MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement (MOA) is made and executed this

__________ _, 2016 in Manila, into by and between:

The PHILIPPINE NORMAL UNIVERSITY (PNU), a state

institution of higher learning with principal address at
Taft Avenue corner Ayala Blvd, Ermita, Manila,
represented by its President, DR. ESTER B. OGENA,
and hereinafter referred to as the PNU;
and
The BICOL UNIVERSITY, a state university created
under Republic Act 5521, with principal office address in
Legazpi City, represented herein by its President, DR.
FAY LEA PATRIA M. LAURAYA, hereinafter referred to
as BU.

WITNESSETH; that
WHEREAS, PNU, by virtue of an existing contract with the
Commission on Higher Education (CHED) currently provides
technical assistance to the CHED K-12 Transition Team in the
planning and implementation of the CHED K-12 Engagement
Program which aims to enable the CHED to systematically support
the K-12 implementation by leveraging the expertise of Higher
Education Institutions;
WHEREAS, Republic Act No. 10612 provides that PNU, being the
National Center for Teacher Education per Republic Act No. 9647,
and its network of universities in teacher education like the
National Network of Normal Schools (3NS), are tasked to provide
training for hired teachers.
WHEREAS, BU, as member of the National Network of Normal
Schools (3NS), commits itself to the goals and objectives of the
3NS, one of which is the organization of training programs and
lectures on different areas of specialization;
WHEREAS, PNU, as the Lead Shepherd of the National Network of
Normal Schools (3NS), shall delegate the task of training teachers
to each 3NS member which, in turn, shall undertake to train such
teachers in its region;

NOW, THEREFORE, for and in consideration of the foregoing

premises, the parties hereby agree, as follows:
A. ROLES AND RESPONSBILITIES OF PNU
1. Provide total funding assistance to BU in the amount of
__________________. Fund releases shall be in accordance with
the approved Schedule of Tranche Payments as will be agreed
upon by the parties. It is understood that BU shall shoulder
any and all expenses in excess of the approved budget.
Excess funds, if any, shall be turned over to PNU. All releases
shall be suject to the submission of duly audited financial
statements and liquidation reports in conformity with
applicable rules and regulations.
2. Monitor the performance the each 3NS member in the
implementation of the project.
B. ROLES AND RESPONSIBILITIES OF BU
1. BU shall be undertake the project strictly in accordance with
the provisions of this contract and the approved financial
plans.
2. BU shall utilize the funds for purposes for which the same
are intended including expenses which BU may deem
necessary; provided, such expenses are evidenced by
substantial documents upon liquidation.
3. BU shall obtain all relevant permits and licenses that may be
required in pursuit of this project.
4. Issue official receipts or such other documents that will
prove receipt of every amount received from PNU.
5. BU shall train teachers in its region for the period herein
stipulated. If upon the end of such period, the training has
not yet ended or if BU deems it necessary to extend the
term of the project to attain the purpose for which it was
started, it may do so; provided, PNU shall agree to an
extended term and no additional costs shall be incurred
unless with the consent of PNU.
C. RESPONSIBILITES OF BOTH PARTIES
1. Jointly monitor the progress and implementation of the
project, and ensure the acceptability and adherence to this
Agreement.
2. Represent that they have the requite power, authority, and
capacity to execute the provisions of this Agreement.
3. Comply with the pertinent laws, rules and regulations of the
Government of the Republic of the Philippines.
4. This MOA shall be binding upon the parties hereto and their
respective successors in interest and assigns. All other terms
and conditions subsequently agreed upon by the parties in
writing after the signing of this MOA shall constitute and
addendum thereto and form an integral part thereof.
D. SEPARABILITY CLAUSE

Any provision of the MOA declared illegal, invalid, or

unconstitutional by the court of law shall not affect the rest of the
other provisions which shall remain valid, subsisting and binding.
E. EFFECTIVITY AND DURATION OF THE PROJECT
This Agreement shall take effect immediately upon signing of both
Parties. It shall automatically be terminated upon the last day of
the period herein stipulated, but may be extended by motion of
either party upon the concurrence of the other. The project shall
run for ___________ months/years commencing from the date from
which this Agreements was signed by both parties.
IN WITNESS WHEREOF, the parties have hereunto affixed their
signature on __________________ 2016 at the City of Manila, Metro
Manila.
