It is a requirement of The Estate Agents Act of 1979 that you understand and accept our Terms and Conditions prior to instructing
Casa Bella Properties Limited t/a MyHouseAdvert.co.uk (We or Us) on the sale of your property.
We offer a full estate agency service, with the exception of accompanied viewings, including sale progression support.

1. Payment options:
a.

Pay monthly - 75 (including VAT) for the first 4 months, after any free trial, then just 39.95 (including VAT) a month.

The monthly payment will recur until you request cancellation of your account, or exchange of sale contracts.
If you accept an offer the monthly fee is payable until exchange of sale contracts.

Pay a one-off fixed fee - 395 (including VAT), after any free trial.

This entitles you to 12 months of anytime marketing.

FREE MONTH TRIAL MyHouseAdvert.co.uk is currently offering a free month of full service to new clients. The free month trial
runs from the date of instruction. At the end of the free month you will be able to choose between the two payment options
above, should you wish to continue with the advert. If youve agreed a sale within the free month you are obliged to select from
the two payment options above. No credit or debit card is required to register for the free month.

2. The home visit
As soon as we receive your instructions a member of our team will contact you using the details provided on the application form.
We will arrange a suitable date and time to visit your house and take the appropriate key room measurements along with a floorplan, photos and/or EPC if purchased. MyHouseAdvert.co.uk can also assist you with valuing your property if requested by
researching local comparable information. We are not responsible or liable for any delays that your personal circumstances may
cause in getting your advert live on the internet. It is your responsibility to liaise with us as soon as possible.
3. Website listings
We will list your house on Rightmove, Zoopla, Primelocation, and Facebook and of course MyHouseAdvert.co.uk along with
search partners affiliated with Zoopla. Your advert will reach over ten million prospective buyers each month nationwide. You
may also Like your advert on our Facebook Property Search page, and share it with your friends.
4. Advert descriptions
You must approve your property details before marketing of the property can commence. Once your advert is live on the internet
it is your responsibility as the seller to inform MyHouseAdvert.co.uk of any form of mis-description in your advert so we can
amend it. The Seller shall indemnify MyHouseAdvert.co.uk, its proprietors, directors, employees or agents against any claim made
in respect of the Property or any mis-description. We also reserve the right not to publish information provided by you, the Seller.
5. Viewing requests and offers
MyHouseAdvert.co.uk will receive viewing requests for properties via the telephone or email, and unless stated by you, we
promise to forward all viewing requests immediately to your email address and/or telephone and advert control panel. All offers
on your property must come through us as acting agent if we arranged the viewing. We will then notify the potential buyer that
we have forwarded the offer to you. If you are approached directly please give the potential purchaser our contact details.

5.2 The Consumer Protection from Unfair Trading Regulations 2008


Vendors whom provide their own viewings should not mislead potential purchasers. The Consumer Protection from Unfair
Trading Regulations 2008 have replaced previous legislation and now apply to property sales. The regulations require you to
inform all potential buyers at the earliest opportunity of any material factor that would affect their transactional decision. You
are responsible for disclosing any such information to potential buyers at the viewing. The Seller shall indemnify
MyHouseAdvert.co.uk, its proprietors, directors and employees against any claim made in respect The Consumer Protection from
Unfair Trading Regulations 2008.
6. Beneficial owner
You are confirming that you are the beneficial owner(s) of the property being sold or have the authority from the beneficial
owner(s) to sell the property.
7. Unoccupied property
MyHouseAdvert.co.uk cannot accept responsibility for the maintenance or repair of any unoccupied property for sale.
8. Viewings
You will be conducting all viewings, so it is your responsibility as the seller to ensure the property is safe for visitors.
MyHouseAdvert.co.uk cannot be held responsible for any instances or accidents that may occur during any viewings. You are
responsible for keeping your availability for viewings up to date within your control panel calendar.
9. Money laundering
Under the Money Laundering Regulations of 2003 we must carry out identity checks on both buyers and sellers. We may require
some additional information to confirm your identity such as your passport or driving licence and a recent utility bill if available.
We may also verify your identity online using a credit referencing agency.
10. Advert amendments
You can make amendments to your advert at any time for free in your Advert Control Panel.
11. Performance fee
In the event that MyHouseAdvert.co.uk achieves a sale in excess of the asking price resulting from successful negotiation on your
behalf, we reserve the right to charge 7%+VAT of the difference between the achieved sale price and the asking price. This does
not apply to adverts using the price qualifier of Offers in Excess of or Offers Over. For example, if we achieve 1,000 over the
set asking price; a performance fee of 70+VAT is payable to MyHouseAdvert.co.uk upon completion of the sale.
The Performance fee is capped at 250 including VAT.
12. Advert suspension
Should you wish to suspend your advert we can retain the details for up to 12 months, upon request.
13. Energy Performance Certificates (EPC)
Please note that it is a legal requirement to advertise your property with an up to date EPC report. We can arrange an EPC for
69.95 or alternatively you can arrange the report and upload it to your advert control panel. If you need advice on where to find

14. Cancellation & refund policy
a.

Once weve visited your house no refunds will be available for monies paid to MyHouseAdvert.co.uk for advertising. We
will consider refunds for Floorplan(s) and the For Sale Board if deemed un-satisfactory.

b.

One subscribed to the monthly fee payment option, if you wish to cancel our services you must log-in to your advert
control panel to request cancellation of your account before the day of the monthly payment to avoid paying the next
monthly fee.

c.

If you choose the monthly payment option and cancel the subscription payment after an offer has been accepted (due
to one of our introductions) but before exchange of the sale contracts, and you attempt to avoid payment under our
Terms of Service we reserve the right to charge 1.5%+VAT of the asking price, as a completion fee.
The cost of recovering any outstanding payments or fees via a third party debt collection agency will be added to
your account, and by accepting out Terms of Service you agree to be liable for these costs.

Services provided in conjunction with online marketing


MyHouseAdvert.co.uk will provide the following services when instructed to act on your behalf during the sale of your property:
a.

All clients will be visited by a representative of MyHouseAdvert.co.uk in order for us to take room measurements and
complete any optional advert extras. The details will be uploaded to your Control Panel within 2 working days of the
visit.

b.

All clients will have access to an Advert Control Panel where the advert can be edited at any point, so long as you
remain subscribed to our service. You may add, remove and re-order photos, change your asking price, and edit the
room descriptions as often as you wish. All advert edits are sent to an administrator within MyHouseAdvert.co.uk to
check the changes before they are sent live to the portals.

c.

All clients have an online calendar within their Advert Control Panel which should be updated each week to clarify
availability for viewings.

d.

When a viewing request is received via telephone you will be notified instantly via text message and email. Viewing
requests will also be available to view within the Advert Control Panel. A potential buyer can also request a viewing
online anytime at www.myhouseadvert.co.uk/requestaviewing. This link is available from the home page of the
MyHouseAdvert.co.uk website. If a request is made via email to MyHouseAdvert.co.uk for further information or a
viewing we will reply within one hour to the email with a link allowing the enquirer to request a viewing online. Viewing
requests can be confirmed within the Control Panel and a viewing confirmation text and email will be sent to the
potential buyer.

e.

It is possible to request feedback from past viewers in the Control Panel. All feedback will be uploaded to your Control
Panel by MyHouseAdvert.co.uk staff once received.

f.

When an offer is received we will notify you immediately via text, email and message via your Control Panel. We will
provide assisted negotiation. Once an offer is accepted we will ask the purchaser for evidence of funding, the details of
their solicitor and check the chain details (if applicable). A memorandum of sale will also be issued to confirm the sale
once agreed.

g.

Once you have accepted an offer we will provide on-going support throughout the sale via your advert control panel.

h.

During the conveyancing process it is your solicitors responsibility to highlight any concerns they have relating to sale
progress to MyHouseAdvert.co.uk so we can address any potential issues with the sale.

i.

If you have any issues or questions regarding your advert before an offer is received you can submit a support ticket at
anytime in your Control Panel and a member of staff with respond to your query within one working day.
