Drug Abuse Prevention and Control Program
INTENT To formulate and implement drug abuse prevention and control program in the workplace, including the formulation and adoption of company policies against dangerous drug use, in compliance with the mandatory requirement of Article V of Republic Act 9165 otherwise known as he Comprehensive Dangerous Drugs Act of 2002. 1.0 POLICY It is the policy of the Company to have a drug free workplace by instituting programs on drugs prevention and control pursuant to law. 2.0 SCOPE This policy applies to all regardless of employment status. 3.0 RESPONSIBILITY The VP for Admin shall be responsible for implementing this policy. 4.0 4.1
GUIDELINES AND PROCEDURE
Drug Testing Program for Employees: a. The company requires all employees to undergo an annual drug test for purposes of reducing the risk in the workplace. Strict confidentiality shall be observed with regards to screening and the screening results. b. Drug testing should conform to the procedures as prescribed by the Department of Health (DOH). Only drug testing centers accredited by the DOH shall be utilized. c. Drug testing shall consist of both the screening test and the confirmatory test. Confirmatory test shall be carried out should the screening test turn positive. The employee concerned must be informed of the test results whether positive or negative. d. Where the confirmatory test turns positive, the company shall evaluate the results and determine the level of care and administrative interventions that can be extended to the concerned employee. e. A drug test is valid for one year. Additional drug testing may be required for just cause as in any of the following cases: After workplace- related accidents, including near-miss. Following treatment and rehabilitation to establish fitness for returning to work/ resumption of job In the light of clinical findings f. All cost of drug testing shall be borne by the company

a. The drug prevention and control program shall include treatment, rehabilitation and referral to be provided by the company. It shall also include employee assistance and counseling programs. b. Following rehabilitation, the company shall evaluate the fitness of the drug- dependent employee to resume his job and poses no serious danger to his co-employee and/ or the workplace. c. Repeated drug use even after ample opportunity for treatment and rehabilitation shall be dealt with the corresponding penalties under the company policy in relation to Republic Act 9165 and its Implementing Rules and regulations. 4.3 Monitoring and Evaluation The implementation of the drug- free workplace policies and programs shall be monitored by the company nurse and evaluated periodically to ensure that the goal of a drug- free workplace is met. 4.4 Confidentiality Confidentiality of all information relating to drug tests or to the identification of drug users in the workplace shall be maintained unless when required by law in case of overriding public and safety concerns or when authorized in writing by the employee concerned. 4.5 Consequences of Policy Violations a. Any employee who uses, possesses, distributes, sells or attempts to sell, tolerates or transfers dangerous drugs or otherwise commits other lawful acts as defined under Republic Act 9165 and its implementing Rules and Regulations shall be dealt with in accordance with the Company policy in relation to the Article 282 of the Book VI of the Labor Code and under Republic Act 9165 and its implementing Rules and Regulations. b. Employees who shall be investigated for violation of this policy shall enjoy the right to due process pursuant to law. 5.0 EFFECTIVITY: January 2, 2014
