COMPLAINTAFFIDAVIT
I, ATTY.VIVENCIORUIZ,oflegalage,married,Filipinoanda
residentof#115ImeldaVillage,MarcosHighway,BaguioCity,Philippines,
and a practicing lawyer for 15 years after having been sworn to in
accordancewithlaw,doherebydeposeandstate:
1 That I am instituting this CRIMINAL COMPLAINT against
EXEQUIELVICTORIOmyformerclientincertaincivilcasesfrom
2010 until 2014 when petitioner decided to hire the services of
anotherlawyer,Atty.L.Castillo.
2 Exequiel Victorio and his wife afterwards filed an administrative
chargeagainstforinvestigationanddisbarmentproceedingsagainst
me,thenpendingintheOfficeoftheSolicitorGeneral.
3 During the hearing of the administrative case on that particular
afternoon of March 9, 2015 in the sala of Judge Avancea, Atty.
Castillo, counsel of the Victorios, presented an urgent motion to
disqualify Judge Avancea to hear the administrative case, who
apparentlytakenaback,calleddownAtty.Castilloandgavehima
lecture,whileAtty.Ruiz,ascounselforrespondentJudgeGuiangin
the administrative case, moved that Atty. Castillo be cited for
contemptofcourt.
4 Afterthesaidhearingandwhilethetwoaccusedwerelaterwalking
down the corridor leading to the stairs from the sala of Judge
Avancea,Ioverheardthemutteringthefollowingdefamatorywords:
Daniel:"KayabangngputanginangabogadongRuiznaiyan,tunaw
namanangutak,suwapangatestapador."
Exequiel:"LastogtaukinnanataabogadoRuiz,suwapang,estapador,
paltogak ta ukinana ta abogado Ruiz, suwapang ken estapador."
(Translated in Tagalog as, Mayabang yang putanginang abogado
Ruiz na iyan, babarilin ko ang putang inang iyan, suwapang at
estapador.")
5 "Thatthestatementwasutteredby ExequielVictorioonMarch9,
2015publiclyandclearlypromptednotbysenseofmoraldutybutby

personalillwill,spiteand/ormalicewiththeobjectofdestroyingmy
reputationanddiscreditingandridiculingmeasanindividualbefore
thebarofpublicopinionandcontempt;
6 Theilleffectsofthemaliciousutterancesareshownbythenegative
responsesthatIhavereceivedfrommyneighbors,expressingbeliefin
respondents baseless allegations as shameful, heinous and
unequivocallybarbaricalltomydamageandprejudice.
7 Thatbyreasonoftheforegoing,Isufferedsleeplessnights,wounded
feeling, moral and social embarrassment which Exequiel Victorio
shouldcompensatebywayofmoraldamageswhichisthenatural,
proximate and necessary result of the malicious publication in the
amountofnotlessthanOneHundredFiftyThousandPesos(Php150,
000.00);
8 That I am executing this affidavit to attest to the truth of the
foregoingavermentsandforthepurposeofcriminallyprosecuting
saidExequielVictorioforORALDEFAMATION/SLANDERas
therearegraveutterancesasdeterminedbytheProsecutionOffice
inthepreliminaryinvestigation.
