbrakes,andanydeviceforensuringthatbrakes,silencers
andsteeringgearareefficientandkeptinproperworkingorder;

(viii) theappliancestobefittedforsignallingtheapproachofamotorvehicleor enabling


thedriverofamotorvehicletobecomeawareoftheapproachofanother
vehiclefromthe
rear,orforintimatinganyintendedchangeofspeedordirectionof amotorvehicle,andthe
useofsuchappliance,andforensuringthattheyareefficientandkeptinproperworkingorder;

(ix)

forprohibitingtheuseofappliancesfittedtomotorvehiclesforsignallingtheir
approach,beingappliancesforsignallingbysound,atanytime,oronorinany
specifiedpartofaFederalhighway;

(x)

fortheplacingonornearaFederalhighwayoftrafficsignsconformablewith
internationalstandardsandlocalrequirements;

(xi)

fortheprohibitionorcontrolofadvertisingonFederalhighwaysorwithin30.48
metresoftheformation;

(xii)

fortheexclusionofanyclassorclassesofvehiclesusingorlikelytouseaFederal
highwayandforvehicleinspection;

(xiii)

forrestrictingtheuseoffederalhighwaysbyanybreedofanimal;

(xiv)

forthelinetobekeptonaFederalhighwayandthedirectiontobefollowedby
vehicles;

(xv)

forroaddivisionortemporaryclosureofanypartofaFederalhighway;

(xvi)

fortheprohibitionofparkingorwaitingon,orasthecasemaybe,forprescribing
specifiedparkingorwaitingplaces,andtheprovisionofspacereasonablyrequired
forvehiclesapproachingorleavingpremisesadjoiningaFederalhighway;and

generallyfortheuninterruptedflowofvehicularandpedestriantraffic.

(2)Regulationsmayprescribepenaltiesforoffencesbywayoffinenotexceedingtwohundrednairaorby
imprisonmentforatermnotexceedingeighteenmonthsorbybothsuchfineandimprisonment.

Powertoremoveobstruction

(1)AnofficerauthorisedinwritingbytheMinistermaycauseanybuildingorpartthereofwhichhasbeenoris
beingcreatedoranyotherobstructionwhichhasbeencreatedorisbeingcreatedincontraventionofparagraph2
oftheseRegulations,within45.72metresofthecentrelineofanyFederalhighway,tobepulleddownor
removed.

(2)Whenanyexpensehasbeenincurredinthepullingdownorremovinganybuildingoranypartthereoforofany
otherobstructionasaforesaid,suchexpensemayberecoveredinasummarymannerfromthepersonwho
createdtheobstructionorfromthepersonwhocausedthesametobecreated.

(1)Nopersonshall,onorimmediatelyadjacenttoanyspecifiedFederalhighway
(a)

driveorpermitthemovementoflivestock,otherthanthatbeingcarriedinamotorvehicle;

(b)

permitorbeconcernedwiththebuyingorsellingoflivestock;

(c)

permitthegrazingoflivestock;

(d)

operateorpermittheoperationofanyhandcart.

(2)Anypersonwhofailstocomplywithanyoftherequirementsofparagraph(1)ofthisregulationshallbeguilty
ofanoffence.
(3)Apoliceofficermayarrestwithoutwarrant,anypersonwhowithinhisviewcommitsanoffenceunderthis

WEIGHBRIDGES)REGULATIONS

[Commencement.]

[11thMarch,1983]

1.ConditionsrelatingtoweightofvehiclesonFederalhighways
AsfromthecommencementoftheseRegulations,nopersonshallcauseorpermitavehicletobeusedonany
Federalhighwayorshalldriveorhavechargeofamotorvehicleortrailerwhensousedonsuchhighwayunlessall
theconditionshereinaftersetfortharesatisfied,thatis

(a)
avehicle,ifitsnetweightexceeds250kg.,shallbecapableofbeingsoworkedthatit
maytraveleitherforwardsorbackwards;

(b)
nomotorvehicleortrailerinclusiveoftheloadthereonshallexceed2.5metresin
overallwidth;andtheoveralllengthofanarticulatedvehicleshallnotexceed14metres
andtheoveralllengthofavehicleandtrailerdrawnbysuchvehicleshallnotexceed18
metres;

(c)
noloadmayprotrudemorethanonemetrebeyondthefrontelevationofamotor
vehicleortrailerormorethantwometresbeyondtherearelevationofthevehicleor
morethan75mmbeyondeithersideofthevehicleandwheretheloadprojectsmore
thanonemetrefromtherearofsuchvehicle,aredflagshallbefixedbydayandared
lampbynightinasimilarpositionandtheflagorlampshallbeclearlyvisiblefromthe
rear;

(d)
theheightfromthegroundlevelofanymotorvehicleortrailerwithanyfreightorload
placedthereonshallnotatanypointexceed3.5metres;sohoweverthatwherethe
freightorloadisentirelycomposedofseedcottonorcottonlinttheheightofthe

highestpointofsuchfreightorloadfromthegroundmaybeincreasedtonotmorethan
4metres;

(e)
anyfreightorloadonanymotorvehicleortrailershallbesecuredinsuchmannerasto
renderitimpossibleforsuchfreightorloadoranypartthereoftofallorbejoltedoff
thatmotorvehicleortrailerwheninmotionortocomeintocontactwiththeroadwhile
themotorvehicleortrailerisinmotion;

(f)
nofreightorloadofgreaterweightthanthatwhichthevehicleisconstructedtocarry
asregisteredandstatedintheregistrationbookshallbeplacedonanycommercial

vehicleortrailer,andtheownershallcausethenetweightofthevehicleortrailer,the
weightofsuchfreightorloadandtheaxleweightstobepaintedonsomeconspicuous
partoftheoffsideofthemotorvehicleinfiguresandlettersnotlessthan2.5cmin
heightandofsuchshapeandcolourastobelegibleandclearlydistinguishablefromthe
colourofthebackgroundwhereonthelettersandfiguresarepaintedormarked.

2.Vehiclesnottoexceed32tonnesgrossweight,etc.
(1)NovehicleshallbeusedonaFederalhighwayifthesingleaxleandtandemaxleweightexceeds10tonnesand
16tonnesrespectivelyorifthegrossweightofthevehicleexceeds32tonnesexceptasspecifiedinPartsIandIIof
theScheduletotheseRegulations.

(2)Notwithstandingtheforegoingprovisionsofthisregulation,anyauthorisedofficermaygrantapermitfora
particularoccasionoroccasionsfortheuseofamotorvehicleortrailerwhichdoesnotconformtothe
requirementsoftheseRegulationsandsuchpermitshallbesubjecttosuchconditionsasmaybeimposedthereon
andshallbecarriedbythedriverofthemotorvehicleonalloccasionsandbeproducedbyhimondemandbya
policeofficeroranauthorisedofficer.
(3)Anownerofamotorvehicleabovetentonnesbutnotexceeding32tonnesshallobtainanannualpermitin
suchformastheMinistermaydeterminetooperatethesaidvehicleonanyFederalhighway.
3.

Establishmentofweighbridges

(1)TheMinistermayinstallatsuchlocationsonanyFederalhighwayashemaydetermine,weighbridgesforthe
purposeofweighingofvehiclesinpursuanceoftheseRegulations.
(2)Anauthorisedofficermay,ifhesorequireswiththeassistanceofapoliceofficer,atanytimeandfor
reasonablecauserequireavehicleaffectedbytheseRegulationstobedriventoaweighbridgelocationtohaveits
net,grossoraxleweightascertainedandthepersondrivingthevehicleorinchargethereofshallcomplywithsuch
requirement.
(3)TheprovisionsoftheseRegulationsshallnotapplytoanomnibus,beingavehiclecapableofcarryingaloadof
notlessthan750kgdesignedandconstructedforthesolepurposeofcarryingpassengersandtheirluggage.
4.

Penalty

(1)NopersonshallcauseorpermittobeusedonanyFederalhighwayorthereonhavechargeofamotorvehicle
oratrailerwhichisnotinallrespectsinaccordancewiththeprovisionsoftheseRegulations.
(2)AnypersonwhooperatesamotorvehicleincontraventionoftheseRegulationsshallpayattheweighbridge
locationapenaltyofN100andinaddition,theownershallathisownriskandexpense,removetheexcessload
fromhisvehicle.
(3)Anypersonwhofailstopaythepenaltyinparagraph(2)ofthisRegulationorwhofailstocomplywithoractsin
contraventionofanyprovisionoftheseRegulationsshallbeguiltyofanoffenceandliableonsummaryconviction
toafineofN200ortoimprisonmentforaperiodnotexceedingsixmonthsortobothsuchfineandimprisonment.
5.

Interpretation

IntheseRegulations,unlessthecontextotherwiserequires
"authorisedofficer"meansanyofficerintheMinistryauthorisedinthatbehalfbytheMinister;

"owner"includestheagent,driverorotheremployeeoftheownerorhirer,chartereroranyotherpersonin
controlofthevehicleatthematerialtime.
6.

Shorttitle

TheseRegulationsmaybecitedastheFederalHighways(PermissibleWeightsandWeighbridges)Regulations.
