RULES AND REGULATIONS GOVERNING THE NEW


ACROPOLIS MANILA EXECUTIVE VILLAGE
HOMEOWNERS ASSOCIATION, INC.

Pursuant to the authority granted in the Articles of Incorporation and


By-Laws of NEW ACROPOLIS MANILA EXECUTIVE VILLAGE HOMEOWNERS
ASSOCIATION, INC. (Hereinafter referred to as the Association), the Board of
Directors hereby promulgate these rules and regulations:
I. MEMBERSHIP
1. All owners and/or buyers of lots and/or house & lots in the
subdivision shall automatically be members of the Association. They shall
be required to file their application of membership and pay the prescribed
membership fee.
2. All transferees of rights from the original property owners shall
assume the membership of the said original owners in the Association and
therefore need not apply for membership. They shall, however, likewise
assume all liabilities or obligations that the original owners will leave. Any
lien that the Association has on the property transferred shall continue to be
binding on the new owner.
3. Long-term lessees in the Subdivision may be considered regular
members provided the lessor/owner assigned its rights to the lessee and
furnishes the Association with copies of the lease contract and the Deed of
Assignments of Rights. The long-term lessee shall be entitled to the same
rights as the property owners and shall likewise to the same dues, fees and
charges. Notwithstanding this however, the lessor shall still be held primarily
responsible for the faithful compliance of the lessee with all Association rules
and for the payment of required dues, fees and charges.
4. The applicant for membership shall indicate in its application form
the official addressee of all correspondence of the Association and, in case
he/she is not residing in the Subdivision, his/her postal address. He/she must
likewise officially inform the Associations Secretary of any change in the said
postal address or in the members of his/her household. The Association shall
not be held liable for any failure to furnish the Association with accurate
information.
5. The roster of members of the Association and any information
pertaining thereto shall not in any event be divulged or open to any person
or party who is not a member of the Association.
6. All ASSOCIATION members are required to faithfully comply with the
rules and regulations, as well as any other rules that the Board of Directors
of the Association (Board) may promulgate from time to time. They are
likewise required to promptly pay all dues, fees and other charges set forth
by the Board. The Board may post the names of all members who

continuously violate Association rules or who are habitually remiss in the


payment of dues, fees and other charges.
II. DUES, FEES AND OTHER CHARGES
1. A membership fee of P 20,000.00 shall be paid by the lot or house &
lot buyer upon filing its application for membership in the Association.
2. A monthly membership dues, the specific amount of which shall be
fixed and /or adjusted by the Board from time to time, must be paid by each
member to the Association which shall be due every ___ calendar day of the
month. After the last day of the month, any unpaid due is considered past
overdue. Said membership dues shall cover the authorized expenses and
projects of the Association.
3. Special assessments and other charges may be imposed by the
Board from time to time, such to be used for specific purpose or
undertakings. No special assessment shall be imposed on any member
without specifying clearly the purpose of such assessment.
4. The Board may impose penalties and surcharges on any delayed
payment of members dues on any unpaid accounts of the member. It may
likewise disallow any member with unpaid accounts from availment of
Association services and/or entitle to any membership right or privilege. Any
unpaid account, including penalties and surcharges, whether for Association
dues or for the use of community facilities, shall constitute a lien on the
property of the member, subordinate only to lien of the government and
voluntary mortgages. Defaulting members shall likewise be liable for the a
fixed amount to be made part of the general reserved fund of the Association
which may be used to finance various community projects and/or activities,
and
III.RIGHTS AND PRIVILEGES OF MEMBERS
1. All members shall be entitled to all the following rights and
privileges on the express condition that they shall be in good standing at all
times, meaning they must constantly comply with Association rules and
update their accounts with the Association.
2. The right to privacy of abode of all members and the right to
exercise ownership of their property shall be inviolable and should always be
respected and protected by the Association. The Board may impose
appropriate sanctions or penalties against any member found to violate or
disturb the privacy of another member, or in any way restrict the latters
ownership rights over their property.

3. All members in good standing are eligible for any elective or


appointive position in the Association, provided however that they possess
the other qualifications required for the specific position for which they
aspire.
4. Every member in good standing shall be entitled to vote in any
election, to participate in the deliberation and/or decision-making on all
matters and/or issues brought before the general membership and to take
active part in any Association activity or project.
5. Every member in good standing shall be entitled to the use of
subdivision roads, open spaces, community facilities and/or services, and
public utilities, subject however to individual limitation and/or restriction set
forth in the Deed of Restrictions, Association rules and such other rules that
the Board may promulgate from time to time, and subject further to the
payment of appropriate fees or charges, if any.
IV. DUTIES AND OBLIGATIONS OF MEMBERS
1. All members must comply with the Association rules and regulations
and such other rules and/or decisions that the Board may adopt from time to
time. They must likewise comply with the Deed of Restrictions, Facilities
Rules and Construction Rules.
2. All members must respect the authority of the Board and any person
or entity to which it has delegated its powers. They must respect and abide
by the decision of the majority of the Association members on any matter or
issue concerning the Association.
3. All members are required to promptly pay their fees, dues and other
charges or assessments to maintain their good standing.
4. All members should at all time respect the privacy and the rights of
the other members and conduct themselves with decency and observe good
manners in dealing with others. The Board may impose appropriate sanctions
on any member found to have acted in an unreasonable and/or unprovoked
aggressive behavior to-wards any member.
5. All public places and facilities in the subdivision (such as the roads,
sidewalks, drainage and water supply systems, fire hydrants, playgrounds,
and other open spaces) are for the use, availment and enjoyment of all
Association members. These shall not in any way or manner be appropriated
for the unauthorized private use of any member.

V. USE OF LOTS AND BUILDING RESTRICTIONS


A.

USE OF LOTS

Use of lots within the Subdivision shall be governed by the following


restrictions and provisions:
1.

The subdivision lot and improvements shall be used exclusively


for residential purposes. The use and occupancy of residential
buildings within the subdivision will be exclusively for the private
residence of the Associations members, their families, house
guests and household helps/drivers and strictly not for the
purpose of conducting business or engagement in commercial
activities.

2.

The subdivision lot may not be further subdivided or


reconfigured from its originally titled size, points and
specifications.

3.

A residential house may be constructed on two or more adjacent


lots. In this event, the resulting consolidation will be treated as
one lot by the Association in the interpretation and enforcement
of its rules and regulations particularly but not limited to those
pertaining to single family dwelling, easements and construction
standards except for payment of dues and in voting.

4.

The subdivision lot may not be used for business, or for any
illegal or immoral activities. The aforesaid conduct of business or
engagement in commercial activities may include usage of a
residential building for the preparation, processing or storage of
produce or raw materials in commercial quantities, the
employment/deployment there-in of non-resident clerical or
professional staff workers or as a venue for the meeting or
congregation of business callers, clients and/or customers.

5.

The use of vacant subdivision lots for vehicular parking for


vehicles with stickers, planting of trees/vegetables or storage of
soil, gravel, sand or any construction materials will require prior
written clearance from the owner and/or the Association and with
the consent of the lot owner.

6.

No existing trees, whether found within or outside the lot, shall


be cut, removed, or damaged nor shall it be relocated or
transferred without written approval of the Association. Violation

fine is P10,000.00 per tree plus full restoration of the tree at the
expense of the violator.
7.

No open-fire burning of any refuse, tree-cuttings, dried leaves


and construction debris will be allowed in any space, sidewalk or
vacant lot within the subdivision.

8.

No sand, gravel or soil may be removed from one lot and


transferred to another without the written permission of the lot
owners and/or the Association.

9.

For corner lots, the vehicular entrance driveway shall be


constructed no less than five (5) meters from the intersection
corner.

10. It is prohibited to dump any garbage, fallen leaves, tree-cuttings,


construction debris or refuse of any nature (including refuse
container) in any vacant lot or on any part of the home owners
property.
11. Pet animals may excrete in the vacant lot. Pet owners should
take care of their pets droppings. The Homeowners shall limit
the number of their pet dogs. One (1) for large breed and three
(3) for small breed.
12. The cleanliness and proper upkeep of vacant lot (e.g. termite
control, grass trimming to avert brush fire, etc.) will be the
responsibility of the owner. In the event of failure in this regard,
the Association may, without need to serve formal notice to the
owner, commission the necessary maintenance work on the
vacant lot and charge the owner for the reimbursement of its
corresponding maintenance costs.

B.

BUILDING RESTRICTIONS

Building of residential houses and other facilities within the Subdivision will
be governed by the following restrictions:
1.

All buildings and improvements must be made of strong


materials and should be properly painted.

2.

All buildings must be provided with modern sanitary installations


connected to the public sewer or an approved septic tank.

3.

All building(s), including servants quarters, and/or parts thereof,


must be constructed at a distance of not less three (3) meters
from the boundary fronting a street and two (2) meters wide
along the side/s and rear portion of the lot measured from the
property line to the nearest finished wall or column or any
projection from the said wall or column. Outside edges or roofs
and/or eaves of the buildings, including porte cochere or canopy
shall be without columns.
However, roofline setback may
protrude within setback restrictions from property lines not
fronting the streets, provided they shall not exceed two-third
(2/3) of the easement with the following limitations:
- one-third (1/3) of the length of the left or right side; or
- one-half (1/2) of the length of the rear side

4.

Walls on the perimeter of a property shall not exceed two (2)


meters from the average elevation of the curb line fronting the
street, except that no restrictions as to height applies to walls
made of live vegetation. Cyclone or mesh wire fences are
permissible only at the rear and the side boundaries and must
not be higher than four (4) meters from the reference elevation.

5.

The building must not be higher than ten (10) meters, measured
from the elevation of the curb line facing the building to the
highest protruding portion or part of the roof. There shall be no
full third floor allowed. Only two floors with attic.

6.

Walls on the perimeter of a property shall not exceed two (2)


meters from the average elevation of the curb line fronting the
street, except that no restrictions as to height applies to walls

made of live vegetation. Cyclone or mesh wire fences are


permissible only at the rear and the side boundaries and must
not be higher than four (4) meters from the reference elevation.
7.

No firewall is allowed on the property line facing the road.


Firewall is allowed only on one side of the property; either right
side, left side as long as the firewall does not exceed 33% of the
length on that chosen particular side (should have the consent of
the adjacent neighbor) of the property.

8.

It is prohibited to use booster pumps of more than 1 Hp for water


connections without any complimentary cistern or reservoir.
(The Maynilads diagram of the correct sequence of water supply
line for a legal booster pump connection may be obtained from
the Associations Administration office).

VI.
A.

CONSTRUCTION PROJECTS AND RELATED MATTERS

PRE-CONSTRUCTION

The procedures and conditions indicated below will have to be followed by


the Applicant/Lot-owners to obtain approval of their building permit.
1.

The Applicant/Lot-Owner or his duly authorized representative


will submit to the Association through the chairman of the
Construction Committee, a copy of the house plan prepared by a
licensed architect. The plan must indicate clearly the minimum
distances of the eaves and other easements, such as veranda,
etc., from the property boundaries.

2.

The Applicant/Lot-Owner must settle with the Association, the


following:
a)

Payment of all unpaid and overdue association dues and


penalties for late payment of dues as of the date of
application for building permit.

b) Putting up a construction performance bond in cash in the


amount
of
TWO
HUNDRED
THOUSAND
PESOS
(P200,000.00). Out of this amount, the sum of TWENTY
THOUSAND PESOS (P20,000.00) shall be considered as
payment of the construction fee and is not refundable to
the Applicant/Lot-Owner.
The sum of ONE HUNDRED

EIGHTY THOUSAND PESOS (P180,000.00) is refundable to


the Applicant/Lot-Owner only upon completion of the house
or construction site and its surroundings are cleaned and
cleared of waste materials and debris. Should there be any
violation of the Associations construction rules and
regulations by the lot-owner, the corresponding penalties
shall be deducted from the refundable construction bond.
This shall also cover the payment of any unsettled
accounts with the Association and for any kind of damages
that might have been caused to the Association. The
refundable construction bond minus the obligations
mentioned above shall be released upon inspection and
granting of clearance by the Chairman of the Construction
Committee.
3.

The Applicant/Lot owner must submit a duly notarized written


undertaking
signed
by
the
owner
and
his
Contractor/Administrator stating among other things the
following:
a) That they have read and understood the provisions of the
Associations Rules and Regulations
b) That the project/house will be built in accordance with the
approved plans and specifications
c) That they agree to comply with the provisions of the
Associations Rules and Regulations governing the
construction project
d) That they will pay the corresponding fines and penalties to
include the forfeiture of the Cash Bond for violations as
provided for by these Rules and Regulations
e) That they authorize any representative of the Association
assigned by the President to enter the premises of the
project for inspection purposes
f) That they will submit a list of all construction personnel
who will be authorized to enter, stay-in, and/or work at the
project site. Only two (2) persons will be authorized to
sleep inside the construction site.
g) That they will cause all of their construction workers to
comply with the requirements for the issuance of the
necessary Association ID which shall include an NBI

clearance and an accomplished application form, with the


signature and endorsement of the Lot-Owner or of the
Contractor as an employer.
That at all times, the
Association ID issued to the construction workers thus
issued shall be surrendered to the guard at the entrance of
the subdivision upon leaving the area. When entering the
subdivision, he shall give his name to the guard-on-duty,
and his ID will be given back to him to be worn at all times
and said ID shall be surrendered to the Association once
the said construction workers are no longer employed in
the construction project.

B.

The Applicant/Lot-Owner shall be responsible and liable for all


acts of all those working or staying at the construction site
and/or those delivering materials thereto, who have caused
damage to the properties of the Association and/or which were
committed in violation of the rules and regulations.

DURING CONSTRUCTION
1.

All construction works to be done by the Applicant/Lot-Owner


must be in accordance with the approved house plan submitted
to the Association. In particular, they must conform to and
comply with all the easement requirements annotated on the
Torrens Certificate of Title covering the Property of the
Applicant/Lot-Owner. Any violation of the rules shall mean the
total forfeiture of the Cash Performance Bond, without prejudice
to any judicial or administrative action the Association or any of
it members may decide to undertake against the Owner.
Forfeiture of the Cash Bond may also be imposed on any
violation of the Covenants and Restrictions on the Deed of Sale
and/ or general policies of the Association that pertains to the
use of the lands and building restrictions as stated in I. A and B.

2.

Upon the completion of the construction of the house, all debris,


construction waste materials and garbage must be removed from
the jobsite and adjoining lots and brought out of the subdivision.
Spreading of such debris and materials to adjoining lots is strictly
prohibited. Only after the area is cleared of waste materials and
debris shall the Cash Performance Bond be released to the
Owner, minus whatever is due the Association.

3.

The weight of the delivery vehicle shall not be more than 5 tons.
Delivery of construction equipment materials, supplies, etc. can

only be done between the hours of 8:00 A.M. to 5:00 P.M.,


Mondays through Saturdays. Construction deliveries are strictly
prohibited during Sundays and Holidays. Any damages done by
the delivery vehicle shall be shouldered by the construction
owner. A fine of ONE THOUSAND PESOS (P1,000.00) will be
imposed for every violation. Entry of ten wheeler delivery trucks
and up will be charged a fee of P2,000.00 per entry.
4.

Streets should be kept clean and unobstructed at all times. They


must be clear of any kind of construction material and must not
be used for any construction purposes. The fine for using the
street for construction purposes, like mixing cement, is
P1,000.00 per day. For obstruction and making the street littered
with construction wastes and dirt, the fine is P100.00 per day
until cleared and cleaned.

5.

Pets such as fowls, hogs, birds, dogs, cats and other animals are
strictly prohibited
and not allowed to be kept or raised at the
job site. Violation fine is P500.00 per day until removed from the
premises.

6.

Owner/Contractor shall provide a fire extinguisher at the


construction site. Failure to comply with this requirement will
mean the following penalties:

7.

Only two (2) workers or bodegeros are allowed to stay-in and live
on the job site and only if issued an ID card by the Association.
Even if staying in, this worker is not allowed to loiter around the
Subdivision after 6:30 pm. If violated, the Owner/Contractor will
be fined P2,000 per excess worker per night.

8.

Gambling of any type is strictly prohibited. The penalty for


violation is P1,000 and confiscation of the involved workers ID
card and all gambling paraphernalia and cash.

9.

Construction workers are not allowed to bring into the


Subdivision alcoholic drinks, including beer. Drinking alcoholic
beverages by the construction workers is absolutely prohibited

inside the Subdivision. Violation fee is P2,000.00 per violation


and cancellation of ID Card.
10. Construction work of any kind shall not be allowed before 8:00
A.M. and after 6:00 P.M. Violation fine is P1,200.00 per day.
11. Construction work of any kind shall not be allowed at any time
during Sundays and Holidays. Violation fine is P5,000.00 per day.
12. Garbage and other similar waste materials are not allowed to be
scattered or thrown out within or around the construction site.
Properly covered trash cans must be provided to keep the job
site clean at all times. Violation fine is P2,000.00 per day.
13. Latrines with a minimum depth of six (6) feet must be provided
for the use of construction workers and must be kept clean and
covered at all times when not in use. Violation fine is P2,000.00
per day.
14. Compost pits should be provided throughout the period of
construction for the proper disposal of food waster of workers.
15. Loitering of workers is not allowed in any area within the
Subdivision. Violation fine is P500.00 per violation per person for
the first offense. Repeat offenders shall be banned from working
within the subdivision.
16. The delivery of materials and entry of laborers into the
Subdivision may be stopped by the Association is in its opinion
the Owner/Applicant is intending to or persisting to violate the
Rules and Regulations on easements and/or to construct his
house, add, modify or make improvements thereon, without prior
authority, permission or approval of the Association. The same
rule shall apply in case the Owner/Applicant shall build his house
in a manner that is not in accordance with the house plan that he
has submitted to the Association.
17. The Owner/Applicant shall be liable to the Association and/or
third parties for any damage that may be caused to the
properties of the Association and/or to third parties by any of the
laborers working at, or by anybody delivering materials to, the
job site or construction being undertaken by and/or on behalf of
the Owner/Applicant.
18. Whenever applicable, a vacant lot near the construction site may
be used for storage of construction supplies and materials upon

request of the projects owner/contractor. Since the lot is owned


by a member of the Association and in order to protect his rights
and interests, the following Rules will apply:
a)

The lot-owners consent shall be obtained.

b)

The project owner/contractor will post a bond of


P10,000.00 for this purpose to guarantee the clearing of
the lot once the project is completed.

c)

If the lot owner will use the lot prior to the completion of
the project, the project owner/contractor must clear the lot
within the period specified by the lot owner.
The lot will be used solely for storage of construction
supplies and materials. No living quarters or latrines or
makeshift shanties for construction workers will be built
thereat.

d)

e)

If the construction debris and/or excavated soil from the


construction site are dumped thereat, such debris and/or
soil must be removed not later than the first Saturday from
the date such debris or soil has been dumped. Fine of
P400.00 per violation per day will be imposed.

19. Families, especially children of construction personnel are not


allowed to reside in the workers living quarters. Construction
personnel are likewise not allowed to bring unauthorized persons
(including females) to their living quarters at any time. A fine of
P200.00 per violation will be imposed.
20. Construction personnel are not allowed to bring firearms and/or
deadly weapons inside the Subdivision. Anyone who is
apprehended for this violation shall be brought to the nearest
Police Station by the village Security Personnel. Violation fine is
P1,000.00
21. All construction personnel must have a valid ID card issued by
the Association and should have their IDs in their possession at
all times. Workers who are found outside the construction
premises without their ID cards will be sent out of the Village by
the Security Officer.
Violation fine is P100.00 per person.
Personnel without ID will be refused entry into the Village.
22. If the owner decided to change or make alterations on the
approved plan (building) and specifications after the Building
Permit has been issued by the City Building Official, he must first

submit to the Association, through the Chairman of the


Construction Committee, the new set of plans and/or alterations
for evaluation.
The new plans will be implemented upon
approval by the Association and/or after a new Building Permit
has been issued by the Municipal Building Official whichever is
necessary according to the National Building code.
23. If a construction project extends beyond 24 months, the
construction bond shall be forfeited and the owner shall be
required to post a new bond upon resumption of project.
24. For any violation of the easement requirement, the refundable
portion of the bond will be confiscated.
a) A prescription of sixty (60) days after receipt of the final
notice of measurement will be given to the homeowner to
rectify the easement violation or accept the penalty charge.
b) The Association reserves the right to any course of action it
may deem necessary against homeowners whose violations
are obviously done in bad faith.
25. To Minimize the disturbance to next-door neighbors, the
construction area must be fenced with sawali or any other
suitable material.
C.

POST CONSTRUCTION

All post construction activities including major and minor renovations


and/or other forms or repairs and maintenance must follow the restrictions
of the Association particularly the compliance to perpetual easement
requirements as indicated under section B (Building restrictions) and the
proper disposal of construction debris.
Proper disposal of construction debris. Construction debris should be
hauled away and not dumped in vacant lots or common areas such as
sidewalks.
1.

Major renovations with potential easement violations and/or which may


generate substantial debris.
(Examples: Construction of additional room or other improvements
that expand the original plans, swimming pools, bath house, cabana, or
other permanent structures.)
The Homeowner must fulfill the following requirements:

a) Accomplish the. request for Post-Construction form.


b) Obtain approval of the project by the Construction Committee.
c) Post a cash bond in the amount of FIFTY THOUSAND PESOS
(P50,000.00). (Out of this amount, 10% will be retained as
construction fee and shall be non-refundable.)
d) Pay all overdue accounts with the Association.
e) Sign an authorization that will allow the Association to monitor entry
and exit of workers and construction materials into the village.
f) Sign an Affidavit of consent allowing the inspection of the project by
the Associations designated representative, to determine adherence
to construction rules and regulations.
2.

Minor renovations with potential easement violations and/or which may


generate substantial debris.
(Examples: Complete re-roofing, Partial re-roofing with possible
easement violation, general floor re-tiling; repainting of the whole
house, landscaping that includes installation/construction of structures
such as trellis, gazebo, outdoor spa and the like, installation of grills
from roof to external wall, installation of ground level water reservoir,
construction of transceiver antenna on a steel frame.)
The Homeowner must fulfill the following requirements:
a) Accomplish the. request for Post-Construction form.
b) Obtain approval of the project by the Construction Committee.
c) Sign an authorization that will allow the Association to monitor entry
and exit of workers and construction materials.
d) Pay all overdue accounts.
e) Sign an Affidavit of consent allowing the inspection of the project by
the Associations designated representative, to determine adherence
to construction rules and regulations.

3.

Projects that accumulate substantial amount of debris.

(Examples: Plumbing works that entail major excavations, partial reroofing without possibility of easement violations, repainting of portions
of the house, general landscaping.)
The Homeowner must fulfill the following requirements:
a) Accomplish the Request for Post-Construction form
b) Obtain approval of the project by Construction Committee
c) Sign an authorization, allowing a designated representative of the
Association to monitor entry and exit of workers and materials into
the village.
d) Pay all overdue accounts.
e) Sign an Affidavit of consent allowing the inspection of the project by
a designated representative of the Association to determine

Projects that have no possibility of easement violation and that incur a


minimal amount of debris.
(Examples: Minor plumbing repair, minor electrical repair, roof and
gutter repairs-application of sealant, installation of heating equipment,
repair of swimming pool, additional landscaping, minor gate doors and
window repairs, construction and installation of cabinets, installation of
cyclone wire as additional perimeter fence.)
The Homeowner must fulfill the following requirements:
a) Accomplish the Request for Post-Construction form
b) Sign an authorization that will allow the Association to monitor entry
and exit of workers and construction materials into the village.
Note that there is no bond required for this type of projects and that
work on these projects may be allowed as long as supervised by the
Homeowner and the work does not cause any disturbance to the
neighbor.

5.

Additional Guidelines
a)

The construction Committee shall classify all projects that do not


clearly fall in any of the abovementioned types of projects.

b)

All projects that are very minor (i.e., those that require only a few
hours of work and a minimal amount of materials) do not need
approval from the Association. However, the Homeowner shall
inform the Subdivisions security guards about the work so that it
will facilitate the entry of the workers, who will be allowed to enter
the Subdivision only for one day.

c)

In cases where the Homeowner has several projects ongoing at


the same time, he/she shall only be required to provide a bond
corresponding to the largest single project.

d)

The Construction fee is imposed as compensation for the


additional security guards who will monitor the workers, the
delivery of construction materials, and the compliance to the other
construction rules and regulations mentioned that might be
assigned by the Construction Committee.

e)

A construction fee is imposed on projects that take more than six


(6) consecutive working days based on the classification that the
project falls under.

f)

Project time is computed based on the number of consecutive


days the workers have reported for work.

g)

A prescription period of fifteen (15) days after receipt of the final


notice of measurement and computation of penalty cost is given
the Homeowner to rectify easement violation or accept the penalty
charge.

h)

To facilitate the refund of the construction bond, the Homeowner


must accomplish the Request for Inspection and Bond Refund
Form. The Construction Committee or any of its designated
representatives will then carry out the inspection of the completed
project. The refund of the bond less the penalties that will be due
as the case may be, will be released within one week after
inspection.

VII.

USE OF PARK FACILITIES

The Subdivisions park, playground, and sports/recreational facilities have


been provided for the exclusive use of the Associations resident-members.
However, resident-members may accompany their guests in using these
facilities provided the enjoyment of their use by other resident-members is
not compromised.
The Association enjoins all its resident-members to use these facilities and
areas properly and to cooperate in keeping them clean at all times.
Appropriate fees will be charged for the use of some of these facilities to
cover the cost of their upkeep and maintenance.
The Association will not assume responsibility for the safety of the persons
using the park facilities and other common areas and loss of valuables and
belonging that they may bring and leave in the park premises but will
exercise all possible care, diligence and vigilance in preventing injury to
persons and in preventing loss or damage to personal property.
A.

SOCIAL HALL

The Social Hall (Clubhouse) is open for use by any of its resident-members
for their social or civic functions provided the following conditions are met:
1.

The said facilities have not been committed to any previouslyscheduled function at the proposed time of usage.

3.

The duration of the use if anytime from 6:00 am to 12:00


midnight.

4.

Drinking of any alcoholic beverage if not allowed at anytime in the


premises. Persons who are intoxicated are also not allowed in the
premises.

5.

The appropriate charges are paid for by the applicant residentmember.

6.

Carrying of deadly weapons is not allowed within the premises.

7.

The user undertakes to strictly follow the rules and regulations


indicated below.

The Social Hall may also be available for use by a non-Association member
provided the user is sponsored by an Association member. The same
provisions as those required from the resident-members as mentioned
above will apply. However, non-Association members shall be charged a
higher fee.
The fees for the use of these facilities are shown on Annex A. The standard
fees shall cover the use of the reserved facility, electricity for lights and air
conditioning, and the use of the reserved facility, electricity for lights and
air conditioning, and the use of toilet facilities. Additional fees shall be
charged for the use of the equipment like mobile disco lights and sound
system, PA, karaoke, video camera, computer and LCD/overhead projector.
In addition to these general conditions, the applicant resident-member and
the user of these facilities shall strictly follow and observe the following
rules and regulations:
1)

Reservation and Posting of Cash Bond.


a) Reservations for the use of the facilities shall be made in writing by
accomplishing the Associations Reservation Agreement Phoned-in
reservations are discouraged and shall be accepted only on a
tentative basis until the cash bond (P1,000) and the required
reservation fees are paid. Reservations become final and effective
when a 50% down payment is made. If the reservation fee and
cash bond are not received within the specified time, the
Association shall be free to accept other reservations without
further notice to the party who fails to complete the required
payment.
b) Full payment shall be made 15 days before the scheduled date of
use.
c) No refund shall be made if a reservation is cancelled within 15 days
before the scheduled date. In special cases, a refund may be
allowed, but and administrative fee equivalent to 10% of the facility
fee shall be charged.
d) The cash bond of P1,000 is refundable and shall be released within
three working days after the Association has determined that the
Facility used is clean and free from any loss or damage. Any loss or
damage incurred shall be chargeable against the cash bond,
without prejudice to the collection of additional amounts should the
loss or damage exceed the cash bond.

Observance of Proper Behavior and Discipline

a) The presence of at least t wo (2) supervising adults is required if


the use of the facility will be by minors. The names of the adults
shall be specified in the Reservation Agreement.
b) The use or sale of any prohibited drugs is strictly prohibited.
c)

Smoking is not allowed inside the air-conditioned halls. The


consumption of alcoholic drinks by minors is strictly prohibited.

d) The possession of any form of deadly weapon is strictly prohibited.


e) Loud music and other noise should be kept within reasonable
f) Dishwashing and littering are strictly prohibited.
g) Cooking is not allowed inside the Social Hall.
3.

Restoration of the Cleanliness of the facilities and Related-Matters


a)

The CLEAN AS YOU GO policy must be adhered to. The


homeowner/resident and/or its caterer for an event should clean up
the facilities after it use and bring out all kinds of wastes generated
from the event. This should be completed within the reserved time.
The cash bond shall only be returned if the Association has
determined that the facilities are clean and free from any damage
or losses.

b)

Any time needed for setting up and clearing the area shall be
included as part of the reserved time and any excess shall be
charged accordingly and shall only be allowed it will not encroach
into another reservation agreement. Should additional time be
needed to set up/decorate the place, the resident shall make prior
arrangements, in writing, with the Association, which may allow the
additional time if there are no other reservations/bookings and the
cost shall be charged to the account of the resident who caused the
delay.

c)

If the place is not cleared by the expiry of the reserved time,


the Association shall clear the area to give way to the next booking
and the cost shall be charged to the account of the resident who
caused the delay.

d)

The homeowner/resident shall be fully responsible for any


damage that may arise during the use of the specified venue and its
premises. The homeowner/resident shall accordingly fulfill the

necessary repairs to be incurred, or instead totally indemnify the


Association for the actual cost of such.
4. Other Rules and Guidelines
a) The homeowner/resident shall be responsible for ensuring
compliance to all Association rules and regulations including it
parking and traffic regulations.
b) The homeowner/resident shall be fully responsible for any bodily
injury that may arise during the use of the specified venue and its
premises. The Association shall be freed of any responsibility and
obligation to shoulder any expense that may be incurred for the
person injured.
c) The Association reserve the right to terminate the use of the facility
at any time should there be any infringement of its rules and
regulations.
B.

COVERED BASKETBALL COURT

The covered court may be used for playing basketball or badminton. The
said facilities are for the use and enjoyment of our residents. Guests may be
allowed to play in these facilities when accompanied by residents.
The covered basketball court may also be used for Association-sponsored
and village-wide functions such as bazaars, garage sale, and other
Association social functions. During said functions, playing in these premises
will not be allowed. Private functions, playing in these premises will not be
allowed. Private functions, including those that are hosted or sponsored by
individual resident-members shall not be allowed in both the covered court
and open basketball courts.
The use of these facilities shall be subject to the following rules and
regulations:
1.

Playing Time
Ordinary Days 9:00 AM to 8:30 PM
Summer Days (April 1- May31)9:00 AM to 8:30:00 PM
Week-ends & Holidays-9:00 AM to 6:00 PM

Fees
Please see Annex A for the fees and rates to be charged for the use of
these facilities. The use of the covered court is open to all residents for

free from 3:00 pm to 6:00 pm., during which period, there shall be no
reservations allowed fro the whole court. For the open basketball
court, its use by the residents is free of charge at any time during the
allowed playing time.
3.

Reservations
Except during the period of 3:00 to 6:00 pm for the covered court, the
rule is NO RESERVATION, NO PAYMENT, NO PLAY.
a) Reservation is on a First Come, First Served Basis.
b) Reservation shall be made from Monday to Friday at the
Administrative Office. Paid reservations shall have priority. Only full
payment in cash will be accepted.
c) Reservations can be made by filling up the reservation form. All
reservations must be fully endorsed by at least one-resident player.
d) Residents shall have priority over non-residents.
e) During summer time (April 1 May 31) the covered court is
reserved for residents and the Inter-Village Summer League teams.
f) The rules and procedures for reservations shall apply to all games
other than basketball.
g) Advance booking is allowed.
h) Reservations are good only for 2 hours/game to allow other teams
to play.
i) Half court playing is not allowed from 6:00 PM to 10:00 PM.
j) Cancellation of reservation should at least be two days before the
reserved date for the fees and charges to be refundable. Otherwise,
no refund of fee will be made.

4. Other rules and regulations.


a) All players shall strictly observe the all the Rules and Regulations of
promulgated by the Association.
b) Any loss, breakages or damages to the facilities incurred by any
individual or group will be assessed and billed to the party

concerned or a corresponding legal action will be taken should the


Board deem it necessary.
c) Players shall bring their own ball and wear proper attire or
uniforms.
VIII. USE OF STREETS, ROAD, ALLEY AND OTHER
IN COMMON AREAS IN THE SUBDIVISIONS
The streets, road, alley and other common areas in the subdivision are for
the use and enjoyment of the homeowners and their guests. The following
rules and regulations, are hereby promulgated.
a. The use of or indulgence in narcotics and other
prohibited drugs and substances is strictly prohibited.
b. Possession and/or use of firearms and other deadly
weapons in any public place are strictly prohibited.
c. Gambling in public places is strictly prohibited.
d. Throwing or leaving garbage, trash and litter in public
places is prohibited. Unauthorized posting of bills, placards,
streamers, and banners, or painting or writing on walls of public
structures, or the willful destruction of public property and other
similar acts of vandalism are likewise strictly prohibited.
e. Repair of cars other than flat tires and emergency repair
should be done inside the garage and not on the streets.
f. Motor vehicles including motorcycles with loud mufflers
are prohibited. Protective helmets are required for drivers and
passengers of motorcycles and scooters. Only licensed drivers
and LTO registered vehicles shall be allowed to operate inside the
subdivision
g. Vehicles should be registered with the Association for
the issuance of a village sticker, which should be prominently
displayed and permanently attached to the vehicle. Vehicles
with village stickers may be parked outside the residential
houses, while those vehicles without stickers should be parked
inside the lot owners property only. Likewise, parking of vehicles
with stickers outside in front of his lot should not go beyond the
boundary of his property to encroach the adjacent property.
Should there be a need to park vehicles beyond the boundary of
his property, prior consent of the association and the lot owner is

needed. In case of violation, the wheels of the vehicles will be


clamped, the key shall be safe keep by the association and will
only be released upon payment of One Thousand Pesos
(P1,000.00) penalty per day counted from the day of violation as
day One (1) until full payment of the penalty.
h. Speed limit inside the subdivision is __ kilometers per
hour. Residents shall observe and should instruct their drivers
and guests to observe the speed limit.
i. Trucks, trailers, and other equipment of heavy tonnage
shall not be permitted to enter the subdivision without the
approval of the Association.
The Association reserves the right to deny entry to and/or disallow usage of
any or all the community facilities and common areas to any person
suspected or found to cause public danger or nuisance and to eject, using
reasonable force if necessary, any person who refuses to comply with these
Rules and/or who creates trouble or public disturbance. The Association
further reserves the right to file appropriate charges against any person for
any unlawful behavior, act or deed.
IX.

SECURITY AND SAFETY

1.
All drivers, domestic helpers and other household helps of the
home owners or residents must be registered with the Association.
2.

Vehicles without stickers shall not be allowed to enter the village.

3.
Visitors of homeowners and residents with vehicles shall be
required to leave their Drivers License ID with the guard posted at the gate
before entering the subdivision compound. No other kind of identification
card shall be accepted except the Drivers License ID. In case the guest has
no Drivers license, the homeowner or resident should fetch the guest in the
guard house. Visitors without vehicles are required to leave any form of ID.
4.
Bags and packages brought in and out by domestic helpers,
drivers, workers, visitors and other non-residents may be subjected to search
and inspection by the Security guards. Vehicles belonging to the visitors
may be subject to search.
5.
The homeowner or resident must not store any highly
inflammable and explosive materials within the house unit nor is he
permitted to install any apparatus, machinery or equipment that may emit
foul odors, cause tremors, produce loud noise or expose the premises to the
risk of fire.

6.
Owners of vehicles with village stickers are required to notify the
Association of any changes of ownership of their vehicles. They are also
required to remove or destroy their stickers.
7.
Private Security Personnel of the homeowners or resident are
permitted in the premises but only with prior clearance from and registration
with the Association.
X.

WASTE MANAGEMENT

The following guidelines for garbage handling and disposal shall be


observed:
1.
It is mandatory to use a durable garbage disposable plastic bag
which must be securely tied to prevent garbage from spilling out.
2.
Dry garbage must be segregated from the wet garbage and must
be enclosed in a separate disposable plastic bag.
3.
All wet garbage must be thoroughly drained and separately
wrapped in a newspaper then in a disposable plastic bag. To make it more
secure, smaller grocery bags may be used first before re-wrapping in the
disposable garbage bags.
4.
All loose paper must be crushed into tight bundles before placing
the same into the plastic bag.

XI.

OTHER RULES AND REGULATIONS

1. The duly-contracted security agency shall take charge of the


maintenance of peace and order in the Subdivision, as well as the security of
all members. The guards are authorized and empowered to apprehend any
person, using reasonable force if necessary, who creates trouble or who
engages in illegal activities within the Subdivision.
The Philippine National Police and Barangay Tanods will render police
assistance to residents of the subdivision.
2. For better control of entry of unauthorized persons in the area,
residents are required to instruct their domestic helpers, drivers and others
under their employment, to secure identification cards from the Association.
These identification cards will be provided at minimum fee but the resident

employers shall surrender the same when the domestic helpers cease to be
in their employ.
3. Loitering within the Subdivision premises is prohibited. Homeowners
are requested to report to the security guards suspicious persons frequenting
their vicinities or visiting their domestic helpers. The security guards shall
direct or bring any person, using reasonable force if necessary, to his
residence whenever found loitering without any specific purpose or
destination.
4. No vendors, solicitors, peddlers, agents, salesmen, and the like are
allowed in the Subdivision unless they are given specific permit by the
Association.
5. All pets must be kept within the premises of the members house.
Pets brought outside the members property must be leashed and
accompanied by a household member. Farm animals such as chickens,
fighting cocks, goats, pigs, cows and carabaos are strictly prohibited. Any
stray animals will be taken/captured by the guards and brought to a
designated place where the owner may redeem it with payment of a
prescribed fine, otherwise the said animals will be turned over to the proper
authorities for proper disposition.
6. Pets are to be housed within the perimeter wall of the house and
controlled in a manner that will not threaten others. Chaining animals to
trees or other structures outside of lot is prohibited.
7. Members shall regulate the volume of their stereo radios, TV sets
and other musical instruments in such manner as to minimize noise and
disturbance of neighbors particularly after noontime and late hours of the
evening.
8. Drag racing is not permitted in the subdivision.
9. Quarrelling or brawling or creating unnecessary noise or disturbance
on the streets of the subdivision is not permitted.
XII.

PENALTIES AND FINES

These violations of the rules and regulations and corresponding


penalties/fines are but a limited array of transgressions. The Board of
Directors thru Board Resolutions will continue to formulate appropriate
sanctions/penalties as the need arises. These however does not preclude the
Homeowners Association from pursuing matters through the duly constituted
judicial courts or administrative entities.

Aside from the penalties and fines already mentioned in the preceding
provisions, below are the corresponding penalties and fines for other
violations:
1. Excessive noise and disturbing neighborhood peace and tranquility:

approved by the Board during the meeting held on __________________ at
