UNIVERSITY OF PITTSBURGH AT GREENSBURG HOUSING AND FOOD SERVICE

APPLICATION AND CONTRACT

ThisHousingandFoodServiceContractisalegalagreementbetweentheindividual
studentand/orparent,hereinreferredtoasStudent,andtheUniversityofPittsburgh
atGreensburg,hereinreferredtoasUniversity.

TERMS AND CONDITIONS:

1. Eligibility-TobeeligibletoliveinUniversityHousing,anindividualmustbeafulltimeregisteredUniversitystudentingoodstanding.Ifatanytimeduringthe
termofthiscontracttheStudentsstatuschangesfromfull-timetolessthanfulltime,orifthestudentseligibilityisaffectedbyproceedingsundertheStudent
CodeofConduct,thiscontractmaybeterminatedbytheUniversityassetforth
below.TheUniversityreservestherightnottoacceptanapplicationforhousingif
theindividualhasbeenfoundinviolationofresidencehallpolicies.

2. ContractTerm-ThiscontractisforboththeFallandSpringtermswhilethe
UniversityisinsessionandcannotbecancelledorterminatedbytheStudent
exceptassetforthinthisagreement.Ifthisagreementisenteredintoafterthe
startoftheFallterm,thisagreementappliesonlytothebalanceoftheterm(s)as
applicable.IfthiscontractisnotreturnedtotheOfficeofStudentServicesbythe
specifiedduedate,theUniversityreservestherighttorejectthiscontract.Once
signedbytheStudentandacceptedbytheUniversity,allprovisionsofthe
contractwillbeenforceableandshallremainineffect,unlessterminatedor
cancelledbytheUniversity.

3. OccupancyThiscontractprovidesonlyalicenseforoccupancyofanassigned
spaceinUniversityHousingfortheentireacademicyear,exceptasotherwise
providedherein.Thiscontractshallconstitutealicenseonlyandshallnotbe
deemedtoconstitutealeaseortocreateortransferaninterestinorlienonreal
estate.Thiscontractmaynotbeassignedortransferred.TheStudentmaynot
occupyUniversityHousingduringperiodsbetweenacademicterms,duringthe
ThanksgivingholidayandSpringBreak.UniversityHousingwillnotbeavailable
foroccupancypriortothecheck-indateannounced.Studentsmaynotoccupy
UniversityHousingotherthanasspecifiedabove.Astudentisconsideredtohave
takenoccupancyofhis/herresidencespaceuponreceiptofkeystotheassigned
space.Uponmovingintotheresidencehalls,eachstudentmustregisterwitha
ResidenceLifestaffmember.

4. Payment-TheStudentagreestopaytheprevailingroomandmealplanrates
(Fees)establishedbytheUniversityforthetypeofaccommodationtowhich
he/sheisassignedandforthetypeofmealplanselected.Allamountsdueand
payabletotheUniversityinconnectionwiththiscontractwillbebilledtothe

Studentsaccount.StudentagreestopayallFeesandanyothercharges
(including,butnotlimitedto,damageassessments)whendueaccordingtodates
setbytheUniversity.TheUniversitymaycancelthiscontractforanyunpaid
amountsowedtotheUniversity.

5. HousingDepositAdepositintheamountof$150.00(theDeposit)isrequired
withthiscontract.Exceptasspecifiedinthisagreementorotherwiseagreedtoby
theUniversity,theDepositisnon-refundableandwillbeappliedtoSpring-term
Fees.IfitisdeterminedthattheStudenthasoutstandingindebtednessfor
currentorpriortermstheDepositmaybeappliedbytheUniversitytoanysuch
indebtedness.

6. CancellationIftheStudentattendstheUniversityduringthefallandspring
terms,havingexecutedthecontract,thefullroomandboardfeesforthe
academicyearmustbepaid.Thiscontractmaybecancelledbyprovidingwritten
requestforcancellationtotheOfficeofHousingandResidenceLife.Neitheroral
communicationwiththeOfficeofHousingandResidenceLifenorwritten
communicationwithotherofficesconstitutescancellationofthiscontract.
CancelingUniversityregistrationoradmissiondoesnotautomaticallycancelthis
contract. Upon proper cancellation, pro-ration of such Fees may be made
as provided herein. Notwithstanding any other provision of this
contract to the contrary, if the Student is dismissed from the University
for disciplinary reasons, the Student and/or parents will not be relieved
of the obligation to pay all room charges and damages for the term in
which the Student is dismissed.Contract cancellations for a current term
received after the end of the course add/drop period of that term will be
assessed the full term Fees, and no pro-ration of such Fees shall occur.

7. Refund/Forfeiture- A refund or pro-ration of Fees and Deposit may occur

in the following situations:

A.
A full refund of paid Fees will be made in the event of nonattendance or complete withdrawal by the Student from the University
prior to the start of the Contract Term (except the Deposit, which shall be
forfeited). The Deposit will be refunded for new entering students and
new transfer students when notification of intent to cancel contract is
received prior to the first of July for the following fall term and prior to
the first of December for contracts initiated for spring term.
B.
After occupancy in University Housing has been established by the
Student, the Student may cancel the contract up until the end of the
course add/drop period (except as otherwise set forth herein) and
receive a partial refund or pro-ration of Fees (except the Deposit, which
shall be forfeited), pro-rated beginning on the date that the Student

officially surrenders use of University housing and returns all appropriate

keys (room and mailbox keys) to the University staff and satisfies
University mandated housing separation requirements and procedures.
This provision applies in situations where the cancellation occurs after
occupancy by the Student and the start of a given term (but not after the
end of the course add/drop period of the term), and could involve
cancellation of the entire remaining Contract Term (including single term
contracts) or only cancellation of the remaining current term (with the
second term of the Contract Term continuing in effect), as the case may
be.
8. LateArrivalTheStudentmustnotifytheDirectorofHousingandResidenceLife
inadvanceifhis/herplannedarrivaldateislaterthanthedesignatedcheck-in
date.Failuretodosomayresultinterminationofthiscontractandforfeitureof
theDeposit.

9. Vacating-Residencehallsmustbevacatedonthelastdayofthecontract,within
24hoursafterdiscontinuanceasaStudent,terminationofthecontractbythe
University,orthestudentslastfinalexaminationoftheterm,whicheveroccurs
earliest.Uponrequest,graduatingseniorsmaybepermittedtostayuntil
graduationday.TheUniversitymaychargeapenaltytoanyStudentwhofailsto
vacateUniversityHousingwhenspecifiedbytheUniversity.

10. Assignments-ThisContractdoesnotguaranteetherightofassignmenttoor
selectionofaparticulartypeoflivingaccommodation.TheUniversityhasthesole
righttoassignorreassignspace,toassignroommates,toconsolidatevacancies
andtochangeoccupanciesasitdeemstobenecessary.

11. AcademicandThemedHousingAviolationoftheAcademicVillageand/or
ThemedHousingAgreement(s)and/ortheUniversityStudentCodeofConduct
mayresultinlossoftheAcademicVillageand/orThemedHousingassignment.

12. FoodServiceTheStudentisrequiredtopurchaseaUniversitymealplan.Meal
hoursmaybeadjustedbytheUniversityasnecessary.Foodserviceisnot
providedunderthisagreementduringperiodsbetweenacademictermsand
duringtheThanksgivingholidayandSpringBreakperiod.Refundswillnotbe
madeforunusedportionsofthemealplan.

13. StudentConductEachStudentisresponsibleforknowingandobserving
Universitypolicies,rulesandregulationsassetforthinofficialUniversity
publications(UniversityRegulations).Studentagreestoabideby(1)theterms

ofthisContract,(2)alllawsandordinancesaffectingtheuseandoccupancyof
UniversityHousing,and(3)allUniversityRegulations(including,butnotlimited
to,theStudentCodeofConductandthePitt-GreensburgResidentHandbook)
pertainingtotheUniversityand/orUniversityHousing,asthesamepresently
existorasamendedbytheUniversityinitssolediscretionfromtimetotime.All
UniversityRegulationsareherebyincorporatedinandmadeapartofthiscontract
asifsetoutinfullherein.ViolationsofUniversityRegulationsmayresultinthe
cancellationofthecurrentroomassignmentwithoutrefundand/orfuture
considerationforhousingaccommodations.

14. ProhibitedUsesandActivities-WithoutlimitingtheStudentConduct
requirementssetforthabove,Studentherebyacknowledgesthatthefollowing
shallnotbepermittedin,on,orabouttheStudentsaccommodations:
unauthorizedpets,air-conditioners,spaceheaters,anyopenflamecookingdevice
orheatingunit,halogenlightfixtures,exteriorradio/televisionaerials,controlled
substances,waterbeds,loftbeds,firecrackers,ammunition,firearmsoranyother
weapons,andanyflammableitems.Extensioncordsareprohibited.Smoking is
not permitted in University owned buildings.

15. Damages-TheStudentisabsolutelyandunconditionallyliable,individuallyand
jointlywithotheroccupants,forwhateverdamage,regardlessofcause,which
occurstotheassignedaccommodationandcontentsandfurnishingstherein.In
allcases,theUniversity'sdeterminationofthecostofrepairshallbeconclusive.
Residentsagreetopayfordamages,lostorstolenUniversityproperty,and/or
servicecostsnotduetonormalwearandtear,andtotheimpositionofafinancial
holdontheiraccountifthedamageamountsarenotpaid.Damagesorlossmust
bereportedpromptlytotheresidencestaff.Studentswillbebilledfordamageto
thebuildingandfordamagedormissingfurnitureandequipment,includingthose
incommonareas,basedonthecostofreplacement,laborand/ormaterials.The
Studentagreesthathe/sheisjointlyresponsibleandwillbechargedanequal
shareofthecostsfordamageoccurringtothepublicandsemi-privateareas,
alongwithotherresidentStudents,wheretheUniversitycannotdeterminethe
identityoftheresponsibleparty.Damagechargeswhichremainunpaidafterthe
duedatestatedontheinvoicemayresultinthecancellationofthecurrentroom
accommodationand/orfutureconsiderationforhousingaccommodationandany
otheractiondeemednecessaryforcollectionbytheUniversity.EachStudentis
requiredtocompletetheRoomCondition/InventoryFormswithinthestatedtime
period.

16. Liability-TheStudentagreesthattheUniversityisnotresponsibleforany
damageorinjurytotheStudentorhis/herpersonalpropertyfromanyactof
anotherresidentoranyotherperson.TheStudentagreesthattheUniversityis
notresponsibleorliabletotheStudentforanypersonalpropertythatislost,
stolenormissingfromUniversityHousing.The Student shall be responsible
for having adequate and appropriate insurance (i.e., homeowners

supplemental or other approved insurance) to protect against any loss or

damage to the Students personal property. Under no circumstances shall
the University be liable for any damage or injury to the Student or any
other individual or loss of personal property of a Student.

17. Keys-AllkeysarethepropertyoftheUniversityandcannotbeduplicated,
exchangedorgiventoanotherperson.Failuretoreturnkeysatthecompletionof
thecontractperiodwillresultinapenaltyfee.Thereisalsoachargeforreplacing
lostkeysduringthetermofthiscontract.Keysfoundinthepossessionofanyone
otherthanthepersontowhomtheyhavebeenassignedwillbeconfiscated.

18. AuthorizedEntry-TheUniversityreservestherightforauthorizedpersonnelto
enterroomsforthepurposeofmaintainingsanitationandsafetystandards,
conductinginventoryanddamageinspection,makingrepairstoroomsand
furnishings,enforcingUniversitypolicies,andinemergencysituations,ensuring
thesafetyandwell-beingofmembersoftheUniversitycommunityand/or
Universityproperty.

19. TerminationbyStudent-TheStudentmayterminatethiscontractforanyofthe
followingreasons:

a.Withdrawalduetomid-yeargraduation;
b.ParticipationinaUniversityrecognizedstudyabroadprogram;or
c.Withdrawalduetoinvoluntarymilitaryservice.
Inallcases,studentswhowishtowithdrawfromUniversityHousingmust
completeawithdrawalformintheOfficeofHousingandResidenceLife.Ifthe
StudentcomplieswiththerequirementstoterminatethisContractforoneofthe
above-listedreasons,theStudentwillberefundedthefullamountofhis/her
HousingDepositandwillonlyberesponsibleforfeesandchargesforthetermin
whichtheterminationoccurs(exceptforwithdrawalsduetoinvoluntarymilitary
service,inwhichcase,thefeesshallbeproratedfortheperiodoftermduring
whichUniversityHousingisoccupied).
Allotherreasonsforacontractterminationarereviewedonacase-by-casebasis
bytheDirectorofHousingandResidenceLife,subjecttothetermsandconditions
statedherein.Suchotherterminationsarenotguaranteed,andappropriate
documentationisrequiredtosupportanysuchrequests.Ifastudentwithdraws
fromUniversityHousingforanyotherreasonwithouttheconsentofthe
University,he/shewillbeliableforthefullamountofthisagreement(bothFall
andSpringTerms).
20. TerminationbyUniversity-TheUniversitymayterminatethiscontractforanyof
thefollowingreasons:

a.Violationofanytermorconditionofthiscontract;
b.Verifiedwithdrawal,suspensionoracademicdismissaloftheStudentfromthe
University;
c.IftheStudentloseshisorherhousingprivilegespursuanttoproceedingsunder
theStudentCodeofConduct;or
d.BehavioronthepartoftheStudentwhich,intheopinionoftheUniversity,
posesaclearandpresentdangertotheStudent,Universitycommunityor
communityatlarge.
Inallcases,theHousingDepositwillberetainedorchargedbytheUniversity.In
addition,theUniversitymaydeclaretheentireamountofFees(FALLandSPRING
TERM),alongwithanyotherapplicablecharges,dueunderthecontracttobe
immediatelydueandpayablebytheStudent.Uponterminationofthiscontractby
theUniversity,StudentshallvacateUniversityHousinginaccordancewiththe
termsspecifiedbytheUniversity.
