ANSWER

COMES NOW, respondent, and unto this Honorable Office, most respectfully states and
avers that :

1. Respondent denies the allegations stated in the Pre-Charge Evaluation that he


incurred seven (7) days absences without filing the necessary application for leave or
secured approval from the authorized official and that he is liable for Neglect of Duty
defined and penalized under NAPOLCOM Memorandum Circular 2007-001.
2. The respondent has never been absent on August 1,8, 10,12,13,19, and 22 all of 2014,
as stated in the Pre-Charge Evaluation. In fact, the Chief Clerk of the REGIONAL
BAND PRO7 (R-Band for Brevity) SP03 Ricardo Abellanosa can attest to the fact
that the respondent was presenct in the office on those dates. However, the respondent
admits that he was late during those times and failed to render duty as an organic
member of the REGIONAL BAND PRO7 (R-Band for Brevity).
3. As a policy laid down in the R-Band, once a member of the R-Band failed to perform
band activities, he is already considered absent notwithstanding his presence in the
entire office hours of the said unit.
4. The respondent has never failed to perform his duty since he was admitted in the RBand unit on the year December 2008. It was unfortunate for him that on August
2014 and on the dates specified in the Pre-Charge Evaluation, he was played by some
unfortunate circumstances which lead him to incur late and eventually resulted in his
failure to perform his duty as member of the aforementioned unit.

5. The respondents two daughters named Sophia Mendez and Stephanie Mendez 6
years old and 4 years old were both afflicted with disease last week of July 2014. The
respondent as the breadwinner of the family and whose family solely depends on has
to attend to the needs of her two daughters for medical treatment. The respondent as a
good father of the family cannot just allow that his spouse will be the one to take
charge of the ill condition of their two daughters during those times, hence, he
himself was the one taking care of his two daughters with the assistance of her
spouse.
6. This recurring health condition of her two daughters lead him to incur lates on
specified dates since aside from being the one who took care of her two daughters in
bad health condition, he is also studying law in the Gullas Law School. During those
times, he oftentimes missed his usual sleep hours and as a result he arouse late in the
morning.
7. The respondent had to seek help from relatives and friends to secure financial support
for the medical treatment of her two daughters which complement to the family
problems of the respondent.
8. The respondent understands that he is not relieved nor excused from any
administrative liability by his aforementioned justification, however, he is humbly
asking for your kind consideration for him to be relieve of any administrative liability
and vows to faithfully execute and render service in the R-Band for the rest of his
membership in the unit.
9. The respondent has filed his Answer to the Pre-Charged Evaluation this 2 nd day of
July 2015 or three (3) days beyond the five (5) days reglementary period from receipt
of the Summons to submit his defense considering that his wife has undergone prenatal check-up at Cebu Doctors University and that he is caught unaware and thinking
in good faith that the five (5) days period excludes Saturdays and Sundays. Thus, this
delayed filing. The respondent is hereby asking for consideration that your good
office find merits to consider his delayed submission despite the lapse of the period to
submit his defense.

WHEREFORE premises considered, it is most respectfully prayed for by this


Honorable Office that the respondent be relieved from any administrative liability for his failure
to render service on the dates specified in the Pre-Charge Evaluation.
