RESOLUTION
This is to resolve the complaint of Arnel Abatayo Bughao, 39 years
old, married, a resident of Purok Fine Tree, Brgy. San Miguel, Digos City,
Davo del Sur, Philippines, against JOEL Caada Bambi for a crime of
Robbery under Article 299 of the Revised Penal Code.
On August 23, 2015, around 2:00PM, the complainant arrived
home coming from Sta. Cruz,Davao del Sur, he notice that the cover
of the hole in the wall intended for the air conditioned was already
destroyed. Upon verification inside the room he found out that his
cash worth Twenty-two thousand pesos (Php 22,000) and assorted
jewelleries placed in the black sling bag were missing.
Around 5:30 PM of the same day, the complainant saw Joel
Bambi at the rice Land going to Purok Caymeto of same Barangay.
Since the respondent has already a record of Robbery, the
complainant approached him and requested him to see his black bag
but, instead of heading to the complainants request, he evaded and
run away heading to Legs Inn lodge and disappeared.
Around 8:30 PM the complainant decide to report the case at
the police station, after recording he was invited at the office of the
intelligence section of Digos City Police Station and while there, the
duty desk officer called and shown a necklace which he found out
when he checked the pack bag endorsed by security guard Dennis
Gador of Gaisano Grand Mall Digos City. Gador positively identified
when shown by a picture of Joel Bambi, to be the same person who
claimed to be the real owner of the said bag.

In the affidavit submitted by the Sagarena Gador, the subject


bag was endorses to him by security guard Solis after closing the
mall. Before placing the bag to the drawer intended for unclaimed
baggage, he checked it and found out a short firearm inside which
prompted him to inform his supervisor and call for police assistance.
Prior to the arrival of the mobile patrol members, a male person, later
known as Joel Bambi, with a woman companion arrived and claim
that he is the owner of the bag. He instructed them to claim it the
following morning because it is their policy for unclaimed baggage,
from which the male person got angry, the hurriedly leave the vicinity
of gaisano mall.
In a separate affidavit submitted by PO2 Edmund Lilagrosa, Jr.,
upon inspection, he found out a silver necklace placed inside the
black sling. He then called the Bughao who was in the intelligence
section at that time, then showed to him the necklace and sling bag
from which he confirmed that it was his property and it was recorded
in blotter entry no. 14375.
Based on the description of the person who earlier claimed t be
the owner of the unclaimed baggage as forwarded by witness Dennis
Gador, plus the pictures on filed of the intelligence section of Digos
City police station, the respondent was positively identified as Joel
Bambi who is a neighbour of the complainant Arnel Bughao.
WHEREFORE, PREMISES CONSIDERED, the undersigned finds
probable cause that the crime of Robbery defined and penalized under
Article 299 of the Revised Penal Code of the Philippines has been
committed and that the respondent is probably guilty thereof and must be
held for trial Accordingly. Let the Information thereof be filed in the Regional
Trial Courtm, Digos City, Davao del Sur, against JOEL BAMBI.
SO RESOLVED AND RECOMMENDED. OCTOBER 06, 2015, Digos
City, Davao del Sur.
