I am sure you are wondering what communication we have had with CDC regarding this incident. There was no proactive effort to contact us on CDC's
part and I spent the day tracking down who we needed to talk to. I just got off the phone with Dan 50S in, head of the Select Agent Unit, and Kate
Hendricks, anthrax countermeasures medical epi In the CDC EOC, who is managing CDC's response. There seems to be a lot of confusion about this
incident because of both DoD and CDC are Involved. Here Is what I found out:
1. CDC has already visited the Dugway lab on Sunday (we were not notified of this visit) and determined that they don1 think there was any risk to
personnel there. DoD and CDC will be following up with the lab to determine why the radiation procedures that were supposed to inactivate the agent
didn1 work completely.
2. The main concem is with the laboratories that DoD contracts with that received specimens. Many of these are commercial labs and located in the
states publicized In the Washington Post article. What the lab staff did with the specimens determines their exposure risk. Most labs handle these
specimens using BSL II or BSL II standard procedures and their staff are not at risk. Nationally, so far they have determined that 4 laboratory staff
needed prophylaxis due to unsafe specimen handling processes.
3. We have one lab: __

are not at risk. However, CDC wants us to follow-up with them to ensure this using a systematic questionnaire, which they will send us. If the

There is a lot of confusion about this incident and communication to states was not well-{)oordinated (-we should have been getting regular conference
call updates as with any ICS incident). Partly, though this does not excuse CDC. there is a confusion about who is in the lead on this event DoD or
CDC. Apparently, many more labs received specimens from this lot than they initially thought. Yesterday, when I talked with Dan Sosin, he told me no
Utah labs had received them and 5 minutes later I got a call from Kate Hendricks saying
'laS one of the labs. There is also some concem
about another lot of B. anthracis that may have some issues as well as processing was the same. So I think things are rapidly changing as we would
expect with any investigation. My main issue, though, is that if they would just do a better job with communication and coordination, we would all be on
the same page!
So I will do my best to keep everyone updated as I hear. Also,
should not be named in any media releases from here for now.

staff this moming. We interviewed them with the questions that CDC provided. We

offered to do follow-up with lab staff if they provide contact info. but they declined this saying that they did not think anyone was
exposed. From the responses to questions. it appeared there was very little risk of exposure so most staff wont need prophylaxis.
I called Kate Hendricks at CDC and they want the remaining, unautoclaved specimens shipped to them early next week. Kim Christensen in
our lab went over there today to help them with packaging.
Instructions for de-{)ontamination of the lab and re-opening will be forthcoming early next week.

located in the states publicized in the Washington Post article. What the lab staff did with the specimens determines their exposure risk.
Most labs handle these specimens using BSL II or BSL II standard procedures and their staff are not at risk. Nationally, so far they have
determined that 4 laboratory staff needed prophylaxis due to unsafe specimen handling processes.
3. We have one lab
received the specimens and they have been communicating with CDC by email and so far they think that
their staff are not at risk. However, CDC wants us to follow-up with them to ensure this using a systematic questionnaire, which they will send
us. If the questions look like lab expertise is needed, Robyn, I hope I can Involve Kim or Annette?
4. There is no risk to our general population.

As a follow up to the conference call held this afternoon, I wanted to reach out and share with you a draft application
package that you can use to apply for the FIFRA crisis exemption to use an unregistered pesticide for anthrax
decontamination. EPA's intention is for applicants to use this document as a plug and play form that will expedite the
process for participating State Agencies. The most direct process for decontamination would be for the states to use
products currently registered for use against Bacillus anthrac;s. However, the State can declare a crisis exemption under
FIFRA for use of ethylene oxide, paraformaldehyde, hydrogen peroxide, peracetic acid, and sodium hypochlorite. The
attached Word file has an example of how to ask EPA for such a crisis. It has a few placeholders for the state agency to fill
in and then send back to EPA Office of Pesticide Programs. The outline in the file has the details on the products and use
directions that would need to be followed for use of these products for the decontamination of anthrax spores.
EPA does not typically prepare the applications for a state or federal agency to fill in, but we are trying to do everything we
can to expedite the process so that labs can reopen as soon as possible while still abiding by applicable regulations. If

The background regulatory context on this is that under section 18 of the Federal Insecticide, Fungicide, and Rodenticide
Act and in accordance with 40 Code of Federal Regulations (CFR) 9166.40 the head of a Federal or State agency, the
Governor of a State, or their official designee, may issue a crisis exemption in situations involving an unpredictable pest
emergency.

In accordance with 40 CFR ~166.43, the State or Federal Agency issuing the crisis exemption must notify the Administrator
in advance of utilization of the crisis provisions. If states would like to decontaminate labs under the crisis provision
from June 5, 2015 through June 7, 2015, the state can e.mail their crisis declaration to, Dan Rosenblatt, Deputy
Director of the Registration Division, Office of Pesticide Programs (Rosenblatt.Dan@epa.gov).
If the state will be
declaring the crisis exemption after June 7,2015 the state can e-mail MarionJohnson.Chief of the Minor Use and
Emergency Response Branch (Johnson.Marion@epa.gov). In accordance with 40 CFR ~166.45 the crisis exemption may
be authorized for as long as is necessary to control the conditions causing the emergency; but no longer than 15 days.
If additional time is needed the state should contact the EPA, Office of Pesticide Programs regarding an application for a
specific, quarantine, or public health exemption for this use.

The {list authorized agency in state declaring the emergency} hereby issues crisis exemptions
under the provisions of section 18 of the Federal Insecticide, Fungicide, and Rodenticide Act.
The {list authorized agency in state declaring the emergency} is authorizing the use of multiple
products containing the following active ingredients: ethylene oxide, parafonnaldehyde,
hydrogen peroxide, peracetic acid, and sodium hypochlorite to inactivate Bacillus anthracis
(anthrax) spores on interior and exterior inanimate, non-food contact surfaces in laboratories that
processed potentially viable Bacillus al1thracis spore-containing samples originating from
Dugway Proving Ground's Lot AGDOOO1667. These crisis quarantine exemptions will ensure
that responders have effective antimicrobial pesticide products for decontamination.
{list authorized agency in state declaring the emergency} has determined that an emergency
condition exists and a crisis exemption is necessary, according to 40 C.F.R S I66.40(b).

When fumigation is complete, air filtering and testing will be conducted to ensure that
levels of the decontamination chemicals remaining in the air are at acceptable levels prior
to allowing re-entry by unprotected persons.
The public will not be permitted in areas undergoing treatment or allowed to re-enter areas
until the anthrax decontamination is complete.
Therefore, {list authorized agency in state declaring the emergency}, herby authorizes the use of
ethylene oxide, paraformaldehyde, hydrogen peroxide, peracetic acid, and sodium hypochlorite
to decontaminate the following facilities (provide name and location of each lab to be
decontaminated). This crisis program will be conducted under the following conditions:

understanding of when to use PPE; what PPE is necessary; how to properly put on, use,
take off, properly dispose of, and maintain PPE; and the limitations of PPE. Any reusable
PPE will be properly cleaned, decontaminated, and maintained after/between uses. Filter
cartridges will be discarded after use.
I Note that the use of sporicides and sterilizers may pose a chemical hazard. Therefore, appropriate PPE, including
elastomeric respirators with combination particulate/chemical cartridges, may be necessary to protect workers from
exposure to the chemicals in addition to Bacillus anthracis spores. Disposable N95 respirators and certain cartridges
for elastomeric respirators may be adversely affected by an increase in moisture and spray from certain work tasks.
This may include the cleaning and decontamination process when significant amounts of liquid sporicides and
sterilizers are used. In such instances, or during other tasks to improve worker comfort, a powered air purifying
respirator (PAPR) equipped with appropriate cartridges may be an alternative.

Respirator use will follow a complete respiratory protection program in accordance with
the OSHA Respiratory Protection standard (29 CFR 1910.134) and other requirements.
Staff wearing NIOSH-approved respirators will be medically-cleared, trained, and fittested for respirator use. Detailed information on respiratory protection programs,
including fit testing procedures, can be accessed at OSHA's Respiratory Protection eTool.

1. What laboratories do these recommendations
These recommendations are for laboratories that opened and processed samples of live Bacillus
anthracis from Dugway Proving Ground Lot AGD0001667 and received confirmation from CDC that
their samples contain low colony counts.
4. What disinfectants can be used for decontamination of laboratory spaces and equipment?
Of the three products EPA registered for decontamination of Bacillus anthracis spares, Diklor-G
Chlorine Dioxide Sterilant Precursor EPA Reg No. 73139-3 (Sabre Oxidation Technologies) is currently
marketed.
Additional EPA registered products that are not registered specifically for Bacillus anthracis have been
shown to be effective against Bacillus anthracis. State and local public health officials will have to work
with the site(s) and apply for a Federal Insecticide. Fungicide, and Rodenticide Act (FIFRA) Section 18
quarantine exemption. The EPA has expedited the process for state or local health officials to apply for
a Section 18 exemption, allowing them to use the following products (http://www2.epa.gov/pesticideregistrationlpesticide-emergency-exemptions).

EPA registered sodium hypochlorite products (CAS No. 7681-52-9), when used in accordance to
the decontamination directions described in the EPA's Office of Emergency Management (OEM)
exemption.
5. Who will determine that decontamination was perfonned appropriately and when it is safe to
reoccupy the laboratory?
State and local health departments with jurisdiction over laboratories, in conjunction with laboratory
directors and managers, will work with laboratories to develop site-specific decontamination protocols
and will make decisions regarding reopening the laboratories. The "Interim Decontamination
Recommendations for Laboratories that Opened and Processed Bacillus anthracis Spore Samples from
DoD Lot AGD0001667" can guide these decisions; however, state and local officials may choose to
exceed these recommendations and may require different standards for decontamination. CDC and
EPA do not have regulatory authority for determining decontamination efficacy.
6. What rate does CDC play in ensuring that site-specific decontamination procedures were
satisfactory?
CDC's role is to work with EPA to provide these recommendations to assist state and local health
departments and laboratory directors. CDC's role is not to set standards for decontamination. The
state and local heallh departments in reviewing the process would make the determination when the
process has been completed and the laboratory can reopen.
7. How was the 12-foot radius around the work area established as an acceptable standard for
spot decontamination?
The 12-foot radius was chosen for this response based upon a conservative doubling of the 3--0 foot
area of defined risk for droplet contact transmission established through epidemiologic and simulated
studies in healthcare settings.5.6
8. How was the 3-foot radius established as an acceptable standard for spot decontamination?
The 3-foot radius around the work area was chosen for this response based upon a conservative
estimate of usual contact with contaminated surfaces.
9. How should electronics and porous materials that are not disposed of as waste be
decontaminated?
Rarely would a laboratory or biological safety cabinet (SSG) need to be decontaminated by fumigation
(see Attachment 2). A SSC may be fumigated when it requires servicing. Fumigation may be
appropriate in situations where hard surface spot decontamination is not an option, such as for porous
materials, electronic equipment, and hard-ta-reach areas.
A fumigant produel for use against Bacillus anthracis may be considered. EPA's Office of Emergency
Management (OEM) provides an example of alternative fumigation products under the Seelion 18
exemption.
What is the appropriate procedure for disposing of porous material generated and PPE used
during the decontamination process?

Disposal of PPE or other waste materials is a state-by-state decision based on state and local
requirements. State authorities should be consulted to determine options, including waste acceptance
criteria for treating the waste as regular solid waste.

not interfere with the safe use of an N95 or other tight-fllting respirators. Tight-fitting respirators cannot
be used by people with facial hair that comes between the sealing surface of the facepiece and the
face. Loose-fitting powered air purifying respirators (PAPRs) can be worn by workers with facial hair.
Mild local reactions occur in 30% of recipients and consist of slight tenderness and redness at the
injection site. Severe local reactions are infrequent and consist of extensive swelling of the forearm in
addition to the local reaction. Systemic reactions occur in fewer than 0.2% of recipients. Additional

During the 2014 CDC anthrax laboratory incident, samples were dry and more susceptible to becoming
aerosolized than wet samples. During the current 000 investigation, decontamination of the samples is
different because the preparations are in a liquid state, and spore concentrations are known. In this
event surface contamination is less extensive. CDC performed surface and equipment
decontamination with either sodium hypochlorite (a 1:10 dilution of bleach) or the application of SporKlenz@(Steris). Laboratory equipment (MALDI-TOF instruments) were disinfected with vapor phase
hydrogen peroxide.

Thank you for helping navigate the recall situation. While we do not believe we've had a contamination event because all our BSL2 procedures were
followed without incident and there is no detectable Ba nucleic acid in the laboratory. we will follow the CDC interim decontamination recommendations
for laboratories that opened and processed Ba spore samples from DoD Lot -
Please apply for a FIFRA Section 18 quarantine exemption for the use of EPA registered sodium hypochlorite products (CAS no. 7681-52-9) to perform
spot decontamination of hard nonporous surfaces (there are no porous surfaces in the BSL2 laboratory and no aerosol generating procedures were
performed). We will use this solution in accordance with the OEM exemption.
We'd like to schedule the cleaning for Friday aftemoon. The cleaning protocol is being drafted according to the guidelines provided. We will also follow
the guidelines for the protection of the decontamination workers; we have several employees who are compliant with OSHA respiratory protection
standard.

As a follow up to the conference call held this afternoon, I wanted to reach out and share with you a draft application
package that you can use to apply for the FIFRA crisis exemption to use an unregistered pesticide for anthrax
decontamination. EPA's intention is for applicants to use this document as a plug and play form that will expedite the
process for participating State Agencies. The most direct process for decontamination would be for the states to use
products currently registered for use against Bacillus anthracis. However, the State can declare a crisis exemption under
FIFRA for use of ethylene oxide, paraformaldehyde, hydrogen peroxide, peracetic acid, and sodium hypochlorite. The

attached Word file has an example of how to ask EPA for such a crisis. It has a few placeholders for the state agency to fill
in and then send back to EPA Office of Pesticide Programs. The outline in the file has the details on the products and use
directions that would need to be followed for use of these products for the decontamination of anthrax spores.
EPA does not typically prepare the applications for a state or federal agency to fill in, but we are trying to do everything we
can to expedite the process so that labs can reopen as soon as possible while still abiding by applicable regulations. If
anything needs to happen this weekend, the states/applicants can e-mail Dan Rosenblatt at rosenblatt.dan@epa.gov or call
his mobile at 703-939-7565.
The background regulatory context on this is that under section 18 of the Federal Insecticide, Fungicide, and Rodenticide
Act and in accordance with 40 Code of Federal Regulations (CFR) 9166.40 the head of a Federal or State agency, the
Governor of a State, or their official designee, may issue a crisis exemption in situations involving an unpredictable pest
emergency.
In accordance with 40 CFR 9166.43, the State or Federal Agency issuing the crisis exemption must notify the Administrator
in advance of utilization of the crisis provisions. If states would like to decontaminate labs under the crisis provision
from June 5, 2015 through June 7, 2015. the state can e-mail their crisis declaration to, Dan Rosenblatt. Deputy
Director of the Registration Division. Office of Pesticide Programs (Rosenblatt.Dan@epa.gov).
If the state will be
declaring the crisis exemption after June 7, 2015 the state can e-mail MarionJohnson.Chief of the Minor Use and
Emergency Response Branch (Johnson.Marion@epa.gov). In accordance with 40 CFR 9166.45 the crisis exemption may
be authorized for as long as is necessary to control the conditions causing the emergency; but no longer than 15 days.
If additional time is needed the state should contact the EPA, Office of Pesticide Programs regarding an application for a
specific, quarantine, or public health exemption for this use.

The Environmental Protection Agency (EPA)would like to quickly acknowledge and concur upon the crisis exemption request under the
provisions of section 18 of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA)that was received from the Utah Department of
Agriculture and Food on June 12,2015, for decontamination of described surfaces in laboratories that may have processed Bacillus anthracis
(anthrax). This crisis program will allow the use of the sole active ingredient sodium hypochlorite, as requested, to assist in ensuring that
responders have effective antimicrobial products for these decontamination purposes.
You are reminded that this crisis exemption will be effective for up to fifteen days to commence on June 12, 2015, as requested, and will
expire on June 27, 2015. If additional time is anticipated for the need and utility of this pesticide beyond the expiration date, it is recommended
that you contact me well ahead of the expiration date, so that further discussions can ensue regarding an application for a public health emergency
exemption. As a matter of major importance, you should also resubmit a revised/corrected version of your crisis exemption that includes a
signature from a designated person of authority in your state and that removes the additional active ingredients In paragraph one that you are
not requesting to use at this time for this particular crisis exemption situation.
In addition, in accordance with 40 CFR166.50, you should be aware that a brief summary of the results of the treatment under the crisis
exemption must be submitted to the agency (i.e., Ms. Tawanda Maignan, Emergency Response Team Leader) within 3 months from the last date of

The {list authorized agency in state declaring the emergency} hereby issues crisis exemptions
under the provisions of section 18 of the Federal Insecticide, Fungicide, and Rodenticide Act.
The {list authorized agcncy in state declaring the emergency} is authorizing the use of multiple
products containing the following active ingredients: ethylcne oxide, paraformaldehyde.
hydrogen peroxide, peracetic acid, and sodium hypochlorite to inactivate Bacillus amhracis
(anthrax) spores on interior and exterior inanimate, non-food contact surt~1cesin laboratories that
processed potentially viable Bacillus anthr({cis spore-containing samples originating from
Dugway Proving Ground's Lot
These crisis quarantine exemptions will ensure
that responders have effective antimicrobial pesticide products for decontamination.
{list authorized agency in state declaring the emergency} has determined that an emergency
condition exists and a crisis exemption is necessary, according to 40 C.F.R S I66.40(b).

When fumigation is complete, air filtering and testing will be conducted to ensure that
levels of the decontamination chemicals remaining in the air arc at acceptable Icvels prior
to allowing re-entry by unprotected persons.
'Ibe public will not be permitted in areas undergoing treatment or allowed to re-entcr areas
until the anthrax decontamination is complete.
Therefore, {list authorizcd agency in state declaring the emergency}, herby authorizes thc use of
ethylene oxide, paraformaldehyde, hydrogen peroxide, peracetic acid, and sodium hypochlorite
to decontaminate the following facilities (provide name and location of each lab to be
decontaminated). This crisis program will be conducted under the following conditions:

All PI'E will be uscd in accordance with OSHA regulations found at 29 CFR 1910 Subpart
I (Personal Protective Equipment). Workers will receive training on and demonstratc an
understanding of whcn to use I'I'E; what PPE is necessary; how to properly put on. usc,
take off, properly dispose of, and maintain PPE; and the limitations of I'PE. Any rcusable
PPE will be properly cleaned, decontaminated, and maintained afterlbetween uses. Filter
cartridges will be discarded after use.
Respirator use will follow a completc respiratory protection program in accordancc with
the OSHA Respiratory Protection standard (29 CFR 1910.134) and other requirements.
I Note that the use of sporicides and sterilizers may pose a chemical hazard. Therefore. appropriate PPE. including
elastomeric respirators with combination particulate/chemical
cartridges. may be necessary to protect workers from
exposure to the chemicals in addition to Bacillus anthracis spores. Disposable N95 respirators and certain cartridges
for elastomeric respirators may be adversely affected by an increase in moisture and spray from certain work tasks.
This may include the cleaning and decontamination process when significant amounts of liquid sporicidcs and
sterilizers are used. In such instances, or during other tasks to improve worker comfort, a powered air purifying
respirator (PAPR) equipped with appropriate cartridges may be an alternative.

Staff wearing NIOSH-approved respirators will be medically-cleared, trained, and fittested for respirator use. Detailed information on respiratory protection programs,
including fit testing procedures, can be accessed at OSHA's Respiratory Protection eTool.

The EPA registered product label and this order will be in the possession of the user at the
time of application.
The Crisis Exemption expires on (list date 15 days from start of program).
Use of the products will begin (list date in which first decontamination will take place).
Applications will be made using the EPA registered products and decontamination use
directions found in the tables I and 2 below.
Any additional PPE required for the use of the product as listed on the EPA registered
product label must be worn.

Tables I and 2 below list the liquid and gaseous/vapor products, respectively, which are supported by available safety and efficacy data and
which may be used undcr the crisis exemptions declared. The last column of these tables details the requircd dircctions for decontamination

Protective Equipment (PPE). At a minimum, workers will wear the following La prevent

All PPE will be used in accordance with OSHA regulations found at 29 eFR 1910 Subpart
I (Personal Protective Equipment). Workers will receive training on and demonstrate an
understanding of when to use PPE; what PPE is necessary; how to properly put on. use.
take off, properly dispose of, and maintain PPE; and the limitations of PPE. Any reusable
PPE will be properly cleaned, decontaminated, and maintained after/between uses. Filter
cartridges will be discarded after use.
I Note that the use ofsporiddes and sterilizers may pose a chemical hazard. Therefore, appropriate PPE. including
elastomeric respirators with combination particulate/chemical cartridges, may be necessary to protect workers from
exposure to the chemicals in addition to Bacillus anrhraci~ spores. Disposable N95 respirators and certain cartridges
for e1astomeric respirators may be adversely affected by an increase in moisture and spray from certain work tasks.
This may include the cleaning and decontamination process when significant amounts of liquid sporicidcs and
sterilizers are used. In such instances. or during other tasks to improve worker comfort, a powered air purifying
respirator (PAPR) equipped with appropriate cartridges may be an alternative

Respirator use will follow a complete respiratory protection program in accordance with
the OSIIA Respiratory Protection standard (29 erR 1910.134) and other requirements.

Regarding the use of Ba spore materials, with the exception of AMES lot

Dear colleagues:
We are writing to alert you to the discovery that a laboratory in your state or tenritory has received samples of inactivated Bacillus anthracis (anthrax)
spores that were found to contain small numbers of live anthrax spores. These samples were prepared by Dugway Proving Ground.
Earlier this year, you may have been notified that other laboratories in your state received a sample with live anthrax spores. Today's notifications are
being sent because CDC has learned that the National Guard's Civil Support Teams received these materials for use in proficiency testing of their
ability to detect and report a positive result for anthrax correctly.
CDC's Select Agent Program is reaching out to affected laboratories to ensure they secure and destroy all samples sent to Civil Support Teams. These

laboratories will also determine whether there has been any use of these materials within the past year. If CDC identifies a laboratory in your state or
territory that has used these samples in the past year, we will notify you. We will also work directly with you to assess the need for workers to receive
prophylaxis, as well as the need for facility decontamination. None of the laboratories contacted by CDC as of today had used samples from the
affected production lot in the past year. There has been no need for follow-up with these facilities since that determination.
At the present time we are stili trying to reach the Civil Support Teams In PRo IA, KY, NM, and SC. as well as a military facility In NC. If CDC
has not made contact with your state or territory's Civil Support Team yet, we would appreciate your assistance in reaching out tD these entities. You
can contact CDC's Emergency Operations Center at 404-488-7100 for additional information about the laboratory in your state or territory that has not
been reached. If you are able to reach the laboratory in your state, please direct the laboratory to contact CDC's Emergency Operations Center. For
states with laboratories already In contact with CDC, we do not anticipate the need for further actions or follow-ups to this notice at this time.

HI Everyone,
From Robyn's comment that Allyn was the main point of contact, it seems to me that the GRAMA records officer that works with Allyn needs to also
work on responding to this request. I thank Robyn for her help. We need to see what records Allyn's section has.
With two bureaus within UDOH having to respond to this, the records officer for each bureau will need to look for the records that meet the description
of the request. Robyn has provided what the lab has. I would ask Tom to forward a copy of the request to Allyn's section, so they can also look for
records the meet the description of the request.
As of now with the lab records, there is one that is proprietary to the private lab which UDOH can~ release. Some documents
procedures which are not what the request asks for. The remaining documents do meet the description of the request.
My next question to Allyn and anyone else that may know, is, did CDC or Dugway Indicate any kind of confidentiality or protective status that should be
given to any records created from this Dugway-anthrax to a private Utah lab episode. If not, I can~ find a reason under GRAMA for not releasing some
of these records. My concern for a protective status of the records from a federal level is that news reports Indicate that CDC and Dugway would not
identify the Utah Lab. Yet, I contacted another attorney within the AG's office who has specialized experience with GRAMA and her response Is that
much of our records appear to her as releasable.

As you recall, we only had one lab in Utah that was sent the contaminated specimens. We are also being GRAMA'd (our equivalent of FOIA) for our
information conceming the incident. However, we feel that our one lab should not be singled out for scrutiny so unless CDC is planning to release
the names of the other labs we are thinking of not releasing information on the one lab on privacy concems. If, on the other hand, CDC is planning to
release this information, then we would like to have the heads up so we can get ready for the media issues.
Very much appreciate your help with coordinating this!!
