In response to the Courts minute order of February 12, 2016, most defense counsel
conferred by email and by phone. The Federal Defenders Office agreed to assist in coordinating
the attorneys. In addition, Amy Baggio agreed to take on a coordinating role, and we expect that
one additional attorney may be selected to help coordinate. CJA resource attorney Jennifer
Horvath, from the CJA panel office, is willing to serve as an additional, neutral point person for
communication. We will review how to add her email to the docket.
The defense attorneys have established several methods for efficiently communicating
and sharing work product, including a secure drop box to share collected media information, and
a regularly scheduled conference call on Wednesday at noon among all defense counsel.
It appears that defense counsel have different positions on the issues raised in the motions
at dockets #141 and 145, and on the governments proposed responses. In order to present a
more coherent summary of the positions, I request on behalf of all counsel that the court allow a
supplemental pleading with these positions to be filed by noon on Friday, February 19, 2016.
