Thepartieshavecompleteddiscovery,savefordepositionssoughtbyPlaintiffof

opposeanyextensionofthediscoverydeadlineandanydiscoveryproceedingafterthe
discoverydeadline.Plaintiffbelievesthathehasarighttocompleteanysubpoenas

ThereareseveralopenMotions:onebyPlaintiffformiscellaneousrelief(review
incameraofDefendantsloggedbutunproducedmaterialsassertedasprivileged),oneto
compeltheFBItocomplywithitssubpoena,andonetosanctionnonpartyWilliam
Hogeforissuessurroundingasubpoena,andonetoallowPlaintifftouseconfidential
documentsinaRule56motionforsummaryjudgment.Defendanthasnotrespondedto
thelattermotionbutintendstorespondinoppositiontothatmotionbytherequired
responsedate.
III.
DispositiveMotionsAnticipated
PlaintiffintendstofileaRule56motionforsummaryjudgment,andDefendant
intendsacrossmotionforsummaryjudgmentunderthesamerulealongwitha
responsivememorandumregardingPlaintiffsanticipatedRule56,bothconsistentlywith
theLocalRulesgoverningsuchmotions.Defendantmayfileasubsequentmotionunder
28U.S.C.section1404tochangevenuefromMarylandtoSouthernDistrictof
California,shouldthismatterproceedtotrialafterdispositivemotionsPlaintiffstateshis
oppositiontosuchamotionforchangeofvenue.
IV.
JuryTrial
Plaintiffexpressedhisintentiontoproceedbywayofjurytrialinthismatter.Itis
estimatedthatajurytrialshouldtaketwoorthreedays.Asnotedabove,Defendantmay
fileamotionforachangeofvenuetotheSouthernDistrictofCalifornia,shouldthis
matterproceedtotrial,andPlaintiffwouldopposesuchamotion.
V.
CertificationastoSettlementNegotiations
Thepartiesagreethattheyhaveengagedinsettlementnegotiationsinthepastas
notedinthepriorStatusReport,butthatthedistancebetweenthepositionsoftheparties
appearstoprecludemeaningfulsettlementnegotiations.Liabilityitselfisdisputed.Itis
possiblethattheresolutionofdispositivemotionsmayfacilitatenewnegotiations.

ReferraltoAnotherJudge/ADR
PlaintiffisatthistimeamenabletoADRorareferralasettlementjudge.
DefendantFreydoesnotatthistimeagreewithareferraltoADRorasettlementjudge,
butmayreconsiderhispositionaftertheresolutionofdispositivemotions.
