Part III of EPA's response to the LTC FOIA is due to the LTC by COB Friday March the 28th. We are
with Ms. Riddick of the LTC this afternoon. To date, we intend to produce copies of all responsive
City of Midland, et al, in response to EPA's CERCLA 104(e) request, but not copies of any responsive
information produced by
Dow in response to EPA's CERCLA 104(e) requests (EPA has not had time to adequately review this info

This morning you asked for an update on the Dow FOIAs. There are 2 outstanding (until the next round,
of course):
1. The request below is from the law firm Spencer Fane in Missouri . It is very broad (see below), but
seems primarily interested in sediment sampling results since 1/1/08. John S., Mark P. and Greg R. will
call the requester this week to clarify and potentially narrow the request to the point where privileged
a. The City of Midland sampling data is included in what is due on March 28. John has drafted a
letter to the City, to be sent on March 26, informing the City that the information will be released . Ralph
b. The 19th floor e-mails are included in what is due on April 28. Mark will contact Julie Spellman
this week to understand where the previously provided detailed instructions need to be expanded (if at
all), to help the 19th floor perform a search for what is relevant to the request, and also a first cut at what
should be withheld and what can be released . Previous instructions were to search the "sent" and "to"
columns for messages from the Dow team. If Dow is in the heading, it is obviously relevant . If Dow is not
in the heading, then someone must go through and determine whether it is still Dow -related. My view is
that, if the 19th floor cannot perform the search, then the program, the FOIA office or Lynn Calvin should

I have a FOIA request on Tittabawassee Saginaw River of Michigan . The requestor Tara D. Inzerillo from
Spencer Fane Britt & Browne, Kansas City MO. is requesting all letters , memos interoffice
correspondence, all email and all records of telephone calls for the period January 1st to the present.
She wants sediment sample test results, summary charts of table or table associated with the soil or

I have a FOIA request on Tittabawassee Saginaw River of Michigan . The requestor Tara D. Inzerillo from
Spencer Fane Britt & Browne, Kansas City MO. is requesting all letters , memos interoffice
correspondence, all email and all records of telephone calls for the period January 1st to the present.
She wants sediment sample test results, summary charts of table or table associated with the soil or
sediment sample test results etc. I'm sending you a copy of this request which explains in more detail . I
did find some of he information in SDMS in the record center. Do you have any of this information.

against the deadline again. I agree it's not an ORC function to perform the search, but we're the ones

Yesterday morning you asked for an update on the Dow FOIAs. There are 2 outstanding (until the next
round, of course):
1. The request below is from the law firm Spencer Fane in Missouri . It is very broad (see below), but
seems primarily interested in sediment sampling results since 1/1/08. John S., Mark P. and Greg R. will
call the requester this week to clarify and potentially narrow the request to the point where privileged
2. The Lone Tree Council FOIA response is due March 28, with a partial extension for certain information
a. The City of Midland sampling data is included in what is due on March 28. John has drafted a
letter to the City, to be sent on March 26, informing the City that the information will be released . Ralph
b. The 19th floor e-mails are included in what is due on April 28. Mark will contact Julie Spellman
this week to understand where the previously provided detailed instructions need to be expanded (if at
all), to help the 19th floor perform a search for what is relevant to the request, and also a first cut at what
should be withheld and what can be released . Previous instructions were to search the "sent" and "to"
columns for messages from the Dow team. If Dow is in the heading, it is obviously relevant . If Dow is not
in the heading, then someone must go through and determine whether it is still Dow -related. My view is
that, if the 19th floor cannot perform the search, then the program, the FOIA office or Lynn Calvin should
do perform it; it is not ORC's function to do the search for them. Lynn Calvin does have a copy of Mary

and extensive FOIA request for the Tittabawassee River as we speak. Most of the documents have

Attached please find two documents for your edification on the Dow Chemical /dioxin
issue as it relates to regulatory authority .
This cleanup is regulated under the Resource Conservation and Recovery Act , a
federal program of the EPA. EPA granted authority to MDEQ to oversee Dow’s
corrective action obligations under RCRA for the company’s dioxin contamination in
the Saginaw Bay Watershed . MDEQ negotiated the terms of the RCRA corrective
action over several years with Dow , culminating in the two entities signing the
document in June of 2003, DEQ Director Chester, on behalf of the state and Susan
Carrington on Dow Chemical’s behalf. Because RCRA is a federal program EPA has
Make no mistake--- there is no ambiguity about how cleanup should proceed . Part 111
or final response. This corrective action license is a legal binding contract between
Dow Chemical and the people of Michigan . Not only does it state how activities will
be conducted , it states they will be conducted in an open public process , perhaps the
one item Dow dislikes the most. That the Board of Commissioners would support with
a resolution Dow Chemical’s desire for closed -door negotiations and the company’s
efforts to abandon a legal binding contract because they no longer want to play by
the rules is beyond the pale. Again, there is no ambiguity in Dow’s RCRA
responsibility. Any delay in resolving the dioxin "situation" is the direct result of the
creating needless delays and interj ecting specious arguments and groundless debate
Your passage of Resolution B calling on EPA to resume lead negotiations with Dow
1. Dow does not need to play by the rules or the laws of the land
2. It’s OK for negotiations to take place behind closed doors over this public resource
3. Dow does not have to honor their contract signed in June 2003
EPA ordered Dow into negotiations under CERCLA last fall and ended them in January
after a thirty-day extension. These negotiations were private , the discussions known
only to the respective parties . EPA stated that they were disappointed but that Dow
important detail. This was the third time in six years Dow has negotiated privately
with regulators— creating delays, derailing timelines and always, always to no avail.
That nothing substantive came from recent negotiations should surprise no one . Lone
Tree Council obj ected to all of these closed -door negotiations and we will continue to
do so.
I would submit that your j ob as elected officials is to support the laws of this state
and to rej ect any negotiations that do not guarantee transparency . As elected
officials you have the responsibility to ensure the business of the people is
transparent and that the people who own these resources are assured a voice and a
place at the table. Given the geographic size of the contamination and the
unprecedented concentrations of dioxin in this county , one would think the Board of
Commissioners would want to be fully apprised of how public health measures and
response activities are being negotiated . Closed-door negotiations leave you, the
elected representatives and your local health department out of the information
loop. Your support for Resolution B essentially denies the elected representatives of

minorities consuming the most highly contaminated fish from these waters are the
most legitimate stakeholders. Who is their voice in a closed -door negotiation? We all
own these natural resources and we are all stakeholders . No one should be in the dark
on this very important issue. Every citizen is entitled to information so they can
participate as equals in the one of the worst contaminations in this state’s history .
This isn’t j ust about Dow and a quick resolution . This is about public health, property,
restoration and the quality of Lake Huron . It’s about how this county chooses to

one from the Saginaw County Board of Commissioners had contacted them for input
on Dow activities, the regulatory process or their perspective on how activities are
progressing. Your support for Resolution B without gathering the facts or deliberating
is bothersome at best.
Contrary to the language put forth in Resolution B , MDEQ is moving this process along
and EPA is actively involved . Consistent with past practice Dow is the only obstacle to
progress. Perhaps you would find the courage to call into question all the delays
created by Dow Chemical. MDEQ with EPA’s support has issued dozens of Notices of
Deficiencies to this recalcitrant company over the past five years ; the first one being
in December of 2003 and the most recent this past December. I would be most happy
As for the timely and final resolution being called for in Resolution B , it has always
been within Dow’s power to bring this cleanup to fruition . In 2003 when Dow and DEQ
signed the RCRA corrective action license Dow proclaimed it was the path forward .
Again in 2005 after 8 months behind closed doors the public was told the resulting
FRAMEWORK AGREEMENT was the " path forward" to resolve this issue. In 2007 upon
entering negotiations with EPA , the public was once again told about Dow’s desire to
settle this issue and move forward . Again they dropped the ball. Now in 2008 Dow is
shopping around to create more delays and tossing aside their legal and binding
obligations under RCRA. Is it the position of the board that Dow does not have to
with Region V. EPA headquarters told Dow they were confident in the State of
Michigan retaining the lead on this corrective action with back up from Region V
when things began to bog down. It worked very well last year on Reach D, JK, O and
Wickes Park. The sampling required by MDEQ under RCRA authority and the authority

year with the two agencies working together than in the previous 30 years. Perhaps it

I propose to send the following message to Dr. Cook of EPA's Duluth lab. Dr. Cook has done
great work on persistent bioaccumulative toxic organic chemicals in the Great Lakes , in particular Lakes
Ontario, Michigan, and Superior. Of particluar note, he is the EPA scientest that first raised the possibility
that dioxin/furan toxicity to LakeTrout fry (at ~ 3 ppm) may be the reason why not Lake Trout populations
(and other similar fish) were not self-sustaining in the Great Lakes (i.e. why fish stocking was necessary ).
While he is familiar with PCB and dioxin contamination of the Saginaw Bay watershed , he has not done
any assessment or research work in the watershed . On the other hand, he has a lot of experience with
ecotoxicology and risk assessment for TCDD and related chemicals that contribute to AHR mediated
effects, especially in fish . Attached is his paper on Lake Ontario and a soon to be released EPA report on
a framework for use of the TCDD toxicity approach that may be relevant to the assessment of toxicity risks

The April 3 meeting involved Jim Agustyn (and maybe other OSCs). The purpose was to see what
additonal removal work Dow would perform at Reach D to reomve residual dioxin contaminated sediment .
Talking to Jim, I understand that Dow has agreed to voluntarily (per an amended CERCLA AOC workplan)
remove the residual dioxin contamination and then complete the Site restoration work .

About 2 minutes ago I finished the "one pager" that will be used for the Sunday meeting of RCRA
Brownfields Coordinators. See attached. At the Brownfields Conference Mary Ann Horinko will have a
panel on Dow's hot issue and Mary G is already well aware of it . Regarding CA, I will certainly defer to
Greg and others on that. Also, for the Brownfields Conference we were encouraged to not submit too
much. Her staff felt that Mary would not want to carry a lot of paper around with her.

An estimated 10 residential properties in an area along the Tittabawassee River will be sampled.
Small plugs from up to 36 inches below surface level will be sent for laboratory analysis.
Analysis may take two to three weeks. Once the data is returned, EPA and MDEQ, along with
Michigan Department of Community Health, will consider a range of options, including more

The investigation aims to determine the extent of dioxin contamination present in the
neighborhood. The project was prompted by Dow Chemical Co.'s February 2008 disclosure to

conduct certain soil and embankment sampling along the Middle Branch of the Tittabawassee
River.
Dow's Midland facility is a 1,900-acre chemical manufacturing plant. Dioxins and furans are
byproducts from the manufacture of chlorine-based products. Past waste disposal practices,
emissions and incineration at Dow have resulted in on and off-site dioxin and furan
contamination.

I don't know who in ORC will be the attorney assigned to this FOIA. I doubt that it will be me since I have
had no involvement in the dioxin cleanup at Dow . As far as I know there are three attorneys assigned to
the dioxin cleanup work at Dow. They are: Jeff Cahn, Catherine Garypie and John Steketee. I'll let you
know to whom you should send any ARD documents (if any) that are responsive to this case as soon as I
find out.

New FOIA - Dow Chemical
Hello Everyone:
The FOIA below is regarding Dow Chemical . They are getting a fee waiver and they are also requesting
this FOIA to be expedited, but that is in the process to be determined yet. This is regarding Dow Chemical
and Mary Gade. This was assigned to all Divisions but ORC is the lead office , so we will be giving our
documents to whomever will be doing the response in ORC , which might be Christine since she is the
attorney, just guessing. So we can do what you think is easier, which would probably get your documents
together and have Christine look over them and hand the documents into her. I know the specifics on this
is regarding the superfund site but not sure what ARD has , thanks.

New Chicago Tribune FOIA request just arrived at HQ - we'll either get an identical FOIA or get it referred
to us.
Office of Administrator received identical CREW FOIA that we received . Usually in this situation a
combined response by all the offices FOIAed is done . Not sure at this time how we'll figure out who takes
the lead on a combined response. John Steketee and I had planned to call the requestor for an extension
when he got in from his Dow trip but may now have to coordinate with HQ in contacting the requestor .
Julie Spellman - What she has done so far in response to the LTC FOIA is transfer all of Mary Gade 's Dow
emails to a separate folder in Gade's email account Julie used the word "thousands" to describe the
number of emails so transferred . She never had a chance to copy or do anything else with the emails ,
and now the Gade email account is closed by RMD and no one currently has access to it . The LTC FOIA
Cynthia Faur is leaving on 5/23- She has printed for me all her emails responsive to the LTC FOIA. She is

upper management to provide comment. I don't think we need more than an hour.
I know that there will be an air managers' meeting in CA next week. Are you planning to attend that
meeting? Maybe some of our questions will be answered at the CA meeting if the topic is on the agenda .

Dear Everyone,
I just wanted to bring to everyone's attention that there are now 4 similar requests. I have prepared a brief synopsis
for clarification purposes and for those who might not hve access to FOIAXpress. The numbers assigned at
HQ-RIN-01328-08 Melanie Sloan, Citizens for Responsibility and Ethics in Washington (CREW)
Request centers on 3 questions. Dow's release of dioxin at Lake Huron and Saginaw Bay,
any and all records that discuss the role of Regional Administrator Mary Gade and
DOW's efforts to clean-up; any communications between EPA and the White House
concerning Ms. Gade's role in evaluating DOW's release and cleaning of dioxin.
Any and all records relating to e-mails, memoranda, letters, correspondence from 12/07
related to EPA and , White House, Office of the Vice President, and members of
Congress about dioxin contamination at and around the DOW Chemical company plant in
Midland, MI.
Any and all communication received by or sent from Administrator Stephen L. Johnson
and Marcus Peacock from 4/24/08 to 5/7/08 that include words: Mary Gade, Gade, Dow,
It is still my understanding that Region 5 will take the lead on these 4 FOIA requests. I will be the central contact for
the processing of requests in response to the Immediate Office of the Administrator, OCIR, and OEX and interacting
with the National FOIA Office (Cynthia Floyd-Coleman and Larry Gottesman) for Headquarters issue, as needed.

Region 5 and HQs FOIA request
Dear Everyone,
I just wanted to bring to everyone's attention that there are now 4 similar requests. I have prepared a brief synopsis
for clarification purposes and for those who might not hve access to FOIAXpress. The numbers assigned at
Headquarters are as follows:
HQ-RIN-01328-08 Melanie Sloan, Citizens for Responsibility and Ethics in Washington (CREW)
Request centers on 3 questions. Dow's release of dioxin at Lake Huron and Saginaw Bay,
any and all records that discuss the role of Regional Administrator Mary Gade and
DOW's efforts to clean-up; any communications between EPA and the White House
concerning Ms. Gade's role in evaluating DOW's release and cleaning of dioxin.
Any and all records relating to e-mails, memoranda, letters, correspondence from 12/07
related to EPA and , White House, Office of the Vice President, and members of
Congress about dioxin contamination at and around the DOW Chemical company plant in
Midland, MI.
Any and all communication received by or sent from Administrator Stephen L. Johnson
and Marcus Peacock from 4/24/08 to 5/7/08 that include words: Mary Gade, Gade, Dow,
It is still my understanding that Region 5 will take the lead on these 4 FOIA requests. I will be the central contact for
the processing of requests in response to the Immediate Office of the Administrator, OCIR, and OEX and interacting
with the National FOIA Office (Cynthia Floyd-Coleman and Larry Gottesman) for Headquarters issue, as needed.

John, here is a copy of the Headquarters FOIA request from CBS. This is a headquarters assignment
only, not a combined processing. The requester is seeking records in the possession of Headquarters

Trina/Cynthia: For request HQ-RIN-01354-08 (05-rin-01048-08) , I will respond for the agency Under the
FOIA , requests are for existing records as of the time of the request . Since we have not responded to the
request we do not have any responsive records. We can certainly send the actual FOIA request form
Crew as a response to Warner, but they already have this request. I will inform the requester
(Warner,Norcross & Judd) of this, they can submit another request if they want to ascertain if such
records are available. I will send you a copy of the response, both rin numbers will be referenced .
The FOIA does not require that we place them on a distribution list for records as they become available .
I have a call to Mr. Dewitt and informed him of this , have not received any call back.
For Requests HQ-RIN-01328-08 Melanie Sloan, Citizens for Responsibility and Ethics in Washington
(CREW) and HQ-RIN-1339-05 Michael Hawthorne, Chicago Tribune, Region 5 will make the expedited and
fee waiver determinations, you will be copied on this. Also, the responding programs will get additional

Susan --- Thanks again for coming to northern Kentucky, located at the "continental divide" between
Regions 4 and 5.
Your talk was humble and gracious, and hit just the right tone of the Brownfields grants being "seed
money", which States and locals leverage to revitalize their communities . --- (I apologize if my own
talking points upstaged you in any way by naming our four R 5 grantees who were present before you did
-- I presumed our press folks had cleared the points with your staff --- I may have messed up).
Thanks again for all your leadership in the many and varied OSWER programs . We are all very fortunate
