Subject: Gratitude for Peace/Staying the Light

Aloha Kkou e Ka Lhui Hawai'i,

We all owe a debt of gratitude to the Mauna Kea Hui. First for challenging the permit issued to the
Thirty Meter Telescope; second for requesting the emergency stay to prevent the confrontation that the
TMT leadership and State of Hawaii political leadership sought to create.
We also owe a debt of gratitude to the Supreme Court for granting the emergency stay. While only for
two weeks, the stay will at least provide an opportunity for cooler heads to prevail against those seeking
confrontation.
The process of granting the permit was unconstitutional, as the Supreme Court justices so clearly
indicated during the oral argument in the case brought by the Mauna Kea Hui. That private citizens had
to bring suit against a State agency to teach the agency about the Constitution is only a measure of how
far from pono that State agency had strayed.
The people did not need the Supreme Court to tell them that the permit was illegal. They rose up to
stop construction based on a true understanding of the law. They were seeking to enforce the law.
The State responded with law enforcement personnel, who at least had the decency later to apologize.
Then the Office of Mauna Kea Management issued rules severely restricting the practice of the
traditional Hawaiian faith on Mauna a Wkea. Prior to issuing the rules, the agency gave no notice and
offered no opportunity for the public to be heard. The agency conducted no public process at all.

The United Nations Charter provides the rest of the authority to do it. (An autonomous independent sovereign nation-state contemplated
under Article 1 of the 1933 Montevideo Convention on Rights and Duties of States requiring the state as a person of international law
possessing the four qualifications of (a) a permanent population, (b) a defined territory, c) government;
and (d) capacity to enter into relations with the other states.)

Shortly after the Kahuna of the Temple of Lono filed suit in Federal Court challenging the obviously
unconstitutional rules, the State agency withdrew the rules.
Again, the idea that a State agency had no understanding about the requirements for rule making, the
constitutional requirements for Due Process, and the State law requirements for public participation is a
measure of how lawless the State government can become when seeking to serve corporate interests,
instead of the people.
Then the BLNR declared a phony emergency and issued a new set of rules that lacked a factual basis,
violated the United States constitution, and violated the State of Hawaii constitution.
A court had to set things right by invalidating yet another lawless decision by a State agency.
There is a frustration building among State officials over their inability to make government a tool for
corporations seeking to exploit our aina. They were fully prepared to bring hundreds of law
enforcement officers into a confrontation with those still peacefully trying to enforce the law. The
Governor had no problem with that confrontation. The Attorney General had no problem with that
confrontation. The Chair of the Board of Land and Natural Resources had no problem with that
confrontation. The Hawaii County Prosecutor and law enforcement agencies had no problem with that
confrontation. Essentially, the State of Hawaii has abandoned its proper role in order to further a
billion dollar private project.
Clearly, they have demonstrated their contempt for the constitutions and laws of both the United States
and the State of Hawaii. They have demonstrated their desire to suppress a political movement that
will not bow down to their corrupt use of official power.
Of course, there are those within the State government that are still connected to the community,
understand and respect the reasons for the political uprising sparked by the TMT, and would never
consider using the power of government to suppress the people. Certainly, I hope that the wiser
counsel of such people will prevent the excesses intended by those without honor.
I will continue my work to complete the restoration of the Kingdom government. I leave it up to those
within the State of Hawaii government who know what is right to convince their colleagues to abandon
their plans to go rogue yet again.
