I Charles Henry Kajubu C/o Birungi & Co. Advocates do state as follows;
1. That I am an adult male Ugandan aged 71 years and a retired
personnel officer and a resident of Fort Portal.
2. That I worked together with the Claimant since 1999 at the Respondent
Company.
3. That I was a Personnel Officer while the Claimant used to work in the
Accounts Office.
4. That my duties as a Personnel Officer included among others workers
appointments, looking into the welfare of workers, attending
disciplinary meetings and attending court proceedings on behalf of the
company.
5. That the Claimant ceased to be an employee of the Respondent
Company on the 15th May 2012 when he was terminated in a meeting
in which the Assistant General Manger (PS Sharma), the Executive
Director (Mr. Manik Singh) and myself were present.

6. That on the said day the Executive Director (Mr. Manik Singh) and the
Assistant General Manger (PS Sharma) held a meeting and I was
invited to come and attend the said meeting.
7. That upon arriving for the meeting I was told that the Executive
Director (Mr. Manik Singh) and the Assistant General Manger (PS
Sharma) had reached a decision to terminate the services of Mr.
Mwaka Moses.
8. That I was requested to write a termination letter for the said Mwaka
Moses. They gave me reasons that I should state in the letter among
which were; that he had been assigned duties going to town on several
occasions but he never came back to office, he disobeys orders and
indiscipline.
9. That I wrote the said letter and I took it for signing to the Assistant
General Manger (PS Sharma). He refused to sign and he instructed me
to sign the said letter. I also refused to sign the said letter telling him
that I could not sign since I was not in the position to do so.

The Executive Director (Mr. Manik Singh) and the Assistant
General Manger (PS Sharma) however discussed it among themselves
and they agreed that I should sign as a Personnel Officer. I signed the
said letter and handed it over to the Assistant General Manger who
read through it and kept it.

That I was then asked to call the Claimant Mr. Mwaka Moses
which I did and we met at the Assistant General Mangers office. The
Executive Director then informed Mr. Mwaka that his services had been
terminated.

That the Claimant Mr. Mwaka Moses requested for his
termination letter but was asked to first handover company property
such as keys and files. He handed over the said materials to his
supervisor in my presence.

That I then asked the Claimant Mr Mwaka Moses to come back
the following morning on the 16 th May 2012 to take his terminal
benefits.

That the Claimant came as instructed and upon arrival he
requested for his termination letter. The Executive Director (Mr. Manik

Singh) and the Assistant General Manger (PS Sharma) both refused to
give the claimant his termination letter.

That the Claimant was given an offer for terminal benefits but he
refused to sign it saying that it was not the full amount of the benefits
and that he needed to consult on the issue before he could sign the
document.

That the Claimant was then instructed to leave the premises and
that I together with his supervisor escorted him to the gate. The
Supervisor then informed the security guard at the gate never to let
Mr. Mwaka on the premises at any other time whatsoever.

That this is what I can state.

That I confirm that whatever is stated herein is the truth, the
whole truth and nothing but the truth.
