Murthy panel for

major tax breaks for

ENS ECONOMIC BUREAU
MUMBAI, JANUARY 20

THE NR Narayana Murthy committeeappointedbytheSEBIhas

proposed tweaking safe harbour norms and implementing
the Securities Transaction Tax
(STT) approach to taxation of investments and distributions by
alternate investment funds
(AIFs), including venture funds
and private equity funds.
Currently most fund managers of offshore funds manage
their investments from offshore
locations rather than from India.
This is a disadvantage to them
and India. The fund managers
lose the benefit of being close to
the Indian private equity and
venture capital deal flow i.e. the
pipeline of investible ventures,
the committee has said.
India loses the employment
and tax revenue benefits of a
large India-based fund management industryandlargerrelated
volumesof long-termandstable
private equity and venture capital inflows. In order to attract
significant amounts of foreign
capitalbyhavingfundmanagers
based in India, it is important
that their operations in India are
not treated as permanent establishments.
Amongtaxsuggestions,ithas

indirect transfers at fund level. It
has recommended taxability of
income of AIF as capital gains as
against business income will
avoidunnecessary litigation and
build in more certainty. The
panelsuggestedexemptionfrom
service tax on services for raising funds from overseas investors.
A key proposal is for introductionof SecuritiesTransaction
Tax (STT) for private equity and
venture capital investments.
According to the committee,
an appropriate rate of STT could
be introduced on all distributions of AIFs, investment, shortterm gains and other income
and eliminate any withholding
of tax.
After Securities Transaction
Tax income from AIFs should be
tax free to investors. To ensure
that there are not too many hassles in attracting overseas funds,
it has said the government
should clarify the rules for investment by non-resident
Indians (NRIs) in AIFs on a nonrepatriation basis. Clearing the
ambiguity in this regard would
help NRIs invest in AIFs using
funds in their rupee accounts,
among others.
