AFRICANS

TheFWdeKlerkFoundationhastodaysubmittedacomplainttotheSAHumanRightsCommission
regarding45socialmediapostingsthatinciteextremeviolenceagainstwhiteSouthAfricans.

The Foundation is particularly concerned about recent statements in the media and the social
mediathatconstitutehurtfulracistremarks.Inthisregarditissuedastatementon5Januaryin
whichitstronglycondemnedtherecentracistremarksmadebyPennySparrowregardingblack
SouthAfricanswhomadeuseofpublicbeachesonNewYearsDay.

MostmediacommentatorsviewedSparrow'sremarksandthesubsequentfarlesscontroversial
comments of Chris Hart and Gareth Cliff as evidence of rampant and pervasive white racism.
However,ananalysisofFacebookandTwittermessagesshowsthatbyfarthemostvirulentand
dangerous racism expressed in the most extreme and violent language has come from
disaffectedblackSouthAfricans.Themessagesarerepletewiththreatstokillallwhitesincluding
children;torapewhitewomenortoexpelallwhitesfromSouthAfrica.

Section16(1)oftheConstitutionstatesthateveryonehastherighttofreedomofexpressionand
section 16(2) adds that this right does not extend to propaganda for war; to Incitement to
imminentviolence;ortoadvocacyofhatredthatisbasedonrace,ethnicity,genderorreligionand
thatconstitutesincitementtocauseharm.

Section10ofthePromotionofEqualityandProhibitionofUnfairDiscriminationAct(PEPUDA),
which deals with hate speech, states that "no person may publish, propagate, advocate or
communicatewordsbasedononeormoreoftheprohibitedgrounds,againstanyperson,that
couldbeconstruedtobehurtful;tobeharmfulortoinciteharm;ortopromoteorpropagate
hatred.

IntheFoundationsview,themessagesthatithassubmittedtotheSAHRCstarklycontraveneall
theseprovisions.

TheFoundationhasrequestedtheSAHRCtomakeuseofitspowerstoinvestigateandtoreport
ontheobservanceofhumanrightsinsofarasthesemessagesconstitutehatespeechinterms
ofsection16(2)oftheConstitutionandSection10ofPEPUDA.

IthasalsoaskedtheSAHRCtouseitspowerstotakestepstosecureappropriateredresswhere
humanrightshavebeenviolatedand,ifitbelievesittobeappropriate,torefercommunications
thatdirectlyincitethekillingofpeopleortheperpetrationofgrievousbodilyharm,totheNational
DirectorofPublicProsecutionsforfurtherconsideration.

The Foundation calls on the Government and on South Africans of goodwill from all our
communitiescometogetherurgentlytocondemnracismfromwhateversourceitcomes.
