A person who is (i) well versed in Vyavahara [laws regulating judicial proceedings] and
Dharma [law on all topics], (ii) a Bahushruta [profound scholar] (iii) a Pramanajna [well
versed in the law of evidence], (iv) Nyayasastra valambinah [law abiding] and (v) has
fully studied the vedas and Tarka [logic] should be appointed to carry on the administration
of justice. [Mahabharata Shanti Parva 24-18]

RELIGIOUS EXPERTISE MUST BE CRITERION TO PICK JUDGES


Religious expertise of a candidate must be made as one of the eligibility criteria for appointment
of judges to the high court, according to the Temples Protection Movement (TPM), Hyderabad.
In a representation made to the Union government in response to suggestions for improvement
of the collegium system of judicial appointments, TMP convenor M.V. Soundararajan said their
submission was being made on behalf of crores of devotees. He said a better understanding of
laws relating to religion will help a judge in proper dispensation of justice in religious matters.
Hundreds of suggestions are pouring from across the country and the Centre has taken up the
responsibility to compile the suggestions and present them to the court during the hearing on
November 18.
He requested the Constitution bench to consider their views and either add religious expertise
defined by the Hindu Religious Endowments Commission, headed by eminent jurist C.P.
Ramaswamy Iyer, as one of the eligibility criteria for appointment of judges or consider their
view on essential practices doctrine to ensure future judgments as per the principle Yato
Dharmastha Jayaha to protect Hindu religion from mindless experimentation and reform which
is critical for the very survival of Hindu temples in the country.

Your Excellency - Protect Dharma


'VAK' readers, please note... your editor has petitioned His Excellency the President
of India.... Text of the same is as under .....
All High Court and Supreme Court judges must demonstrate that they have deep
knowledge of our itihaas, culture and religious practices. Tests must be conducted by
eminent, religious minded historians, to ensure this. In the alternative, religious matters
should be referred to a duly constituted National Tribunal as recommended by Hindu Religious
Endowments Commission report of 1962, headed by eminent Jurist Sri C P Ramaswami
Iyer.
It is to be noted that the Hindu Religious Endowments Commission has recommended
that the National Tribunal consisting of Religious experts have exclusive original jurisdiction
on Determination of what are matters of religion or essential religious practices and what
are ancillary or unessential accretions. In view of this the Religious Organizations have
recommended that till the National Tribunal is constituted the question of Essential Practices
relating to Hindu Religion be dealt with by Benches of five or more Judges to be in
conformance with the spirit of Art 145(3) as Religious expertise has never been a criterion
for Judges Selection.
it is unfortunate that the Hon'ble Supreme Court has allowed appointment of the
Judges as per the existing Collegium system in the order dated 19.11.2015 without addressing
the issue of Religious expertise of Judges raised in the suggestions and neither incorporating
the same in the eligibility criteria nor to provide a safeguard for dealing with the question
of application of Essential Practices of Hindu Religion.
In view of the fact that the issue of how the Hindu Religion is being reformed out
of existence against the warning of Sri Nani Palkhivala in the way the Essential Practices
Doctrine is currently being applied by the Supreme Court is already brought to your kind
notice through the representation dated 18th April 2015 and numbered as
PRSEC/E/2015/05585 we request your Excellency to the following :
1.
Not to approve the appointment of Judges as per the existing Collegium
system under Art 124(2) till the Hon'ble Chief Justice of Supreme Court issues a directive
that the question of application of Essential Practices of Hindu Religion is to be dealt
with by Benches of five or more learned Judges in conformance with the spirit enshrined
in Art 145(3) of our Constitution.
2.
Direct the Central Government to constitute a National Tribunal with Religious
Experts with exclusive Original jurisdiction on Determination of what are matters of religion
or essential religious practices and what are ancillary or unessential accretions as
recommended by the Hindu Religious Endowments Commission of 1962 headed by the
eminent Sri C.P. Ramaswamy Iyer. A draft Bill constituting such a Tribunal in 1968 was
inexplicably dropped by the then Central Government.
We request your Excellency as keeper of Nation's Dharma to ensure that the principle

on the above representation securing the ideals enshrined in the Preamble of our Constitution.

There should be no regional boundaries for temples.

Four headed deity Brahma arose from the lotus


of Lord Vishnu as the first among the deities.
Lord Vishnu taught him the Vedas and assigned
to him the creation of universe and its governance
using Vedas as the manual.
Atharvan was the eldest son of Brahma. Brahma
taught him the knowledge of Lord Vishnu referred
to as Brahman often. Knowledge of Brahman
is the foundation of all knowledges.
Dr.S.Radhakrishnan recalls the words of Aristotle
All the other sciences which are not
philosophy are more necessary , but none is
more important than philosophy to explain
why the knowledge of Brahman is described as
foundation of all knowledges.
Atharvan taught this knowledge of Brahman to
Angiras, who in turn taught it to Satyavaha.
Satyavaha taught this knowledge of Brahman
to Angiras (Jr).
Sounaka, a large hearted householder came to
know about the greatness of the knowledge of
Brahman. He approached Angiras and submitted
to him:
Oh! Venerable Soul! I am told you have the
knowledge of Brahman. I am also given to
understand that knowledge of Brahman passes
for the foundation of all knowledges. I would be
grateful to you if you can grace me with that
knowledge. It is exciting to know that one single
Brahman is the cause of all varieties in this
world.
At this Angiras (Jr) told him There are two
kinds of knowledge .One is of the lower level.
It is in the form of Scriptures that are called
Rig Veda, Yajur Veda, Sama Veda and Atharvana
Veda with the auxiliary texts in the six fields
of Phonetics, Rituals Grammar, Etymology,
Metrics and Astrology. Any one well versed in
the lower level of knowledge will be qualified to
the higher level which is in the form of meditation
of the Brahman as understood through the texts
in the lower level. This single minded meditation
of Brahman forming the higher level knowledge,
otherwise called Bhakti Yoga will lead to a vision
where one will feel as if he were seeing the
Brahman-the Lord in front of him

He then described to Sounaka the essence of


the lower knowledge describing Lord Vishnu the
Brahman the one single cause for all varities.
All varities in the world basically can be described
under the two types: the one that has knowledge
Chetana and the other one that does not have
knowledge Achetana. Lord Vishnu the Brahman
is the single source from which both Chetana
and Achetana emerge.
Oh! Guruji! Sounaka said. Is Lord Vishnu the
Brahman is a being with knowledge or not?
Why this doubt my Child! Obviously Lord Vishnu
the Brahman should have the capacity to think,
plan and execute the same. Otherwise He cannot
be the managerial cause for all the Chetana and
Achetana.
Well Master! Sounaka said. If Lord Vishnu
the Brahman were to be the Executive Cause
for the Universe then what is the material Cause
for the Universe? Obviously it is to be different
from Him. We have the raw material the Material
Cause for a product with a producer the Executive
Cause converting the Raw Material as the end
product. These two are different from each other.
Material cause and Executive cause are seen
to be different from each other. How do the texts
of lower knowledge described by you declare
Lord Vishnu the Brahman as single cause of
the Universe?
Angiras (Jr) smiled and thought over for a
moment.
Then He looked here and there.
He heard his wife ordering the maid servant to
clean the walls and roof of the Kitchen
Get rid of the Spiders and their cobwebs and
keep the walls clean on the eve of the New Year
He felt he had got the answer for the query of
Sounaka.
Look at the spider! He said.
It sends forth the threads that make cobweb
from its own self and when feeling done it draws
in its threads.
Now Gossamer is a product .It is made of threads
spun by spiders. As spiders spin the threads,
Spiders become the Executive Cause for the

Gossamer. The threads that are the Material cause


for the Gossamer emanate from the spider. Thus
the spiders become the Material Cause for
Gossamer.
If the tiny spider on the wall of our kitchen can
be both the Material and Executive Cause for
Gossamer, how can Lord Vishnu the Brahman
be not the single cause of the Universe?
Sounaka then submitted Oh! Master! Lord Vishnu
the Brahman is a Chetana. How can He be the
material Cause for the Achetanas in the Universe?
Sounaka! When did you have your last shave?
Swamy! said Sounaka Why this question now?
Just like that!. Your youthful beard is nice thick
black attractive and well grown.
I had my shave one month ago.
The hair in your beard - is it an achetana
or Chetana?
Achetana
It originates from you and grows .You are therefore
the material cause for the hair in your beard
How is it that you a Chetana is the material
cause for your beard an achetana?
Sounaka stood silent.
Angiras (Jr) said :As the hair grows on the
head and body of a living person so from the
imperishable Lord Vishnu the Brahman arises
the world
With this clarification Angiras (Jr) proceeded to
give the knowledge of Lord Vishnu the Brahman
to Sounaka. Further details of the Upadesam
form the text of Mundakopanishad.
This anecdote gives us the message that the
Lord is the one who is the single cause of the

vast universe. The spider and the youthful beard


all are examples given by Him to us to
understand this power par excellence of His.
There is a reference to Lord as the one craving
for curd in Vedas. They use the term Dadhikrava
for this. Chanting the mantra on the craver for
curds is supposed to cleanse our mouth and
remove the foul smell.
Why is the Lord letting Himself to be identified
with curd?
For Milk becomes curd without the need of any
external element.
We do perform the operation if sprinkling a
teaspoon of Butter-milk on Milk of appropriate
temperature to get curd of a desired taste. But
left to itself Milk would become curd.
Similarly Lord Vishnu the Brahman transforms
as all in Universe without the assistance of any
external parameter.
Such is His Power.
He is therefore described by the name
Mahasakthi which is listed as 177 th in Vishnu
Sahasranama.
Nirukti sums up this when it says

Sri Ranganatha Travel Part II

Story so far: The story based on the 14th century incidents,
was written by Sri Venugopalan which is based on the
historic facts elucidated in Madhura Vijayam composed
by Maharani Ganga Devi, Chief Queen of King
Kampanaraya. Two young men Vallabha and Dutta
set out on an expedition to locate the idol of Lord
Ranganatha of Srirangam, which was saved and kept
hidden by four Kodavas without being ransacked by
Muslim invaders. After several adventures the two boys,
with the help of Chenchu tribes found the idol along
with one Kodava who protected the idol for more than
eighteen years deep inside the forest of Chandragiri.
Lord Ranganatha was brought to Tirumala by King
Ranganatha Yadavaraya the ruler of that place. In
order to persuade the Vijayanagar king Bukka Raya
to take-up the expedition of restoring Lord Ranganatha
at Sri Rangam Vallabha took to fast unto death.
Coincidentally Sri Gopanna, commander-in-chief of the
Vijayanagaras mulvoy province reaches Tirumala in
search of Lord Ranganatha. He intervenes in the fast
of Vallabha and vows to restore Lord Ranganatha to
Sri Rangam, starts acting on the vow and thus ending
Vallabhas fast. Vallabha and Datta turned to
Kancheepuram on their way back and were shocked
to know that Singhazagar had passed away and Manjari
was left all alone. Both Vallabha and Dutta got affected
very deeply as they could not share the good news to
the man who was behind this whole expedition. They
ensured safety of Manjari with her neighbors and left
the town with disguised Vaishnavas as the fort doors
were closed as a defense to an impending attack by
Vijayanagar army. The disguised Vaishnava leader was
no other than Camphor merchant who revealed that
he was the head of Intelligence army of Vijayanagar.
Dutta, Vallabha and the Vijayanagar men were pursued,
but they managed to kill all the pursuers and escaped
and reached the foothills of the mountain on which
Sambuvarayas fort exists where at the behest of
Camphor merchant Vallabha and Datta enter the
Rajagambhira fort as Gem merchants to rescue
Makaravizhiyaal. They spot her in the palace while selling
gems to the queen. Datta wanted to abort the mission
and go while Vallabha stays firm. After some mutual
arguments the parting friends unite again to the mission
and get trapped in the palace attempting to meet the
princess.

Bukkaraya has convened a high level meeting with


his son Kampana Raya, Gopanna, Salva Mangu and
other subjects at Vijayanagara to discuss the course
of action on conquests to south. Gopanna spoke
Your majesty! Such small armies cannot conquer
Sultan. Vallaladeva came with a lakh of soldiers
to wage a war against Sultan. Many small kings
also helped him in the battle. But still he lost the
battle. So we must also take a huge army to defeat
the enemy. Otherwise it is very difficult. But I would
like to tell something at this stage. In Southern part
of India people are waiting for us to come with an
army. They were totally unhappy that we were not

doing anything all these days. I have personally seen


the sufferings of the people there. I was not able
to see the plight of the people there. People who
have some kindness in their heart cannot tolerate
their difficulties. They would definitely like to act
immediately. Oh King! I really wanted to do something.
Whether we have enough army or not we will fight.
If alive we will live with those people or else we
will also die along with them. Oh King! Please dont
decide that I am being emotional. I came from South
India taking the oath that I will help them in some
way. I will have to work for it until I die. Gopanna
said sternly to the King.
Oath? What kind of oath? asked Bukkaraya.
Gopanna slowly narrated the whole Thiruvarangan
story to them. While narrating sometimes his voice
choked due to sadness and in some places his
speech stuck. Whenever he narrated about Lord
Ranganatha he was totally shaken with full devotion
for the Lord.
Gopanna when he finally finished the entire story
of Lord Ranganatha and about his oath, the whole
court room where the council of ministers were
listening was totally dumbstruck as if in a spell with
some kind of magic. There was complete silence.
Bukkaraya was already filled with emotions. His
eyes were wet with tears. Then slowly he called
Gopanna and got up from his seat.
Gopanna! My son Kampana told me that I should
not get emotional. But after hearing all this story I
am left with emotions alone. Sometimes too much
emotions can mislead us but it can also lead us
to a good path and make us reach the top. The
birth of Viayanagara kingdom is a result of emotions.
We wanted to build a state and we could do. Now
that we heard your story do you know how we feel.
We feel the same like we had when we wanted to
build Vijayanagar. What you said is right. It is very
true that Lord Ranganatha is a great symbol of
southern states. You described very well the troubles
and struggles that Lord Ranganatha had to undertake.
In fact this struggle of Lord Ranganatha would be
a symbol for southern states. You have made me
realize this. If we understand the struggles undertaken
by the Lord we can very well understand the plight
of the people who underwent such struggles. Gopanna
please I am really feeling the pain. Tell me what
we should do. We can do whatever is possible
said the King.
We should straightway march with an army for a
battle with Sultan said Gopanna. The rest of members
of the court agreed with his suggestion. Bukkaraya
turned and asked his son Kampana that what he
feels.
I am anytime ready to wage a battle against Sultan.
Just waiting for your orders. Said Kampana.
Bukkaraya looked at everybody deeply.

Ok I agree to whatever you say. But who will fight


against Bahmanis. Asked Bukkaraya.
The entire court was silent for a while. They were
in deep thoughts. They all know that Bahmanis
are big stumbling block for them. If these people
do not exist, Bukkaraya would have beaten Madurai
sultans by this time and would have brought the
entire sourthern states together and would have
named it as Vijayanagara Kingdom. He would have
even changed his name to Rajadiraja from
Mandaladipathi. But all this did not happen because
of Bahminis. After eleven years of the formation
of Vijayanagara Kingdom, (AD 1347), a King called
Alauddin Bahman formed a Turkish kingdom having
Gulbarga as its capital and from that time this
Bahman kingdom was always a nuisance for
Vijayanagara kingdom. After several wars between
these two kingdoms, they both came to mutual
agreement of peace as both of them understood
each others strengths. But the cold war was still
existing between them in spite of their agreements.
The Bahman kingdom was in the northern part of
Vijayanagara kingdom. Gopanna has decided to
go ahead and fight Madurai sultan who is in the
southern region of Vijayanagara kingdom. If the entire
army leaves for south then who will take care of
the northern region which also needs sufficient army
to face bahminis. So far the Bahminis did not attack
the kingdom because of the strength of our army.
If that is moved to south, the strength in the northern
region would get reduced and the Bahminis would
definitely use this opportunity to capture our kingdom.
It is for this reason all these days we were quiet
and tolerant with Madurai sultan. Do we need to
loose our kingdom which we formed after several
hardships in the hands of Bahminis by committing
a mistake? The entire court was hearing this silently.
The word Bahmini itself made them think a lot.
Bukkaraya after seeing all this stood up. He slowly
smiled at everybody and said clearly, Dear court
members! Please stop worrying about Bahminis.
Everybody were surprised to hear this from
Bukkaraya. Bukkaraya continued. how long we
will not get into other activities with the fear of these
Bahminis. Now I have clearly decided that we should
bring all southern region as one kingdom.
Immediately Kumara Kampana rose from his eat
with a jump. Oh Father! I was only waiting for these
words from you. Please command us as to what
to do. He said with excitement.
Kumara! Be patient! This was not the decision
taken by me. This has been decided by Lord
Ranganatha said Bukkaraya.
Gopanna immediately reacted to this and asked,
Oh Majesty! What do you say? Did Lord Ranganatha
order you?
Gopanna! I would have been elated soul if Lord
Ranganatha himself had ordered me to do so. But
I was not blessed that much. But Queen Devayi
has been expressing her two wishes for all these

twenty years which might be a small wish but very
difficult to accomplish.
What ? Is it so difficult for Mandaladipathi himself?
asked SalvaMangu.
Yes. Let me explain the queens wish. She wants
one Rathyatra to be performed for Lord Ranganatha
at Srirangam. And also she wants a holy dip in
Tamiraparini, in the southern region. These are her
wishes. This wish she has been telling for the past
twenty years for which I keep telling her that one
day it will be fulfilled. Last month she took me to a
room in the palace. When she opened the doors I
was shocked. The entire room was filled with gold
coins, sarees . When I asked what for all these,
she told me all these coins belong to Lord Ranganatha
and the sarees has to be donated to people on the
banks of Tamiraparani. I came to understand the
truth that she was believing strongly that one day
her wishes will be fulfilled. Otherwise would she
collect these coins for all the twenty years? The
whole night I thought about it a lot. Will the people
in the south not be having the same belief like
the queen for all these twenty years? They would
be thinking and waiting all these years that this

save us. How long I will keep answering them that
one day that will happen ?
The two messengers of Yadavaraya and Gopanna
came to us from Tirupathi at this point of time when
my mind was full of thoughts like these. So that
showed that God wants to do something and he has
shown the way. That gave me more clarity and I
wanted to take a quick decision on this. So come
what may, we will start expanding our kingdom in
the southern region. That has to be accomplished
somehow by using all our wisdom. So Kumara I called
all of you to Vijayanagara to discuss about this.
After completing his emotional speech Bukkaraya
slowly sat on his seat. Gopanna immediately rose
and said, Long life your Majesty! You have made
a way for my oath to get fulfilled. Kampana also
joined Gopanna saying, even my wish to expand
our state till southern ocean will also be fulfilled.
Then Later they elaborately discussed the ways to
take the army to south and the possibilities of risks
involved. That too when Bahminis are there on the
banks of Tungabhadra. One bank of Tungabadra is
Bahmini kingdom and the other bank is Vijayanagar
kingdom. By the time they completed the discussion
and come to a conclusion it was almost night.
The conclusion was to first conquer the Sambuvaraays
and annex their state to Vijayanagara state and also
closely monitor the activities of Madurai Sultans side
by side. If the situation permits they can start the
attack on sultans. After these discussions he proudly
embraced his son Kampanar and adorned him with
all golden and gemstone garlands which he was
wearing. He also said that they can start the journey

Protection of Sanathana Dharma


Duty of Ahobila Mutt and its disciples
So far VAK readers have been reading various important
historical events in Ahobila Mutt which have indicated
the importance of this great Mutt in protecting Dharma
and the importance of the disciples of this mutt in
following various niceties about Dharma. People
of all walks of life are disciples of this Mutt and it
is their duty to protect Dharma. In this context I
would like to bring out excerpts of an important editorial
article which was published in Vedanta Deepikai
during 1915 and it talks about the inner meaning
of Dharma:

It means that there are seemingly lots of confusing
alternatives making the choice of Dharma,
righteousness difficult, there are many different vedas
which seem to have mutual contradictions (although
they may actually not) which further enhances the
confusion, there are differences among sages who
have tried to lead the way and hence difficult to
follow, and the meaning of Dharma is not that easy
to understand and hence it is advisable to follow
people who understand the vedas correctly and have
the habbit of helping people in making them understand
vedas in a correct way. These are learned scholars
and practitioners of dharma and austerity filled life
called Mahajanas or a group of learned people who
understood the inner meaning of Dharma. The definition
of Mahajana is given by Yagnyavalkya as follows:

It means a Parishad of atleast four erudite scholars
in Dharma and vedas or among them having people
with knowledge of three vidyas adhyaathma,
adhibhouthika and Adhideivika or atleast one with
Adhyatma knowledge can guide people in the Dharma
path. This means people with deep knowledge about
Lord and strong practitioners of devotion to him only
can be qualified to be members of the
Dharmikaparishad or group of Judges who can decide
on matters pertaining to Dharma. In modern days
these kind of people are rarely found. As many
respectable dharmik practioner families have

denigrated themselves into materialistic desires and


practitioners of materialistic walks of life it is tough
to find a good Dharmika Parishad. As a result
significant amount of decisions and conclusions have
become mired with flaw in Dharmik thought. People
who understand Dharma are rare and even if they
are available they are voiceless spectators. Many
have become selfish and as a result have tried to
misinterpret scriptures to serve their selfish needs.
These are wanton breaking of Dharmik rules and
they are not pardonable. However these type of people
are now more in number and they lead the world
in wrong directions. Although what they say is nondharma it is ironic to see that others admire these
selfish people and say oh! What a dharmik
decision?!. This is even more a pathetic situation.
More than outward purity, the inner purity is the
most important item and all people who love dharma
should realize this. Under such difficult circumstances

following all these become qualified for being a judge
and he who does not touch wrongly earned money

where there is Dharma, there is almighty or Lord
Balaji. It also means where there is Balaji, there
is Dharma which in essence means Dharma is
nothing but a personification of Lord himself. In

All the erudite scholars of vedas and knowers of
the difference between soul and supreme paramatma
they say that Lord Krishna himself is Dharma. It
is because of this ardent devotion to Lord such pure

worth mentioning an anecdote from Mahabharatha
where Dhuryodhan comes to Gandhari to seek
blessings of his mother before start of the war. It
is believed that a mothers blessing and that too a
pious and ardent pathivratha and devotee of Lord
Vishnu like Gandhari when she blesses it will come

of Dharma did not do this. Instead she told oz |ooz

knowledge of dharma? How can we allow this to


happen? How can religion be reformed out of
existence? Is this dharma? Thinking in all these
angles Ahobila Mutt made a forerunning effort to
suggest to Supreme Court prescribing knowledge
of dharma and religion to Judges and constitution
of a parishat of atleast 4 members of learned scholarly
judges as a minimum requirement to decide on
matters concerning religion so that Dharma is upheld.

Worrying scene in State
With rise in number of farmers suicides, pesticides
available across the State have come under scrutiny.
Pesticides marketed in Telangana include Class I a
(extremely hazardous) chemicals such as methyl
parathion, phorate and phosphamidon
At the outset, one must understand that suicides on
farms are occurring with alarming frequency, not only
in developing countries like India and China, but also
in the United States, France, England, Canada, and
Australia. Prolonged drought, failed crops, mounting
debt, and poor economics on the farm have been
offered as possible reasons, in addition to depression
caused by pesticide exposures.
In France, a farmer dies by suicide every two days.
In China, farmers are killing themselves to protest
the governments seizing of their land for urbanisation.
In Ireland, the number of suicides jumped following
an unusually wet winter in 2012 that resulted in trouble
growing hay for animal feed. In the UK, the farmer
suicide rate went up by 10 times during the outbreak
of foot-and-mouth disease in 2001, when the
government required farmers to slaughter their animals.
In Australia, the rate is at an all-time high following
two years of drought.Researchers from US National
Institutes of Health did a 20-year study involving about
84,000 farmers and spouses of farmers, who were

interviewed since mid-1990s, to investigate the


connection between pesticides and depression. Freya
Kamel, the lead researcher, subsequently provided
justification for the study: There had been scattered
reports in literature that pesticides were associated
with depression We wanted to do a new study
because we had more detailed data than most people
have access to.
What the researchers found generated intense debate
among experts and eco warriors. I dont think theres
anything surprising about the fact that pesticides would
affect neurological functions, Kamel says. According
to the team, though theres a significant correlation
between pesticide use and depression, two types in
particular, says Kamel, reliably moved the needle on
depression: organochlorine insecticides and fumigants,
which increase the farmers risk of depression by a
whopping 90 per cent and 80 per cent, respectively.
The seven types of pesticides mentioned above arent
necessarily uncommon either; one, called malathion,
was used by 67 per cent of thousands of farmers
surveyed. Reports suggest that hazardous pesticides
marketed in Telangana include methyl parathion, phorate
and phosphamidon in Class I a (extremely hazardous)
as well as oxydemeton-methyl, edifenphos,
methamidophos, methomyl and monocrotophos in Class
Ib.
In addition, many moderately hazardous (WHO Class
II) pesticides are also implicated in earlier studies
and reports of acute poisoning, including carbaryl,
cypermethrin, endosulfan, fenvalerate, profenophos,
quinalphos , carbofuran, chlorfenvinphos, coumatetralyl,
dichlorovos, methomyl, monocrotophos, oxydemeton
methyl, propetamphos, sodium cyanide, triazophos,
warfarin and zinc phosphide. Although the study did
not deal with exactly how pesticides are affecting
farmers, nobodys quite sure where depression fits
in.
Asked by experts whether approved pesticides have
been wreaking havoc on the neurological systems
of farmers, Kamel doesnt recommend policy; but
says shes a scientist and would only suggest we
should cut down on the use of pesticides in general.
Kamel's study, however, did find farmers with a
higher lifetime exposure to pesticides had more

neurological problems. Some of the chemicals these


farmers used, like DDT, are no longer on the market,
but others remain in use.
Some are even found in lawn and garden treatments
that people use at home. However, because the
concentrations of the chemicals are lower in home
formulas, and because home gardeners tend to use
pesticides less often than farmers do, it's hard to
say if the general public faces a significant risk.
Pesticide-suicide meme gained currency in October
with the publication of the article, Pesticide use by
farmers linked to high rates of depression, suicide,
in Environmental Health News.
The article noted recent research has linked longterm use of pesticides to higher rates of depression
and suicide. Kamel is clear that while research shows
that pesticide exposure does affect mental health,
some people are misreading the study as evidence
of a pesticide-suicide connection. In our study, we
found absolutely no association of pesticides with
suicide. Suicide and depression are not the same
thing, she says.
We did a paper earlier on suicide, and only 15 per
cent of people who committed suicide have reported
depression, so its not a strong link. It is clear that
depression is a risk factor for suicide, but there are
other psychological characteristics that increase risk.
Other studies have established links between
pesticides and suicides. A WHO survey of 9,800 people
in a Chinese province revealed those who stored
pesticides at homes had more than double the risk
of having suicidal thoughts. Since 1999, at least 10

peer-reviewed studies have found a link between


pesticides and mental depression.

Constitution is above all things, says BJD MP

THE BRAIN BEHIND THE AMBEDKAR SPECIAL SITTING
BJD leader Bhartruhari Mahtab's proposal for a
'Constitution Day' was accepted by the government and
resulted in the two-day special sitting of Parliament. He
explains why remembering B R Ambedkar is relevant
and why the uniform civil code is compatible with the
stalwart's view of the Constitution.
Dr B R Ambedkar is sometimes portrayed as a sectarian
leader of a certain community and as if he stood only for
reservations and nothing else. His achievements, given
his humble background, clearly demonstrate that he
made the most of the opportunities that came his way
despite the discrimination he faced.
He was a great thinker and social reformer. After gaining
high education, he did not seclude himself from the
problems of the poor. That is why when Babasaheb's
125th anniversary came up, I felt that the occasion could
be observed as 'Constitution Day'. This can now be a
regular feature.
The idea is to not only remember his great contribution
in framing the Constitution but also deliberate on the
basic scripture on which our democratic polity exists.
That is why I said during the debate on the budget earlier
this year that regular observance of a 'Constitution Day'
will help children and college students learn about the
document that empowers our citizenry.
Young people could become more aware of the rights
and duties enshrined in the Constitution and how these
values are reflected in the legislation that Parliament
debates and passes. For example, a section of the
Constituent Assembly was virulently opposed to the Hindu
code bill and attempts to examine other religious codes.
Partition had taken place very recently on religious lines.
This was why the UCC was put in the directive principles.
The UCC is a natural corollary to the adoption of a single
transferable vote. Perhaps the Congress was also not
confident of pushing this measure. But it is time to actively

BJD bats for debate on Uniform Civil Code


New Delhi:- The BJD today batted for a debate on Uniform
Civil Code in Parliament, against the backdrop of the
Supreme Court asking the government to come up with a
view on the contentious issue.
The Supreme Court has asked the government to take a
quick decision on the Uniform Civil Code. Article 44 of the
Indian Constitution states that India should strive to have a
Uniform Civil Code. The Constitution has enough powers
for protection of rights of the minorities and the government
should begin a discussion on the issue, BJD leader B
Mahtab said while participating in a debate in Lok Sabha
on the Constitution.

SWAMY VIVEKANANDA 'S VIEWS ON IMAGE WORSHIP


#. All of you have been taught to believe in an omnipresent God. Try to think of it. How few of you can have any idea
of what omnipresence means! If you struggle hard, you will get something like the idea of ocean, or of the sky,
or of a vast stretch of green earth, or of a desert. All these are material images, and so long as you cannot
conceive of the abstract as abstract, of the ideal as the ideal, you will have to resort to these forms, these
material images. It does not make much difference whether these images are inside or outside the mind. We
are all born idolators, and idolatry is good, because it is in the nature of man. Who can get beyond it? Only the
perfect man, the God-man. The rest are all idolators. So long as we see the universe before us, with its forms
and shapes, we are all idolators. This is a gigantic symbol we are worshipping. He who says that he is the
body, is a born idolator. We are spirit, spirit that has no form or shape, spirit that is infinite, and not matter.
Therefore any one who cannot grasp the abstract, who cannot think of himself as he is, except in and through
matter, as the body, is an idolator. And yet how people fight among themselves, calling one another idolators!
In other words, each says, his idol is right, and the others' are wrong.
#. Two sorts of persons never require any image--the human animal who never thinks of any religion, and the
perfected being who has passed through these stages. Between these two points all of us require some sort
of ideal, outside and inside.
#. The Christians think that when God came in the form of a dove it was all right, but if He comes in the form of
a fish, as the Hindus say, it is very wrong and superstitious. The Jews think if an idol be made in the form of
a chest with two angels sitting on it, and a book on it, it is all right, but if it is in the form of a man or a woman,
it is awful. The Mohammedans think that when they pray, if they try to form a mental image of the temple with
the Caaba, the black stone in it, and turn towards the west, it is all right, but if you form the image in the shape
of a church it is idolatry. This is the defect of image worship.
#. We may worship anything by seeing God in it, if we can forget the idol and see God there. We must not project
any image upon God. But we may fill any image with that Life which is God. Only forget the image, and you are
right enough---for "out of Him comes everything". He is everything. We may worship a picture as God, but not
God as the picture. God in the picture is right, but the picture as God is wrong. God in the image is perfectly
right. There is no danger there. This is the real worship of God.
#. Superstition is a great enemy of man, but bigotry is worse. Why does a Christian go to church? Why is the
cross holy? Why is the face turned toward the sky in prayer? Why are there so many images in the Catholic
Church? Why are there so many images in the minds of Protestants when they pray? My brethren, we can no
more think about anything without a mental image than we can live without breathing. By the law of association the material image calls up the mental idea and vice versa. This is why the Hindu uses an external symbol
when he worships. He will tell you, it helps to keep his mind fixed on the Being to whom he prays. He knows
as well as you do that the image is not God, is not omnipresent. After all how much does omnipresence mean
to almost the whole world? It stands merely as a word, a symbol. Has God superficial area? If not, when we
repeat the word "omnipresent", we think of the extended sky or of space, that is all.
#. Unity in variety is the plan of nature, and the Hindu has recognised it. Every other religion lays down certain
fixed dogmas, and tries to force society to adopt them. It places before society only one coat which must fit
Jack and John and Henry, all alike. If it does not fit John or Henry, he must go without a coat to cover his body.
The Hindus have discovered that the absolute can only be realised, or thought of, or stated, through the
relative, and the images, crosses and crescents are simply so many symbols---so many pegs to hang the
spiritual ideas on. It is not that this help is necessary for every one, but those that do not need it have no right
to say that it is wrong. Nor is it compulsory in Hinduism.
#. It has been a trite saying, that idolatry is wrong, and every man swallows it at the present time without

#. Therefore, we should get rid of these childish notions. We should get beyond the prattle of men who think that
religion is merely a mass of frothy words, that it is only a system of doctrines; to whom religion is only a little
intellectual assent or dissent; to whom religion is believing in certain words which their own priests tell them;
to whom religion is something which their forefathers believed; to whom religion is a certain form of ideas and
superstitions to which they cling, because they are their national superstitions. We should get beyond all
these, and look at humanity as one vast organism, slowly coming towards light----a wonderful plant, slowly
unfolding itself to that wonderful truth which is called God---and the first gyrations, the first motions, towards
this are always through matter and ritual.

'VAK' expresses its deep condolences on the death of Shri Ashok Singhalji, the International Working
President of VHP who had fought for freedom of Hindu Temples from Government Control all his life.
He passed away on 17th Nov. 2015. His last wish was for a Central Endowments Legislation to free
Lakhs of Hindu Temples an expectation he has from the current Government expressed in his interview
with Shri Prabhu Chawla.
PC : You mean to say that the temples and the maths should be taken out of the government's control.
AS : Yes. The temples will be safe only when they are freed from government control.
PC : Name the temples.
AS : There are lakhs of temples in the country. All the temples in South India are under government control.
PC : So you would expect the PM to (free the temples from government control.)
AS : Definitely. There are many temples in North India that are under government control. They should be
made autonomous. The temples belong to the Hindu community and they should be governed by the
community. There should be a law for the same.
PC : That's your expectation from Modi.
AS : Definitely. I expect him to do this. Also, India's culture is facing challenges. The intellectual heritage
being thrust upon us is a huge threat to our tradition and culture.

AHOBILA MUTT SUGGESTS ELIGIBILITY CRITERION FOR JUDGES
Sri Ahobila Mutt with branches across India and millions of devotees across the world has represented to
the Department of Justice that deep knowledge of Indian history, culture and religious practices must be
made an eligibility criterion for all High Court and Supreme Court Judges.
The 617-year-old institution made this suggestion in response to the call given by the Supreme Court to
the general public on the eligibility criteria for High Court and Supreme Court Judges.
Root cause
Lack of knowledge of the Judges of various Hindu religious practices could be a root cause of misplaced
judgements, it said.
The representation further said that tests must be conducted by eminent, religious minded historians to
examine the knowledge of Judges. Otherwise religious matters be referred to a duly constituted National
Tribunal as recommended by Hindu Religious Endowments Commission report of 1962, headed by eminent
Jurist C.P. Ramaswami Iyer.
The Mutt representative said that Hindu religious freedom has been diluted by successive judgements
both at High Court and Supreme Court levels.
The control of State government over Hindu religious matters and temple properties were total, affecting
Hindus Constitutional right under Article 25 to practice and propagate its religion.
The memorandum said that in the guise of regulating financial irregularity, gross injustice was meted out
to Hindu religious institutions and those practicing it.
The courts seem to be unwittingly abetting with State governments to reform and regulate Hindu practices
in violation of fundamental Constitutional Rights.

MAKE RELIGIOUS EXPERTISE A CRITERION FOR APPOINTMENT OF JUDGES
It will help in protecting Hindu religion from mindless experimentation and reform which is
critical for the very survival of temples in the country, says TPM convenor
Temples Protection Movement (TPM) that has been striving to free temples from the government control
and commercialisation of temples urged the Constitution Bench of the Supreme Court to add religious
expertise as one of the eligibility criteria for appointment of Judges.
In response to the suggestions called by the Constitution Bench of the Supreme Court from the public
on November 5 on improvement of present Collegium system appointing Judges, Temples Protection
Movement (TPM) convenor M.V. Soundararajan said their submission was on behalf of crores of devotees.
Appeal : Dr. Soundararajan in his representation to the Joint Secretary, Department of Justice on
Friday said that they offered their suggestion under the category of improving eligibility criteria for
appointment of Judges to Supreme Court.
He requested the Constitution Bench to consider their views and either add religious expertise defined
by the Hindu Religious Endowments Commission headed by eminent jurist C.P. Ramaswamy Iyer as
one of the eligibility criteria for appointment of Judges or consider their attached note appealing for
review of Essential Practices Doctrine to ensure future judgements as per the principle Yato Dharmastha
Jayaha to protect Hindu religion from mindless experimentation and reform which is critical for the very
survival of Hindu temples in the country.
Criticisism on Essential Practices Doctrine : Dr. Soundararajan citing the book Government Rules
Hindu Temples said it reiterated the criticism of the Essential Practices Doctrine by senior Supreme
Court advocates Rajeev Dhavan and Fali Nariman that the Judges assumed much greater power and any
error in judgement meant irrevocable damage to religious freedom as substantiated with data in the book.
They said that the Judges virtually assumed the theological authority to determine which tenets of a
faith are essential to any faith.
Recalling that the Doctrine has been criticised widely for its use in declaring Jain ritual of Santhara as
unlawful, Dr. Soundararajan said jurist Ramaswamy Iyer had suggested in his report in 1962 for
constitution of a National Tribunal.
The Supreme Court, he regretted, in some of its judgements went against the spirit of Article 25 and
Article 26 and the fundamental rights enshrined in them.
