NON-DISCRIMINATION POLICIES

Equality in the Educational and Employment Environment

No student, employee or prospective employee in the Falls Church City Public Schools
system may be excluded from, denied the benefits of, or be subjected to different treatment with
respect to any educational program or activity, or employment, on the basis of sex, race, color,
religion, national origin, age, disability, or sexual orientation, except where it is determined,
pursuant to the applicable federal or state statutes or regulations, that the fundamental quality
and fairness of a program permits distinction or classification.

Equal Employment Opportunity obligations are defined in Policy IB.3

Freedom From Sexual Harassment is governed by Policy and Regulation IB.4 and IB.4R

Non-discrimination on the basis of disability is governed by Section 504 of the


Rehabilitation Act of 1973, as amended, the Individuals with Disabilities Education Act (IDEA)
as amended, and the Americans with Disabilities Act (ADA), as amended. The Falls Church
City Public Schools will not discriminate against qualified disabled persons in any aspect of
school division employment solely on the basis of disability. The schools will provide facilities,
programs, and activities that are accessible, usable and available to qualified disabled persons.
The schools will provide free appropriate education at elementary and secondary levels,
including non-academic and extracurricular services and activities, to qualified disabled persons
of ages 2 through 21. The schools will not exclude any qualified disabled person solely on the
basis of disability from participation in any preschool education or day care program or activity
or any adult education or vocational program or activity. The schools will not discriminate
against qualified disabled persons in the provision of health, welfare and other social services.

The provision of services for qualified disabled students is governed by Policy and
Regulation 6.25. Programs for Students with Disabilities, and Policy and Regulation 6.2
Declaration of Non-Discrimination Students with Disabilities.

The Falls Church City Public Schools will complete all required assurances, and
compliance reports and fully cooperate with any and all periodic compliance reviews.

The Division Superintendent will develop regulations necessary for the implementation
of this policy and for compliance with applicable state and federal laws and regulations

Accordingly, the School Board will designate at least one individual to act as the
division's compliance officer for each of the following federal laws: Title IX, Section 504 of the
Rehabilitation Act, and the Americans with Disabilities Act (ADA). All students and employees
will be notified annually of the name, office address and telephone number of the designee.
