the individuals, companies and details are strictly protected through the US Code 50, Section
2170, from dissemination to parties outside of the CFIUS review process. Inappropriate use of
such “business proprietary” information could constitute insider trading or violate other federal

DHS AFIS FOIA Exemption 3 is applied to a Proposal. Section 253b(m) of Title 41, United States Code,
prohibits the release of any competitive proposal under the FOIA, except for those portions of the
proposal set forth or incorporated by reference in a government contract. The proposal is also
exempt from disclosure pursuant to exemption (b)(4) of the FOIA and is being withheld in order
to protect the submitter’s proprietary interests.

Exemptions 6 and 7(C) are applied to protect from disclosure the name and telephone number of
an ICE Detention and Removal Officers, the release of which would constitute an unwarranted
invasion of personal privacy and possibly subject the person to harassment by the public such as
solicitors and inquiries by the media.
Information withheld pursuant to Exemption 7(E) includes a description of the law enforcement
cooperation between ICE and a foreign country regarding that country’s ability to share law
enforcement information with ICE through a particular technology in order to track criminal
activities. If this information were released, persons seeking to violate the immigration and
customs laws would have knowledge of a certain country’s ability to track their criminal activities
and would be able to change their behavior to avoid detection
