ProtectionoftheArchaeologicalHeritageLand(CAT),anofficeattachedtotheInstituteofPuerto
RicanCulture(ICP),whichregulatesthestudiesandarchaeologicalexcavationsforpublicand
privateprojectssuchasthePaseodePuertadeTierraconstruction.
RodriguezcontinuesremarkstotheCEAPRC,that"theprojectwaspresentedtotheCouncilin
fragments,aswiththenefariousPaseoCaribeprojectafewyearsago."
"InthebeginningtherepresentativesofAFIandtheOmegacompanyhadassuredtheICPthe
projectwouldnothaveanyimpactonthePreColumbianIndianarchaeologicalsiteknownasSan
Juan2(SJ2),andlocatedonlandnorthofthebuildingoftheGuardNational,norontheremainsof
historicstructuresthatcouldbeundertheearth,sothecontractorswereissuedaconditional
endorsement.
But"nothingisfurtherfromthetruth,"explainsRodriguezLopez"becausedeveloperswereextending
theoriginalscopeoftheproject,toincludetheremovalofarchaeologicalgroundforplacingsidewalks
andpipes,placementontheSJ2depositofdebrisandmaterialsconstructionandfinallytheuseof
heavymachinerytomovesoilmaterialsarchaeologicalprojectduringtheconstructionoferosion
control,allinviolationofagreementsandauthorizationsthatCATawardedingoodfaith.
InrecentdaystherewasanimpressivedisplacementoflandborderingthecanyontowardstheSea,
nearFortinTajamar,animportantplaceveryclosetotheprojecthistoricalresources.Inpicturesof
thedramaticcollapsespublishedinvariousmedia,itshowsthatthedevelopersputheavycranesand
otherlargemachinerywithouttheauthorizationoftheCAT,impactingthoselandsformingpartofthe
deposit.
TheArchaeologiststates:"WhileitistruethatAFIhashiredarchaeologiststobepresentatthe
worksite,thiscomplianceisnojustificationfortheimpactssufferedbythesitesandhistoricalremains
throughouttheproject.Toconstructdoesnothavetomeantodestroy.Theconstructionofapath
necessaryforwalkersandcyclistscouldhavebeendesignedasalowimpactprojectforimportant
naturalandculturalresourcesofthearea."
InordertoavoidfurtherdamagearcheologistRodriguezLopezindicatesthat:"Iwillrequestthe
membersofCATatitsnextmeetingonMarch31,2016,thatwefulfillourministerialresponsibilitiesto
removethearchaeologicalendorsementforthePaseodePuertadeTierraproject.
IalsointroducedamotiontostoptheimpactstothearcheologicalsiteSanJuan2,neartheTajamar
Fort,andthecallareaErosionB8,toapplyadministrativesanctions,includingfinesforfailingto
complywiththepreviousrequirements.

Law112ofJuly20,1988,theProtectionoftheArchaeologicalHeritageLandAct,makesresponsible
themembersoftheCATfortheprotectionandcustodyofourculturalresourcesthatare
archaeologicalinnature.Section13oftheActempowerstheCATtoimposefinesofuptoten
thousanddollarsforanybreachoftheresolutions,ordersanddecisionsissuedbytheCouncil.
IfviolationsarerepeatedtheCouncilcanimposeanadditionalfineofuptofiftythousanddollars.

ArchaeologistMiguelRodriguezLopezisamemberoftheCouncilfortheProtectionof
ArchaeologicalHeritageLandsinceitsinception.HehaschairedthePuertoRicanAssociationof
ArchaeologistsandAnthropologists,aswellastheInternationalAssociationforCaribbean
Archaeology.Fortheirstudyanddefenseofarchaeologicalsitesinthecountryhehasreceivedthe
RicardoAlegriaMedal,aMedalcommemorating50yearsofservicewiththeInstituteofPueroRican
CultureandwasawardedtheOrderofCemissuedattheTainoIndianFestivalinJayuya,Puerto
Rico.

authoritytoparalyzeworksatleastuntilameetingcanberealizedafterHolyWeek.This

anyindicationofasign/permitforextraction,andleavingthefaceiftheclearedareaexposed.
