INVITATION TO TENDER: PROVISION OF REGULAR CLEANING AND CHEMICAL DOSING OF THE
SWIMMING POOL AT MEGAWATT PARK, SUNNINGHILL

We invite you to submit a tender to provide the services identified above. The list of documents provided for
the purpose of the tender is attached to this Letter of Invitation.

The scope of work is given in the Scope. The terms and conditions of the proposed contract are identified
in Contract Data.

Eskom Holdings SOC Limiteds Standard Conditions of Tender specifies the actions to be taken during
the process of tendering.

The section entitled Tender Data provides the details which make the

standardised Conditions of Tender specific to this tender, including the criteria you are required to comply
with in order to be able to submit a tender in response to this Invitation.

The tender documents are supplied to you free of charge.

We have delegated the responsibility for this tender to Eskom Holdings SOC Limited's Representative whose
name and contact details are given in the Tender Data. We deem that a submission of a tender by you in
response to this invitation constitutes your acceptance of the Conditions of Tender.

3.

SCOPE OF WORK
a) Regular Support and maintenance of Swimming Pool, which includes:
The support and maintenance of the Swimming Pool, as follow:
Cleaning and Chemical Dosing of the Swimming Pool and Fountains
Water to be kept CLEAR and floor to be kept CLEAN at ALL times
Surrounding floor areas to be kept FREE of debris, i.e plastic bags,grass etc
All cleaning equipment to be supplied by the contractor
Storage area provided to be kept neat and tidy
Eskom will maintain any existing pumps and motors
Restricted access card will be provided by Eskom
Water test results to be forwarded to the Eskom Representative ONCE a week
Supplier evaluation meeting to be held with Eskom Representative ONCE a week
b) Regular cleaning & chemical dosing of swimming pool
One person to be on site daily-5 working days
Ensure regular HTH dosage of the pool as and when required
Ensure regular Acid dosage of the pool as and when required
Ensure that the water level in the pool is correctly maintained at all times
Ensure regular backwashing of the filters
Report any malfunction of the pools system to Eskom Supervisor
Regular brushing of the pool
Ensure that the surrounding pool area and storeroom is regularly swept and litter free
Regular pool water analysis to ensure correct chemical dosage/s
Ensure SAFE Storage of all pool chemicals
EQUIPMENT TO BE SUPPLIED BY THE CONTRACTOR

Pool acid in order to maintain the pools PH level


Soda ash to control the pools PH and Alkanity level
HTH to control any algea
All other chemicals required to ensure that the pool water is clean and safe for swimming
Cleaning equipment-brushes,nets,brooms etc
Electrical cable for the pool sweeper
Water testing reageant

2.1 The Eskom Cardinal Rules


RULE 1: OPEN, ISOLATE, TEST, EARTH, BOND, AND/OR INSULATE BEFORE TOUCH
(That is, any plant operating above 1 000 V)
No person may work on any electrical network unless:
he/she is trained and authorised as competent for the task to be done;
a pre-task risk assessment to identify all risks and hazards has been conducted prior to any
work commencing;
an equipotential zone is created for each worker on the job site by earthing, bonding, and/or
insulating according to approved divisional procedures;
all conducting material is connected together, all staff on site wear electrical safety shoes, and
insulating techniques are applied according to standards; and

the authorised person (team leader) has certified and shown all team members that the
apparatus is safe to work on.
NB: in the case of live work, work is to be conducted according to standards and procedures
while maintaining minimum safe working clearance.
RULE 2: HOOK UP AT HEIGHTS
Working at height is defined as any work performed above a stable work surface or where a person
puts himself/herself in a position where he/she exposes himself/herself to a fall from or into.
No person may work at height where there is a risk of falling unless:
a pre-task risk assessment to identify all risks and hazards has been conducted prior to
commencing any work at height;
he/she is appropriately trained;
he/she is appropriately secured during ascending and descending; and
he/she is using an approved fall arrest system where applicable
RULE 3: BUCKLE UP

No person may drive any vehicle on Eskom business and/or on Eskom premises:
unless the driver and all passengers are wearing seat belts.

RULE 4: BE SOBER
No person is allowed to work under the influence of drugs and alcohol.
Under the influence means the use of alcohol, drugs, and/or a controlled substance to the
extent that:
the individuals faculties are in any way impaired by the consumption or use of the substances;
or

the individual is unable to perform in a safe, productive manner; or

the individual has a level of any such substance in his/her body that corresponds to or exceeds
accepted medical/legal standards; or
the individual has a level of alcohol in his/her body that is greater than 0.02% blood alcohol
concentration.
This includes any level of an illegal substance in the body, irrespective of when the substance
was used.
RULE 5: PERMIT TO WORK
Where an authorisation limitation exists, no person shall work without the required permit to
work.
Work is as defined in the Plant Safety Regulations (PSR) and Operating Regulations for High
Voltage Systems (ORHVS) of Eskom.
A risk assessment must be carried out jointly by the authorised person and the responsible
person on all work before it commences.
The permit to work must be issued by an authorised person in accordance with the Plant Safety
Regulations.
The permit to work must be accepted in writing by an authorised responsible person.
The permit to work shall be shown to everyone working on the job and the risks explained.
The responsible person must ensure that all staff, working on that job, are entered on a workers
register and the risks explained to each one.
The responsible person must ensure that the conditions of the permit to work are enforced for
the duration of the work

Financial Conditions Value added Tax and the offered prices should be exclusive of VAT.

 Upon evaluation of tenders received, a contract may be concluded with one or more
tenderers. Eskom will not be bound to accept the lowest or any tender. Eskom reserves the
right to enter into negotiations with any one or more of the respondents.
 The onus is upon the tenderer to ensure that copies of the documentation listed above are in
his possession and that his tender is submitted strictly in accordance with the documents

 All clarification questions and additional information sought during the tendering process will
have to be submitted in writing. Written confirmation of the answers given and notes
covering required questions will be issued within two days after the questions are raised, to

SPECIAL CLAUSE
Eskom reserves the right not to award this tender to the highest ranked or highest scoring tenderer, as it
needs to leverage and align its procurement practices to driving socio-economic development objectives that
are enshrined in various governments policies such as B-BBEE, Industrial Policy Action Plan and the New
Growth Path. Preference will be given to tenderers who score high in these areas. For further details on

DISCLAIMER
Eskom Holdings Limit may decide to award only part of a contract or not to award a contract at all. Normally
Eskom Holdings Limit awards the contract to a tenderer who proves to be fully capable of handling the
contract, and whose tender is either the lowest acceptable tender or economically the most advantageous to
Eskom Holdings Limit, in terms of the evaluation criteria stipulated in the enquiry and tender documentation.
Eskom Holdings SOC Limited Limits choice is based on an evaluation price, which takes a number of factors

ANNEXURE A
DECLARATION (BY TENDERER) OF GOOD STANDING REGARDING TAX
IT IS A CONDITION OF TENDERS THAT:1. It is an absolute requirement that the taxes of the successful tenderer MUST be in order, or
that suitable arrangement is made with the Receiver of Revenue to satisfy them.
2. The tenderer must include with his tender documents a copy of a Tax Clearance Certificate (in
respect of Tenders).
3. If the certificate is not included or found not to be correct, Eskom Holdings SOC Limited may, in
addition to any other remedy it may have: a) Recover from the contractor all cost, losses or damages incurred or sustained by Eskom
Holdings Limit as a result of the award of the contract; and/or
b) Cancel the contract and claim any damages, which Eskom Holdings SOC Limited may
suffer by having to make less favourable arrangements after such cancellation.
4. Each party to Consortium / Sub-contractors must complete a separate declaration.
The onus will be on the tenderer to obtain Tax Clearance Certificates (in respect of tenders), from
the office of the South African Revenue Service (SARS) and submit the same with their tenders.
Please ensure that the procurement function is informed for immediate implementation of abovementioned requirements.

Broad Based Black Economic Empowerment (BBBEE)


Eskoms requirements regarding Black/Black Women-owned Suppliers are as follows:
Definitions:
Black: Black people are defined as African, Coloured, Indian, Chinese persons who are natural
persons and are citizens of the Republic of South Africa by birth or descent; or are citizens of the
Republic of South Africa by naturalization before the commencement date of the Constitution of the
Republic of South Africa Act of 1993; or became citizens of the Republic of South Africa after the
commencement date of the Constitution of the Republic of South Africa Act of 1993, but for the
Apartheid policy that had been in place prior to that date, would have been entitled to acquire
citizenship by naturalization, prior to that date.


Black Women Owned (BWO): An EME (Exempted Micro Enterprises) or QSE (Qualifying
Small Enterprises) that is more than 50% owned and effectively managed by Black women.

Youth: means persons between the ages of 14 and 35.

Disabled Person: Person with a long term or recurring physical or mental impairment that
substantially limits their entry into, or advancement in employment.

Large Black Suppliers (LBS): An LME (Large Measured Enterprises) that is a minimum of a
Level Four Contributor to BEE.

Large Black Women Owned: An LME that is more than 50% owned and effectively managed
by Black women.


Small Black Enterprise (SBE): An EME or QSE that is more than 50% owned and
effectively managed by Black persons.

Verification Agency: A Verification Agencies that have applied for Accreditation licence
through SANAS and have been approved.

Verification Certificate: The certificate and accompanying documentary proof obtained


from an Accredited Verification Agency or a Verification Agency (as defined herein)
confirming the B-BBEE Status of a Supplier.

When determining the hierarchy of preference with respect to BEE, the steps are as follows:
Step 1: Determine preference with respect to size and turnover: i.e. EMEs before QSEs before
LMEs. It must be noted that EMEs which are Level Three Contributors are Eskoms first
preference as they represent very small businesses with more than 50% Black ownership, while
EMEs which are Level Four Contributors are last on the Eskom hierarchy of preference as they

Step 2: Once Suppliers are sub-categorised with respect to their size / turnover, then EMEs and
QSEs must once again be grouped based on whether they are Black Disabled, BWO, or SBE.
Eskoms preference is Black Disabled over BWO over SBE.
Step 3: Within each category and sub-category, preference will be given to the Supplier with the
highest B-BBEE Status - i.e. Level One Contributor before Level Two Contributor before Level
Three Contributor, etc. It must be noted that when dealing with EMEs which are Level Three
Contributors, the preference is the highest level of Black ownership (e.g. 100% Black ownership
over 75% Black ownership over 51% Black ownership, etc) as the highest B-BBEE Status for an
EME in terms of the Codes is that of a Level Three Contributor.

Supplier Development & Localisation (SD&L) requirements

Our mandate is to achieve maximum and sustainable local development impact through
leveraging Eskoms procurement spend in a manner that allows flexibility within the business in
order to accommodate government local development initiatives and policies.
The suppliers have opportunities to meet Supplier development and localization requirements
through their activities in the entire value chain. The opportunities that will be identified shall be
grouped under the relevant SD&L objectives of industrialization, localization, skills development,
job creation, supplier development. All Suppliers are required to meet the BBBEE requirements.
a)

BBBEE rating
Suppliers shall be certified to be BBBEE level 1 to 4 contributors. This is a gate keeping
criterion; the failure to comply shall lead to automatic disqualification from further evaluation.

b) Industrialisation
The suppliers shall be required to commit investment in new competitive industries in the
energy sector for the purpose of increasing their capability and capacity to meet Eskom
requirements. It is not relevant in this enquiry.
c)

Localisation
(i) Sub-contracting
The suppliers shall demonstrate that they are procuring some of their goods and services
from companies that are owned by People Living with Disabilities, Black Youth Owned,
Black Woman Owned and Black Owned in this order of preference.
(ii) Local-to-site
The suppliers are required to procure their resources from firstly the district municipality,
secondly the province before enlisting the suppliers elsewhere in South Africa. The
supplier shall submit proof of their offices in each province where they have presence.
(iii) Local content
Utilisation of Eskoms and suppliers spend to develop South Africas based suppliers
relevant to the energy sector. The local content target for this enquiry is 20%

d) Skills development
Increasing the skill base (number and skill level) of South African workers in areas relevant to
the energy sector and where there is a national scarcity. All suppliers shall be required to
propose a higher number of skills and the types of skills to be developed. The composition of

e)

Job creation
The suppliers shall all be required to propose new jobs that will be created as a direct result of
this contract. They will also be required to disclose the number of jobs they shall retain as a
direct result of this contract.

f)

Supplier development
The suppliers shall be requested to respond with proposals for developing their
subcontractors. Any efforts and plans towards continuous improvement of their supply
network will be requested.

Post contract award, all suppliers shall be notified to submit their SD&L implementation schedule
within 30 days of contract award. This will be used as a reference document for monitoring,
measuring and reporting on their progress in delivering on their stated SD&L commitments.
