END USER LICENSE AGREEMENT
Tibbo Device Server Toolkit
This License Agreement for the Tibbo Device Server Toolkit ("License Agreement")
is a legal agreement between you (either an individual or an entity) and Tibbo
Technology, Inc. ("Tibbo") for Tibbo Device Server Toolkit software ("Software")
. You may install as many copies of the Software as necessary provided that thes
e copies are used SOLELY in conjunction with Tibbo's Serial-to-Network Devices (
i.e. DS100 SERIAL DEVICE SERVER, EM100 ETHERNET MODULE, other similar Devices th
at may be released by Tibbo in the future.). You MAY NOT use this software to en
able communications with or through the Serial-to-Network Devices that are not m
anufactured by Tibbo, or in any other manner that does not incur the use of Tibb
o's Serial-to-Network Devices. By clicking on the YES button, installing, copyin
g or otherwise using the Software, you agree to be bound by the terms of this Li
cense Agreement. If you do not agree to the terms of this License Agreement, the
n do not install the Software.
YOU AGREE THAT YOUR USE OF THE SOFTWARE ACKNOWLEDGES THAT YOU HAVE READ THIS LIC
ENSE, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.
1. GRANT OF LICENSE: Tibbo hereby grants you a non-exclusive license to use the
Software and any related documentation ("Documentation") subject to the followin
g terms:
You may: (i) use this Software on as many computers as necessary provided that t
his Software is used SOLELY to communicate with or through Tibbo's Serial-to-Net
work Devices (DS100, EM100, etc.); (ii) copy the Software for back-up and archiv
al purposes provided any copy must contain all of the original Software's propri
etary notices.
2. LICENSE RESTRICTIONS:
a) You may not: (i) permit other individuals to use the Software except under th
e terms listed above; (ii) modify, translate, reverse engineer, decompile, disas
semble or create derivative works based upon the Software or Documentation; (iii
) resell, rent, lease, transfer, or otherwise transfer rights to the Software or
Documentation; or (iv) remove any proprietary notices or labels on or in the So
ftware or Documentation.
b) You may not use the Software to communicate with or through Serial-to-Network
Devices that are not manufactured by Tibbo, or in any other manner that does no
t incur the use of Tibbo's Serial-to-Network Devices
3. TITLE: Title, ownership, rights, and intellectual property rights in and to t
he Software and Documentation shall remain in Tibbo. The Software is protected b
y the international copyright treaties.
4. DISCLAIMER OF WARRANTY: THE SOFTWARE AND DOCUMENTATION ARE PROVIDED "AS IS" W
ITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW,
TIBBO FURTHER DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED
WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRING
EMENT. THE ENTIRE RISK ARISING OUT OF THE USE OR PERFORMANCE OF THE SOFTWARE AND
DOCUMENTATION REMAINS WITH YOU. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE L
AW, IN NO EVENT SHALL TIBBO BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, DIRECT,
INDIRECT, SPECIAL, PUNITIVE, OR OTHER DAMAGES WHATSOEVER (INCLUDING, WITHOUT LI

MITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF B

USINESS INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THIS AGREEMENT OR T
HE USE OF OR INABILITY TO USE THE PRODUCT, EVEN IF TIBBO HAS BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES.
4. TERMINATION: This License Agreement shall terminate automatically if you fail
to comply with the limitations described in this license. No notice shall be re
quired from Tibbo to effectuate such termination. Upon termination, you must des
troy all copies of the Software and Documentation.
