Dear Louis Flores:
This letter responds to your correspondence dated November 17, 2015, which, pursuant
to the FOIL, requested the following:
[R]e: Complaints made by tenants against 421-a program
Following-up on my FOIL Request submitted last May, I attach the list of
addresses that was requested of me. I was told after my FOIL Request was denied
that the Attorney Generals Office needed the addresses of the 421-a buildings to
cross-reference against the AGs records of tenant complaints.
The 421-a building address information (for The Bronx, Brooklyn, Manhattan,
Queens, and Staten Island)) in the attached Excel spreadsheets were obtained
from New York City.
As a reminder, I am seeking :
(a) records/statistics going back ten (10) years in connection with complaints of
any kind made to the state Attorney Generals Office by tenants in affordable
housing in buildings built with 421-a tax abatements; and
(b) records/statistics going back ten (10) years in connection with how the state
Attorney Generals Office referred/resolved/disposed of these complaints.
Please let me know how long it will take to receive the information I am seeking
in (a) and (b) above.
The Office of the Attorney General has conducted a diligent search for the records that

you have requested.


Please be advised that the records responsive to your request are exempt from disclosure
and have been withheld for one or more of the following reasons:

pursuant to New York Public Officers Law 87(2)(e), because the documents
requested were compiled for law-enforcement purposes and would, if disclosed,
interfere with law-enforcement investigations or judicial proceedings; and

pursuant to Public Officers Law 87(2)(b), because disclosure of the records


would constitute an unwarranted invasion of personal privacy.

You have a right to appeal the foregoing decision. If you should elect to file such an
appeal, your written appeal must be submitted, within 30 days, to Kathryn Sheingold, Records
